Upon review of the 1997 UBC, Chapter 33, Excavation and Grading, we are exempt frorn the grading permit pursuant to several of the provisions of Section 3306.2, 1, 6 & 7. The discussions with City Officials in 1994 provided initial concurrence with our reclamation plan for the former pit. That ongoing work is in compliance with the DOE NPDES permit under which the County operates. No written plan has been required by DNR due to the inactive, grandfathered nature of the pit operations however; we will be preparing a master plan for the completion of the reclamation, paralleling the Soils/Geotechnical/Civil engineering requirements of the referenced Chapter 33. Two copies of that completed plan will be provided to you, later this year. We are pursuing this in good faith to maintain our good working relationship with the City and want to ensure there is some documentation of our activity, for both our organizations, in the current frenzied 'permitting' environment in which we work. Our discussion has focused on the manner by which appropriate mitigation could be made that would fully satisfy city code requirements. An approach that we have agreed upon is for the county to perform certain maintenance or capital work of an equivalent value to the mitigation obligation. The following is a list of suggested projects located in the Arlington/Smokey Point annexation area, which could be performed by Road Maintenance forces. We do not have a preference as to which work to perform, we only ask that work be selected such that the total obligation is completed within three years. Thom Meyers December 5, 1999 It is our understanding that the pending permit will be issued contingent upon the Department of Public Works providing$100,000 of work to be performed under our the authority of the current Maintenance Agreement. The work to be performed will be at the descretion and priority of the City, and may include projects listed above, or others as can be reasonably accomplished by county forces or contracts. Although the suggested list is in excess of the total dollar value of projects required, there may be a number of priority projects the City would like accomplished. We also continue to be interested in additional contracting for efforts in excess of the mitigation credits. The estimated costs for paving are based on 1999 actual costs. Projects selected will be billed for actual costs incurred at current labor and equipment rental rates. It appears that this pipe drains the roofs and parking lots on the east side of your property. ➢ A six inch diameter drainage pipe that enters our property over the same boundary further to the west. It appears that this pipe drains paved areas around your concrete processing operation on the west side of your property. During periods of heavy rainfall, we have witnessed heavy discharges of dirty chalky water from both the pipes. Snohomish County requests Cuz Concrete both remove the above pipes from County property and direct any flow away from County property by December 31, 1999. Should removal and/or redirection not be completed to the County's satisfaction by that time, the County will have no other choice but to turn this matter over to the Prosecutor's Office for potential legal action. While waiting for the permnit to be issued our fall weather is heading for winter and we have a significant investment which we need to protect from the potential cold weather. We fully realize that after the permit is issued and construction completed we must obtain your Beneficial Occupancy permit,prior to using the building. On August 27th we were requested by County Officials stop work untilresolution of the requirements in your letter of August 12th. The installation of the modular was about 75% completed at that time. At present the water service is charged, Electrical and gas service to the building is complete. The Electrical and Mechanical sub- contractors for interior finishing and the Evergreen mobile finishing work, interior and exterior remain to be completed. Some of these crews are now scheduled through the Thanksgiving Holiday. Therefore, this is a request with two options for your permission to proceed to complete the installation work prior to receipt of the permit so the affected contracts can be completed this year and we can protect our investment. A. Complete installation of all aspects of finishing the building. B. Complete installation of all contract items required to minimally turn on the heat. Following are the clarifications and additional information that you requested regarding Dave Anderson's letter to Bob Campbell dated August 12, 1999: 1. The City of Arlington has requested frontage improvements to 67`h Avenue NE per the City of Arlington Unified Development Code, Chapter XI, Section C,Mitigation of Impacts Resulting from Development Proposals. In lieu of half-street improvements of a 5-lane roadway section with curb, gutter and sidewalk,the City will accept$105,000.00. This dollar amount is based on cost estimates prepared in a 30%preliminary design done earlier this year. The $105,000 was derived by taking the total project cost of the proposed improvements on 67`h and then dividing by the length of the job to get a cost per foot. This number was then multiplied by Snohomish County's frontage length and divided by 2. The City is willing to discuss with the County alternative means for paying. The City,for instance, is willing to allow the County to trade its maintenance services over a period of time in lieu of cash. One idea is that the County could continue to provide maintenance to the Smokey Point area after October 1,when this area is officially a part of Arlington, until the$105,000 is amortized. 2. The second issue brought up in your letter was the requirement that the County treat and detain the runoff from the new impervious area due to the widening of 67`h as required in number 1 above. This comment goes away if the County does not widen 67th. The original intent of this comment was that the County would have to provide treatment and detention of the new impervious area added to 67'1'and one option would have been to combine this with the County's drainage system. Use of Dedicated Land and/or Fees Collected Land accepted by the City through this Section of the UDC will be developed as a neighborhood or district park,as appropriate,and will be developed with funds available from deposited fees, in accordance with a priority schedule to be established by the City Board of Parks Commissioners and approved by the City Council. Such schedule shall be revised annually and may be revised dmore frequently, if required. 8. Review of Development Fees The park development fees for each development,structure,or unit established by this Chapter shall be reviewed by the City Parks Board annually at a public hearing.The Parks Board shall report and make recommendations to the City Council. dC. MITIGATION OF IMPACTS RESULTING FROM DEVELOPMENT PROPOSALS 1. Policy It is the policy of the City to implement the State Environmental Policy Act, RCW 43.21 C, and the State Subdivision Code, RCW 58.17, by requiring the proponent of any subdivision, rezone, project or development to mitigate any and all impacts directly resulting from the same which adversely affect the environment or the public health, safety, or welfare. Mitigation measures, including dedication of property to public use and voluntary payments into the City's Growth Management Fund,shall be a material consideration in the approval, modification or denial of all such proposals. 2. Projects Subject to Mitigation Requirements All subdivisions, rezones, projects, and developments (hereinafter collectively referred to as "projects")which are found by the responsible official of the City,the Planning Commission,Board of Adjustment,or City Council to directly result in adverse environmental impacts or to adversely affect the public health, safety or welfare (hereinafter referred to as"adverse impacts"), shall be required to mitigate such impacts as a condition of receiving City approval to proceed with the project;provided,that mitigation requirements shall not apply to categories of projects which are exempt under WAC 197-10-170, except for short plats, duplexes and triplexes,the exemption for which is repealed for the purposes of this Section of the UDC. 3. Mitigation Requirements Identified The City legislative or administrative authority issuing the project approval shall determine and f identify those adverse impacts which will directly result from the proposed project, and shall determine and identify required mitigation of the same. It must be established that each mitigation requirement is reasonably necessary as a direct result of the project. 4. Mitigation of Adverse Impacts The City legislative or administrative authority issuing the project approval shall condition the same upon satisfactory mitigation of all identified adverse impacts by one of the following alternative methods: a. The proponent may modify the project so as to avoid creating adverse impacts;or b. The proponent may undertake,at its own cost,to mitigate all identified adverse impacts on a time schedule agreed upon with the City legislative or administrative authority issuing the project approval;or C. If the City determines that the identified adverse impacts would best be mitigated on a regional basis, the City shall prepare a cost estimate for the regional capital improvements,and shall define a benefit area for the same.The City and the proponent shall negotiate the fair share of said total cost to be allocated to the proponent's project, being guided by assessment methods allowed in RCW Chapter 35.44.A proponent may enter into an agreement with the City to pay the mitigation assessment for the project on a mutually agreed upon time schedule, or may dedicate land or do public works as a credit against the mitigation assessment,as provided below. If such mitigation is not deemed possible,practical,or in the public interest,the proposed project may be denied. 5. Recovery Contracts At the option of the City Council,a proponent may be allowed to enter into a recovery contract with the City providing for partial reimbursement to the proponent, or its assignee,of costs of regional capital improvements required by this Chapter, including design,grading, paving, and installation of streets, curbs, gutters, storm drainage, sidewalks, street lighting, traffic controls, and other similar improvements required by the street standards of the City,and regional storm drainage facilities.Such contracts shall be governed by the following provisions: a. An assessment area shall be formulated based upon a determination by the City as to which parcels of real estate adjacent to the street improvements would be required by this Chapter to make similar improvements at the time development is proposed for said parcels;in the case of regional storm drainage facilities,a similar analysis shall be made with respect to all parcels within the drainage basin as defined by the City. b. The reimbursement share of all property owners in the assessment area shall be a pro rata share of construction and contract administration costs of the improvement project. The City shall determine the reimbursement share by using a method of cost apportionment which is based upon the benefit to each property owner from the project. There shall be no reimbursement to the proponent for the share which is allocated to its property,nor for any contributions paid by the City. C. A preliminary determination of area boundaries and assessments, along with a description of the property owners'rights and options, shall be forwarded by registered mail to the property owners of record within the proposed assessment area. If any property owner requests a hearing in writing within twenty(20)days of the mailing of the preliminary determination,a hearing shall be held before the City Council,notice of which shall be given to all affected property owners. The City Council's ruling shall be determinative and final. City of Arlington Unified Development Code December8, 1998 XI-6 d. The City Council may,in its discretion,determine that interest shall accrue for the benefit of the proponent, or its assignee, on all unpaid assessments. In such cases, the City Council shall establish an interest rate and shall include it within the recovery contract. e. The contract,upon approval by the City Council,shall be recorded in the records of the l Snohomish County auditor within thirty(30)days of such approval. A recorded contract shall constitute a lien against all real property within the assessment area which did not contribute to the original cost of the project improvements. f. If, within a period of fifteen (15) years from the date the contract was recorded, any property within the assessment area applies for development rights which implement the requirements of this Section of the UDC, the lien for payment of said property's proportionate share, plus accrued interest,shall become immediately due and payable to the City as a condition of receiving development approval. g. All assessments and interest collected by the City pursuant to a recovery contract shall be paid to the original party constructing the improvement, or his/her personal representative,successors or assigns,within thirty(30)days after receipt by the City,less an administrative charge of fifty dollars($50.00)for each collection. 6. Credit for Mitigation Assessment for Dedication of Land At the option of the City Council, a proponent may be allowed or required to dedicate land, or cause land to be dedicated, to the City for public purposes. In such a case,the proponent shall be granted a credit against any part or all of the mitigation assessment referred to above, to the ti extent of the appraised value of the land which is dedicated.The implementation of this credit shall be in accordance with the following criteria: a. Dedication of land shall only be required or accepted by the City upon a finding that it is reasonably necessary as a direct result of the proposed project, and will tend to mitigate adverse impacts of the project. b. No credit shall be given for dedication of land for public road right-of-way located on the subject property or which abuts the same or otherwise provides direct access to the subject property. C. In evaluating a specific parcel of land for dedication,the City shall consider the following factors: 'c (1) Compatibility of the land with the City's then-current comprehensive plan for public facilities; (2) Topography,geology, access,and location of the land, as the same relates to its effective development and use for public purposes; (3) The proximity of the land to pre-existing property under public ownership; (4) The proximity of the land to existing and foreseeable population concentrations; (5) The possibility of combining the land with abutting properties which are presently under public ownership or are anticipated for future acquisition; (6) The environmental and economic impact of developing and using land for public purposes; (7) The fair market value of the land; Clry of Ar*- n U*Yied De-oapment Code X l-7 December g— 1998 3r. �• ■ ■ ■ ■ 1 1 r ■ or ■ ■ y ■ � ■ I ■ Y ' ■ � I ■ ■ ■ (8) The extent, if any,which dedication of the land to the public would reasonably interfere with the private development and use of abutting properties. d. If either the City or the proponent desires to pursue the option of land dedication, they shall, by mutual agreement, retain the services of a qualified appraiser who shall investigate and report to the parties the appraised value of the subject land.The cost of the appraisal shall be bome equally by the City and the proponent.Within thirty(30)days from the date of the appraisal report,the City shall notify the proponent of its decision whether the dedication will be required or allowed as a condition of project approval. e. In the event the City requires or allows dedication,the owner of the property shall deed or dedicate the same to the City with a warranty of clear title,as a condition of receiving final approval of the project. f. The proponent shall be given a credit against the mitigation assessment referred to above which is equal to the appraised value of the dedicated land. g. The City shall have complete discretion with respect to the use of the dedicated land,and the schedule for the development of the same; provided, that any such use or development shall be consistent with all applicable laws of the city, state, and federal governments. (Ord.980§1(part), 1990.) 7. Credits for Public Work on Regional Improvements In any case where a proponent requests permission to develop, at its own cost, a regional improvement to the public street system,park and recreational facilities,storm drainage and flood control facilities, or public safety facilities,which are located either on the subject property or off site and would contribute to mitigation of identified adverse impacts resulting from the project,the City may, in its sole discretion,grant permission to the proponent to perform such public work,and the value of the same shall be credited against the mitigation assessment for the project. The value of such work shall be determined by the City Engineer and shall be consistent with the probable cost of such public work, and in granting a credit against the mitigation assessment, the City Council must find that the work is in the public interest and meets the following standards: a. The public work must be a regional improvement which is provided for and anticipated in the City's Comprehensive Plan; no credit shall be allowed for construction of local access streets within the subject property or which abut the same or otherwise provide direct access to the subject property. b. The public work must be directly related to the mitigation of impacts created or contributed to by the project. C. The timing for the development of the public work must be consistent with the long-range scheduling for such development by the City. d. The proponent or its contractor must demonstrate its financial and professional ability to perform the project in a workmanlike manner and in compliance with all specifications for the project and all governmental regulations relating thereto. e. The proponent or its contractor shall be required to comply with all bonding and warranty requirements otherwise applicable to public works. f. The proponent or its contractor shall be required to deposit with the City,cash in a sum equal to the public work contract retainage requirement specified in RCW 60.28.010. The proponent shall deed and convey the completed project and facilities to the City, for no cost, as a condition of receiving final approval of the development or construction in question. 8. Use of Mitigation Assessments All mitigation assessments paid to the City under this Chapter shall be deposited in the growth management fund established under Chapter 3.64 of the Arlington Municipal Code,and shall be held and used subject to the following provisions: a. Mitigation assessment paid by a proponent may only be expended by the City on capital improvements agreed upon between the proponent and the City which are designed to mitigate impacts directly resulting from the proposed project. b. Mitigation assessments shall be expended for such purposes within five years after the date of payment to the City. C. Any mitigation assessment not so expended shall be refunded with interest at the rate then established by state law as applying to judgments.The refund shall be made to the property owner of the subject property who is of record at the time of refund; provided, that if the mitigation assessment is not expended within a five-year period due to delay attributable to the proponent, or its successors or assigns, the mitigation assessment shall be refunded without interest. We have a minor drainage issue which has developed this week which we request your office provide assistance in resolving. As you know we are engaged in a new building project on our Road Maintenance property off 67th Avenue NE. The excavation of the southeast portion of the property has uncovered a drainage pipe, which is the outfall from a catchbasin, under the fence from Cuz Concrete property. We have requested on two occasions to have the pipe relocated so their drainage does not run onto our property, without receiving cooperation from Glenn Zachery, the owner. The best way to work out this type of issue is directly with the responsible party, however he has stated he has no intention of changing the drainage. Barbara stated that"dumping water onto neighboring property is illegal in the City of Arlington." Upon review of the 1997 UBC, Chapter 33, Excavation and Grading, we ariexerfipt from the grading permit pursuant to several of the provisions of Section 3306.2, 1, 6 & 7. The discussions with City Officials in 1994 provided initial concurrence with our reclamation plan for the former pit. That ongoing work is in compliance with the DOE NPDES permit under which the County operates. No written plan has been required by DNR due to the inactive, grandfathered nature of the pit operations however; we will be preparing a master plan for the completion of the reclamation, paralleling the Soils/Geotechnical/Civil engineering requirements of the referenced Chapter 33. Dear Mr. Pratt: The City of Arlington would like to request at this time an additional 30(thirty) feet of Right of Way from Snohomish County along 67th Ave.N.E., this would be along the frontage of your District 1 Maintenance Facility in Arlington.This request for additional R.O.W. is required to construct a five lane roadway section from 188th St. N.E. to 204th St. N.F:., this would replace the existing two lane section (see attached). The first phase of this project is funded and scheduled for the 2000 construction season. The first phase will end approximately 700' south of the County facility, with the second phase continuing to 204th St.,this would occur hopefully during the 2002 construction season. It has come to our attention that the County is planning to install a modular office unit on the southeast portion of their site,parallel to 67th Ave. The City of Arlington would like to establish the proposed Right of Way and building setbacks to accommodate the planned roadway construction,and avoid the relocation of the county's office building in relation to the project. if this is agreeable to the County, I will have our attorney draft the Right of Way dedication documents post-haste for your review.
