Councilmember Marilyn Oertle moved and Councilmember Debora Nelson seconded the motion to approve the purchase and sale agreement for 3209 180th Street NE, and authorized the Mayor to sign it. The motion passed unanimously. Ordinance Amending AMC Section 10.54.160 Regarding Parking Notice of Infraction Police Chief Jonathan Ventura requested Council approve amendments to City Ordinance AMC section 10.54.160. Councilmember Michele Blythe moved and Councilmember Don Vanney seconded the motion to approve the ordinance amending AMC section 10.54.160 and authorized the Mayor to sign the ordinance. The motion passed unanimously. Washington State Transportation Improvement Board Grant Agreement for 211th Place Public Works Director Jim Kelly requested Council approve the TIB Grant agreement for improvements to 211th Place from 67th Avenue to SR-530. Councilmember Jan Schuette moved and Councilmember Marilyn Oertle seconded the motion to authorize the Mayor to sign the grant agreement with the Transportation Improvement Board. The motion passed unanimously. Award of Division/Broadway Restoration Project Design to LDC, Inc. Public Works Director Jim Kelly requested Council approve the selection of LDC, Inc. for design services. Councilmember Jan Schuette moved and Councilmember Debora Nelson seconded the motion to approve the selection of LDC, Inc. for design services for the Division/Broadway Restoration Project, and authorized the Mayor to sign the agreement. The motion passed unanimously. Amendment #1 to the Brown & Caldwell Contract for the Haller Wellfield Improvement Project Public Works Director Jim Kelly requested Council approve Amendment #1 to the Brown & Caldwell contract for design of the Haller South Wellfield Improvement Project. Councilmember Debora Nelson moved and Councilmember Marilyn Oertle seconded the motion to approve Amendment No. 1 to the Brown & Caldwell contract for additional design services for the Haller Wellfield Improvement Project, and authorized the Mayor to sign the amendment. The motion passed unanimously. Councilmember Jan Schuette moved and Councilmember Marilyn Oertle seconded the motion to approve supplement Number 2 to the Toole Design Group LLC contract for design services for the 74th Avenue Trail Project, and authorized the Mayor to sign the contract supplement. The motion passed unanimously. COMMENTS FROM COUNCILMEMBERS Councilmember Jan Schuette encouraged Councilmembers to contact legislators. ADMINISTRATOR & STAFF REPORTS City Administrator Paul Ellis reminded Councilmembers of next Monday’s City Council/Planning Commission joint meeting beginning at 5 p.m., with the regular workshop following at 6 p.m. City Attorney Steve Peiffle stated that after speaking with Finance Director Kristin Garcia, the Mayor Pro Tem would no longer be required to read the accounts payable figures in the consent agenda aloud at meetings. The Mayor Pro Tem will make a motion to approve the consent agenda, as presented. Police Chief Jonathan Ventura invited the Mayor and Councilmembers to the police department’s annual meeting and awards dinner January 26 from 6 to 9 p.m. at the Byrnes Performing Arts Center. MAYOR’S REPORT Mayor Tolbert provided information regarding the Governor’s budget and the legislative agenda. EXECUTIVE SESSION None. WORKSHOP ITEMS – NO ACTION WAS TAKEN Termination of Interlocal Agreement (ILA) with North County Regional Fire Authority (NCRFA) City Administrator Paul Ellis reviewed the discussion with NCRFA. Both parties agreed that it is appropriate to terminate the ILA and for the City to assume the responsibilities for the services in the ILA. The termination date will be the last date signed by either party. The City will be responsible for all services provided through the termination date within thirty (30) days following receipt of a final invoice from NCRFA. Discussion followed with Mr. Ellis answering Council questions. Establishing Fees for Airport Long Term Parking and Amendment of Fee Resolution for Body-Worn Camera Video City Airport Director Dave Ryan reviewed the Airport’s request for a new fee and rate structure. The airport would like to start charging customers for long term vehicle parking at the Airport on landside designated parking area. Staff proposed a $30 monthly charge for Minutes of the Arlington City Council Workshop Minutes of the City of Arlington City Council Workshop January 23, 2023 Page 2 of 2 parking ($1 a day). This money would be applied into the Airport budget. Discussion followed with Mr. Ryan answering Council questions. City Attorney Steve Peiffle reviewed the need to update the fee resolution. Council previously approved an amendment to the fee resolution for the redaction of body work videos, but a public hearing is required to amend that fee. A public hearing will be held regarding the proposed changes at the February 6, 2023 Council meeting. Discussion followed with Mr. Peiffle answering Council questions. ADMINISTRATOR AND STAFF REPORTS City Administrator Paul Ellis reminded the Councilmembers that Monday, January 30 is the fifth Monday of the month and there will not be a City Council meeting. MAYOR’S REPORT Mayor Tolbert stated that she meets with the city’s lobbyist every Friday, and that she shared the upcoming legislative bills with Councilmembers and City directors. COMMENTS/ FROM COUNCILMEMBERS Councilmember Heather Logan stated that she has been elected to the Snohomish County Health Department Advisory Board. COUNCILMEMBER REPORTS Councilmembers had nothing to report this evening. PUBLIC COMMENT Joe Beardslee, 137 N Olympic Ave, provided public comment, via Zoom, regarding pedestrian safety. Dave Kraski provided public comment regarding the termination of the interlocal agreement between the City and North County Regional Fire Authority. Political Action Committee Chair for North Snohomish County Professional Fire Fighters Union Local 3438 Kirk Normand provided public comment regarding the termination of the interlocal agreement between the City and North County Regional Fire Authority. DISCUSSION ITEM – NO ACTION WAS TAKEN Comprehensive Plan Presentation with Consultant, OTAK Community and Economic Development Director, Marc Hayes introduced the OTAK consultants, Mandi Roberts, Nathen Lamb, Cara Donovan, and Sierra Carson. The OTAK consultants reviewed the details of the Arlington Comprehensive Plan that included the planning process and timeline, plan framework, Comprehensive Plan table of contents, community profile and mapping, city review process, engagement of public comments and input received to date, and next steps. Discussion followed with City Staff and OTAK consultants answering Planning Commission and City Council questions. Page 1 RESOLUTION NO. 2023–XXX A RESOLUTION REPLACING RESOLUTION NO. 2022-003, AND ADOPTING A REVISED FEE SCHEDULE WHEREAS, the City Council, through ordinance, has adopted regulations requiring certain actions and services; and, WHEREAS, these various ordinances set forth that fees shall be set by resolution; and, WHEREAS, the cost of providing these various services consistent with applicable codes, regulations, and policies periodically increase or decrease, or certain services or practices are discontinued and fees are no longer needed; and, WHEREAS, it is the intent of the City of Arlington to charge appropriate fees and charges that are consistent with the services provided and to cover the public cost of providing these various services so that the public is not subsidizing individual benefits derived therefrom; and WHEREAS, the City Airport Commission recommended establishing fees for long-term parking at the airport; and WHEREAS, the City Council held a public hearing concerning the establishment of the fees for body-work camera footage redaction and determined the adoption of the fee was reasonable; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARLINGTON AS FOLLOWS: The following rates, fees, and charges for various services provided, actions performed, or items sold by the city and/or its contract service providers, and fines levied against code violators, are hereby adopted: Section 1. Fees and Charges—General. 1.1 Fees. Fees are intended to cover the normal, recurring costs associated with providing a given service. Fees are non-refundable. 1.2 Prices. In some instances, the City provides certain goods and merchandise for sale. Prices for these goods may be included in this resolution. 1.3 Payment Due. Fees are due at the time the action is requested (e.g., at time of application) or occurs (e.g., prior to a specific action). An applicant may pay all fees of a multi-phased project in advance; however, doing so does not vest applicable fees due. Because all City employees contribute to the production of public records requests and all employees earn different salaries or rates of pay, the public records officer would have to be privy to salaries of all employees in order to calculate the invoice; (b)Employees supplying scanned records to the public records officer would be required to track time spent, thereby creating a burden for those employees without work stations as well as additional work not assigned in many employees’ job descriptions and or union contracts; (c)The City’s public records officer would be required to maintain a record of all employees who contribute to each part of a public record request and potentially charge different amounts for multiple scanned pages; (d)The City uses more than seven document scanning machines with different costs and lease agreement fees which change from time to time. The cost of supplies for the City’s various scanning machines is subject to change based on current market rates. Calculating the portion of the machines and supplies used toward scanning public records would require knowledge of the cost of supplies and an in-depth analysis of timing and application multiplied by each contributing employee’s hourly rate of pay; and (e)The response time to a public records request may be delayed in order to calculate scanning costs and create an invoice with different rates of scanning charges. Because all City employees contribute to the production of public records requests and all employees earn different salaries or rates of pay, the public records officer would have to be privy to salaries of all employees in order to calculate the invoice; (b) Employees supplying scanned records to the public records officer would be required to track time spent, thereby creating a burden for those employees without work stations as well as additional work not assigned in many employees’ job descriptions and or union contracts; (c) The City’s public records officer would be required to maintain a record of all employees who contribute to each part of a public record request and potentially charge different amounts for multiple scanned pages; (d) The City uses more than seven document scanning machines with different costs and lease agreement fees which change from time to time. The cost of supplies for the City’s various scanning machines is subject to change based on current market rates. Calculating the portion of the machines and supplies used toward scanning public records would require knowledge of the cost of supplies and an in-depth analysis of timing and application multiplied by each contributing employee’s hourly rate of pay; and (e) The response time to a public records request may be delayed in order to calculate scanning costs and create an invoice with different rates of scanning charges. City staff worked with Snohomish County DEM staff and consultants in coalition to update the county plan and City of Arlington Annex, resulting in the newest updated and revised version located at http://www.snohomishcountywa.gov/2429/Hazard-Mitigation-Plan. Resolution No. 705, adopting the Snohomish County Multi-Jurisdictional Hazard Mitigation Plan, was approved in 2005. In order to be eligible for federal disaster funding and reimbursement, the City of Arlington must adopt the most recent version of the Hazard Mitigation Plan. None. RESOLUTION NO. 2023-XXX 1 RESOLUTION NO. 2023-XXX A RESOLUTION OF THE CITY OF CITY OF ARLINGTON ADOPTING THE UPDATED AND REVISED SNOHOMISH COUNTY MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN WHEREAS, all of Snohomish County has exposure to natural hazards that increase the risk to life, property, environment, and the County’s economy; and WHEREAS, pro-active mitigation of known hazards before a disaster event can reduce or eliminate long-term risk to life and property; and WHEREAS, The Disaster Mitigation Act of 2000 (Public Law 106-390) established new requirements for pre- and post-disaster hazard mitigation programs; and WHEREAS, a coalition of Snohomish County, Tribes, Cities, and Special Purpose Districts with like planning objectives has been formed to pool resources and create consistent mitigation strategies within the county; and WHEREAS, the 2010 edition (including the 2015 update) of the Snohomish County Hazard Mitigation Plan has been updated, the coalition has completed a planning process that engages the public, assesses the risk and vulnerability to the impacts of natural hazards, develops a mitigation strategy consistent with a set of uniform goals and objectives, and creates a plan for implementing, evaluating, and revising this strategy; and WHEREAS, the coalition has completed a planning process that reviewed and/or revised the risk assessment, goals and objectives, action plan, and reengaged the public; and WHEREAS, FEMA has completed pre-adoption review of the revised Snohomish County Hazard Mitigation Plan pursuant to 44 CFR Part 201, and City Council adoption must occur for the City of Arlington to have a FEMA approved Natural Hazards Mitigation Plan; and WHEREAS, it has been found that the proposed Plan is consistent with the City of Arlington’s Comprehensive Plan, and other State, Federal, and local regulations; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARLINGTON, WASHINGTON AS FOLLOWS: A. The Arlington City Council hereby; 1. Adopts Volume 1 in its entirety and adopts the following portions of Volume 2: Part 1; the City of Arlington jurisdictional annex and all Volume 2 appendices of the Snohomish County Hazard Mitigation Plan (SC HMP). A copy of said documents shall be available for review and inspection at the Snohomish County DEM Office and online at: http://www.snohomishcountywa.gov/2429/Hazard-Mitigation-Plan RESOLUTION NO. 2023-XXX 2 2. Will use the adopted portions of the SC HMP to guide pre- and post-disaster mitigation of the hazards identified. 3. Will coordinate the strategies identified in the SC HMP with other planning programs and mechanisms under its jurisdictional authority. 4. Will continue its support of the Planning Coalition and continue to participate in the Coalition Partnership as described by the SC HMP. 5. Will help to promote and support the mitigation successes of all SC HMP Planning Partners. B. It is the purpose of the Resolution to provide for the health, welfare, and safety of the general public, and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected of benefited by the terms of this Resolution. No provision or term used in this Resolution is intended to impose any duty whatsoever upon the City or any of its officers, agents, or employees for whom the implementation of this Resolution shall be discretionary and not mandatory. C. Nothing contained in this Resolution is intended to be, nor shall be construed to create or form the basis for, any liability on the part of the City or its officers, agents, and employees for any inquiry or damage resulting from the failure to comply with the provisions of this Resolution or be a reason or a consequence of any inspections, notice, or order, in connection with the implementation or enforcement of the Resolution, or by reason of any action of the City related in any manner to enforcement of this Resolution by its officers, agents, or employees.
