Home My WebLink About2011-011 ORDINANCE NO. 2011-011 AN ORDINANCE OF THE CITY OF ARLINGTON, WASHINGTON MAKING AMENDMENTS TO THE CITY'S COMPREHENSIVE PLAN AND ZONING MAP AND APPROVING THE STAR COMPREHENSIVE PLAN AMENDMENT (PLN20110010) AND CONCURRENT REZONE (PLN20110012). WHEREAS, the City of Arlington, Washington has the authority to regulate land uses within the City, and has gone through its periodic review and update of the Comprehensive Plan; and WHEREAS, the City of Arlington Comprehensive Plan may be updated once per year per RCW 36.70A.130; and WHEREAS, included in the review of the Comprehensive Plan was a proposed amendment to the City of Arlington Comprehensive Plan and Zoning Map; and WHEREAS, the Star Comprehensive Plan Amendment is included in the 2011 Comprehensive Plan Amendment docket; and WHEREAS, staff reviewed the project for environmental impacts under the State Environmental Protection Act and issued a Determination of Nonsignificance (DNS) on March 11, 2011 for the Star Comprehensive Plan Amendment and Concurrent Rezone; and WHEREAS, the Planning Commission considered the proposed Comprehensive Plan amendment and rezone at their March 15, 2011 meeting and at a public hearing on April 5, 2011 and made a recommendation to the City Council to adopt the amendment and rezone. The City Council considered this amendment and rezone at their March 14, 2011 workshop and at a public hearing on April 18, 2011 and determined approving the amendment and rezone was in the best interest of the City and its citizens. NOW, THEREFORE, the City Council of the City of Arlington do hereby ordain as follows: Section 1. Star Comprehensive Plan Amendment (PLN20110010) and Concurrent Rezone PLN20110012). The City of Arlington Official Zoning Map, pursuant to AMC §20.36.100, and Land Use Map of the Comprehensive Plan shall be amended as described on Attachment "1" (Proposed Land Use Map Amendments) and Attachment "2" (Proposed PreZoning Amendments), amending land use designations and zoning to the following: ORDINANCE NO. 2011-011 1 Parcel 1: (Parcel #31052500200100 —Northern parcel) (Grayl) Change land use and pre-zoning designations of eastern portion from Residential High Density (RHD)to entirely General Commercial (GC). Parcel 2: (Parcel #31052500201800 — Southern parcel) (Equity Funding) Change land use and pre-zoning designations of western portion from GC to entirely RHD. Section 2. Severability. If any provision, section, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 3. Effective Date. A summary of this Ordinance consisting of its title shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days of the date of publication.
