There were several conditions that Dave had prior to occupancy but I assume they can be worked out by Dave. It was very clear that should the basement be used for other then storage it may need to be sprinkled. I am hoping that Dave has put in writing his issues. I was also very surprised as to the progress they have or haven't made and the pressure that the Beck's are placing on the City to allow occupancy. 3 weeks ago at the meeting Ms. Beck said she wants to open in less then 2 weeks, my guess is that the interior of the structure is still 3 to 4 weeks away from inhabiting. As far as getting them operating, Building and Fire will still have issues that will not allow them to operate but the project appears to be cleared from the Planning Plate. As always, my intent is to insure the safety of the public and my firefighters should something bad occur. The Coffee/Cafe area will take up 482 sq.feet,and will be in the front right corner on the main floor. The seating will be shared space with the gaming area I will supply in the packet copies of the floor plan. We plan to rent out office space on the third floor in the front and the back of the building,the total sq.footage of that office space is 1,343 sq.feet. For now the basement will be used for dry storage. There are two restrooms in the basement, one for each gender,and there will be a multi-gender restroom on the main that will be wheelchair accesible. All the restrooms,and the floor plan are the original floor plan. As far as making the main floor wheelchair accesible we are doing so by putting in a ramp on the front right hand side of the building,and putting in an additional door at the last window on the right hand side of the building. That again will be illustrated on the plans. To address traffic to and from the business,I will go off of the peak times for our other two businesses. The our customers is when school islet out. Application Process: The zoning permit application was received by the City of Arlington on December 22, 2005. The application was deemed complete on January 12, 2006. Per AMC §20.16.100, a zoning permit is issued by the Planning Manager after an administrative review process. 2. Comprehensive Plan, Zoning and Permissible Uses: The City of Arlington Comprehensive Plan identifies this area as Central Business District 2, and the subject property is zoned Central Business District 2 per AMC §20.36.100 (zoning map). Per AMC Table 20.40-2, the proposed use (Use 2.120, low-volume traffic generation sales) is a permitted use. 3. Density and Dimensional Standards: Per AMC Table 20.48-4, Density and Dimensional Standards, the proposed development complies with the following standards for the Central Business District 2 zone: minimum lot size (0) and lot boundary setbacks (5 feet) and with maximum building height (50 feet) and lot coverage (100 percent). However, it does not comply with minimum lot width (60 feet) or maximum street setback (0 feet), but the lot and building are legal nonconforming. 4. Non-residential Performance Standards: Per AMC Chapter 20.44 Part III, the proposed development must comply with the performance/operation standards for noise, vibration, odors, smoke and air pollution, disposal of liquid and hazardous wastes, water consumption, electrical disturbance or interference, lighting, and site and building maintenance. Design: Per AMC §20.46.010, developments in the Central Business District 2 zone shall conform to the applicable guidelines or standards set forth in the Design Guidelines. However, since no exterior modifications are proposed, the project is not subject to design review. 6. Off-street Parking: Per AMC Table 20.72-6, the required parking for the proposed use (Use 2.120, low-volume traffic generation sales) is 21 spaces at 1 space per 400 square feet of gross floor area (GFA), which is 8,124 square feet. Per AMC §20.72.100, no loading space is required because the normal operation does not require that goods, merchandise, or equipment be routinely delivered to or shipped from the development. The previous use had no parking associated with it, and the proposed site plan shows 0 parking spaces, (and 0 handicap accessible spaces). Per AMC §20.72.020, the Planning Manager has determined that no parking spaces are required to accommodate the specialty retail as most of the business is anticipated to be teens and preteens, who do not drive, therefore the business caters primarily to walk-in trade; the area is adjacent to the CBD-1 zone, where parking for non-residential uses is not required; it is impossible to provide additional parking in this area, which is already built-out; it would allow for redevelop of a use that has been vacant for many year; and public parking is available in the area. 7. Screeninq and Trees: Per AMC Table 20.76-9, no screening is required for the adjacent uses, but the required screening for the adjacent streets is Type C, which requires a minimum of 10 feet of Intermittent Screen along all street frontages. Per AMC §20.76.130, a minimum of 20 percent of the vehicle accommodation area must be shaded; however, in this instance there is no parking area. (NOTE: Screen types are described in AMC §20.76.040, and suggested planting patterns to achieve the required standards are included in the Public Works Construction Standards and Specifications.) There is sufficient existing frontage landscaping to meet the general landscape requirements specified in AMC Chapter 20.76. The final site plan shall comply with the requirements of AMC Chapter 20.76. Plant material must be guaranteed for one year, with any replacements guaranteed for one year also. 8. Streets and Sidewalks: The proposed development is located on the north side of Division Street and east of the Burlington Northern Santa Fe railroad tracks/Centennial Trail. It is anticipated that this project will add 12 p.m.-peak- hour trip (7 existing p.m.-peak-hour trips). to the street system as well as pedestrian and bicycle trips. The site will be accessed off of Division Street for pedestrian traffic and the alley via Gilman Street for vehicular traffic. a. Frontage Improvements - To mitigate safety impacts and provide both vehicular and pedestrian access to the project, AMC §20.56.170 provides that no permit may be issued for a project unless and until all roads on which the project fronts are developed to their full 3/4-street standards. The ordinance provides for various ways for this to happen. In this instance, frontage improvements have already been constructed on Division Street; no further frontage or alley improvements are required. b. Impact Fees — To mitigate impacts to the City's overall transportation system, AMC §20.90.040 requires the developer to pay transportation impact fees for each new p.m.-peak-hour trip (12 new p.m.-peak-hour trips and 7 existing p.m.-peak-hour trips). City transportation impact fees shall be paid prior to issuance of any building permits. 9. Stormwater Management: Per AMC §20.64.300, all stormwater systems shall be in compliance with Arlington Municipal Code Chapter 13.28, Stormwater Management, and the most current edition of the Department of Ecology's Stormwater Management Manual for the Puget Sound Basin (The Technical Manual). A preliminary review of the system indicates that they have a conceptually feasible plan. A detailed drainage review will occur during the site civil construction review process. 10. Environmentally Critical Areas: Per AMC Chapter 20.88, the site does not lie within any known environmentally critical areas. 11 Groundwater Resources: Per Figure NF-2 of the Comprehensive Plan, the site does not lie within the Arlington Aquifer Recharge Area. 12 Potential Cultural Resources: The Stillaguamish Tribe has expressed concern about potential cultural resources in the area where the proposed project will occur. If any archaeological materials are discovered on the site, the State Historical Preservation Officer, the Stillaguamish Tribe, and the City of Arlington shall be contacted and measures taken to preserve the materials and the site. 13. Airport Management: The Arlington Municipal Airport requires that street lamps or light poles located on the property be down-shielded as to avoid interfering with flight operations. 14. Water and Sanitary Sewer: Adequate water and sewer service is available to the site from the City of Arlington; utility services, fire hydrants and fire protection are required and will be reviewed when site civil construction drawings are submitted. All existing and planned utilities shall be shown on the site civil construction drawings. All utilities shall be operational prior to building occupancy. F. CONCLUSIONS 1. The City of Arlington Comprehensive Plan identifies this area as Central Business District 2 and the subject property is zoned Central Business District 2 per AMC §20.36.100 (zoning map). Per AMC Table 20.40-2, the proposed use (Use 2.120, low-volume traffic generation sales) is a permitted use. Therefore, the proposed development as noted and conditioned is consistent with policies governing those types of uses and is allowed in that zone. 2. The requested zoning permit, as conditioned, is consistent with all AMC requirements, permit processing procedures, and all other applicable codes. 3. Prior to issuance of a building permit, the applicant shall file a drainage plan and site civil construction plans, which meet the following conditions, in conjunction with a building permit application. The final site plan shall comply with all requirements of the Land Use Code, International Building Code, International Fire Code, and Public Works Construction Standards and Specifications. 3. The developer shall meet all local, state, or federal code requirements. Attached is a list of code requirements that are specifically called to the developer's attention. It is in no way intended to be a complete list of code requirements but a general checklist of major steps and issues. Please refer to the AMC for a complete list of code requirements for your particular project type. 4. Prior to issuance of a building permit, the developer shall submit payment of the following estimated City of Arlington impact fees (based on an 8,124 square foot building): Traffic at $1,038.00 per new p.m.-peak-hour trip, which is 12 (with 7 existing p.m.-peak-hour trips), or $12,456.00. (NOTE: Actual impact fees due are those as set by resolution at the time the fees are paid. These amounts are provided here as an estimate. They may either increase or decrease by the time they are paid. 5 If any archaeological materials are discovered on the site, the developer shall contact the State Historical Preservation Officer, the Stillaguamish Tribe, and the City of Arlington and take measures to preserve the materials and the site. 6. Comments are as follows: 1. The application lists eight units, which tenants are these improvements for? 2. Pretreatment was not an issue last October when the original application was made and the cafe was called a coffee kitchen for staff. The kitchen is now being used as a cafe restaurant, therefore the requirements change and call for the installation of a Fats, Oil and Grease (FOG) removal device. The installation of a dishwasher prohibits discharge through a grease trap as per UPC 1015.0. For this tenant improvement application an interceptor will be required. The size of this interceptor is to be determined by the building department. 3. No plumbing drawings were ever submitted with the plumbing permit application sent to Utilities for review some time ago. The location of the kitchen area has been moved from the rear of the building to the front, along with the addition of a hair salon. Please submit plumbing drawings showing these changes with water and wastewater lines showing on the drawings. 4. The hair salon will be required to install and maintain hair traps in all sinks where hair is washed or cut. 5. The drawings show two floor sinks in the kitchen area for future use. These will need to be connected to the interceptor. 6. Will water be supplied to the piercing facility? 7. Each business will be required to provide an equipment list and show where they plan to connect to water. Fixture isolation assemblies inside the building may be required. 8. The tenant improvement lists different businesses sharing the same source of potable water. Originally the use was for a coffee/kitchen and game room with a 5/8"domestic service. ENVIRONMENTAL REVIEW The proposal was categorically exempt under Chapter 43.21 C RCW (SEPA). D. FINDINGS OF FACT 1. Application Process: The application for a minor modification to the zoning permit was received by the City of Arlington on June 1, 2006. The application was deemed complete on June 2, 2006. Per AMC §20.16.250, a minor modification to a zoning permit is made by the Planning Manager after an administrative review process. 2. Comprehensive Plan Zoning and Permissible Uses: The City of Arlington Comprehensive Plan identifies this area as Old Town Business District 2, and the subject property is zoned Old Town Business District 2 per AMC §20.36.100 (zoning map). Per AMC Table 20.40-2, the proposed uses (Use 2.210, high- volume traffic generation sales, use 3.122 2nd floor or higher office, use 8.200 restaurant with no carry out or drive in, and use 5.400 social, fraternal clubs) are permitted uses. (The applicant proposes to use the basement in the future for classes, dances, music, etc — essentially a meeting hall. The closest approximation of this use in the Table of Permissible Uses in terms of impacts is use class 5.400.) 3. Density and Dimensional Standards: Per AMC Table 20.48-4, Density and Dimensional Standards, the proposed development complies with the following standards for the Old Town Business District 2 zone: minimum lot size (0) and lot boundary setbacks (5 feet) and with maximum building height (50 feet) and lot coverage (100 percent). However, it does not comply with minimum lot width (60 feet) or maximum street setback (0 feet), but the lot and building are legal nonconforming. 4. Non-residential Performance Standards: Per AMC Chapter 20.44 Part III, the proposed development must comply with the performance/operation standards for noise, vibration, odors, smoke and air pollution, disposal of liquid and hazardous wastes, water consumption, electrical disturbance or interference, lighting, and site and building maintenance. Design: Per AMC §20.46.010, developments in the Old Town Business District 2 zone shall conform to the applicable guidelines or standards set forth in the Design Guidelines. However, since no exterior modifications are proposed, the project is not subject to design review as no exterior remodeling is proposed. 6. Off-street Parking: Per AMC Table 20.72-6, the required parking for the proposed uses is 32 spaces (see table below) for the uses on the 1" and 2"d floors, and 42 spaces for the future proposed use of the basement. No loading space is required because the normal operation does not require goods, merchandise, or equipment be routinely delivered to or shipped from the development (AMC §20.72.100). The previous use had no parking associated with it, and the proposed site plan shows 0 parking spaces. Per AMC §20.72.020, it has been determined that no new parking spaces are required to accommodate the high- volume retail, restaurant, or office space as much of the business is anticipated to be teens and preteens, who do not drive, and therefore the business caters primarily to walk-in trade. Additionally, the building is adjacent to the OTBD-1 zone, where parking for non-residential uses is not required; it is impossible to provide additional parking in this area, which is already built-out; it would allow for redevelop of a use that has been vacant for many year; and public parking is available in the area. However, at the time the applicant proposes to convert the basement into the social/fraternal club (5.400) parking for that use will be required. Streets and Sidewalks: The proposed development is located on the north side of Division Street and east of the Burlington Northern Santa Fe railroad tracks/Centennial Trail. It is anticipated that this project will add 5 PM-peak-hour trip (20 existing PM-peak-hour trips) to the street system as well as pedestrian and bicycle trips. The site will be accessed off of Division Street for pedestrian traffic and the alley via Gilman Street for vehicular traffic. (Note: Though the building was originally built and used as a church, evidence has been provided that it housed the Arlington Boys' and Girls' Club for approximately 3 years. Thus, existing PM peak hour trips is now being calculated using recreation as a baseline use.) a. Frontage Improvements - To mitigate safety impacts and provide both vehicular and pedestrian access to the project, AMC §20.56.170 provides that no permit may be issued for a project unless and until all roads on which the project fronts are developed to their full 3/4-street standards. The ordinance provides for various ways for this to happen. In this instance, frontage improvements have already been constructed on Division Street; no further frontage or alley improvements are required. b. Impact Fees — To mitigate impacts to the City's overall transportation system, AMC §20.90.040 requires the developer to pay transportation impact fees for each new p.m.-peak-hour trip (5 new PM-peak-hour trips and 20 existing PM-peak-hour trips). The fee shall be that fee in effect at the time of payment. (NOTE: The current transportation impact fee is $1,038.00 for each p.m.-peak-hour trip, but this may change.) City transportation impact fees shall be paid prior to issuance of any building permits. 9. Stormwater Management: Per AMC §20.64.300, all stormwater systems shall be in compliance with Arlington Municipal Code Chapter 13.28, Stormwater Management, and the most current edition of the Department of Ecology's Stormwater Management Manual for the Puget Sound Basin (The Technical Manual). However, as no new impervious surfaces are being created, not additional stormwater facilities are required. 10. Environmentally Critical Areas: Per AMC Chapter 20.88, the site does not lie within any known environmentally critical areas. 11. Groundwater Resources: Per Figure NF-2 of the Comprehensive Plan, the site does not lie within the Arlington Aquifer Recharge Area. 12. Potential Cultural Resources: The Stillaguamish Tribe has expressed concern about potential cultural resources in the area where the proposed project will occur. If any archaeological materials are discovered on the site, the State Historical Preservation Officer, the Stillaguamish Tribe, and the City of Arlington shall be contacted and measures taken to preserve the materials and the site. 13. Airport Management: The Arlington Municipal Airport requires that street lamps or light poles located on the property be down-shielded as to avoid interfering with flight operations. 14. Water and Sanitary Sewer: Adequate water and sewer service is available to the site from the City of Arlington; utility services, fire hydrants and fire protection are \\coaadminl\planning\ypage\Alamo Amendment A-06-033\Alamo Minor Modification.doc 6/27/06 Page 4 of 6 I i i Zoning Permit Minor Modification June 27, 2006 Alamo Z-05-080-MM required and will be reviewed when site civil construction drawings are submitted. All existing and planned utilities shall be shown on the site civil construction drawings. All utilities shall be operational prior to building occupancy. E. CONCLUSIONS 1. The City of Arlington Comprehensive Plan identifies this area as Old Town Business District 2 and the subject property is zoned Old Town Business District 2 per AMC §20.36.100 (zoning map). Per AMC Table 20.40-2, the proposed uses ((Use 2.210, high-volume traffic generation sales; use 3.122, 2nd floor or higher office; use 8.200, restaurant with no carry out or drive in; and use 5.400, social/fraternal clubs) are permitted uses. Therefore, the proposed development as noted and conditioned is consistent with policies governing those types of uses and is allowed in that zone. 2. The requested zoning permit, as conditioned, is consistent with all AMC requirements, permit processing procedures, and all other applicable codes. 3 The zoning permit should be approved subject to conditions noted below. F. CONDITIONS The applicant shall meet the following required conditions in order to receive approval for the zoning permit. 1. All development shall be in substantial conformance with the approved site plan received on June 1, 2006, subject to any conditions or modifications that may be required as part of the zoning permit and site civil construction plan review. 2. Prior to issuance of a building permit, the applicant shall file a drainage plan and site civil construction plans, which meet the following conditions, in conjunction with a building permit application. The final site plan shall comply with all requirements of the Land Use Code, International Building Code, International Fire Code, and Public Works Construction Standards and Specifications. 3. The developer shall meet all local, state, or federal code requirements. Attached is a list of code requirements that are specifically called to the developer's attention. It is in no way intended to be a complete list of code requirements but a general checklist of major steps and issues. Please refer to the AMC for a complete list of code requirements for your particular project type. 4. Prior to issuance of a certificate of occupancy or building permit (whichever comes first) the developer shall submit payment of the following estimated City of Arlington impact fees (based on an 8,124 square foot building): Traffic at $1,038.00 per new p.m.-peak-hour trip, which is 5, or $5,190.00. Per AMC §20.16.220, this zoning permit shall expire automatically one year of the below date of approval if the use is not commenced or if less than 10 percent of the total construction cost has been completed. 8. The basement may not be used except as storage for tenants within the building until adequate parking is provided and other proper improvements have been applied for, permitted, inspected, and approved by the City of Arlington. 9. The applicant will need to meet all pretreatment requirements for wastewater, which may include the installation of grease interceptor and hair traps. 10 Each business within the building will be required to provide an equipment list and show where they connect to the water supply. Fixture isolation assemblies may be required. G. APPEALS Per AMC §20.20.010, to appeal this decision, an appeal application must be filed, with all required fees, within 14 days of the date of issuance of this permit. The Hearing Examiner would hear the appeal of the permit, and his/her decision is appealable to the City Council, The Council's decision would be considered the City's final decision on the underlying governmental action. Prior to commencing any site work, including installing any easement or right-of-way improvements, utility systems, drainage systems, street lights, mailbox structures, emergency facilities, storm water control systems, or any other improvements, the developer shall submit site civil construction improvement plans for review and approval by the Department of Development Services, Engineering Division. Said plans shall be in conformance with applicable code and below listed conditions. a. The developer shall survey and mark all property corners prior to review of any submitted construction plans. b. The developer shall design and install erosion control measures deemed necessary by the City. These measures shall be installed and inspected by the City prior to the issuance of any permits. C. The developer shall undertake no site preparation or other disturbances within environmentally sensitive areas or their required buffers. d. Install a potable water system to serve the project per City of Arlington's Engineering requirements. Water is to be served by the City of Arlington. Relocate any existing water facilities and/or install water services/fire hydrants at the expense of the developer. d. Install a sanitary sewer system per Engineering Division requirements. Per AMC Table 20.40-2, the proposed uses (Use 2.210, high- volume traffic generation sales, use 3.122 2"d floor or higher office, use 8.200 restaurant with no carry out or drive in, and use 5.400 social, fraternal clubs) are permitted uses. (The applicant proposes to use the basement in the future for classes, dances, music, etc - essentially a meeting hall. The closest approximation of this use in the Table of Permissible Uses in terms of impacts is use class 5.400.) 3. Density and Dimensional Standards: Per AMC Table 20.48-4, Density and Dimensional Standards, the proposed development complies with the following standards for the Old Town Business District 2 zone: minimum lot size (0) and lot boundary setbacks (5 feet) and with maximum building height (50 feet) and lot coverage (100 percent). However, it does not comply with minimum lot width (60 feet) or maximum street setback (0 feet), but the lot and building are legal nonconforming. 4. Off-street Parking: Per AMC Table 20.72-6, the required parking for the proposed uses is 32 spaces (see table below) for the uses on the 1s` and 2nd floors, and 42 spaces for the future proposed use of the basement. No loading space is required because the normal operation does not require goods, merchandise, or equipment be routinely delivered to or shipped from the development (AMC §20.72.100). The previous use had no parking associated with it, and the proposed site plan shows 0 parking spaces. Per AMC §20.72.020, it has been determined that no new parking spaces are required to accommodate the high- volume retail, restaurant, or office space as much of the business is anticipated to be teens and preteens, who do not drive, and therefore the business caters primarily to walk-in trade. Additionally, the building is adjacent to the OTBD-1 zone, where parking for non-residential uses is not required; it is impossible to provide additional parking in this area, which is already built-out; it would allow for redevelop of a use that has been vacant for many year; and public parking is available in the area. However, at the time the applicant proposes to convert the basement into the social/fraternal club (5.400) parking for that use will be required. Streets and Sidewalks: The proposed development is located on the north side of Division Street and east of the Burlington Northern Santa Fe railroad tracks/Centennial Trail. It is anticipated that this project will add 5 PM-peak-hour trip (20 existing PM-peak-hour trips) to the street system as well as pedestrian and bicycle trips. The site will be accessed off of Division Street for pedestrian traffic and the alley via Gilman Street for vehicular traffic. (Note: Though the building was originally built and used as a church, evidence has been provided that it housed the Arlington Boys' and Girls' Club for approximately 3 years. Thus, existing PM peak hour trips is now being calculated using recreation as a baseline use.) a. Frontage Improvements - To mitigate safety impacts and provide both vehicular and pedestrian access to the project, AMC §20.56.170 provides that no permit may be issued for a project unless and until all roads on which the project fronts are developed to their full 3/4-street standards. The ordinance provides for various ways for this to happen. In this instance, frontage improvements have already been constructed on Division Street; no further frontage or alley improvements are required. b. Impact Fees — To mitigate impacts to the City's overall transportation system, AMC §20.90.040 requires the developer to pay transportation impact fees for each new p.m.-peak-hour trip (5 new PM-peak-hour trips and 20 existing PM-peak-hour trips). The fee shall be that fee in effect at the time of payment. (NOTE: The current transportation impact fee is $1,038.00 for each p.m.-peak-hour trip, but this may change.) City transportation impact fees shall be paid prior to issuance of any building permits. 9. Stormwater Management: Per AMC §20.64.300, all stormwater systems shall be in compliance with Arlington Municipal Code Chapter 13.28, Stormwater Management, and the most current edition of the Department of Ecology's Stormwater Management Manual for the Puget Sound Basin (The Technical Manual). However, as no new impervious surfaces are being created, not additional stormwater facilities are required. 10. Environmentally Critical Areas: Per AMC Chapter 20.88, the site does not lie within any known environmentally critical areas. 11. Groundwater Resources: Per Figure NF-2 of the Comprehensive Plan, the site does not lie within the Arlington Aquifer Recharge Area. 12. Potential Cultural Resources: The Stillaguamish Tribe has expressed concern about potential cultural resources in the area where the proposed project will occur. If any archaeological materials are discovered on the site, the State Historical Preservation Officer, the Stillaguamish Tribe, and the City of Arlington shall be contacted and measures taken to preserve the materials and the site. 13. Airport Management: The Arlington Municipal Airport requires that street lamps or light poles located on the property be down-shielded as to avoid interfering with flight operations. 14. Water and Sanitary Sewer: Adequate water and sewer service is available to the site from the City of Arlington; utility services, fire hydrants and fire protection are \\coaadminl\planning\ypage\Alamo Amendment A-06-033\Alamo Minor Modification.doc 6/27/06 Page 4 of 6 1 Zoning Permit Minor Modification June 27, 2006 Alamo Z-05-080-MM required and will be reviewed when site civil construction drawings are submitted. All existing and planned utilities shall be shown on the site civil construction drawings. All utilities shall be operational prior to building occupancy. E. CONCLUSIONS 1. The City of Arlington Comprehensive Plan identifies this area as Old Town Business District 2 and the subject property is zoned Old Town Business District 2 per AMC §20.36,100 (zoning map). Per AMC Table 20.40-2, the proposed uses ((Use 2.210, high-volume traffic generation sales; use 3.122, 2nd floor or higher office; use 8.200, restaurant with no carry out or drive in; and use 5.400, social/fraternal clubs) are permitted uses. Therefore, the proposed development as noted and conditioned is consistent with policies governing those types of uses and is allowed in that zone. 2. The requested zoning permit, as . conditioned, is consistent with all AMC requirements, permit processing procedures, and all other applicable codes. 3. The zoning permit should be approved subject to conditions noted below. F. CONDITIONS The applicant shall meet the following required conditions in order to receive approval for the zoning permit. 1. All development shall be in substantial conformance with the approved site plan received on June 1, 2006, subject to any conditions or modifications that may be required as part of the zoning permit and site civil construction plan review. 2 Prior to issuance of a building permit, the applicant shall file a drainage plan and site civil construction plans, which meet the following conditions, in conjunction with a building permit application. The final site plan shall comply with all requirements of the Land Use Code, International Building Code, International Fire Code, and Public Works Construction Standards and Specifications. 3. The developer shall meet all local, state, or federal code requirements. Attached is a list of code requirements that are specifically called to the developer's attention. It is in no way intended to be a complete list of code requirements but a general checklist of major steps and issues. Please refer to the AMC for a complete list of code requirements for your particular project type. 4. Per AMC §20.16.220, this zoning permit shall expire automatically one year of the below date of approval if the use is not commenced or if less than 10 percent of the total construction cost has been completed. 8. The basement may not be used except as storage for tenants within the building until adequate parking is provided and other proper improvements have been applied for, permitted, inspected, and approved by the City of Arlington. 9. The applicant will need to meet all pretreatment requirements for wastewater, which may include the installation of grease interceptor and hair traps. 10. Each business within the building will be required to provide an equipment list and show where they connect to the water supply. Fixture isolation assemblies may be required. G. APPEALS Per AMC §20.20.010, to appeal this decision, an appeal application must be filed, with all required fees, within 14 days of the date of issuance of this permit. The Hearing Examiner would hear the appeal of the permit, and his/her decision is appealable to the City Council. The Council's decision would be considered the City's final decision on the underlying governmental action. H. The developer shall survey and mark all property corners prior to review of any submitted construction plans. b.
