HomeMy WebLinkAbout2012-012 ORDINANCE NO. 2012-012 AN ORDINANCE OF THE CITY OF ARLINGTON, WASHINGTON AMENDING TABLE 20.40-1 OF CHAPTER 20.40 OF THE ARLINGTON MUNICIPAL CODE REGARDING REGULATION OF GAMBLING ESTABLISHMENTS WHEREAS, the City of Arlington, Washington has the authority to regulate land uses within the City; and WHEREAS, the City of Arlington has adopted a land use code and development design guidelines; and WHEREAS, gambling establishments, or also known as house-banked card rooms, are regulated by the City of Arlington in Chapter 20.40 of Title 20 Arlington Municipal Code; and WHEREAS, gambling establishments have been restricted to only those properties located within the Highway Commercial (HC) zone and, more specifically, only permitted in areas specified in Footnote 21 of Table 20.40-1: Table of Permissible Uses; and WHEREAS, new regulations have been drafted to permit gambling establishments within the Smokey Point Shopping Center, and more specifically, at the current Buzz Inn Restaurant site; and WHEREAS, the Planning Commission considered these amendments at their June 5, 2012 public hearing and recommended that the City Council adopt the amendments. The City Council considered these amendments at their April 23, 2012 workshop and at a public hearing on June 18, 2012 and determined approving the amendments was in the best interest of the City and its citizens; and WHEREAS, amendments to AMC 3.32.050 regarding a tiered taxing system for multiple casinos will be discussed at a future meeting; and NOW, THEREFORE, the City Council of the City of Arlington do hereby ordain as follows: Section 1. Footnote 21 to Table 20.40-1 of the Arlington Municipal, shall be modified to read as follows: "fable 20.40-1: Table of Permissible Uses. 21 Subject to the requirements of AMC Chapter 3.32, and further subject to the following locational criteria: only permitted in areas east of Interstate-5 (I-5), west of Smokey Point Drive, north of 172"d Street NE/SR 531, and south of 3207 Smokey Point Drive. ORDINANCE NO. 2012-012 1 Section 2. Severability. If any provision, section, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 3. Effective Date. A summary of this Ordinance consisting of its title shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days of the date of publication.
