A AESOLUTIOR OF THE CITY OF ARLINGTON REGARDING THE "AT LARGE"
COUNCIL POSITION.
1VHEREAS, the City has maintained a city council position which has had a two year
term and which has been referred to as a "council at large" position; and
WHEREAS said position is currently occupied by Councilman Ken Klein, having been
elected to a two year term by the voters in 2011; and

WHEREAS, RCW 3 5A. 12,040 expressly provides that "The mayor and the
councilmembers shall be elected for four-year terms of office and until their successors are
elected and qualified and assume office in accordance with RCW 29.04.170"; and
WHEREAS, the City has no ordinance or other legislation authorizing a two-year te
contrary to the provisions of RCW 3 5A. 12,040; and I
WHEREAS, the City believes the two year term of office is inconsistent with state lajjR,
and desires to correct what it believes to be an error;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ARLINGTON:
Section 1. The Council declares that certain position previously known as the "City of
Arlington Council —At — Large" position, shall hereafter be a four year term as required by
RCW 3 5A. 12.040, and shall be renamed "City of Arlington Council — Position 7".
Section 2. The Mayor and City Clerk are authorized and directed to certify a copy of this
resolution and submit it to the Snohomish County Auditor. The Auditor of Snohomish County,
as ex officio of elections, is hereby requested to amend all future election ballots to conform to
the provisions of Section 1, above.
Section .3, The City Clerk is directed to certify to the Auditor a copy of this Resolution
showing its adoption by the City Council and to perform such other duties as are necessary and
required by law to make the above changes in advance of the May 13-17, 2013 candidate filinij
periods.
Section 4. SevcrabLl�qA:. In the event any one or more of the provisions of this resolution
shall for any reason be held invalid, such invalidity shall not affect or invalidate any other
[irovisions of this resolution, but this resolution shall be constructed and enforced as if such —
invalid provision had not been contained therein; provided, that any provision which shall for

any reason be held by reason of its extent to be invalid shall be deemed to be in effect to the
extent permitted by law.
