HomeMy WebLinkAboutOrdinance No. 2017-012 Making Certain Findings and Adopting by Reference Amendments to the Comprehensive Water System Plan for the City of Arlington ORDINANCE NO. 2017-012 AN ORDINANCE OF THE CITY OF ARLINGTON, WASHINGTON, MAKING CERTAIN FINDINGS AND ADOPTING BY REFERENCE AMENDMENTS TO THE COMPREHENSIVE WATER SYSTEM PLAN FOR THE CITY OF ARLINGTON WHEREAS the City of Arlington operates a water system governed in part by Washington Administrative Code (WAC) Chapter 246-290; and WHEREAS, the City of Arlington is required to periodically take legislative action to review and, if needed, revise its comprehensive water system plan, including capital improvement plans, service levels, and operational and maintenance plans to ensure compliance with city policies, state and federal regulations, to identify any deficiencies which present threats to public health and safety, and to develop and identify funding sources and requirements; and WHEREAS, the City of Arlington's comprehensive water system plan was last amended in 2016, but subsequent revisions to the City's Comprehensive Plan required updates to the comprehensive water plan; and WHEREAS, the City of Arlington contracted with R112 and FCS Group to conduct a thorough review of the City's water comprehensive plan and prepare with the assistance of city staff amendments to the plan for consistency with the City Comprehensive Plan; and WHEREAS, on August 1, 2017, the City Planning Commission first considered the amendments to the comprehensive water plan for the City of Arlington; and WHEREAS, based on its review of the requirements of WAC Chapter 173-240 and other requirements of state law, the Planning Commission conducted a public hearing and took public testimony on August 15, 2017; and WHEREAS, the City Council considered the recommendation of the Planning Commission at its workshop on September 25, 2017 and thereafter took the matter under consideration at its October 2, 2017 public meeting; and WHEREAS, based on its review of the requirements of state law, the analysis and proposed revisions prepared by the Planning Commission and staff, and the public comments received, the City Council finds and declares that the review and needed revisions have been prepared in conformance with applicable law, including Chapter 36.70A RCW, Washington Administrative Code Chapter 246-290, RCW Chapter 43.21C RCW, and the approved public participation and adoption process; and WHEREAS, based on its review of the requirements of state law, the analysis and proposed revisions prepared by the Planning Commission and staff, the recommended findings ORDINANCE NO. 2017-012 1 on review and proposed revisions forwarded by the Planning Commission, and the public comments received, the City Council hereby finds and declares that Arlington's comprehensive water system plan as revised by this ordinance complies with the requirements of state law; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARLINGTON, WASHINGTON, DOES MAKE THE FOLLOWING FINDINGS: 1. Findings. The Arlington City Council finds that: a. The City has established and followed a public participation program in accordance with RCW 36.70A.130(2)(a), which program was formally adopted and followed by the City via City of Arlington Resolution#2014-022. b. The City Council believes that the SEPA Determination of Non-Significance (DNS) issued by the City's Responsible Official for the Water System Plan update adequately evaluated all known environmental issues associated with the adoption of the updates to the comprehensive plan. C. The comprehensive water system plan identifies operational and capital improvement projects and has been updated to address changes established in the Arlington General Comprehensive Plan, amended on September 18, 2017. d. Notice of all amendments to the comprehensive plan adopted to fulfill the state law was sent to the Washington State Department of Health and the Snohomish County Planning Department. e. The City Council finds that the review and needed revisions to the Water Comprehensive Plan have been prepared in conformance with applicable law, including Chapter 36.70A RCW, Chapter 43.21C RCW, WAC Chapter 246-290, and the approved public participation and adoption process and, taken collectively, are in the best interests of all its citizens. NOW, THEREFORE,the City Council of the City of Arlington does hereby ordain as follows: Section 1. Adoption of Water Comprehensive Plan. The City Council approves that certain Comprehensive Water System Plan prepared by the City of Arlington staff with assistance from RH2 Engineers and the FCS Group dated January 2016, and amended July, 2017, a true copy of which is attached to the original of this ordinance as Exhibit"A"hereto. Section 2. Severability. If any provision, section, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 3. Effective Date. This ordinance or a summary thereof consisting of the title shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after publication.
