Blvd. Maryville, WA 98270 Dear Keith, After reviewing the pen-nits submitted for the Stillaguamish Senior Center it has come to the attention of staff that some of the buildings proposed do not meet the designs that were approved by the Design Review Board and will need to go back to the board for approval. Would it be possible to meet with staff to discuss? Based on the current submittals the buildings noted that do not match the approved Decision of the board are listed following: 07-7479 Bldg. 1 07-7512 Bldg. 2 07-7513 Bldg. 3 07-0714 Bldg. 6 07-7515 Bldg.13 07-7516 Bldg.16 07-7534 Bldg.4 07-7535 Bldg.5 All of the Building Pen-nits must also meet the conditions of the Conditional Use C 06- 018 decision of 09/08/06. See attached for reference, i.e.: City of Arlington traffic mitigation fees must be paid and site civil approval must be done prior to issuance of building permits for the expansion. Also requested was an overall site plan that clarifies the setback dimensions for buildings shown right on the 5' dashed setback lines.,See attached mark-up. You can bring that with you when you meet with staff if you wish. All previous comments from the Fire Marshall's office apply and must be addressed as well. Prior to any construction activities, the developer shall file and receive approval of site civil construction plans which comply with all requirements of the Land Use Code, International Building Code, International Fire Code, and Public Works Construction Standards and Specifications. Said plans shall address all site improvements, either required or voluntarily provided. 3. The developer shall meet all local, state, or federal code requirements. Attached is a list of code requirements that are specifically called to the developer's attention. It is in no way intended to be a complete list of code requirements, but a general checklist of major steps and issues. Please refer to the AMC for a complete list of code requirements for your particular project type. 4. Prior to approval of the site civil construction drawings, the landscape plan shall be revised to show the required minimum 3-foot solid fence or wall on the entire south property line and a minimum of 5 feet of "intermittent visual obstruction" type of landscaping on the entire west property line to provide a Semi-Opaque Screen, Type B. In addition, the landscape plan shall show all proposed trees, including the mitigation for the significant trees that are going to be removed from the site. Any significant trees removed because their retention would unreasonably burden a development shall be replaced with 5-gallon-sized native species at a ratio of 3:1. 5. Prior to issuance of any building certificate of occupancy, the developer shall install 2 additional recreational facilities pursuant to AMC §20.52.020(a) that are best suited for the age bracket of seniors that will reside in this development. 6. Please be advised that the age restriction was not part of the Conditional Use Permit but rather a restrictive covenant between the Developer and the Land Owner(s). Per the City of Arlington Municipal Code, Section 20.40.020 (b), 50 plus residential units require a Conditional Use Permit in Residential High Density Zoning Districts. The Conditional Use Permit was approved and issued on September 28, 2006 without age restrictions attached as a condition. This makes the age restriction a private issue between the Developer and the Land Owner and therefore, does not require approval by the City of Arlington. The only caveat is that the mitigation fees that were paid during the review process for"Senior Citizen Housing" is different from regular residential housing and you should check with Community Development, Planning Commission to see if additional fees are required. If you have any questions please let me know. Sincerely, Christopher J.Young Building Official City of Arlington, Community Development AFTER RECORDING, RETURN TO: CITY OF ARLINGTON PLANNING DIVISION 238 N OLYMPIC AVENUE ARLINGTON, WA 98223 CITY FILE NO. The 68 units located at 18222 Smokey Point BLVD do not require sprinkler systems per the approved Townhouse construction, however, there is an issue with a few of the complexes based on Fire Department access. I was informed that during the site layout meeting the Fire Department indicated that a few of the complexes would require sprinkler protection due to the proximity and the units not being located abutting a fire department access road. The complexes are situated at the far west portion of the development and labeled units 34 — 36, 37—40, and 41 — 44 (11 total units).
