A RESOLUTION OF THE CITY OF ARLINGTON, WASHINGTON
REJECTING A BID ON THE 67 AVENUE FINAL PHASE PROJECT AND FINDING
REECE TRUCKING & EXCAVATING COMPANY, INC.
NOT TO BE THE LOWEST RESPONSIBLE BIDDER
WHEREAS, the City of Arlington has solicited bids for a project known as the City
Arlington 67"' Avenue Finai Phwse Project (hereinafter the "Project"): and I
IMHEREAS, Reece Trucking and Excavating Company, Inc. was the apparent low bidder
on the project; and
WHEREAS, the City's contract administration agency, the Washington State Department
*f Transportation ("WSDOThas determined that Reece Trucking and Excavating Company,
rnc. is not the "lowest responsible bidder" within the meaning of RCW 35.52.352;
NOW, THEREFORE, the City Council of the City of Arlington, Washington do hereby
resolve as follows:
The City Council finds as follows:
a. The City of Arlington has sought qualified contractors to bid on the
Project;
b. Reece Trucking and Excavating Company, Inc. submitted a bid containing
a Disadvantaged Business Enterprises (DBE) Utilization Form as required
by state law and the bid specifications;
C. Lopez Valley Nursery and Landscaping is identified on the DBE
utilization form as a DBE subcontractor performing $269,320.50 in
landscaping services;
d. The bid items tabulation spreadsheet in Reece Trucking & Excavating,
Inc.'s bid does not identify $269,320.50 in landscaping work;
e. The bid items tabulation spreadsheet shows $250,000.00 in "property
restoration" work, which is defined in the WSDOT standard specifications
for the Project as force account allowance work which is considered
excessive based on the project plans and specifications; and
r. WSDOT, as the City's contract administration agency, has determined that
Reece Trucking & Excavating, Inc. has not met the contract requirements
for making a good faith effort in using DBE subcontractors and has
recommended rejection of the bid as nonresponsive.
2. Based on the foregoing findings, the City Council hereby declares that the biLi

submitted by Reece Trucking & Excavating, Inc. for the City of Arlington 67th
Avenue Final Phase Project is hereby rejected, and Reece Trucking & Excavating,
Inc is declared not f*r )Pwpv�%c, +f wa-Tiilly
the bid on that project.
APPROVED by the Mayor and City Council of the City of Arlington this day of
March, 2013.
