WHEREAS, the City of Arlington through the exercise of its police power has the
authority to regulate parks and trails located within the City in order to promote the health,
public safety, and the general welfare of the public; and
WHEREAS, the City's parks are intended for the healthy enjoyment of all residents a
visitors to the City, including children and youth, and those partially or wholly disabled by
respiratory disease; and I
WHEREAS, a 2006 study conducted by the Surgeon General entitled Health
Consequences of involuntary Exposure to Tobacco Smoke, concluded that children exposed t
secondhand smoke are at an increased risk for sudden infant death syndrome, acute respirator
infections, ear problems, and more severe asthma, and that the scientific evidence indicates th

there is no risk -free level of exposure to secondhand smoke; and 0

22.04.210 Smoking prohibited, It is unlawful for any person to smoke or light cigars,
cigarettes, tobacco or other smoking material, including electronic nicotine delivery
devices including, but not limited to, electronic cigarettes, vapor cigarettes, or similar
[r,roducts, within city parks or on city trails. The director shall post signs in appropriati
locations prohibiting smoking in the city's parks and trails.
Section 2. A new Section 22.04.220 of the Arlington Municipal Code is hereby adopted to
read as follows:

(1) A violation of any of the provisions of AMC 22.04,040 through 22.04,200
constitutes a misdemeanor, and may be punished by a fine of not more than $1,000 or
by imprisonment not to exceed 90 days or by both such fine and imprisonment.
"2) The first violation of AMC 22.04.210 within a three hundred sixty-five (365) day
period constitutes a Class two civil infraction and shall be enforced in accordance
with AMC Chapter 1.04.

k3) A second or further violation of AMC 22.04.210 within a three hundred sixty-five
(365) day period is a misdemeanor, and may be punished by a fine of not more than
$1,000 or by imprisonment not to exceed 90 days or by both such fine and
imprisonment.
Section 3. Severability. If any section, subsection, sentence, clause, phrase or word of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of
any other section, subsection, sentence, clause, phrase or word of this ordinance,
Section 4. Effective Date. This ordinance shall become effective five days after the date of its
publication by summary.
