I. NATURE OF APPLICATION
A. Request
The applicant is proposing a binding site plan to change the existing properties lines and create a Tract
for the stormwater pond. Currently,the subject property is split zoned between Medical Services (MS)
and Residential High-Capacity (RH) zoning designations. The MS zoning regulation will apply in
accordance with City Code provisions for split zoning conditions.The proposal includes the construction
of a three-story 30,000-square-foot Medical Office Building.Additional site improvements will include
surface parking,stormwater improvements,utility connections,perimeter and interior landscaping.
The proposed Medical Office Building will operate exclusively as an outpatient facility. Hours of
operation will generally fall between 7:00 a.m. and 7:00 p.m.,though exact hours are subject to change.
Ambulance services will not be provided on site; the only circumstance in which an ambulance would
arrive is in response to a 911 emergency,consistent with any other public location.
A driveway is proposed onto 212th Street N.E. near the southwest corner of the subject property and
furthest away from the intersection with Medical Center Drive.Additionally,a driveway to be located at
the northwest corner of the subject property is proposed onto Medical Center Drive. The building is
proposed near the southeast corner of the subject property near the intersection corner. All parking
areas are located to the side and rear of the building.
Grading will include site preparation for hardscapes, landscaping, the building, and retaining walls.
Approximate quantities of grading activities are 7,000 cubic yards of cut and 8,000 cubic yards of fill,
with a total affected area of 2.48 acres.
The building will be constructed with a variety of high-quality building materials including textured
concrete, metal panels (simulated wood), and brick veneer. The building includes three stories and
stands at a height of 43 feet 6 inches. The building's facade includes several large windows situated
inside various bays spaced at 20 feet.The building features a prominent entrance with a dark grey glass
door surrounded by glass panels.
B. Project Chronology/Background
The application for a Zoning Permit and a Binding Site Plan was received on October 17, 2025.The
application was deemed incomplete on November 13, 2025 and notified the applicant.The applicant
submitted the remaining documents on November 20, 2025.The application was deemed complete on
November 21, 2025.The city issued review comments on November 21, 2025,December 15, 2025 and
January 21, 2026 .The applicant submitted revised plans and requested information on December 12,
2025,January 16, 2026 and February 24, 2026.
The Notice of Application was issued on December 3, 2025 and was published in the city's official
newspaper(The Herald),posted on site,mailed to required parties,and posted on the City's website
on December 3, 2025.
The City issued a Determination of Non-significance (DNS) per AMC 20.98.120 on December 17, 2025.

9.Architectural Character The massing is a simple square and
minimizes solar heat gain through
windows by limiting fenestration where
low,western light becomes problematic in
warming months.The building opens the
majority of its windows to the north,east,
and south where street trees and longer
views of the surrounding area can be
found.The building is closer to the west
side,responding to the location of the
existing Helipad.The building uses a
background material (concrete)with two
other primary cladding types to define

22. The placement of Snohomish County PUD transformer cases shall be reviewed and approved
by the city.All cases that abut public right-of-way are required to be decoratively wrapped.
23. The Applicant shall follow the Inadvertent Discovery Plan received October 17, 2025.The plan
is required to be on-site and followed should archaeological resources or human remains be
encountered.

24. City of Arlington Traffic Impact Fees shall be paid prior to issuance of the building permit for
(55) PM Peak Hour Trips.
25. Prior to issuance of the building permit, the applicant shall complete all required or voluntary
improvements unless otherwise secured and authorized by the City Engineer.
26. The applicant shall submit building plans meeting the architectural standards of AMC 20.110,as
approved with this permit.
27. Business Licenses for all contractors working on the site shall be required to obtain a City of
Arlington Business License.
28. Building signage is required to be permitted through a sign permit application. All signage
requires city approval prior to installation. The signage shall meet all code requirements and
blend in with the overall building design.
29. All EV charging stations shall provide proper signage and noticing per AMC 20.114.
EXPIRATION
Per AMC 20.16.220,a Zoning Permit shall expire automatically if,within two (2)years after the
issuance of such permits:
1. The use authorized by such permits has not commenced,in circumstances where no
substantial construction,erection, alteration,excavation, demolition,or similar work is
necessary before commencement of such use, or
2. Less than 10 percent of the total cost of all construction, erection,alteration,excavation,
demolition, or similar work on any development authorized by such permits has been
completed on the site.
The design review decision shall be approved for a maximum of two years with a valid land use permit
or shall expire at the time of the land use permit, if not extended.
Per AMC 20.16.435,a Binding Site Plan shall expire if the binding site plan is not recorded and a
conformed copy is not returned to the city within the required timeline.
(d)All binding site plan approvals are subject to being recorded with the Snohomish County
Auditor by the applicant.The applicant is required to submit the binding site plan documents
with all required notarized and official signatures to the city for review and signature within
thirty(30) days of the binding site plan approval. Once the city has signed the binding site
plan documents the applicant is required to record the binding site plan with the Snohomish
County Auditor within thirty(30) days of the date signed by the city.A conformed copy of the
recorded documents shall be returned to the City of Arlington. If the binding site plan is not
recorded and a conformed copy is not returned to the city within this time period,the city
may expire the binding site plan decision.

VII. APPEAL
This decision may be appealed pursuant to AMC 20.20.010,which provides for a hearing of the Zoning
Permit decision before the Hearing Examiner.Any aggrieved party of record may file an appeal within
14 days of the permit decision. An appeal shall be considered filed when a written notice of appeal,
specifying the grounds and arguments, therefore, is delivered to the Department of Community
and Economic Development by 5:00 PM on Tuesday, March 26, 2026, and the appeal fee as set by
resolution is paid.
