HISTORY: Planning Commission reviewed the amendments at their meeting on August 16,
2011, and on September 8, 2011 they held a public hearing and made a recommendation to
Council to adopt the amendments. City Council previously reviewed the amendments at the
August 22nd workshop.
ALTERNATIVES: No action.
RECOMMENDED MOTION:
None proposed at this time. Planning Commission held a public hearing on September 8, 2011
and made a recommendation to City Council to approve the proposed amendments. A public
hearing is scheduled at the September 19, 2011 City Council meeting to hear from the public and
consider adoption.

Project: Proposed Amendments to Title 20, Land Use Code (PLN20110037)
The following are City-initiated, City-wide amendments to Arlington Municipal Code Title 20, Land
Use Code, for home occupations, crematoriums and funeral homes, design, master plan
neighborhoods, adult family homes and definitions. Staff comments follow each proposed
amendment.
City Council reviewed the proposed amendments at a workshop on August 22nd. Planning
Commission reviewed the proposed amendments at their August 16th meeting and held a public
hearing on September 8, 2011 and made a recommendation to City Council to adopt the proposed
amendments.
1. Amendments to Chapter 20.08 Definitions
The following definitions are being added to Chapter 20.08.010:
Adult Family Home. A regular family abode in which a person or persons provides personal care,
special care, room, and board to more than one but not more than six (6) adults who are not related
by blood or marriage to the person or persons providing the services.
Critical Area Protection Easement (CAPE). See Native Growth Protection Easement (NGPE).
Native Growth Protection Easement (NGPE). An easement granted to the City for the protection
of native vegetation within a critical area or its associated buffer.
Lot Coverage. That percentage of a lot which would be covered by a structure or structures,
excluding allowed projecting eaves. Paved areas, such as driveways, patios, and walkways at or
below grade level shall not be calculated. Decks exempted by the building code are also not
calculated.

The follow definition for Home Occupation is being amended:
Home Occupation. An occupation, enterprise, activity, or profession which results in a product or
service for profit and is conducted in whole or in part on residential premises and is clearly
subordinate to use of the premises as a residence.
A commercial activity that: (i) is conducted by a person on the same lot (in a residential district)
where such person resides, and (ii) is not so insubstantial or incidental or is not so commonly
associated with the residential use as to be regarded as an accessory use (see §20.40.050
(Accessory Uses), but that can be conducted without any significantly adverse impact on the
surrounding neighborhood.
Without limiting the generality of the foregoing, a use may not be regarded as having an
insignificantly adverse impact on the surrounding neighborhood if: (i) goods, stock in trade, or
other commodities are displayed, (ii) any on-premises retail sales occur, (iii) more than one person
not a resident on the premises is employed in connection with the purported home occupation, (iv)
it creates objectionable noise, fumes, odor, dust or electrical interference, (v) the use would
typically generate significantly more traffic than is typically associated with a residential
neighborhood, or (vi) more than 25 percent of the total gross floor area of residential buildings plus
other buildings housing the purported home occupation, or more than 500 square feet of gross
floor area (whichever is less), is used for home occupation purposes.
The following is a non-exhaustive list of examples of enterprises that may be home occupations if
they meet the foregoing definitional criteria: (i) the office or studio of a physician, dentist, artist,
musician, lawyer, architect, engineer, teacher, or similar professional, (ii) workshops, greenhouses,
or kilns, (iii) dressmaking or hairdressing studios.
The following is a non-exhaustive list of examples of enterprises that may not be home occupations:
(i) veterinarians, (ii) clinics, (iii) auto repair, (iv) auto sales, or (v) real estate offices, or (vi) any use
that would cause similar impacts.
Staff Comment
The existing definition of home occupation has proved to be cumbersome and confusing for
both customers and staff, and therefore the definition has been modified to be clear, short and
concise. A new subsection to Chapter 20.44 Supplemental Uses is being proposed to help clarify
home occupations. Home occupations have traditionally been reviewed under the business license
process. City staff is proposing that a zoning permit no longer be required as currently noted in the
Permitted Use Chart.
2. Amendments to Chapter 20.40 Permissible Uses
Adult Family Homes
Amend Chapter 20.40 Permissible Uses to allow for Use 1.415 and Use 1.425 Adult Family Homes
are added as permitted uses and shall be allowed in all zones.

Staff Comment
These uses are added per new state legislation that will be effective in August 2011 that allows
adult family homes, defined in RCW 70.128 as 6 or fewer non-related adults, in all zoning
districts within a jurisdiction (ESHB 1277).
Crematoriums/Funeral Homes
Amend Chapter 20.40 Permissible Uses to remove crematoriums from all residential zoning
districts and allow them in all commercial and industrial zones. Also allow funeral homes in LI and
GI zones, same as crematoriums.
Staff Comment
Funeral homes and crematoriums, which are typically associated, will be allowed in the same
zoning districts.
Home Occupations
Amend Chapter 20.40 Permissible Uses to eliminate Use 1.800 Home Occupations from the
permissible use chart and eliminate the requirement for a zoning permit.
Staff Comment
As noted above, home occupations have been reviewed and conditioned through the business
license process. Eliminating the zoning permit requirement ($2,222) will encourage home
occupations as a business option for individuals while not being financially prohibitive. In-
home daycares would continue to be reviewed under the zoning permit process.
3. Amendments to Chapter 20.44 Supplemental Use Regulations.
Amend 20.44.032 Master Planned Neighborhood Development (MPND) to reduce the minimum
acreage for a master planned development from 75 acres to 25 acres.
20.44.032 Master Planned Neighborhood Development (MPND).
(c) No area of less than two quarter sections or net of 75 25 contiguous acres may be
planned through a MPN approval process, and then only (i) upon the request of the
owner or majority of owners of all the property intended to be covered by such an overlay
zone, or (ii) by the City Council in implementing the MPN land use designation pursuant
to subsection (d). Approval of MPNs is achieved through a rezone process.
Amend 20.44.070 to exclude adult family homes from locational criteria.
20.44.070 Homes Emphasizing Special Services, Treatment, or Supervision.
(b) In addition to other applicable standards, no 1.400 use class, with the exception of
adult family homes, shall be located closer than one-thousand, two-hundred (1,200) feet,

measured from property lines, from another such use. For the purpose of this section, a
development shall be defined as a building or group of buildings on a single parcel of land.
This provision is intended to prevent the creation of a de facto social service district.
Amend Chapter 20.44 to include new subsection for reasonable accommodation.
20.44.072 Reasonable Accommodation.
Any person claiming to have a handicap, or someone acting on his or her behalf, who wishes
to be excused from an otherwise applicable requirements of this Land Use Code under the
Fair Housing Amendments Act of 1988, 42 USC 3604(f)(3)(b), or the Washington Law
Against Discrimination, Chapter 49.60 RCW, must provide the Community Development
Director with verifiable documentation of handicap eligibility and need for accommodation.
The Director shall act promptly on the request for accommodation. If handicap eligibility
and need for accommodation are demonstrated, the Director shall approve an
accommodation which may include granting an exception to the provisions of this Code. The
Director shall not charge any fee for responding to such a request. The Director’s decision
shall constitute final action by the City on the request for accommodation, and review of
that decision will be available only in court. An action seeking such review must be filed not
more than 21 days after the Director’s decision.
Amend Chapter 20.44 to include new subsection for home occupations.
20.44.082 Home Occupations.
(a) Purpose: The purpose of this section is to allow limited commercial activity incidental
to residential use of a dwelling unit while ensuring all residents freedom from excessive
noise, excessive traffic, nuisance, fire hazard, and other possible effects of commercial uses
being conducted in residential neighborhoods.
(b) Applicability: Home occupations are allowed as an accessory use to the residential use
of a single-family, multifamily, or accessory dwelling unit, subject to the requirements of
this chapter. A business license shall be required for all home occupations.
(c) Residency: The location of the home occupation must be the principal residence of the
person(s) conducting the home occupation.
(d) Standards for Home Occupations: A home occupation may be conducted if it:
(i) Is carried on by an owner or renter of the dwelling unit and, in addition, may
involve no more than two (2) other business participants visiting the dwelling unit
(or, for properties that contain an accessory dwelling unit, visiting the property) per
day. “Other business participants” shall include non-family employees and
independent contractors;
(ii) Has no outside storage, including equipment stored on vehicles;
(iii) Requires no alteration to the interior or exterior of the dwelling that changes its
residential character;
(iv) Does not involve activities, including but not limited to the use of heavy

equipment, power tools, power sources, hazardous materials, or other equipment or
materials that result in noise, vibration, smoke, dust, odors, heat, traffic, parking, or
other conditions that exceed, in duration or intensity, such conditions normally
produced by a residential use;
(v) Has, in addition to daily mail service, no more than a combined total of three (3)
commercial and courier pickups and deliveries at the dwelling unit (or, for properties
that contain an accessory dwelling unit, the property) per day, and no more than 10
such pickups and deliveries per week. Said pickups and deliveries shall occur between
the hours of 8:00 a.m. and 6:00 p.m.;
(vi) Occupies no more than 25 percent of the total gross floor area, or no more than
500 square feet of floor area, including any space in an accessory structure;
(vii) No stock-in-trade or any other material associated with the home occupation
shall be visible on the site, nor shall any pick-up of stock-in-trade be permitted at any
time.
(viii) Includes no more than six (6) clients/customers per day and no more than two
(2) clients/customers at any time visiting the dwelling unit (or, for properties that
contain an accessory dwelling unit, visiting the property) for goods or services. A
family arriving in a single vehicle shall be considered one (1) client. Client/customer
visits to a home occupation shall be between the hours of 8:00 a.m. and 8:00 p.m.
(ix) Operates no more than one (1) vehicle, van, truck or similar vehicle. The vehicle
shall not exceed any of the following:
1) A gross vehicle weight of 10,000 pounds;
2) A height of nine (9) feet; and/or
3) A length of 22 feet;
The measurement of vehicle height and length shall include bumpers and any other
elements that are required by federal or state law for the operation of the vehicle on
public roads; and
(x) Shall conform to all performance standards as regulated in Part III. Performance
Standards, Chapter 20.44 Supplemental Use Regulations.
(e) The application for a home occupation shall be reviewed under the business license
process. An application for a home occupation under this section may be approved if the
home occupation:
(i) Will not harm the character of the surrounding neighborhood; and
(ii) Will not include outdoor storage and/or operation of building materials,
machinery, commercial vehicles, or tools, except if it meets the following criteria:
1) Is appropriately screened from other properties;
2) Does not emit noise, odor, or heat; and
3) Does not create glare; and
(iii) Does not create a condition which injures or endangers the comfort, repose, health
or safety of persons on abutting properties or streets; and

(iv) Will not generate excessive traffic or necessitate excessive parking; and
(v) Will locate and screen any required or proposed site improvement in a manner that
minimizes its view from surrounding properties or adjacent streets.
(f) Enforcement – Upon determination that there has been a violation of any provision of
this section, the City may pursue code enforcement in accordance with the provisions of
AMC Chapter 11.01 Enforcement Provisions.
Staff Comment
The amendment to 20.44.032 to reduce the minimum acreage for MPN’s from 75 to 25 acres
is driven by the current market conditions for large-scale developments. By reducing the
acreage, this allows property owners greater flexibility in proposing development, while
still trying to achieve a master-planned community with a mix of housing types and
amenities. This amendment will also make the regulations consistent with the
Comprehensive Plan, which currently identifies MPNs as 25 acres or more. (7.3.1.4.3
Master Planned Neighborhood, pg. 7-8, Land Use Element).
The amendment to 20.40.070 exempts adult family homes from locational criteria placed on
other homes for special services or treatment (i.e. halfway houses, transitional homes, etc.)
The amendment for reasonable accommodation is to provide exceptions to land use
regulations for individuals who are identified as disabled under the Americans with
Disabilities Act (ADA), the Federal Housing Act (FHA) or the Washington Law Against
Discrimination (WLAD). The amendment applies to a disabled person’s right to residential
housing and does not apply to commercial activities or zones. This amendment is being
added to be consistent with other local jurisdiction land use codes.
As noted above, the home occupation definition in Chapter 20.08 has proved to be
cumbersome and confusing for both customers and staff, and therefore the definition has
been modified to be clear, short and concise. The new subsection in Chapter 20.44
Supplemental Uses is being proposed to establish clear regulations for home occupations.
Home occupations have traditionally been reviewed under the business license process.
City staff is proposing that a zoning permit no longer be required as currently noted in the
Permitted Use Chart.
4. Amendments to Chapter 20.46 Design
Amend 20.46.010 to exclude single-family residential from design review requirements.
20.46.010 Conformance with Design Guidelines or Standards.
(a) Structures within the following zones (Subsection (1)) or specific use classes (as classified in
the Table of Permissible Uses, §20.40.010) (Subsection (2)) are subject to the relevant design
guidelines or standards adopted in this Chapter. No building or land use permit shall be issued

for structures or uses that do not conform to the applicable guidelines or standards except as
allowed under Subsection (b).
(i) Residential High Density (multi-family and non-residential only)
Staff Comment
This amendment will make all single-family residential uses exempt from design review.
Currently, design review is not required for single-family housing in all other single-family
zones (SR, RLMD, RMD, OTRD). This amendment to the RHD zone would be consistent with
other residential zones.

DESCRIPTION: Dedication of Right of Way from Arlington School District to construct the 186th
Street Alignment from Crown Ridge Boulevard to the City Limits.
HISTORY: The dedication of right of way for 186th Street was a condition for the construction of
the Arlington High School. Because of the need to coordinate this dedication with a similar
dedication from property to the south to provide right of way for a full width street this
dedication was delayed until an alignment could be confirmed.

DESCRIPTION: Construction of a four-block section of Centennial trail, between 172nd St and
168th St.
HISTORY: The Centennial Trail is a 17.5 mile paved hiking trail that runs on the right-of-way of
the Sumas Branch of the former Seattle, Lake Shore and Eastern Railway which connected
Seattle with Canada. The rail trail project was first conceived in 1982, and development of the
trail began in 1989. Since its construction, the Centennial Trail has become a very popular
recreational trail for walking, bicycling, hiking, and horseback riding accessible to persons of all
levels of physical ability.
There are still sections of the trail that remain incomplete; two of these sections include the
Snohomish County section from 152nd St to 168th St, and the Arlington section from 168th St to
a72nd St. Snohomish County is currently in the process of completing their missing section of
trail and Arlington is now ready to complete its missing section of Trail.
Staff has prepared plans and specifications for completion of the missing trail section and we are
now ready to go to bid using the Small Works Roster.

RECOMMENDED MOTION:
No action at this time – staff will be presenting to Council at their September 19th meeting for
action.

the contractor, engineer, or City and necessary to complete the project. This is a zero dollar
change order and does not impact contract pricing.

of Substantial Completion on WWTP Upgrade
and Expansion Project

DESCRIPTION This is a letter stating that IMCO General Contractors have completed
construction of the WWTP Upgrade and Expansion Project to the satisfaction of the City, and
that they have achieved “Final Acceptance” as defined by the contract documents.
HISTORY: In 2005 the City began actively preparing for the upgrade and expansion of the
wastewater treatment plant (WWTP) to meet new clean water requirements and prepare for
future growth. After design was completed and approved by the Department of Ecology, the
City conducted a public bid for construction of the required upgrades and expansion. IMCO
General Contractors, Inc. were the low bidder and were awarded the contract, a notice to
proceed was issued in April 2009.
IMCO has completed all of the project construction requirements, and has met the contractual
requirements for “Final Acceptance” as stated in the attached letter of Final Acceptance.
ALTERNATIVES:
Do not issue a Letter of Substantial Completion
RECOMMENDED ACTION:
No action is being requested at this time. At the next Council Meeting the recommendation
will be a motion acknowledging that IMCO General Contractors have met the contractual
requirements for construction of the WWTP Upgrade and Expansion project and authorize the
mayor to sign a Letter of Final Acceptance to that effect.
