Councilmembers Present: Don Vanney, Heather Logan, Debora Nelson, Marilyn Oertle, Jan
Schuette, Michele Blythe, and Yvonne Gallardo-Van Ornam.
Council Members Absent: None.
Staff Present: Mayor Barb Tolbert, Paul Ellis, Kristin Garcia, Marc Hayes, Amy Rusko, Rory
Bolter, Mike Phillips, Mike Gilbert, Jason DeVoir, Seth Kinney, Mark Wilde, Tim Zachman,
Andrew Goedl, Jonathan Ventura, City Attorney Steve Peiffle, Tony Orr, and Wendy Van Der
Meersche.
Also Known to be Present: Kathy Vanney, Rich Senff, Nathan Senff, Kim Casteel, Julie Good,
Eyleen Shouman, and John Shouman.
Mayor Barb Tolbert called the meeting to order at 6:00 p.m., and the Pledge of Allegiance and
roll call followed.
APPROVAL OF THE AGENDA
Mayor Pro Tem Jan Schuette moved to approve the agenda as presented. Councilmember
Marilyn Oertle seconded the motion, which passed with a unanimous vote.

CONSENT AGENDA
Mayor Pro Tem Jan Schuette moved and Councilmember Marilyn Oertle seconded the motion
to approve the Consent Agenda that was unanimously carried:
1. Minutes of the November 6 and November 13 Council meetings and
November 8, 2023 Special meeting
2. Accounts Payable: Approval of Petty Cash Check #2029; EFT Payments and Claims
Checks: #109300 through #109436 dated October 17, 2023 through November 6, 2023 for
a total of $1,545,100.59; and

Approval of Payroll EFT Payments and Checks #30314 through #30319 dated
October 1, 2023 through October 31, 2023 in the amount of $1,374,300.26.
3. Resolution Declaring Property as Surplus
4. Amendment No. 1 to the 169th St NE Connecting Segment Design Contract with
SCJ Alliance
PUBLIC HEARING
Resolution Setting the 2024 Regular Property Tax Levy
City Administrator Paul Ellis presented a PowerPoint and requested Council approve one of
two proposed property tax levy options for 2024. One option is taking a 1% increase over
the prior year levy, the other option is using 90% of the city's banked property tax capacity.
A resolution must be submitted to the County on or before November 30.
The public hearing was opened at 6:12 p.m.
John Shouman and Eyleen Shouman provided public comments.
The public hearing portion was closed at 6:16 p.m., and Council questions were opened.
Councilmembers Heather Logan and Jan Schuette provided comments. The public hearing
was closed at 6:19 p.m.
Councilmember Debora Nelson moved, and Councilmember Michele Blythe seconded the
motion to approve the 90% of banked capacity resolution as presented and authorized the
Mayor to sign it. The motion passed 5-2, with Councilmembers Heather Logan and Jan
Schuette voting no.
NEW BUSINESS
Ordinance Amending Arlington Municipal Code Title 13 Water and Sewers
Planning Manager Amy Rusko requested Council approve an ordinance amending the
Arlington Municipal Code (AMC) Water and Sewers. Discussion followed with Ms. Rusko
answering Council questions.
Councilmember Don Vanney moved, and Councilmember Debora Nelson seconded the
motion to approve the amendment to AMC Title 13 Water and Sewers and authorized the
Mayor to sign the ordinance. The motion passed unanimously.
Ordinance Amending Arlington Municipal Code Chapter 20.44 Supplemental Uses
Planning Manager Amy Rusko requested Council approve an ordinance amending
Arlington Municipal Code (AMC) Chapter 20.44 Supplemental Uses.
Councilmember Debora Nelson moved, and Councilmember Marilyn Oertle seconded the
motion to approve the ordinance amending AMC Chapter 20.44 and authorized the Mayor
to sign the ordinance. The motion passed unanimously.
Permit Fee Waiver Request
Community and Economic Development Director Marc Hayes requested Council waive the
permit fees for the Smokey Point Community Park project.

Councilmember Michele Blythe moved, and Councilmember Don Vanney seconded the
motion to approve waiving of permitting fees for the Smokey Point Community Park
project. The motion passed unanimously.
