Renewal of Interlocal Agreement with Snohomish Conservation District Minutes of the Arlington City Council Meeting Minutes of the City of Arlington City Council Meeting February 20, 2024 Page 2 of 3 PUBLIC HEARING None. NEW BUSINESS Contract for Replacement of HVAC System in Police Department City Administrator Paul Ellis requested Council approve the contract with KCDA for upgrade/replacement of HVAC system in the police station and council chambers. KCDA has contracted with Hermanson to perform the work. The project was scheduled for 2023, but material supply chain delays postponed the project to 2024. The project is budgeted from capital facilities funds. Discussion followed with Mr. Ellis answering Council questions. Mayor Pro Tem Michele Blythe moved, and Councilmember Heather Logan seconded the motion to approve the contract with KCDA and third-party agreement with Hermanson and authorized the Mayor to sign, subject to final review by the City Attorney. SCJ Contract Amendment #2 Public Works Director Jim Kelly requested the Council approve the SCJ Contract Amendment #2 that Arlington applied for and received a $2.3 million grant from TIB to upgrade this roadway to Arlington’s current “Complete Streets” standards. The City has engaged with SCJ Alliance for the project design work. Amendment #2 amends the scope of work to design a pond-based stormwater system, as opposed to the original infiltration system, and address additional archeological needs. Discussion followed with Mr. Kelly answering Council questions. Mayor Pro Tem Michele Blythe moved, and Councilmember Heather Logan seconded the motion to approve Amendment #2 to the SCJ Alliance contract for the 211th Place Corridor Restoration Project and authorized the Mayor to sign it. Ordinance Amending Arlington Municipal Code Chapter 6.05 Public Works Director Jim Kelly requested Council approve the amendment to the Arlington Municipal Code Chapter 6.05.015 Mandatory Collection to allow Arlington residents to temporarily suspend Waste Management collection services when they are out of town for an extended period. Discussion followed with Mr. Kelly answering Council questions. Councilmember Rob Toyer moved, and Councilmember Heather Logan seconded the motion to approve the ordinance amending the Arlington Municipal Code Chapter 6.05 and authorized the Mayor to sign it. COMMENTS FROM COUNCILMEMBERS Heather requested Public Works Director Jim Kelly provide an update on the progress of the 172nd road widening. Mr. Kelly reviewed the work from 2017 to present. Mr. Kelly will ask the consultant, who was hired to complete a 30% design build, for a timeline. ADMINISTRATOR & STAFF REPORTS None. EXECUTIVE SESSION City Attorney Steve Peiffle announced the need for an executive session for discussion of pending or potential litigation [RCW 42.30.110(1)(i)] to last no longer than 10 minutes. WORKSHOP ITEMS – NO ACTION WAS TAKEN City’s applications on ArcGIS Online Enterprise Data and Technology Manager Katie Heim provided an introduction to Arlington’s Spatial Technology and Web GIS. January 2024 Financial Report Finance Director Kristin Garcia presented the January 2024 financial report. Discussion followed with Ms. Garcia answering Council questions. City Attorney Steve Peiffle announced the requirement for the City to offer the public equal time to speak against Arlington School District bond and levy proposal under RCW 42.17A.555 and WAC 390-05-271and WAC 390-05-273. Mayor Don Vanney opened the meeting up for public comment at 6:24 p.m. for those who wished to speak against the Arlington School District bond and levy proposal. NEW BUSINESS Interlocal Agreement (ILA) with Snohomish County For Embedded Social Worker City Administrator Paul Ellis requested Council approve the ILA for a law enforcement embedded social worker with Snohomish County which concluded December 31, 2023. The proposed agreement with Snohomish County will continue with a full-time, embedded social worker with Arlington. This agreement also provides for back fill during employee leave and medical oversight needed to administrate the program. Discussion followed with Mr. Ellis answering Council questions. Councilmember Heather Logan moved, and Councilmember Yvonne Gallardo-Van Ornam seconded the motion to approve the interlocal agreement with Snohomish County for the Law Enforcement Embedded Social Worker and authorized the Mayor to sign the agreement. Motion passed unanimously. Minutes of the City of Arlington City Council Meeting January 16, 2024 Page 3 of 4 Ordinance to Amend Arlington Municipal Code Chapter 13.12 City Administrator Paul Ellis requested Council approve the proposal to amend Arlington Municipal Code (AMC) 13.12 allowing the city to reduce implementation of the 2024 mandatory water, sewer, and stormwater utility rate increases. Discussion followed with Mr. Ellis answering Council questions. Councilmember Debora Nelson moved, and Councilmember Michele Blythe seconded the motion to approve the ordinance reducing the scheduled 2024 CPI increase to 2.5% to the water, sewer, and stormwater utility rates for 2024, and authorized the Mayor to sign the ordinance. The motion passed unanimously. Procurement of Surplus Dump Truck from Snohomish County City Administrator Paul Ellis requested the Council approve the purchase of a used dump truck from Snohomish County pursuant to intergovernmental surplus equipment sale allowed in RCW 39.33.010. Councilmember Michele Blythe moved, and Councilmember Rob Toyer seconded the motion to approve the City’s purchase of the dump truck from Snohomish County pursuant to RCW 39.33.010. The motion passed unanimously. Ordinance to Amend Arlington Municipal Code Title 2.44 regarding the Airport Commission City Administrator Paul Ellis requested Council approve the amending of AMC Chapter 2.44 regarding Airport Commission members to be in conjunction with the recent House Bill 1243 requirements. Discussion followed with Mr. Ellis and City Attorney Steve Peiffle answering Council questions. Yvonne Gallardo-Van Ornam moved, and Councilmember Michele Blythe seconded the motion to approve the ordinance amending AMC Chapter 2.44 regarding Airport Commission members. The motion passed unanimously. Resolution to Adopt 2025/2026 Biennial Budget Calendar City Administrator Paul Ellis requested Council adopt a resolution establishing the planning calendar for development of the 2025-2026 budget. The timeline is in accordance with applicable State law and city policy. Mayor Pro Tem Jan Schuette moved, and Councilmember Heather Logan seconded the motion to approve the resolution adopting the planning calendar for the 2025-2026 biennial budget and authorized the Mayor to sign it. The motion passed unanimously. Selection of Mayor Pro Tem City Administrator Paul Ellis reminded the Council it was time to select a new Mayor Pro Tem which happens every two years at the second Council meeting in January. Councilmember Debora Nelson moved, and Councilmember Rob Toyer seconded the motion to select Michele Blythe as the City’s Mayor Pro Tem, to serve until the second Minutes of the City of Arlington City Council Meeting January 16, 2024 Page 4 of 4 Council meeting in January, 2026 because she is the next senior member on this Council. The motion passed unanimously. COMMENTS FROM COUNCILMEMBERS Councilmember Heather Logan announced that the Snohomish Health District has been legally dissolved effective January 10, 2024. The new Snohomish County Health Department has been officially integrated with Snohomish County government located at 3000 Rockefeller Ave. in Everett. It will continue to provide public health services to all residents of Snohomish County. The Snohomish Health Department is focusing on hiring Epidemiologists and adding a mobile service truck to reduce any transportation obstacles for residents of Snohomish County. Councilmember Debora Nelson thanked the Public Works Utility Department for their response to the frozen pipes and water meters. She stated she will not be able to attend the interviews for the vacant City Council seat. Thank you to the Boy Scouts for attending the meeting tonight. Councilmember Jan Schuette also thanked the Public Works Department for their efforts to fix the frozen pipes and meters in Gleneagle neighborhood. Councilmember Yvonne Gallardo Van-Ornam thanked those who are supporting and educating the public on the Arlington School District’s bond and levy and reminded everyone to vote. City of Arlington Council Agenda Bill NB #2 Attachment March 4, 2024 Interlocal Agreement (ILA) with City of Lake Stevens and acceptance of Public Defense Grant Fourth Amendment to Interlocal Agreement between City of Arlington and City of Lake Stevens Police; Jonathan Ventura, Chief EXPENDITURES REQUESTED: BUDGET CATEGORY: Professional Services BUDGET AMMOUNT: 2024 - $8,280 LEGAL REVIEW: DESCRIPTION: Defense Grant of $36,000 over two-years (2024-2025) to provide indigent defense social services. This is a local matching grant in partnership with the City of Lake Stevens. Arlington’s portion of the grant per year is 60% or $8,280. services program for public defense clients of the cities of Lake Stevens and Arlington. The program identifies clients that benefit from social services allowing defense attorneys to spend more time on legal defense work. Clients working with a social worker can benefit from decreased jail time and decreased recidivism. This saves our tax paying community money (arrest, prosecution, defense, medical, and incarceration). In 2017, Arlington and Lake Stevens experienced a recidivism rate of 35% whereas Marysville, which did not participate in the program, experienced a recidivism rate of 67%. The third amendment to the ILA expired on December 31, 2023. ALTERNATIVES: Defense and authorize the Mayor to sign it, pending final review by the City Attorney. FOURTH AMENDMENT TO INTERLOCAL AGREEMENT CONCERNING GRANT FROM OFFICE OF PUBLIC DEFENDER This agreement is made and entered into by and between the City of Lake Stevens, Washington (“Lake Stevens”) and the City of Arlington, Washington (“Arlington”), the parties to an Interlocal Agreement for a grant program through the Office of Public Defense having an effective date of January 1, 2024. WHEREAS, Lake Stevens and Arlington entered into an Interlocal Agreement dated January 1, 2018 for the joint administration of grant funds received from the Office of Public Defense for a Public Defense Social Services Program (“Program”); and WHEREAS, Lake Stevens and Arlington entered into the First Amendment to said Interlocal Agreement on March 19, 2019 to reflect the change in grant funding levels; and WHEREAS, Lake Stevens and Arlington entered into the Second Amendment to said Interlocal Agreement on February 18, 2020 to reflect the change in grant funding levels and granting period; and WHEREAS, Lake Stevens and Arlington entered into the Third Amendment to said Interlocal Agreement on December 16, 2021 WHEREAS, the Office of Public Defense has awarded a grant for two years, beginning January 1, 2024 through December 31, 2025; and WHEREAS, the Office of Public Defense has awarded the grant funding to $18,000 per year for each calendar year of the grant award, for a total grant award of $36,000, NOW, THEREFORE, for the mutual considerations received by the parties from this agreement, the Interlocal Agreement is hereby amended as follows: 1. Paragraph 3. Funds for the Program is hereby amended to read as follows: 3. Funds for the Program. The funds for the Program shall be the annual grant proceeds in the amount of $18,000 each calendar year, for a total of $36,000 over the two-year term of the grant, and the local match of $13,800 annually. Arlington shall pay 60% of the local match funds each year, being $8,280 directly to Feldman & Lee, P.S. within thirty (30) days of invoice for the match funds. Lake Stevens shall pay 40% of the local match funds each year, being $5,520 in addition to the grant funds within thirty (30) days of invoice from Feldman & Lee, P.S. 2. Paragraph 5. Termination is hereby amended to read as follows: 5. Termination. This Agreement shall conclude on December 31, 2025 and terminate when closeout of all obligations under the Grant have occurred and been accepted by the granting agency. Provided however, this Agreement may be terminated by either party in the event the grant funding is discontinued or not received or if the portion which is to be match funding is not appropriated through the budget process of either party. In the event of termination, any unused funding shall be returned in proportion to the contributions of each party after payment of all expenses. 3. Except as herein amended, the Interlocal Agreement and First Amendment to Interlocal Agreement shall remain the same and in full force and effect. Dated this ________ day of _____________, 2024.
