Due to the upcoming renovation to the POTW, the technology to be used and WA State discharge limits to be put into effect, metals contamination in the wastewater effluent has been given a high priority. Therefore, reductions of metals entering the system needs to be addressed and a signed Discharge Agreement with the City of Arlington may need to be provided dependent upon the types of metals that are used. 3. In the future, it would be appreciated that when changes are made to an application pertaining to pretreatment that I (Sandy Boyd) be notified first. It would appear that the previous pre-treatment/sewer comments from the memo from Utilities dated 6/27/07 were omitted from subsequent comments after leaving the Utilities Division. In your letter (no date) to the Mayor and Council, you stated that one business (Alaskan Bushwheel Inc.) requires you to be located on the flightline in order to load parts onto their plane. Based on that information you meet the intent of the Flightline Zoning and would be allowed to expand into the new hangar. The City Planning department has concurred with my interpretation regarding the zoning. As we discussed on the phone I have a few other items that need to be addressed, which are primarily related to vehicles on the taxilanes and taxiways. These issues are: • All employee parking will be in the established parking lots of both buildings. If additional parking is needed there is space along 5e Dr. that can be used. • Delivery vehicles need to load/unload from either the driveway or 591h Dr.with the driveway as the preferred method. • The recycle containers will need to be relocated so that the pickup vehicles do not have to have access to the taxilanes or taxiways. • The area between the new building and the hangars to the south needs to remain cleared. In the Flightline Zone no outside storage is allowed and aircraft will be using the taxilane. • The gates need to stay closed and locked when not in use. Based on our telephone conversation it seemed that Metal Motion did not have any problems with these conditions. If you can confirm that in writing I would appreciate it. I also need to approve the sublease between Metal Motion and Stephen Johnson. What I'm looking for is the statement that the sublease is bound by the terms and conditions of the Master Lease between Stephen Johnson and the City of Arlington. That is all I need from the Airport's stand point, but you will need to contact Sonya Blacker, at the permit center to see if there are any other items. IV. BACKGROUND The subject minor development permit review application was received by the City of Arlington on August 28, 2003, and the application was deemed complete on September 19, 2003. A Notice of Application and Mitigated Determination of Nonsignificance (MDNS) was published, posted, and mailed on November 19, 2003. V. FINDINGS OF FACT 1. Application Process: The minor development permit application was received by the City of Arlington on August 28, 2003. The application was deemed complete on September 19, 2003. A minor development permit is an administrative review process per City of Arlington Unified Development Code (UDC) Chapter VII, Sections CA and C.5. 2. Per UDC Chapter V, Section J, Airplane Hangars (Warehouse) are a permitted use. 3. Lot_ Dimensions, Density, and Related Requirements: The proposed development complies with the minimum lot dimensions for Airplane Hangars (Warehouse) (20,000 square feet in size and 100-foot minimum width) and yard setbacks (front 25 feet, rear 25 feet, and each side 25 feet) and with maximum building height (50 feet). Lot coverage is not applicable in the Airport Industrial zone. 4 Non-residential Performance Standards: The proposed development must comply with the standards of performance for noise, lighting, odors and gases, particulate matter, electrical interference, hazardous materials storage, waste disposal, open storage, maintenance and alterations, and hazardous waste facilities per UDC Chapter IX, Section B.2. 5. Off-street Parking: Per UDC Chapter IX, Section CA, Parking Requirements, the development as proposed, including the existing manufacturing building, requires 50 parking spaces at 1 space per 1,000 square feet of gross floor area (GFA) for the hangar space, which is approximately 25,400 square feet, for 26 spaces; plus 2 spaces per 1,000 square feet of gross floor area for the existing manufacturing space, which is approximately 11,867 square feet, for 24 spaces; plus 2 loading spaces at 1 space for each 25,000 square feet for the first 50,000 square feet; plus a dumpster. The applicant is proposing to install 55 parking spaces (50 spaces plus 1 space inside each of the 4 hangars in Phase I plus 1 inside the hangar in Phase II), plus there is space for 2 loading spaces off the taxiway in front of the hangars, which meets the minimum requirements; however, there is no dumpster space shown on the site plan. A dumpster space will be required as a condition of the project. (NOTE: Phase I requires 15 spaces, and the applicant is providing 11 spaces plus 4 spaces inside the hangars.) 6. Landscaping: The final site plan shall comply with the requirements of UDC Chapter IX, Section N, Landscaping. The required landscaping for Airplane Hangars use is category C, which requires 10 feet of Type III landscaping adjacent to all street frontages. The landscape requirement for the parking area is a minimum of 17-1/2 square feet of landscaping for each parking space for the first 50 spaces and 35 square feet for each parking space over 50 per Chapter IX, Section N.7. The landscape plan reflects sufficient frontage and parking area landscaping to meet the general landscape requirements specified in Chapter IX, Section N.7. Plant material must be guaranteed for one year with any replacements guaranteed for one year also. 7. Transportation: The proposed development is located on the west side of 59th Drive NE north of 1881h Street NE. It is anticipated that the project would add 20 new average weekday daily vehicular trips, which included 2 p.m.-peak-hour trips, to the street system, as well as pedestrian and bicycle trips. The site will be accessed off of 591h Drive NE. Pursuant to Ordinance 1213, frontage improvements shall be installed along 59th Drive NE, in accordance with the Public Works construction standards and specifications. In addition, Ordinance No. 1208 requires the developer to pay transportation impact fees for each new p.m.-peak-hour trip at the fee in effect at the time of payment to mitigate for off-site impacts. (NOTE: The current transportation impact fee is $1,038.00 for each p.m.-peak-hour trip, but this may change.) City transportation impact fees shall be paid prior to issuance of any building permits. Pursuant to the SEPA MDNS, transportation mitigation fees shall be paid to WSDOT and pursuant to the City's Reciprocal Traffic Mitigation Interlocal Agreement, transportation mitigation fees shall be paid to Snohomish County for this project's proportionate share of average daily trips. The developer shall submit proof of payment of the required WSDOT and Snohomish County fees prior to issuance of the building permit. (NOTE: Snohomish County has stated that no County traffic mitigation is required for this project.) 8. Stormwater Management: The City has adopted storm drainage requirements per Arlington Municipal Code Chapter 13.28, Stormwater Management, and the Department of Ecology's Stormwater Management Manual for the Puget Sound Basin (The Technical Manual). A preliminary review of the system indicates that they have a conceptually feasible plan; details will be reviewed and conditioned with the site/civil review phase of the project. (NOTE: The Arlington Airport has developed a drainage master plan for the airport; the stormwater system for the development must be designed to meet that master plan.) 9. Critical Areas: There are no critical areas as defined in the City's critical areas regulations on or near the proposed development. 10. Groundwater Resources: The property is within an aquifer recharge area. Best Management Practices shall be used for the protection of the groundwater resources underlying this site. 11. Potential Cultural Resources: The Stillaguamish Tribe has expressed concern about potential cultural resources in the area where the proposed project will occur. If any archaeological materials are discovered on the site, the State Historical Preservation Officer, the Stillaguamish Tribe, and the City of Arlington shall be contacted and measures taken to preserve the materials and the site. 12. Airport Management: The Arlington Municipal Airport requires that street lamps or light poles located on the property be down-shielded to avoid interfering with flight operations. 13. Water and Sanitary Sewer: Adequate water and sewer service is available to the site from the City of Arlington; utility services to the building and fire hydrants and fire protection as required will be reviewed when construction drawings are submitted. All existing and planned utilities shall be shown on the site plan. Water and sanitary sewer general facility charges may be assessed when construction drawings are submitted. All fees shall be paid before connection is made to the water or sanitary sewer utility. Criteria for Approval of an Application and Issuance of a Permit: Per UDC Chapter VII, Section D, Criteria for Approval, the Development Services Department, Planning Division, is required to review for compliance the following criteria before an application can be approved. a. The development is consistent with the dimensional, density requirements and Performance Standards of the UDC and other applicable laws and regulations; and Staff Analysis: As identified above, the development is consistent with the dimensional, density requirements, and Performance Standards of the UDC and other applicable laws and regulations. b. The development as proposed incorporates, to the maximum extent feasible, mitigation measures to substantially lessen or eliminate all adverse environmental impacts of the development; and Staff Analysis: The development as proposed incorporates, to the maximum extend feasible, best management practices to lessen or eliminate all adverse environmental impacts of the development. C. The applicant has presented certification that the applicant has filed and paid all the taxes, penalties and interest, and that the applicant has satisfactorily made agreement to pay the taxes (NOTE: this requirement is only applicable to subdivision plats); and Staff Analysis: This requirement is only applicable to subdivision plats. d. Prior to final approval the applicant has followed all permit processing procedures and paid all applicable land use fees. Staff Analysis: As stated above, all permit processing procedures have been followed and a condition is included that requires that all applicable land use fees be paid prior to final decision. VI. CONCLUSIONS 1. The City of Arlington Comprehensive Plan identifies this area as Airport Industrial, and the subject property is zoned Airport Industrial per UDC Chapter III, zoning map, Page III-2. Airplane Hangars are a permitted use in the Airport Industrial zone per UDC Chapter V, Section J. Therefore, the proposed development as noted and conditioned is consistent with policies governing airport industrial uses and is allowed in the Airport Industrial zone. 2. The requested minor development permit as conditioned meets all UDC requirements, including Chapter VII, Section D, Criteria for Approval, and all other applicable codes. 3 The minor development permit should be approved subject to conditions noted below. VII. All development shall be in substantial conformance with the approved site plan received by the City of Arlington,on August 28, 2003, subject to any conditions or modifications that may be required as part of the minor development permit. 2 Prior to issuance of a building permit, the applicant shall file a drainage plan and construction plans, which meet the following conditions, in conjunction with a building permit application. The final site plan shall comply with all requirements of the Unified Development Code, Uniform Building Code, Uniform Fire Code and Public Works Construction Standards and Specifications. 3 Prior to approval of the site civil construction plans, the developer shall provide a dumpster space on the property per Public Works Construction Standards and Specifications. 4 Prior to issuance of a building permit, the developer shall submit payment of the following estimated City of Arlington impact fees: Traffic at $1,038.00 per p.m.- peak-hour trip, which is 2, or $2,076.00. (NOTE: Actual impact fees due are those as set by resolution at the time the fees are paid. These amounts are provided here as an estimate. They may either increase or decrease by the time they are paid.) 5. Prior to issuance of a building permit, the developer shall pay transportation impact fees to WSDOT for this project's proportionate share of average daily trips, and the developer shall submit to the City of Arlington proof of payment of the required fees. (NOTE: Snohomish County has stated that no County traffic mitigation is required for this project.) 6 Best Management Practices shall be used for the protection of the aquifer recharge area underlying this site. 7, All exterior lighting, including streetlights, shall be down-shielded. 8 If any archaeological materials are discovered on the site, the State Historical Preservation Officer, the Stillaguamish Tribe, and the City of Arlington shall be contacted and measures taken to preserve the materials and the site. 9. Prior to issuance of a building permit, the developer shall clear all outstanding Planning Division land use and Engineering Division permit-processing accounts with the City. 10. The minor development permit shall become null and void if use and reliance is not established within one year of the below date of approval. Vlll. CODE REQUIREMENT (NOTE: The following items are not conditions of permit approval, rather certain local, state, or federal code requirements that the applicant needs to be aware of. This is in no way intended to be a complete list of code requirements, but a general checklist of major steps and issues. This application is subject to the applicable requirements contained in the Arlington Municipal Code, Zoning Code, and Building Code. It is the responsibility of the applicant to ensure compliance with the various provisions contained in these ordinances. 2. Pre-Construction Phase. Prior to commencing any site work, including installing any easement or right-of-way improvements, utility systems, drainage systems, street lights, mailbox structures, emergency facilities, storm water control systems, or any other improvements, improvement plans must be submitted for review and approval by the Department of Development Services, Engineering Division. Said plans shall be in conformance with applicable code and below listed conditions. a. The applicant shall survey and mark all property corners prior to review of any submitted construction plans. b. The applicant will be required to design and install erosion control measures deemed necessary by the City. These measures must be installed and inspected by the City prior to the issuance of any permits. C. No site preparation or other disturbances shall be undertaken within environmentally sensitive areas or their required buffers. d. Submit to the Engineering Division and receive approval of a storm-water run-off and detention plan in conformance with the AMC Chapter 13.28, Stormwater Management, and the Department of Ecology's Stormwater Management Manual for the Puget Sound Basin (The Technical Manual) for both the construction phase and a permanent system. All site drainage must be directed through biofiltration swales prior to discharge into wetlands. (NOTE: The storm water system must be designed to meet the Arlington Airport drainage master plan.) e. All new utility lines shall be placed underground. f. Provide a temporary rock pad at all points of ingress and egress to the site throughout the construction phase. g. On the construction plans show locations of all required streetlights to be installed as designed. h. A right-of-way permit is required for and prior to any work done in a public right-of-way. i. All lighting shall be low sodium or similar low intensity illumination and placed in a way as to not cause glare on an adjoining property or right-of- way. 3. Construction Phase. The following conditions shall apply during construction. a. During any site grading or clearing activity, the applicant and contractor shall use all available means of controlling air pollution (dust, ash, and smoke). d. The restrictions of the AMC shall apply to any and all grading. 4. Installation of Improvements. Prior to receiving a Final Inspection for Occupancy, the applicant shall: a. Install all rights-of-way and access easement improvements on all proposed streets internal and existing streets adjacent to the project per the requirements of UDC Chapter IX.A.1.c.12-20 or City of Arlington Ordinance 1213 adopted November 1, 1999. The applicant shall coordinate with all adjacent developments the final design of the street improvements and/or include the appropriate transition tapers for the street pavement to be included from the property. Improvements shall meet the following classifications: 1. Frontage improvements shall be required along 591h Drive NE per Public Works construction standards and specifications for a local access street. b. Install a potable water system to serve the project per City of Arlington's Engineering requirements. Water is to be served by the City of Arlington. This system cannot be deferred even if a performance bond is secured. Both water and sanitary sewer must be completely installed and approved before either a temporary or permanent Certificate of Occupancy is issued. c Relocate any existing water facilities and/or install water services/fire hydrants prior to the required improvements at the expense of the developer. d Install a sanitary sewer system created per Engineering Division requirements. Sanitary sewer is provided by the City of Arlington. This system cannot be deferred if a performance bond is secured. Both water and sanitary sewer must be completely installed and approved before either a temporary or permanent Certificate of Occupancy is issued. e. Install a permanent storm water control system, per AMC Chapter 13.28 and the Arlington Airport drainage master plan. f. FOLLOW-UP The applicant shall submit for review and approval engineered site civil construction drawings and building construction drawings that meet all the conditions of this land use permit. X. APPEALS This Minor Development Permit may be appealed per Arlington Unified Development Code Section VII.G. A written notice of appeal must be filed with the City Clerk, with all required fees, within 10 days of issuance of the permit. The City Council (or a Hearing Examiner, if so appointed by the Council) would hear the appeal and their decision would be considered the City's final decision on the underlying governmental action.
