Domestic Violence Awareness Month WHEREAS October is Domestic Violence Awareness Month and October 16-21, 2024, is YWCA’s Week Without Violence; and WHEREAS domestic violence is an epidemic affecting all communities regardless of age, socioeconomic status, educational background, race, ethnicity, culture, religion, national origin, ability, sexual orientation and gender identity; and WHEREAS domestic violence and intimate partner violence (IPV) is a pattern of abusive physical, sexual, emotional, economic, psychological, and coercive, controlling behavior in any relationship that is used by one partner to gain or maintain power and control over another intimate partner; and WHEREAS domestic violence and intimate partner violence (IPV) is a serious, preventable public health problem that affects millions of Americans: and WHEREAS 1 in 3 women and 1 in 7 men in the United States have been the victim of severe domestic violence or IPV in their lifetime; and WHEREAS domestic violence related issues lead to nearly 8 million lost days of paid work each year, the equivalent of over 32,000 full-time jobs; and WHEREAS there are many individual and collective drivers of domestic violence to include poverty, limited access to resources, educational opportunities and healthcare services, patriarchal privilege, and the normative use of violence in interpersonal relationships. These factors also increase childhood trauma, poor mental health and substance misuse, and poor communication and con�lict in relationships; and WHEREAS The City of Arlington is committed to a professional response to incidents of Domestic Violence in our community, and we greatly value the contributions made by organizations like the YWCA and Domestic Violence Services of Snohomish County, as well as the contributions made by our community members to help provide resources and support to those experiencing domestic violence and intimate partner violence; and NOW THEREFORE I, Don Vanney, Mayor of Arlington, do hereby proclaim October as
DOMESTIC VIOLENCE AWARENESS MONTH in Arlington and urge all citizens to become aware of the impacts of domestic violence on individuals and our community and join together in an effort to end violence in our community.

Airport Property Appraisal Operations Manager Monroe Whitman request Council approve the appraisal required by the FAA for federally obligated airports. Staff is requesting City Council approve the new lease rates for the next five-year period. The appraisal was completed in April by Fred C. Strickland and Associates, LLC. Councilmember Yvonne Gallardo-Van Ornam moved, and Councilmember Michele Blythe seconded the motion to approve the airport property appraisal for the five-year period beginning January 1, 2025 and to set lease rates based on this document during that period. The motion passed unanimously.
Perimeter Fencing Improvement Project Change Order and Amendment Operations Manager Monroe Whitman requested Council approve a construction contract change order and construction administration services amendment for the Perimeter Fencing Improvements Project. This project was previously approved as part of the airport’s bi-annual budget, and involves design, construction, and construction administration services. Councilmember Yvonne Gallardo-Van Orman moved, and Councilmember Michele Blythe seconded the motion to authorize the Mayor to sign the construction contract change order with Dallum Build Company to increase the contract amount by $79,734.35, and to authorize the Mayor to sign the construction administration services professional services agreement amendment with DOWL to increase the contract amount by $22,150.00 (subject to the IFE being approved by the FAA). The motion passed unanimously.
SCJ Contract Amendment #3 for the 211th Place Project Public Works Director Jim Kelly requested Council approve Amendment #3 to SCJ Alliance for 211th Place Corridor Project final design. Councilmember Debora Nelson moved, and Councilmember Heather Logan seconded the motion to approve Amendment #3 to the SCJ Alliance contract for the 211th Place Corridor Restoration Project and authorize the Mayor to sign the amendment. The motion passed unanimously.

Condemnation Proceedings for the 211th Place Improvement Project Public Works Director reviewed eminent domain proceedings, and requested Council approve the ordinance allowing the City to move forward with condemnation proceedings. Mayor Pro Tem Michele Blythe moved, and Debora Nelson seconded the motion to approve the ordinance allowing the City to move forward with condemnation proceedings and authorize the Mayor to sign the ordinance. The motion passed unanimously. COMMENTS FROM COUNCILMEMBERS Councilmember Schuette provided a Transportation Policy Board update. Councilmember Nelson thanked police, public, and staff for a smooth evening for the dragstrip cruise through the city. She asked about the deep hole in the new construction of 3rd Street parking lot. City Administrator Paul Ellis indicated that is drainage. Councilmember Van-Ornam reminded everyone about the Hispanic Heritage event September 28. ADMINISTRATOR & STAFF REPORTS City Administrator Paul Ellis stated the Northwest Regional Police Academy will be located in Arlington. He stated that Mayor Vanney worked hard to insure this would happen. MAYOR’S REPORT Mayor Vanney attended the Arlington Food Bank’s Farm to Table dinner and said it was a great event with very good attendance. EXECUTIVE SESSION None. INTRODUCTION OF SPECIAL GUESTS AND PRESENTATIONS Citizen Troy Cecsarini made presentations to thank Officers Sarah Althuisius, Dustin Bartlett, and Austin Shouman of Arlington Police Department, Battalion Chief Phil Knepper and Firefighters/EMTs Blake Hilary and Brenden Hale of North County Regional Fire Authority, who performed life-saving measures during an aid call. Mr. Cecsarini was presented with a Phoenix coin by Battalion Chief Phil Knepper. Mr. Cecsarini was joined by his brother John Michael Stevens, who shared a similar experience in receiving life saving measures by police, fire and EMTs and thanked them for saving his life, as well.
WORKSHOP ITEMS – NO ACTION WAS TAKEN
Low Bid Award 640 for Booster Pump Station Public Works Director Jim Kelly reviewed the City’s contract with RH2 Engineering for the design of the 640 BPS project to install a booster pump station to feed the 640-pressure zone from the 530-pressure zone. Staff has bid and awarded the manufacture and delivery of a skid mounted system booster pump system and emergency generator. RH2’s design will incorporate these two pre-purchased items with necessary infrastructure design to establish a 640-pressure zone fed by the City of Arlington Water Department.

The construction of the Booster Pump Station was bid in August 2024. Ten bids were received and opened on September 12. The qualified low bidder is Trico Companies and staff is recommending the City award this project to Trico Companies as the qualified bidder. Discussion followed with Mr. Kelly answering Council questions.
Ordinance Amending Arlington Municipal Code Chapter 13.12 Finance Director Kristin Garcia reviewed the Ordinance Amending Chapters 13.12 and 13.28 Pertaining to Stormwater Utility Rates. Staff is proposing updates to the Stormwater Utility Ordinance regarding collection of accounts. The proposed language is to provide consistency with other sections of the code regarding water and sewer collection of accounts and more clearly specifies that if an account is turned over to collection or a lien is filed against the property, the customer may incur additional fees. Discussion followed with Ms. Garcia answering Council questions.
July and August Financial Reports Finance Director Kristin Garcia presented financial reports for July and August.
Community and Economic Development Quarterly Report Community and Economic Development Director Marc Hayes presented the department’s third quarter report.
Utilities and Transportation Quarterly Report Public Works Director Jim Kelly presented the department’s third quarter report.
ADMINISTRATOR AND STAFF REPORTS City Administrator Paul Ellis provided an update on the hog fuel piles on the north end of the Airport being done by Reece Construction. Hog fuel is a type of wood waste that's processed into coarse chips and clumps and used as fuel. It’s also known as shred. Mr. Ellis showed a slide with a photo taken July 29 where the area was filled, groomed and seeded. Another photo taken September 20, and shows significant grass growth. A large portion is grass now. Preventative measures will continue to be taken. Mr. Ellis thanked Councilmembers for submitting information regarding the citizen survey regarding quality of life. He wants to brainstorm with Councilmembers at the end of the October 8 retreat to discuss next steps. Discussion followed with Mr. Ellis answering Council questions. Mr. Ellis reminded Councilmembers that next week is the 5th Monday, so there will be no Council meeting. The next meeting will be October 7, with the Council Budget Retreat on the following day, October 8.
MAYOR’S REPORT Mayor Vanney spoke of the presentation by Troy Cecsarini and how law enforcement, paramedics and EMTs change peoples’ lives. Mayor Vanney also thanked Finance Director Kristin Garcia and her staff for a clean audit.

COMMENTS FROM COUNCILMEMBERS Councilmember Jan Schuette spoke about Puget Sound Regional Council (PSRC) and how action is being taken to improve roadway safety in our region and they would like input. PSRC is collaborating with local communities to create a Regional Safety Action Plan. The plan will include coordinated strategies and solutions grounded in comprehensive data analysis garnered through public engagement. The meeting will be Tuesday, October 1 from 5 to 7:30 p.m. at the Everett Station.
COUNCILMEMBER REPORTS Councilmembers had nothing to report this evening.
PUBLIC COMMENT Jay Lindberg, Stanwood, provided comment.
REVIEW OF CONSENT AGENDA ITEMS FOR NEXT MEETING Councilmembers agreed to place the two agenda items on new business for the October 7 meeting.

Staff Present: Mayor Don Vanney, Paul Ellis, Kristin Garcia, Sheri Amundson, Suzanne Soule, and Wendy Van Der Meersche.
Also Known to be Present: Deb Kindinger and Erika Davies. The special meeting began at 3:00 p.m. with Audit Lead Deb Kindinger introducing herself and Assistant Audit Supervisor Erika Davies. Finance Director Kristin Garcia made introductions of those from the City of Arlington who were present.
DISCUSSION Audit Lead Deb Kindinger began with a review of unmodified opinion was issued, followed by a review of internal control and compliance over financial report. An audit was performed on the financial statements of the City of Arlington, as of and for the year ended December 31, 2023, and the related notes to the financial statements, which collectively comprise the City’s financial statements. An unmodified opinion on the fair presentation of the City’s financial statements in accordance with its regulatory basis of accounting was completed. The following exit recommendations were provided for management’s consideration. Exit items address control deficiencies or noncompliance with laws or regulations that have an insignificant or immaterial effect on the entity, or errors with an immaterial effect on the financial statements. Exit items are not referenced in the audit report. Ms. Kindinger introduced Audit Supervisor Erika Davies who continued with a review of related audit work.
Financial Statement Audit Communication The following items were addressed: •No material misstatements during the audit were identified.•There were no uncorrected misstatements in the audited financial statements.•The audit addressed the following risks, which required special consideration:o Due to the possibility that management may be able to circumvent certaincontrols, standards require the auditor to assess the risk of management override.

The auditors will publish the following reports for the period January 1, 2023 through December 31, 2023 on their website: •Financial statement audit•Coronavirus State and Local Fiscal Recovery Funds Compliance Examination AttestationThe next audit is scheduled to be conducted in the Summer of 2025 and will cover thefollowing general areas:• Accountability for public resources for fiscal years 2023 and 2024• Financial statement for fiscal year 2024• Coronavirus State and Local Fiscal Recovery Funds (SLFRF) Compliance ExaminationAttestationMs. Davies stated that a citizen submitted a concern through the Citizen Hotline Referral regarding overnight travel at the City Council Spring Retreat in March 2024. The City provided overnight lodging for those who stayed onsite, with the distance 19 miles away. The City was compliant in the auditor’s findings and everything for expenses was well documented. It was stated that although the City’s travel training policy does not restrict overnight travel, consideration should be given to holding retreats at destinations within a reasonable distance. Ms. Davies provided closing remarks and thanked Finance Director Kristin Garcia, Assistant Finance Director Sheri Amundson, and Fiscal Analyst Suzanne Soule for timely responses to the audit requests and the excellent documentation they provided. She stated they have been a pleasure to work with.

ORDINANCE NO. 2024-XXX
AN ORDINANCE OF THE CITY OF ARLINGTON, WASHINGTON
AMENDING ARLINGTON MUNICIPAL CODE CHAPTERS 13.12 and 13.28 PERTAINING TO
STORMWATER UTILITY RATES
WHEREAS, the City of Arlington has the authority to set rates and charges for its utility
system; and
WHEREAS, the City of Arlington continues to examine equitable rates for water, sewer,
and stormwater service; and
WHEREAS, the City wishes to correct two sections of the municipal code to confirm that
it has the right to send delinquent accounts to collection; and
WHEREAS, the City Council considered this amendment at their workshop on September
23, 2024 and at their regular meeting held on October 7, 2024, and determined approving the
amendment was in the best interest of the City and its citizens;
NOW, THEREFORE, the City Council of the City of Arlington do hereby ordain as follows:
Section 1. Arlington Municipal Code section 13.12.210 shall be and hereby is amended
to read as follows:
13.12.210 - Due date for charges.
The monthly utility bill for water, sewer, and stormwater service shall be paid
immediately upon billing and will be considered delinquent if not paid in full twenty
calendar days from the billing date in which the service was originally charged. A grace
period of five calendar days from the due date will be allowed before penalties are
assessed. A penalty of five percent for each thirty days or fraction thereof shall be
assessed against all delinquencies after said grace period. In the event that the city shall
turn over an account under this chapter to an attorney, collection agency or other
person for collection, the person responsible for payment of the account shall be
responsible for actual costs of collection, including collection agency fees, reasonable
attorney’s fees and other costs incurred in collection.

Section 2. Arlington Municipal Code Section 13.28.270 shall be and hereby is amended
to read as follows:
13.28.270 - Storm and surface water rates.
(a)General. The city council shall establish service rates within AMC 13.12 for the
operation and maintenance of the drainage system, for related drainage services, and
for the operation of the stormwater utility. Shall , which shall establish classifications of
customers or service and rate structures, using any method or methods authorized by
law. In the event that the city shall turn over an account under this chapter to an
attorney, collection agency or other person for collection, the person responsible for
payment of the account shall be responsible for actual costs of collection, including
collection agency fees, reasonable attorney’s fees and other costs incurred in collection.
(b)Rate Basis. Drainage rates shall be based on revenue requirements necessary to
cover all costs of the utility, as authorized by the city council, the adoption of the annual
budget and subsequent amendments and shall be guided by adopted financial policies
and bond covenants.
(c)Rate Adjustments. Rates shall be evaluated periodically as part of the review and
adoption of the annual budget. Rate adjustments shall be recommended by the director
as needed to meet revenue requirements of the utility. The recommendation shall
consider equity, adequacy, costs, NPDES II requirements and other factors allowed by
law.
(d)Rate Relief. The city council may establish drainage rate relief measures, as
authorized by state law and as detailed in the stormwater credit manual, for specific
customer classes where, through site design, regular system maintenance, education
and other approaches, the impacts of stormwater on the drainage system are reduced.
Section 3. Severability. Should any section, paragraph, sentence, clause or phrase
of this Ordinance, or its application to any person or circumstance, be declared unconstitutional
or otherwise invalid for any reason, or should any portion of this Ordinance be preempted by
state or federal law or regulation, such decision or preemption shall not affect the validity of
the remaining portions of this Ordinance or its application to other persons or circumstances.
Section 4. Effective Date. This Ordinance or a summary thereof shall be published
in the official newspaper of the City. The Ordinance shall take effect five (5) days after
publication as provided by law.

HISTORY: through a Local Project Review: Paper to Digital Permitting Grant Program to help jurisdictions convert from paper to digital permitting to streamline the permit process. Council approved Resolution No. 2024-020 at the July 29, 2024 Council meeting, which allowed Community and Economic Development staff to apply for the grant in August of 2024. The grant funding will enable the Community and Economic Development Department to fully integrate to online permitting management. These records will also be viewable to the public through an online portal. ALTERNATIVES: Remand to staff for additional information.
I move to accept the available grant funding of $183,000.00, from the Department of Commerce, and authorize the Mayor to sign the resolution, and sign the contracts for work related to the Local Project Review: Paper to Digital Permitting implementation.

RELATED TO 2SSB 5290 AND ELEMENTS OF ITS LOCAL PROJECT REVIEW: PAPER TO DIGITAL
PERMITTING IMPLEMENTATION TO STREAMLINE PERMITTING WITHIN THE CITY
WHEREAS, the City of Arlington desires to implement several action items as described in the
Second Substitute Senate Bill (2SSB) 5290, related to local project review processes; and
WHEREAS, the Department of Commerce is awarding grants to cities to complete
streamlined permit process efforts through the implementation of a digital permit process;
and
WHEREAS, the Department of Commerce has offered to award a grant in the amount of
$183,000.00 to the City of Arlington to implement a full digital permit process for all permit
types, virtual inspections, electronic review, visual storage, and digitize permit records; and
WHEREAS, the City of Arlington considers it in the best public interest to accept the
available grant funding for the implementation of streamlined permits through the Local
Project Review: Paper to Digital Permitting in efforts to support 2SSB 5290; and
NOW THEREFORE, the City Council of the City of Arlington Washington do hereby
resolve as follows:
1. That the Mayor be authorized to accept the grant funding offered by the
Washington State Department of Commerce, in the amount of $183,000.00, for
the above noted permitting efforts.

Greetings:
I am pleased to inform you that the City of Arlington has been awarded $183,000 for a 2024-2025 Paper to Digital grant.
The purpose of this grant is to help jurisdictions transition their residential permit review process to a fully digital system.
These funds will support the improvement of your permit review process.
The Washington Department of Commerce, Growth Management Services (GMS) unit will administer the grant
program. Before we disburse the funds, a contract with a final agreed upon scope of work and budget will
need to be discussed and executed between your organization and the Department of Commerce.
Funds may be applied to project costs related to your grant scope of work, beginning July 1, 2024, the date the
funding became available. These grant funds are authorized by the 2024-2025 State Operating Budget (Senate
Bill 5290), which directs Commerce to provide this grant to cities or counties for actions relating to transitioning
their residential building permit review process to a fully digital system. Allan Johnson or another member of
