City Council must decide on several items. A) Whether to allow the subject properties to annex into Arlinboundaries and C) Whether or not to require proportionate share indebtedness to be assumed. If these items are agreed upon by City Council, then the proposed annexation may continue to the next phase of the process, the 60% petition. Urban Growth Area (UGA). The current underlying Zoning Designation being Business Park and Residential Low Capacity. The properties are overlayed by Airport Protection Districts A, B and C. The portions of property overlayed by Subdistrict A are also regulated through Outer Safety Zone (OSZ) Zone 4. This request was presented to the Planning Commission at their February 23, 2023, March 7, 2023, andMarch 21, 2023 meetings. The planning commission is not required to make a recommendation to Councilunder our new annexation ordinance and did not make any recommendation.ALTERNATIVES: Workshop; discussion only. At the April 3, 2023, Council meeting the recommended motion will be, “I move to approve the 10% petition, as presented, requesting annexation into the City of Arlington, and authorize the petitioners to proceed to the 60% petition phase of the annexation process.” Steps for Annexation within the City of Arlington When Can Property be Annexed into the City of Arlington? The City Council can review requests for annexation any time during the calendar year. Property must be within Arlington’s Urban Growth Area (UGA), as established by Snohomish County. Annexations beyond the UGA are prohibited by State Law. If property is not within the UGA, property owner(s) must first petition Snohomish County to have the property included in the UGA. Once it is included in the UGA, the City can act on an annexation request. What is the Process for Petition for Annexation into the City of Arlington? There are several steps in the annexation process. They are listed below. Meeting with Planning Staff/Determination of UGA Prior to submitting your request for annexation, your first step should be to schedule a meeting with staff in the Planning Division. They will help you determine whether you are within the City of Arlington’s UGA. If you are, they will assist you in determining the best boundaries as well as provide the information you need for your submittal and an indication of staff recommendation on the proposal. You can then proceed with the next step. If you are not, you must take steps to have the UGA boundary revised to include your property. This is done through Snohomish County’s Planning and Development Services Department, which is located in the County Administration Building at 3000 Rockefeller Avenue in Everett; their phone number is 425.388.3311 10% Petition (Notice of Intention to Commence Annexation Proceedings) The first official step is for you to obtain signatures of property owners within the annexation area that represent at least 10% of the value of the property proposed for annexation, which is based on assessed valuations established by the Snohomish County Assessor’s Office. Once you have obtained the signatures representing 10% valuation, you can submit the 10% petition application. Review of Proposals Planning Staff routes the application to City staff and to Snohomish County for review. Planning staff visits the site, reviews the application packet and the comments received from other City departments and Snohomish County, and makes a recommendation to the City Council on the proposed annexation application. City Council Action on 10% Petition The Council reviews the annexation application at a public meeting and makes a decision whether or not they wish to annex the property, whether or not to amend the boundaries, and whether or not to require proportionate share indebtedness be assumed (generally the case). If they agree to the proposal, then you may continue to the 60% petition phase of the annexation process. (Note: A public hearing is not required for the 10% petition phase of the annexation process, only a meeting with the petitioners). 60% Petition If the Council approves the 10% petition, planning staff prepares the 60% petition for you to circulate. Once ready, you must obtain signatures of property owners within the annexation area that represent at least 60% of the value of the property proposed for annexation. Once this is done, you can submit the 60% petition application. Preparation of Staff Report Planning staff reviews the application packet and the comments received from other City departments and the public, and prepares a staff analysis of the project to make sure that it meets all applicable regulations and requirements, including those of the City, County, State, and Boundary Review Board. City Council Action to Set Public Hearing After receipt of the 60% petition application, planning staff prepares a proposed resolution for the City Council to set the date of the public hearing for your annexation. The Council considers the proposed resolution and makes a decision on the public hearing date. 60% Petition City Council Public Hearing At least 10 calendar days prior to the public hearing for an annexation, planning staff prepares a Notice of Public Hearing, which is posted on the subject property, published in the local newspaper; posted at the Smokey Point Post Office, Library, and City Hall; and mailed to you. At least 7 calendar days prior to the public hearing, planning staff provides the staff memo to the City Council, to you, and to any person or neighbor requesting it in writing. The City Council reviews the information and takes testimony from all interested parties wishing to comment during the public hearing. Comments should be as specific as possible and address findings required for a decision by the hearing body. Once the hearing is closed, the City Council makes a decision in the form of a motion, generally the same night as the public hearing. However, the City Council may continue the hearing to ensure all public comments and information has been reviewed prior to making a decision. Preparation of Boundary Review Board (BRB) “Notice of Intention to Annex” If the City Council decides to proceed with the annexation, planning staff prepares the BRB “Notice of Intention to Annex” and submits it to the BRB for their review. BRB Review Period The BRB has a 45-day review period for each application for annexation. If there are no requests for a public hearing, the annexation is approved by the BRB. Annexation Ordinance After the City receives notification that the BRB has approved the annexation, planning staff prepares an annexation ordinance for approval by the City Council. Once approved, notification is sent to all parities of record, the Snohomish County Assessor and Auditor, the Washington State Office of Financial Management, utility agencies, and several other agencies of interest. A lot of development is occurring along 204th St between 67th Ave and SR9, with this development comes increased vehicle traffic, increased pedestrian and bike traffic, and increased transit usage. To meet these growing demands, the City is making improvements to the 204th St and 74th Ave intersection, these improvements include a traffic signal, multi-use trail connection, ADA compliant pedestrian crossing facilities, and bus pull-outs with shelters. This ROW dedication by Williams Investment is for property on the north side of the intersection and provides the last ROW needed for this project to go forward. ALTERNATIVES: Remand to staff for additional information. Workshop; discussion only.
