CONSENT AGENDA Mayor Pro Tem Jan Schuette moved and Councilmember Don Vanney seconded the motion to approve the Consent Agenda that was unanimously carried: 1. Minutes of the February 6 and February 13, 2023 Council meetings 2. Accounts Payable: Approval of EFT Payments and Claims Checks: 3. #107490 through #107619 dated February 7, 2023 through February 21, 2023 for a total of $769,699.6; Approval of Payroll EFT Payments and Check #30246 through #30253 dated January 1, 2023 through January 31, 2023 in the amount of $1,311,551.29. PUBLIC HEARING None. Minutes of the Arlington City Council Meeting Minutes of the City of Arlington City Council Meeting February 21, 2023 Page 2 of 2 NEW BUSINESS Agreement for Retention of Facilitator City Administrator Paul Ellis requested Council approve an agreement with North County Regional Fire Authority (NCRFA) to utilize the services of Karen Reed as a facilitator in discussions with North County Regional Fire Authority (NCRFA) regarding issues with the existing interlocal agreement (ILA) with NCRFA for fire marshal/investigative services (“the ILA”). The City and NCRFA have had challenges in working together on issues regarding the ILA. It is hoped that Karen Reed, who helped organize discussions around the City’s annexation to the NCRFA, will help the parties by facilitating discussions. Should that effort fail, the parties are committing to following the mediation provisions of the existing ILA. Discussion followed with Mr. Ellis answering Council questions. Mayor Pro Tem Jan Schuette moved and Councilmember Marilyn Oertle seconded the motion to approve the Agreement for Retention of Facilitator, and authorized the Mayor to sign it. The motion passed unanimously. Contract Change Order No. 2 to Water Reclamation Facility Equalization Basin Project Contract Construction Change Directives (CCDs) have been issued on the Water Reclamation Facility Equalization Basin project as issues come up during construction. This Change Order will close out all open CCDs and add the combined value of the open CCDs to the contract. Councilmember Yvonne Gallardo-Van Ornam moved and Councilmember Heather Logan seconded the motion to approve Contract Change Order No. 2 to the EQ Basin Project, and authorized the Mayor to sign it. The motion passed unanimously. COMMENTS FROM COUNCILMEMBERS None. ADMINISTRATOR & STAFF REPORTS None. MAYOR’S REPORT Mayor Tolbert thanked Chief Ventura for providing continual information to help keep the Council and her engaged in public safety bills. EXECUTIVE SESSION None. WORKSHOP ITEMS – NO ACTION WAS TAKEN Resolution Authorizing Airport Staff to open a Bank Account Airport Operations Manager Marty Wray requested City Council authorize the Mayor to sign the resolution, as well as any associated documents that allow the Airport to have a separate checking account in order to receive miscellaneous merchandise sales, and vending machine proceeds, while safeguarding the City’s general checking account. Discussion followed with Mr. Wray answering Council questions. Financial Report for January 2023 Finance Director Kristin Garcia reviewed the January 2023 financial report. Discussion followed with Ms. Garcia answering Council questions. Community Economic Development Report Community Economic Development Director Marc Hayes reviewed the Community and Economic Development quarterly report. City Council Workshop Minutes of the City of Arlington City Council Workshop February 27, 2023 Page 2 of 2 Utilities/Transportation Quarterly Report Public Works Director Jim Kelly reviewed the Public Works quarterly report. Discussion followed with Mr. Kelly answering Council questions. ADMINISTRATOR AND STAFF REPORTS City Administrator Paul Ellis announced that two surveys will be sent to the public. The first one will be for a broadband feasibility study, and the second one will be access to college classes through Washington State University. MAYOR’S REPORT Mayor Tolbert provided an update for the community congressional discretional funding projects update and legislative updates. COMMENTS FROM COUNCILMEMBERS Councilmember Debora Nelson thanked the staff for all their work on the Transportation Benefit District. Councilmember Marilyn Oertle and Michele Blythe shared their appreciation for City Administrator Paul Ellis responding to the public on behalf of the councilmembers. Mayor Tolbert resounded their comments. COUNCILMEMBER REPORTS Councilmembers had nothing to report this evening. PUBLIC COMMENT None. ADJOURNMENT With no further business to come before the Council, the meeting was adjourned at 6:47 p.m. _________________________________________ Barbara Tolbert, Mayor City of Arlington Council Agenda Bill Item: CA #3 Attachment B March 6, 2023 Resolution authorizing Airport staff to open a bank account Resolution Airport; Dave Ryan, Director 360-403-3474 EXPENDITURES REQUESTED: -0- BUDGET CATEGORY: N/A BUDGETED AMOUNT: N/A LEGAL REVIEW: Arlington Municipal Airport Staff is requesting the City Council authorize the Mayor to sign the attached Resolution, as well as any associated documents that allow the Airport to have a separate checking account in order to receive miscellaneous merchandise sales, and vending machine proceeds, while safeguarding the City’s general checking account. In an effort to provide a better service to their users, the airport has a vending machine in the pilot lounge that could have the ability to receive credit cards for the purchases in order to minimize cash handling. Unfortunately, the vending machine management company is unable to send the proceeds to the airport any other way than a direct deposit to a checking account. Ideally, the airport will also be using that same bank account for the incidental marketing items like hats, t-shirts, and challenge coins. I move to approve the resolution and authorize the mayor to sign it. RESOLUTION NO. 2023-XXX A RESOLUTION OF THE CITY OF ARLINGTON AUTHORIZING THE OPENING OF A BANK ACCOUNT WHEREAS, the Airport will be operating a vending machine with the ability to take credit card payments; and WHEREAS, the vending machine vendor requires the ability to directly deposit into a City account; and WHEREAS, to best safeguard the City’s general checking account, it is best practice to open a separate account that limits access to third parties; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARLINGTON, WASHINGTON AS FOLLOWS: The Arlington City Council authorizes the opening of a new checking account at Banner Bank for the purpose of receiving vending machine deposits and miscellaneous merchandise sales. One (1) OSHA‐compliant‐center‐safety‐line system(s), which includes an eyebolt that is located at the dome center and a 5/16‐inch SS wire rope cable with ends finished with a SS thimble and three wire rope clips. One end of the wire rope cable will attach to the eyebolt at the dome center and the other end will be fitted with a carabineer that attaches to the gauger’s platform. All metallic components shall be aluminum, or 300 series SS. Personal protective equipment is not included. B. MISCELLANEOUS ITEMS INCLUDE THE FOLLOWING: 1. Crate and freight to jobsite. 2. Roof approval drawings and calculations stamped by a State Professional Engineer. 3. Dimensional survey should CST deem it necessary to only verify existing tank/basin dimensions prior to cover fabrication. New tanks will require the purchaser to submit a copy of the As Built drawings to confirm tank dimensions. 4. AWWA water leak test. Water and hose provided by the Owner. 5. Labor to be employed will be Non‐Union Ironworkers. 6. Local Prevailing Wages have been included in this quotation. Tank(s) to be covered being out‐of‐service, drained and cleaned (by others) during the cover installation. 2. Weather conditions that allow construction procedures to be performed. Temperatures below 40 degrees Fahrenheit and/or precipitation may interrupt the crew’s ability to weatherseal (i.e., caulk) the dome(s). Persistent bad weather for any period longer than 48 hours may be grounds for a crew move‐in/move‐out, which will be charged to the purchaser at the rate stated in the Scope of Work. 3. The dome(s) being considered as “water‐tight,” not “gas‐tight”. 4. Work area(s) not being considered confined space. 5. The top of the tank wall shall be level as possible and at a constant elevation as prepared by the purchaser to accept the cover. Out of roundness shall remain within 3‐inch on the radius. The vertical elevation of the top of wall may not vary more than 1/4‐inch from pier to pier. 6. Any duct work that penetrates the dome(s) is being routed to avoid interference with the dome’s structural members. 7. The area is being well drained with adequate space adjacent to the foundation for the storage of material and erection equipment. Area should be accessible and suitable for heavy trucks, cranes, and manlifts for the duration of the project and to allow sufficient bearing for unencumbered 360 access around the structure(s) for construction equipment. This area must be for the exclusive use of CST’s crew and any additional work not related to the dome (i.e. dike work, pipe racks, etc.), should be installed once the dome structure is in place. 8. All walls being level and at a constant elevation (by others); 9. Shipping the materials for all structures at the same time. Should the Purchaser elect to stagger (or sequence) the delivery of the covers, the contract price shall be adjusted to reflect the subsequent packing inefficiencies and resulting increased number of shipping containers. 10. Reservoir to be covered being out‐of‐service, drained and cleaned (by others) during the cover installation. 11. All walls being level, smooth and at a constant elevation [by others]. 12. The top of tank to be clean, smooth and free from exposed rebar and grout. 13. Having sufficient access for manlift usage on site. This may require portions of the fence to be taken down temporarily until those sections are completed. Fence removal and reinstallation [by others]. 14. CST will secure material and equipment inside the fence but is not responsible for site security. The area should be accessible and suitable for the required crane, boom truck, forklifts and manlifts for the duration of the project and allow sufficient access around the structure. This area must be for the exclusive use of CST crew and any additional work, not related to the cover [concrete work] should be installed before the cover structure arrives onsite. 15. Work area(s) not being considered confined space. 16. Purchaser/Owner providing sufficient road access wide enough to allow crane mobilization. 17. CST’s material types as specially listed within Section A of this proposal. 18. Dome height being 6 to 7 feet from top of tank wall to top of dome apex. [excluding appurtenances heights] 19. CST submitting approvals based on the dimension information provided. 20. According to the existing plans this vertically post tensioned concrete tank has quite a bit of tendon cups at the top of wall spaced around 2‐8” OC. We highly recommend that the purchaser/owner consider adding a concrete ring beam wall at the top of the tank to avoid potential interference with our pier shoe anchors. D. INSTALLATION INCLUDES: 1. CST Installation is based on performing the work on a continuous, uninterrupted basis (with prevailing wages and one (1) move‐in/move‐out of equipment and crew(s) per tank. In the unlikely event that additional move‐in/move‐outs are required, they will be invoiced as contract extras at a rate of $8,500 each plus the cost of any additional equipment mobilization such as crane, scaffolding, man‐lift, etc.) 2. Purchaser providing and maintaining work areas for CST use as follows: Prepare and maintain a stabilized, level, dry, dewatered, and compacted area for dome assembly. Well drained area with adequate space adjacent to the foundation for the storage of material and use of erection equipment. Accessible and suitable for heavy trucks, cranes, and man‐lifts for the duration of the project. These area(s) must be for the exclusive use of CST crew and any additional work not related to the dome (i.e., dike work, pipe racks, etc.) must be installed by the Purchaser after the dome structure is in place. 2. Installation based on building the cover in place inside the reservoir from the existing reservoir floor. Material and equipment will be placed inside of the water reservoir with a crane supplied by CST prior to installation. Material bundle weight ~8,000lbs. equipment weight ~25,000lbs. The tank floor must be accessible for this erection method, should existing floor need protection, the purchaser shall install plywood to protect the floor seals. 3. Crane‐lift installation pricing is based on the following: An area of 30‐ft wide and 30‐ft in length shall be prepared by Purchaser for Crane pad. Standard outrigger matting is provided by Crane Company and is included in our price. Purchaser is responsible to make any ground or soil improvements to achieve permissible ground bearing pressure for safe use of the crane, including the Purchaser providing a clear and stabilized path from the nearest access road to allow CST to roll in the crane without the need for dirt work or crane mats. This pricing is based on the availability of (1) [crane description and crane vendor upon whose cost CST’s price is based], any change to equipment due to site changes or availability of crane will be a contract extra. Pricing is based on one (1) move in/move out of crane. One (1) day(s) of crane usage is included. Additional days will be at standard time (8 hours) daily rate. In the event of rain, wind or customer delays, the applicable crane rental rate will be utilized. Dirt work, road work, matting or steel plates, if required, are not included in the price. Any work to the dike areas, if required, is not included in CST’s price. If conditions are muddy or become muddy, mats may/will be brought in to make the area suitable for dome assembly. 4. Purchaser providing CST with a suitable area around the perimeter with adequate access for a man‐lift needed for the flashing installation. 5. Crane and tools required for erection to be provided by CST. 6. Labor to be employed will be Non‐Union Ironworkers. 7. Local Prevailing Wages have been included in this quotation. 8. CST field crew will perform a water test after completion of the dome(s) to ensure water tightness. Purchaser/owner is to coordinate and supply water source, 1.5‐inch diameter fire hoses and water pumps needed to provide 50 psi water pressure at the apex of the dome to perform the water test. 9. Certificate of proper installation only if CST performs the installation. E. GENERAL NOTES 1. If the project is tax‐exempt, the purchaser must provide CST with a tax‐exempt certificate. If the project is not tax‐ exempt, the purchaser must furnish CST with a resale certificate. Otherwise, CST will charge applicable sales and use taxes to the purchaser as a contract extra. 2. Because CST is not a local contractor, the punchlist for the aluminum cover (if any) shall be provided to CST for action while we are still mobilized at the site. Additional mobilizations for punchlist(s) generated after we have demobilized shall be considered a contract extra. F. ITEMS NOT INCLUDED: 1. Stainless Steel Columns 2. Bottom tank floor protection. 3. Matte Finish, or Painted Finish. 4. New or modification of any existing ladders/stairs items. 5. Electrical, mechanical, or plumbing work of any kind. 6. CST is a specialty contractor responsible for the design, fabrication, and construction of the roof only. Others shall provide a designer of record responsible for ensuring all designs meet or exceed the specifications and appropriate building code requirements. 13. Any surface preparation interior or exterior on the walls. 14. All stairways, walkways, platforms, handrailing, walkway grating, stairway grating, checkered plate, etc.; (except as specifically noted). 15. Protection (tarping, plywood, mats, etc.) of basin / tank floor and/or interior surfaces 16. Union installation 17. Warranty for buyout items (non‐CST manufacture) such as louvers, vents, fans, motors, etc. are the responsibility of the manufacturer of the specific item and not included in CST warranty agreement. 18. This proposal is offered for your acceptance no later than 30 days from the date issued. 2. The prices quoted are based on the current material costs of metals. Due to the current unprecedented volatility in the metals market, CST reserves the right to review pricing for any orders received and adjust our price accordingly. 3.
