Councilmembers Present: Heather Logan, Rob Toyer, Debora Nelson, Michele Blythe
Yvonne Gallardo-Van Ornam, Leisha Nobach, and Jan Schuette.
Council Members Absent: None.
Staff Present: Mayor Don Vanney, Paul Ellis, Kristin Garcia, Jim Kelly, Jay Downing, Jonathan
Ventura, City Attorney Steve Peiffle, Chelsea Brewer, and Wendy Van Der Meersche.
Also Known to be Present: Kathy Vanney, Randy Nobach, Holly Sloan -Buchanan, Steve
Maisch, Aiden Suchran, John Cermak, Jeri Rugtvedt, Tim Abrahamson, Michelle Heiderer, and
Nathan Senff.
Mayor Don Vanney called the meeting to order at 6:00 p.m., and the Pledge of Allegiance and
roll call followed.
APPROVAL OF THE AGENDA
Mayor Pro Tem Michele Blythe moved to approve the agenda as presented. Councilmember
Leisha Nobach seconded the motion, which passed with a unanimous vote.
INTRODUCTION OF SPECIAL GUESTS AND PRESENTATIONS
None.
PROCLAMATIONS
Mayor Don Vanney read the 55th Annual Professional Municipal Clerks Week proclamation.
Councilmember Leisha Nobach read the Public Service Recognition Week proclamation.
PUBLIC COMMENT
Aiden Suchran, Arlington, read a prepared public comment written by his mother, Anitra
Suchran.
CONSENT AGENDA
Mayor Pro Tem Michele Blythe moved, and Councilmember Debora Nelson seconded the
motion to approve the Consent Agenda that was unanimously carried:
1. Minutes of the April 15 and April 22, 2024 Council meetings
2. Accounts Payable: Approval of EFT Payments and Claims Checks #110544 through
#110649 dated April 2, 2024 through April 15, 2024 for a total of $1,038,038.16.

NEW BUSINESS
Opioid Litigation Settlement - Johnson & Johnson / Janssen
City Attorney Steve Peiffle reviewed the opioid litigation settlement with Johnson & Johnson
for Council's consideration.
Mayor Pro Tem Michele Blythe moved, and Councilmember Heather Logan seconded the
motion to approve the City's participation in the Johnson & Johnson Settlement litigation
brought by the State of Washington and authorize the Mayor or City Administrator to sign
the participation forms and related documentation. The motion passed unanimously.
Maintenance and Operations Tractor Purchase
Maintenance and Operations Manager Jay Downing requested Council approve an
unscheduled equipment purchase request for a Kubota backhoe.
Councilmember Rob Toyer moved, and Councilmember Michele Blythe seconded the motion
to approve the purchase of the Kubota L2502HST Backhoe and proposed attachments, for
$52,677.17, using the Park & Facilities Equipment Replacement Fund. The motion passed
unanimously.
WSDOT Right -of -Way (ROW) Procedure Amendment
Public Works Director Jim Kelly requested Council approve an amendment to the current
city right of way acquisition and procurement procedures and policies.
Councilmember Jan Schuette moved, and Councilmember Debora Nelson seconded the
motion to approve the Right -of -Way Procedure Amendment for the City of Arlington. The
motion passed unanimously.
Ordinance Relating to Eminent Domain Proceeding for 211th Place Improvement
Project
Public Works Director Jim Kelly requested Council approve the ordinance for eminent
domain proceeding for 211th Place Improvement Project.
Councilmember Debora Nelson moved, and Councilmember Heather Logan seconded the
motion to approve the ordinance and authorize the Mayor to sign it. The motion passed
unanimously.
Grant Agreement with Dept of Archaeology and Historic Preservation for Arlington
Cemetery
Public Works Director Jim Kelly requested Council approve staffs request for authorization
for the mayor to sign a grant agreement with the Washington State Department of
Archaeology & Historic Preservation for the Arlington Cemetery.
Councilmember Yvonne Gallardo-Van Ornam moved, and Councilmember Debora Nelson
seconded the motion to authorize the mayor to sign the grant agreement with the
Washington State Department of Archaeology and Historic Preservation. The motion
passed unanimously.

Lodging Tax Advisory Committee Appointments
Finance Director Kristin Garcia requested Council confirm the appointments of Jeri
Rugtvedt and Michele Heiderer to the lodging tax advisory committee to fill the vacant
positions.
Councilmember Heather Logan moved, and Councilmember Yvonne Gallardo-Van Ornam
seconded the motion to confirm the appointments of Jeri Rugtvedt and Michele Heiderer to
the lodging tax advisory committee. The motion passed unanimously.
March 2024 Financial Report
Finance Director Kristin Garcia presented the financial report for March 2024.
COMMENTS FROM COUNCILMEMBERS
Councilmember Heather Logan spoke about WSDOT's 172nd St NE project and lack of
funding. Discussion followed.
