55th Annual Professional Municipal Clerks Week WHEREAS, the office of the professional municipal clerk, a time honored and vital part of local government exists throughout the world; and WHEREAS, the office of the professional municipal clerk is the oldest among public servants; and WHEREAS, the office of the professional municipal clerk provides the professional link between the citizens, the local governing bodies and agencies of government at other levels; and WHEREAS, professional municipal clerks have pledged to be ever mindful of their neutrality and impartiality, rendering equal service to all. WHEREAS, the professional municipal clerk serves as the information center on functions of local government and community. WHEREAS, professional municipal clerks continually strive to improve the administration of the affairs of the office of the professional municipal clerk through participation in education programs, seminars, workshops and the annual meetings of their state, provincial, county and international professional organizations. WHEREAS, it is most appropriate that we recognize the accomplishments of the office of the professional municipal clerk. WHEREAS, every day, residents of Arlington and people throughout the city directly benefit from the dedication and commitment of City of Arlington employees, those public servants and unsung heroes that keep Arlington running; and WHEREAS, City of Arlington employees represent numerous occupations and trades, possess a broad array of skills and expertise, and put these to use with efficiency and integrity for everyone in our city; and WHEREAS, while elected officials come and go, the consistency and institutional knowledge of City of Arlington employees offers continuity of service across years and election cycles, and is essential to the smooth functioning of our city over time; and WHEREAS, we all owe a substantial debt of gratitude to City of Arlington employees; NOW, THEREFORE, I, Don Vanney, Mayor of Arlington, Washington, do hereby proclaim May 1 through May 7, 2024

Appointments to Parks, Arts, and Recreation Commission Community Engagement Director Sarah Lopez requested Council consent to the reappointment of Crista Dietz, and appointments of Heather Watland, Randy Nobach, and Jan Bauer to the Parks, Arts, and Recreation Commission. Councilmember Debora Nelson moved, and Councilmember Jan Schuette seconded the motion to consent to the appointments of Crista Dietz, Heather Watland, Randy Nobach, and Jan Bauer and to the Parks, Arts and Recreation Commission. The motion passed unanimously.
Appointment to Planning Commission Community and Economic Development Director Marc Hayes requested Council confirm the appointment of Tim Abrahamson to the Planning Commission. Councilmember Rob Toyer moved, and Councilmember Debora Nelson seconded the motion to confirm the appointment of Tim Abrahamson to the Planning Commission. The motion passed unanimously.
Round Two of 2024 Lodging Tax Distribution Finance Director Kristin Garcia requested Council approve the second-round of 2024 grant funding, as recommended by the lodging tax advisory committee. Three applications were received for round two of the 2024 lodging tax grant program. One project was short of the match requirement by about $250. The Visitor Center Tear Off Brochure project was not awarded a grant for round two as funding for brochures was awarded to the Chamber in the first round. Councilmember Heather Logan moved, and Councilmember Rob Toyer seconded the motion to approve the second-round of 2024 grant funding as recommended by the lodging tax advisory committee. The motion passed unanimously.
Replacement of Nutanix Production Server Environment City Administrator Paul Ellis requested Council approve staff’s request for an early replacement of the production server environment. Councilmember Leisha Nobach moved, and Councilmember Debora Nelson seconded the motion to approve a contract with Right! Systems, Inc., and authorized the Mayor to sign the necessary documents. The motion passed unanimously.
Right of Way Procurement for the 211th Place Rehabilitation Project for Willett
Property Public Works Director Jim Kelly requested Council approve the full property procurement of the Willett property.

Councilmember Rob Toyer moved, and Councilmember Yvonne Gallardo-Van Ornam seconded the motion to approve the Willett property purchase and authorized the Mayor to sign the property procurement documents, subject to final approval by the City Attorney. The motion passed unanimously.
Right of Way Procurement for 188th Street and Smokey Point Blvd. for Alam
Property Public Works Director Jim Kelly requested Council approve the full property procurement of the Alam property. Councilmember Yvonne Gallardo-Van Ornam moved, and Councilmember Heather Logan seconded the motion to approve the offer package as presented, and authorized the Mayor to sign the property procurement documents, subject to final approval by the City Attorney. The motion passed unanimously.
Right of Way Procurement for 188th Street and Smokey Point Blvd. for Jammeh
Property Public Works Director Jim Kelly requested Council approve the procurement of right-of-way (ROW) and temporary construction easement (TCE) from the Jammeh property. Councilmember Jan Schuette moved, and Councilmember Debora Nelson seconded the motion to authorize staff to pursue the right of way acquisition from Bintou and Yaya Jammeh for a sum not to exceed $272,100, or such other sum approved by the Public Works Director within the project budget and authorized the Mayor to sign the right-of-way / temporary construction easement procurement documents, subject to final approval by the City Attorney. The motion passed unanimously.

DESCRIPTION:
This is another opioid litigation settlement for Council to consider. The Council previously approved three
settlements reached between the State of Washington, numerous cities and county governments and three
opioid manufacturers and distributors.
This proposed $123.3 million settlement is between the state and local governments in Washington and
Johnson & Johnson. This settlement again is split 50% to the state and 50% ($61.67 million) to cities and
counties. The settlement requires substantially all eligible cities and counties to sign on to the settlements
by 05/11/24. The funds must be used to remediate the impacts of opioid addiction and are allocated through
the same basic process as the last settlements, through the regional Opioid Abatement Council. Arlington’s
share of the settlements would be administered through the SWISS counties (Snohomish, Whatcom, Island,
Skagit, San Juan).

To join in the settlement, we would need to authorize the mayor to sign the proposed settlement
participation forms for this settlement agreement. The City’s share of the monies would be pooled and used
regionally to address local impacts of the opioid crisis.
HISTORY:
Opioid litigation started in 2016 and is now approaching resolution. Cities are asked whether they want to
participate. Eligible local jurisdictions who do participate will share in the settlement proceeds. Those
who do not will not share in the settlement. As of May 1, 2024, 84 of 130 eligible cities and counties have
approved the settlement.

The City currently owns a 1994 John Deere backhoe that is approaching the end of its useful life. Originally due for replacement in 2020, staff decided to put the backhoe in reserve status and reevaluate its use over the next few years. Use of the backhoe has recently increased, and it is reaching the end of its useful life much sooner than staff expected. Staff is proposing to purchase a Kubota L2502HST Backhoe with several attachments including, Grass Aerator with Fertilizer Tanks, Box Scraper, and Snowplow. Staff proposes to use current 2024 Estimated Ending Fund Balance $154,279.58 for the purchase. This purchase will not impact any future purchases. ALTERNATIVES:

In 2011 the City adopted Right of Way Procedures that detail rules and procedures City staff must follow in acquiring real property. These procedures are consistent with the federal Uniform Relocation Assistance and Real Property Acquisition Policies Act, as well as consistent with state and federal policies and regulations. The City’s Right of Way Procedures were updated in 2017 and again in 2021. If a property owner is being displaced by ROW procurement, the City is required to calculate and pay fair and just compensation for relocation expenses. Staff recently was informed that if the property owner wants to contest the method of determination or the amount of relocation payment, there must be detailed procedures for the appeal process. Staff drafted the attached Relocation Appeal Procedures and had them reviewed by WSDOT; we are requesting that the City’s Right of Way Procedures be amended to include the attached Relocation Appeal Procedures as Attachment C. ALTERNATIVES: Do not approve policy and procedures.

A)Appealable Actions.
Any aggrieved person may file a written appeal with the City of Arlington in any
case in which the person believes that the City has failed to properly consider the
person's eligibility for relocation assistance. Such assistance may include, but is not
limited to, the person's eligibility for, or the amount of, a payment required under
Chapter 12 of the Washington State Department of Transportation Right of Way
Manual, or a relocation payment required under WAC 468-100-010.
B)Time Limit for Initiating Appeal.
A person must file a written appeal with the Public Works Director within sixty
(60) calendar days of receipt of the City's written determination of eligibility or
entitlement. This written appeal shall be addressed to the Public Works Director,
City of Arlington, 238 N Olympic Ave Arlington, WA 98223. Failure to timely file an
appeal shall result in waiver of any appeal right.
C)Appeal Requirements.
Appeals must be in writing accompanied with the applicable appeal fee if any.
The appeal shall include the following:
1.The City's project name
2.The Project Parcel number or the Tax Parcel number of the real
property involved
3.Date of the relocation notice that is being appealed
4.Name of the aggrieved person(s) ("appellant(s)")
5.A statement of issues/concerns
6.An explanation of what the appellant is claiming; all facts, reasons, and
any supporting evidence as to the nature of the grievance or why the
appellant is otherwise aggrieved.
7.The relief requested
8.The signature, current address and telephone number of the appellant or
the person's authorized representative.
D)Right to Representation and Inspection of Documents.
Any appellant has a right to be represented by legal counsel or other
representative in connection with his or her appeal, but solely at the person's own
expense. The appellant shall have a right to inspect and copy all written materials
in City files pertinent to their appeal, subject to reasonable conditions consistent with
the Public Records Act. The City shall have the right to charge a reasonable fee for
providing copies of documents requested.

E) Scope of Review of the Appeal.
Appeal to Public Works Director. Within fourteen (14) days of receipt of an
appeal under this chapter, the Public Works Director will evaluate the appeal to
determine if it is complete. The Public Works Director will send written notice to the
appellant informing them if the appeal has been determined to be complete or
requesting additional information. If the appeal is determined to be complete, the
Public Works Director will issue and mail to the appellant a written decision on the
appeal, based on applicable relocation assistance regulations, within fifteen (15)
days of the date of notice of completeness. If additional information is necessary to
process the appeal, the Public Works Director will request the appellant to file any
additional information within ten (10) days. Within fifteen (15) days of (a) receiving the
requested additional information, or (b) the deadline for receiving the requested
additional information if sufficient additional information is not received, the Public
Works Director will issue and mail to the appellant a written decision on the appeal
based on applicable relocation assistance regulations. A written decision on appeal
issued by the Public Works Director pursuant to this section shall be the City's final
decision unless an appeal of the Public Works Director's decision is filed.
F) Appeal of Public Works Director Determination to City Council.
If the appellant believes the Public Works Director has not correctly evaluated the
appeal, the appellant may appeal the decision of the Public Works Director to the City
Council by filing a written appeal with the Public Works Director within ten (10) days of

WHEREAS, as part of continuing developments within the City and along
188th Street211th Place NE (the “Project”), the City is preparing to implement
infrastructure improvements; and
WHEREAS, the Project requires acquisition of certain real property
interests and rights for the Project, including the property, rights and interests
described in Section 1 below ("Property"); and
WHEREAS, the City has been and is continuing to negotiate the purchase
of the necessary Property from the Property owner but has yet to conclude a real
property purchase and sale agreement for such Property; and
WHEREAS, the City Council finds that the Property is necessary and critical
to the Project, and that it is in the public interest to have such Property for public
health, safety, welfare and transportation needs.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ARLINGTON, WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Need for Property. The public health, safety, necessity and
convenience require the extension and improvement of the City’s water and sewer
system for the purposes of the Project, and it is necessary therefore that certain
property be condemned, appropriated, taken and damaged for the construction of
said improvements and the Project as provided by this Ordinance, specifically
including the real property and appurtenant rights, interests and improvements as

and over the land legally described in attached Exhibit A, situate in the City of
Arlington, Snohomish County, Washington.
Section 2. Declaration of Necessity. The City Council, after issuing proper
notices, hearing the report(s) of the City Staff, reviewing the planned Project, and
conducting a public meeting and hearing thereon, hereby declares that the
property, rights, interests and improvements described in Exhibit hereto are
necessary for the public use, specifically for the development along 188th
Street211th Place NE, together with all necessary appurtenances and related
work.
Section 3. Costs of Acquisition. The costs of acquiring the property, rights,
interests and improvements authorized by this Ordinance shall be paid by the
capital projects fund of the City of Arlington, or such other funds of the City of
Arlington as may be designated from time to time or provided by law.
Section 4. Relocation of Tenants. There are no tenants currently located
on the property and therefore no relocation assistance under RCW Chapter 8.26
is required.
Section 5. Authority of Attorney. The City Attorney, or special outside legal
counsel retained for prosecution of this condemnation action, are hereby directed
to exhaust reasonable efforts through direct negotiations to acquire the necessary
property described herein for the Project. In the event reasonable negotiation
efforts are not successful, the City Attorney or special outside legal counsel are
hereby authorized and directed to begin and prosecute actions and proceedings
in a manner provided by law to condemn, take, damage, and appropriate the
property, rights, interests and improvements necessary to carry out the provisions
of this Ordinance. In conducting such condemnation proceedings, the City Attorney
or special outside legal counsel are hereby authorized to enter into stipulations for
the purpose of minimizing damages.
Section 6. Severability. If any section, sentence, clause or phrase of this
Ordinance should be held to be invalid by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any
other section, sentence, clause or phrase of this Ordinance.
Section 7. Effective Date. This Ordinance, being an exercise of a power
specifically delegated to the City legislative body, is not subject to referendum, and
shall take effect five (5) days after passage and publication of an approved
summary thereof consisting of the title.
Section 8. Corrections. The City Clerk and the codifiers of this Ordinance
are authorized to make necessary corrections to this Ordinance, including but not

limited to the correction of scrivener's/clerical errors, references, ordinance
numbering, section/subsection numbers, and any references thereto.

In my role as the treasurer of DABA, we effectively leverage grants to support a variety of events. Over
the past year, Cristy and I have collaborated on grant writing efforts. Now, I am eager to delve deeper
into the remaining steps of the process. Contributing to the community in a volunteer capacity brings
me great fulfillment, and I'm keen to expand my involvement by learning more about the commissions.
Since 2016, I've been an active member of DABA. With extensive experience in bookkeeping and
restaurant management spanning several years, I am motivated to deepen my engagement with

Overall Revenues and Expenses:
Overall first quarter revenues are down about 5% from this time last year, mostly because of sales tax
(see next page for more discussion). First quarter expenses are nearly the same as last year, only up
about $54,000 or 1%. As first quarter expenses currently exceed revenue, I wanted to look at the
fund balance over the last year to see how cash flow is trending (see chart below). Cash flow is fairly
consistent and typically spikes up in May and November when property taxes are received and
declines when December debt payments are made. The trend is following the typical pattern
however first quarter 2024 is trending slightly below where fund balance was first quarter 2023. No
significant concerns as fund balance is adequate to cover the minimum two month operating reserve,
planned transfer to capital facility reserve and to meet 2024 debt obligations.

Sales Tax:
Revenues across business types are stable except for a decline from building construction. The
decline was expected after completion of the Amazon facility, however, as seen from the construction
sales tax – 1st quarter chart below, “regular” construction activity also shows a sign of a decline going
into 2024 (the red line dipping down from 2023 to 2024). High interest rates and the difficulty of
obtaining financing is likely playing a role in the construction slow down. The expectation is that this
is temporary and activity should pick back up once inter est rates decline. Revenue from retail sales
has flatlined. Revenues from the retail and construction industry are the two largest sales tax revenue
categories.

Opioid Settlement Fund - This fund was initially created to account for opioid settlements that will
be received under the Distributor and Janssen Settlement Agreements. A separate fund was created
because this money is restricted and can only be used to address the opioid epidemic.
Payments under the Distributor Agreement come in annually over the next 16 years. The Janssen
Agreement will be paid out over the next 11 years. The city has received a total of $75,348.14 from
these settlements.
The city is also participating in the Walmart, Walgreens, Teva, CVS and Allergan Settlements. These
will also be paid annually with final settlements paid out ranging from 2029 through 2036. The city
has received a total of $110,987.80 from these settlements.
Streets Fund – The Streets Fund is primarily funded through motor vehicle fuel tax. Fuel tax is
distributed on a per capita basis and can fluctuate based on the State’s quarterly revenue estimate.
As this is a major revenue for the Streets Fund, it’s important to see revenues are performing. The
chart below shows first quarter revenues since 2019. Revenues are trending slightly downward since
2022 because of the decline in the per capita rate. The rate in 2022 was $17.60, was revised down to
$17.04 in 2023 and expected to be $17.12 in 2024. The 2025 per capita estimate is expected to go
down to $17.07. The slight decline in the per capita rate won’t be a significant revenue impact as
population estimates are expected to increase.
Lodging Tax Fund – Due to the temporary closure of a hotel this winter, lodging tax revenues have
been monitored to determine the extent of the impact, if any, that closure has caused. These
revenues are monitored closely as the city has committed to tourism grant funding in 2024. Revenues
are stable and trending slightly upward from this time next year. I don’t anticipate any significant
impact to revenue unless the closure becomes permanent.

Water/Sewer Funds – Utility revenues are tending slightly upward which is expected based on recent
commercial and residential development.

I have been working with Paul and HR on succession planning as there are expected retirements
within the next 2 years. In 2022, my department experienced nearly 40% turnover and while we’re
now fully staffed, we’re still recovering from that turnover. I want to be proactive as we approach
another significant turnover over the next few years (about 30%). As two known retirements will

requires adding user licenses. By
entering into a new 5 year agreement
