REVIEW OF CONSENT AGENDA ITEMS FOR NEXT MEETING EXECUTIVE SESSION RECONVENE ADJOURNMENT Mayor Pro Tem Michele Blythe / Mayor Don Vanney PROCLAMATION Child Abuse Awareness Month WHEREAS, children are our nation’s most vulnerable members as well as our nation’s most valuable resources, helping to shape the future of Arlington; and WHEREAS, positive childhood experiences, like loving caregivers and safe, stable, and nurturing relationships, can help mitigate trauma and the negative impact of adverse childhood experiences to promote the social, emotional, and developmental well-being of children; and WHEREAS, childhood trauma can have long-term psychological, emotional, and physical effects throughout an individual’s lifetime and impact future generations of their family; and WHEREAS, childhood trauma, including abuse and neglect, is a serious problem affecting every community in the U.S., and finding solutions requires input and action from everyone; and WHEREAS, children who live in families with access to concrete economic and social supports are less likely to experience abuse and neglect; and WHEREAS, prevention is possible because of the partnerships created between families, prevention advocates, child welfare professionals, education, health, community, and faith-based organizations, businesses, law enforcement agencies, and local, state, and national governments; and WHEREAS, we acknowledge that in order to solve the public health issue of abuse and neglect we must work together to change hearts and mindsets through storytelling and sharing, center the needs of families, break down bias and barriers, and inspire action from expected and unexpected partners in prevention; and WHEREAS, we are committed to advancing equitable, responsive, and effective systems that ensure all children and families are healthy and thriving; and WHEREAS, we recognize the need to prioritize kids and invest in more prevention initiatives like home visiting and family-strengthening policies, economic supports, and community-based child abuse prevention programs at the national, state, and local levels; and NOW, THEREFORE, I, Don Vanney, Mayor of Arlington, do hereby proclaim April as NATIONAL CHILD ABUSE PREVENTION MONTH in Arlington and urge all citizens to recognize this month by building a narrative of hope for children and families through collaboration and the creation of an ecosystem of primary prevention. _______________________________ __April 22, 2024__ Don E. Vanney, Mayor Dated PROCLAMATION National Volunteer Week WHEREAS, millions of American volunteers give their time to help others, contributing over 30 million volunteer hours per year worth over $635 million; and WHEREAS, National Volunteer Week was established in 1974, and has grown exponentially each year, with thousands of volunteer projects and special events scheduled throughout the week WHEREAS, National Volunteer Week captures the power of changemakers to come together to build stronger, more vibrant communities through service. WHEREAS, volunteers in Arlington mentor our children, feed our hungry, comfort our lonely, beautify our green spaces, and fundraise for our charitable organizations; and WHEREAS, Arlington's volunteers are young, old, families, workers, retirees, men and women of all ages and backgrounds; and WHEREAS, the collective result of the work done by our city's volunteers is that Arlington is a more desirable place to live; and WHEREAS, organizations in Arlington that rely on volunteers include the City and such fundamental organizations as Arlington Public Schools, Stilly Valley Center, and the Arlington Community Food Bank; and WHEREAS, volunteers play a critical role in determining the direction of the city now and in future years. Vanney, Mayor Dated City of Arlington Council Agenda Bill WS #1 Attachment April 22, 2024 Opioid Litigation Settlement—Johnson & Johnson / Janssen None Administration; Paul Ellis, City Administrator / Steve Peiffle, City Attorney EXPENDITURES REQUESTED: 0 BUDGET CATEGORY: BUDGETED AMOUNT: N/A LEGAL REVIEW: DESCRIPTION: settlements reached between the State of Washington, numerous cities and county governments and three opioid manufacturers and distributors. This proposed $123.3 million settlement is between the state and local governments in Washington and Johnson & Johnson. This settlement again is split 50% to the state and 50% ($61.67 million) to cities and counties. The settlement requires substantially all eligible cities and counties to sign on to the settlements by 4/18/2023. The funds must be used to remediate the impacts of opioid addiction and are allocated through the same basic process as the last settlementsArlington’s share of the settlements would be adminiWhatcom, Island, Skagit, San Juan). To join in the settlement, we would need to authorize the mayor to sign the proposed settlement participation forms for this settlement agreement. The City’s share of the monies would be pooled and used Opioid litigation started in 2016 and is now approaching resolution. Cities are asked whether they want to participate. Eligible local jurisdictions who do participate will share in the settlement proceeds. These procedures are consistent with the federal Uniform Relocation Assistance and Real Property Acquisition Policies Act, as well as consistent with state and federal policies and regulations. The City’s Right of Way Procedures were updated in 2017 and again in 2021. If a property owner is being displaced by ROW procurement, the City is required to calculate and pay fair and just compensation for relocation expenses. Staff recently was informed that if the property owner wants to contest the method of determination or the amount of relocation payment, there must be detailed procedures for the appeal process. Staff drafted the attached Relocation Appeal Procedures and had them reviewed by WSDOT; we are requesting that the City’s Right of Way Procedures be amended to include the attached Relocation Appeal Procedures as Attachment C. ALTERNATIVES: Do not approve policy and procedures. Workshop; discussion only. Any aggrieved person may file a written appeal with the City of Arlington in any case in which the person believes that the City has failed to properly consider the person's eligibility for relocation assistance. Such assistance may include, but is not limited to, the person's eligibility for, or the amount of, a payment required under Chapter 12 of the Washington State Department of Transportation Right of Way Manual, or a relocation payment required under WAC 468-100-010. B)Time Limit for Initiating Appeal. A person must file a written appeal with the Public Works Director within sixty (60) calendar days of receipt of the City's written determination of eligibility or entitlement. This written appeal shall be addressed to the Public Works Director, City of Arlington, 238 N Olympic Ave Arlington, WA 98223. Failure to timely file an appeal shall result in waiver of any appeal right. C)Appeal Requirements. Appeals must be in writing accompanied with the applicable appeal fee if any. The appeal shall include the following: 1.The City's project name 2.The Project Parcel number or the Tax Parcel number of the real property involved 3.Date of the relocation notice that is being appealed 4.Name of the aggrieved person(s) ("appellant(s)") 5.A statement of issues/concerns 6.An explanation of what the appellant is claiming; all facts, reasons, and any supporting evidence as to the nature of the grievance or why the appellant is otherwise aggrieved. 7.The relief requested 8.The signature, current address and telephone number of the appellant or the person's authorized representative. D)Right to Representation and Inspection of Documents. Any appellant has a right to be represented by legal counsel or other representative in connection with his or her appeal, but solely at the person's own expense. The appellant shall have a right to inspect and copy all written materials in City files pertinent to their appeal, subject to reasonable conditions consistent with the Public Records Act. The City shall have the right to charge a reasonable fee for providing copies of documents requested. DRAFT Relocation Appeal Procedures Page 2 of 2 E) Scope of Review of the Appeal. Appeal to Public Works Director. Within fourteen (14) days of receipt of an appeal under this chapter, the Public Works Director will evaluate the appeal to determine if it is complete. The Public Works Director will send written notice to the appellant informing them if the appeal has been determined to be complete or requesting additional information. If the appeal is determined to be complete, the Public Works Director will issue and mail to the appellant a written decision on the appeal, based on applicable relocation assistance regulations, within fifteen (15) days of the date of notice of completeness. If additional information is necessary to process the appeal, the Public Works Director will request the appellant to file any additional information within ten (10) days. Within fifteen (15) days of (a) receiving the requested additional information, or (b) the deadline for receiving the requested additional information if sufficient additional information is not received, the Public Works Director will issue and mail to the appellant a written decision on the appeal based on applicable relocation assistance regulations. A written decision on appeal issued by the Public Works Director pursuant to this section shall be the City's final decision unless an appeal of the Public Works Director's decision is filed. F) Appeal of Public Works Director Determination to City Council. If the appellant believes the Public Works Director has not correctly evaluated the appeal, the appellant may appeal the decision of the Public Works Director to the City Council by filing a written appeal with the Public Works Director within ten (10) days of the date of mailing of the City Public Work Director's decision. Appeals filed after the ten (10) daytime period has lapsed will not be considered. The City Council will conduct an open record hearing and review and make the final decision of the City on the appeal based on applicable relocation assistance regulations. The City received a grant from the Transportation Improvement Board for the design and construction improvements to 211th Place from SR530 to 67th Ave. As part of the 211th Place Improvement Project, the City needs to obtain ROW and Temporary Construction Easement (TCE) from several parcels; failing negotiations on a select few parcels may force the City to proceed with the eminent domain process. WHEREAS, as part of continuing developments within the City and along 188th Street211th Place NE (the “Project”), the City is preparing to implement infrastructure improvements; and WHEREAS, the Project requires acquisition of certain real property interests and rights for the Project, including the property, rights and interests described in Section 1 below ("Property"); and WHEREAS, the City has been and is continuing to negotiate the purchase of the necessary Property from the Property owner but has yet to conclude a real property purchase and sale agreement for such Property; and WHEREAS, the City Council finds that the Property is necessary and critical to the Project, and that it is in the public interest to have such Property for public health, safety, welfare and transportation needs. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARLINGTON, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Need for Property. The public health, safety, necessity and convenience require the extension and improvement of the City’s water and sewer system for the purposes of the Project, and it is necessary therefore that certain property be condemned, appropriated, taken and damaged for the construction of said improvements and the Project as provided by this Ordinance, specifically including the real property and appurtenant rights, interests and improvements as Formatted: Superscript ORDINANCE NO. 2024-XXX 2 and over the land legally described in attached Exhibit A, situate in the City of Arlington, Snohomish County, Washington. Section 2. Declaration of Necessity. The City Council, after issuing proper notices, hearing the report(s) of the City Staff, reviewing the planned Project, and conducting a public meeting and hearing thereon, hereby declares that the property, rights, interests and improvements described in Exhibit hereto are necessary for the public use, specifically for the development along 188th Street211th Place NE, together with all necessary appurtenances and related work. Section 3. Costs of Acquisition. The costs of acquiring the property, rights, interests and improvements authorized by this Ordinance shall be paid by the capital projects fund of the City of Arlington, or such other funds of the City of Arlington as may be designated from time to time or provided by law. Section 4. Relocation of Tenants. There are no tenants currently located on the property and therefore no relocation assistance under RCW Chapter 8.26 is required. Section 5. Authority of Attorney. The City Attorney, or special outside legal counsel retained for prosecution of this condemnation action, are hereby directed to exhaust reasonable efforts through direct negotiations to acquire the necessary property described herein for the Project. In the event reasonable negotiation efforts are not successful, the City Attorney or special outside legal counsel are hereby authorized and directed to begin and prosecute actions and proceedings in a manner provided by law to condemn, take, damage, and appropriate the property, rights, interests and improvements necessary to carry out the provisions of this Ordinance. In conducting such condemnation proceedings, the City Attorney or special outside legal counsel are hereby authorized to enter into stipulations for the purpose of minimizing damages. Section 6. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be invalid by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. Section 7. Effective Date. This Ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title. Section 8. Corrections. First quarter expenses are nearly the same as last year, only up about $54,000 or 1%. As first quarter expenses currently exceed revenue, I wanted to look at the fund balance over the last year to see how cash flow is trending (see chart below). Cash flow is fairly consistent and typically spikes up in May and November when property taxes are received and declines when December debt payments are made. The trend is following the typical pattern however first quarter 2024 is trending slightly below where fund balance was first quarter 2023. The decline was expected after completion of the Amazon facility, however, as seen from the construction sales tax – 1st quarter chart below, “regular” construction activity also shows a sign of a decline going into 2024 (the red line dipping down from 2023 to 2024). High interest rates and the difficulty of obtaining financing is likely playing a role in the construction slow down. The expectation is that this is temporary and activity should pick back up once inter est rates decline. Revenue from retail sales has flatlined. Revenues from the retail and construction industry are the two largest sales tax revenue categories. A separate fund was created because this money is restricted and can only be used to address the opioid epidemic. Payments under the Distributor Agreement come in annually over the next 16 years. The Janssen Agreement will be paid out over the next 11 years. The city has received a total of $75,348.14 from these settlements. The city is also participating in the Walmart, Walgreens, Teva, CVS and Allergan Settlements. These will also be paid annually with final settlements paid out ranging from 2029 through 2036. The city has received a total of $110,987.80 from these settlements. Streets Fund – The Streets Fund is primarily funded through motor vehicle fuel tax. Fuel tax is distributed on a per capita basis and can fluctuate based on the State’s quarterly revenue estimate. As this is a major revenue for the Streets Fund, it’s important to see revenues are performing. The chart below shows first quarter revenues since 2019. Revenues are trending slightly downward since 2022 because of the decline in the per capita rate. The rate in 2022 was $17.60, was revised down to $17.04 in 2023 and expected to be $17.12 in 2024. The 2025 per capita estimate is expected to go down to $17.07. The slight decline in the per capita rate won’t be a significant revenue impact as population estimates are expected to increase. Lodging Tax Fund – Due to the temporary closure of a hotel this winter, lodging tax revenues have been monitored to determine the extent of the impact, if any, that closure has caused. These revenues are monitored closely as the city has committed to tourism grant funding in 2024. Revenues are stable and trending slightly upward from this time next year. None I have been working with Paul and HR on succession planning as there are expected retirements within the next 2 years. In 2022, my department experienced nearly 40% turnover and while we’re now fully staffed, we’re still recovering from that turnover. I want to be proactive as we approach another significant turnover over the next few years (about 30%). As two known retirements will occur in 2026, this will have a budget impact on my department in leave payouts, overlap in replacing key positions and training needs.
