The following applicable code data corrections and/or additional requirements are necessary before the permit can be issued. Conditions of Land Use Permit 1. All development shall be in substantial conformance with the approved land use development site plan received August 10, 2004, subject to any conditions or modifications that may be required as part of the site civil drawing review set. 2. The developer shall submit payment of the following estimated city of Arlington impact fees (based on approximately 3,000 square foot vehicle sales building): Traffic at $1,038.00 per p.m. peak-hour trip, which is 73, or$75,774.00. 3. The developer shall pay transportation impact fees to Snohomish county and WSDOT, and the developer shall submit to the City of Arlington proof of payment of the required fees. 4. The developer shall dedicate to the City of Arlington a Critical Area Protection Easement (CAPE) per the approved mitigation plan by Hydro Terra dated June 25, 2004, received by the City of Arlington on July7, 2004. The signed CAPE shall be submitted to the city of Arlington to be recorded prior to issuance of a building permit. No development shall occur within said buffer. 5. All conditions of the Premier Pacific Properties Special Use Permit (File S-023) shall apply to the development of the property. Utility Corrections 1. Sheet 3 Note 22 should be corrected to "per current City of Arlington Standards". Sheet 3 Note 18 references a 1 '/2" or 2" meter. The correct sizing and location of the meter should be shown on the drawings. 3. A reduced Pressure Backflow Assembly shall be installed immediately after the water meter per city standard; provided with freeze protection. Alternatively, the RPBA may be installed inside the building in a mechanical room if adequate room can be provided for testing, maintenance, repair, and drainage. The RPBA shall appear on the State of Washington Department of Health list of approved assemblies. �5: The RPBA shall be tested by a State of Washington certified Backflow Assembly Tester, at the owner's expense. 6. The RPBA Test Report shall be submitted to the City of Arlington Water Department prior to an inspection. Final inspection must be completed by the Water Department. 7. Additional fixture isolation assemblies may be required upon final inspection. 8. Inspections are required at the following points of construction; a. Prior to covering interior piping connected to a backflow assembly. b. Prior to covering underground piping connecte3d to a backflow assembly. c. Prior to requesting a final inspection by the Building Department. 9. If a landscape irrigation system is installed a separate meter is required along with a Double Check Valve Assembly (DCVA) installed after the meter per the City of Arlington Standard W-13. The location and sizing of the meter should be indicated on the drawings. 10. A monitoring manhole is required per City of Arlington Standards. ,11. Sheet 3 shows a water meter on the sanitary sewer line. This should be corrected. 12. The garage area should be identified to what the use will be. Repair garage, storage garage, or parking garage. The drawings should be corrected. 13. A completed City of Arlington Cross Connection Survey and Industrial/Commercial Waste Discharge Permit Application must be submitted to the Utilities Department. Fire Corrections 1. The minimum fire flow requirement is 1500 gpm. One fire hydrant shall be required at a location determined by the Fire Chief. 2. It appears that the garage area may be used as a repair garage. A repair garage is not allowed unless the building is fully sprinklered. The use of the garage area should be identified on the drawings. 3. Fire extinguishers are required at locations to be determined by the Fire Chief. Airport Corrections 1. Because of the sites proximity to the Arlington Airport the use of spot lights, kites, balloons and other similar devices are prohibited as it has the potential to interfere with flight operations. The FAA Code of Federal Regulations, Part 101 regulates these types of uses. 2. Any equipment in excess of 26 feet in height shall be required with markings during the construction of the project. Now that we know that the kK fronting We is going to be occupied by a car sales business we do have some concerns about the possible use of balloons during the day and spotlights at night to attract customers (we have seen this done by other car dealers). Because of the site's proximity to the airport the use of spotlights is prohibited as it has the potential to interfere with flight operations. The FAA in their Code of Federal Regulation (CFR)Part 101, a copy of which is attached, regulates any use of balloons or kites. The car sales business will need to make sure that they are abiding by that regulation, and by the existing avigation easement over the property. 2. Because of the site's proximity to the Airport we require the contractor to supply markings for any tall construction equipment such as cranes that may be used. The markings supplied should be flags, minimum size 3' x 3' in dimension with an international orange and white checkerboard pattern utilizing 1'x 1'squares. The flags need to be placed on the highest part of the equipment to serve as a visual warning to pilots. Any equipment such as cranes needs to be lowered at night. 3. Because the site is adjacent to the airport we do have an existing a0lg ition easement limiting the height of structures on the property. NOW, THEREFORE, the Developer and the State hereby agree to do the following: . DEVELOPER'S RESPONSIBILITIES 1. The Developer has been offered the option of constructing improvements to State highway facilities to mitigate the identified impacts thereto, and has elected to pay a pro- rata share of the cost of the mitigation in lieu of constructing the improvements. C. ENVIRONMENTAL REVIEW An MDNS was issued on August 4, 2004, with a 14-day comment period; no comments were received during the comment period. Mitigation measures from the MDNS are included as conditions to this project (see Section G, CONDITIONS). D. BACKGROUND The subject special use permit application was received by the City of Arlington on April 5, 2004, and the application was deemed complete on April 12, 2004. Some of it was received on July 7, 2004 and August 10, 2004, and the remainder on September 21, 2004. E. FINDINGS OF FACT 1. Application Process: The special use permit application was received by the City of Arlington on April 5, 2004. The application was deemed complete on April 12, 2004. Per AMC §20.16.140, decisions on special use permits are made by the planning manager unless an interested party requests a hearing. A written request for a hearing was received during the Notice of Application review period; however, that request was withdrawn, so no hearing will be held. 2. Comprehensive Plan. Zoning. and Permissible Uses: The City of Arlington Comprehensive Plan identifies this area as Airport Restricted and Light Industrial. However, the subject property is zoned General Commercial and Light Industrial per AMC §20.36.100 (zoning map). Per AMC Table 20.40-2, the proposed uses (Use 9.110, motor vehicle sales; Use 2.111, high-volume traffic generation sales; and Use 4.120, manufacturing, assembling, warehousing of goods) are a permitted use. Pursuant to Western Washington Growth Hearings Board case Citizens v Mount Vernon, 133 W.2d 861 (1997), the zoning code prevails where there is an inconsistency between it and the Comprehensive Plan. The Comprehensive Plan should be revised to reflect the General Commercial and Light Industrial zoning that exists in the area. 3. Density and Dimensional Standards: Per AMC Table 20.48-4, Density and Dimensional Standards, the proposed development complies with the following standards for the General Commercial zone: minimum lot size (none), width (70 feet), street setback (25 feet), and lot boundary setbacks (5 feet) and with maximum building height (45 feet) and lot coverage (100 percent); and for the Light Industrial zone: minimum lot size (10,000 square feet), width (70 feet), street setback (25 feet), and lot boundary setbacks (5 feet) and with maximum building height (50 feet) and lot coverage (100 percent). 4. Non-residential Performance Standards: Per AMC Chapter 20.44 Part III, the proposed development must comply with the performance/operation standards for noise, vibration, odors, smoke and air pollution, disposal of liquid and hazardous wastes, water consumption, electrical disturbance or interference, lighting, and site and building maintenance. Per AMC §20.60.490, every development is required to provide a dumpster; the site plan shows at least one dumpster at each building, which meets this requirement. 5. Design: Per AMC §20.46.010, developments in the General Commercial and Light Industrial zones shall conform to the applicable guidelines or standards set forth in the Design Guidelines. On August 17, 2004, the Design Review Board reviewed the design of this development. The Design Review Board determined \\Engineering\Planning User Documents\ypage\Premier Pacific Properties SO4-023\Premier Recording Permit S-04-023.doc kjr; 10/15/2004 Page 3 of 9 Special Use Permit October 15, 2004 Premier Pacific Properties S-04-023 that the project meets the required design review guidelines, with the condition that the applicant work with City staff and determine an approved fence material for the adjacent single-family residence pursuant to the Land Use Code and Design Review Decision dated August 18, 2004. 6. Off-street Parking: Per AMC Table 20.72-6, the required parking for the proposed use is as follows: Building 1 (Use 9.110, motor vehicle sales),1 space per 200 square feet of gross floor area (GFA), which is 3,000 square feet, for 15 spaces; Building 2 (Use 2.111, high-volume traffic generation sales), 1 space per 200 square feet of GFA, which is 7,500 square feet, for 38 spaces; Building 3 (Use 2.111, high-volume traffic generation sales), 1 space per 200 square feet of GFA, which is 9,600 square feet, for 48 spaces; and Building 4 (Use 4.120, manufacturing, assembling, warehousing of goods), 1 space per employee on the maximum shift, which the applicant states is 80, for 80 spaces. The proposed site plan shows 51 parking spaces, 2 of which are handicap accessible, for Building 1 (which includes the spaces for the sales vehicles); 43 parking spaces, 2 of which are handicap accessible, for Building 2; 51 parking spaces, 2 of which are handicap accessible, for Building 3; and 86 parking spaces, 6 of which are handicap accessible, for Building 4. This meets the minimum requirements. Per AMC §20.72.100, no loading space is required for the Buildings 1, 2, or 3 because the normal operation does not require that goods, merchandise, or equipment be routinely delivered to or shipped from them. The loading space requirement for Building 4 is 3 spaces for the 58,000 square feet of gross floor area. The proposed site plan shows 5 loading spaces. This meets the minimum requirements. 7. Screening and Trees: Per AMC Table 20.76-9, no screening is required between the various sales uses, but the required screening between the manufacturing/ assembling/warehousing of goods use and the adjacent sales use is Type A, which requires a minimum of 5 feet of Opaque Screen along adjacent borders. The required screening for the single-family residence (located in the corner where the property widens at the Light Industrial zone) between the adjacent manufacturing/assembling/warehousing use and the adjacent sales use is also Type A. The required screening for the adjacent streets is Type C, which requires a minimum of 10 feet of Intermittent Screen along all street frontages. Per AMC §20.76.130, a minimum of 20 percent of the vehicle accommodation area must be shaded. (NOTE: Screen types are described in AMC §20.76.040, and suggested planting patterns to achieve the required standards are included in the Public Works Construction Standards and Specifications.) The landscape plan reflects sufficient frontage and parking area landscaping to meet the general landscape requirements specified in AMC Chapter 20.76. The final site plan shall comply with the requirements of AMC Chapter 20.76. Streets and Sidewalks: The proposed development is located on the southwest corner of 172"d Street NE/SR 531 and 59th Drive NE. It is anticipated that this project will add 1,016 average daily trips, which includes 73 p.m.-peak-hour trips (the traffic study anticipated 69 p.m.-peak-hour trips but the City's traffic consultant determined that the car sales generated 6, not 2, p.m.-peak-hour trips), to the street system as well as pedestrian and bicycle trips. The site will be accessed from 172n Street NE/SR 531 and 59th Drive NE. a. Frontage Improvements - To mitigate safety impacts and provide both vehicular and pedestrian access to the project, AMC §20.56.170 provides that no permit may be issued for a project unless and until all roads on which the project fronts are developed to their full '/z-street standards. The AMC provides for various ways for this to happen. The applicant is proposing frontage improvements on 172nd Street NE/SR 531 and 59th Drive NE, which must be done in accordance with the Public Works construction standards for an Arterial/State Highway and Arterial street. Improvements satisfying this requirement shall be shown on the site civil construction drawings. b. Impact Fees — To mitigate impacts to the City's overall transportation system, AMC §20.90.040 requires the developer to pay transportation impact fees for each new p.m.-peak-hour trip (73 p.m.-peak-hour trips). The fee shall be that fee in effect at the time of payment. (NOTE: The current transportation impact fee is $1,038.00 for each p.m.-peak-hour trip, but this may change.) City transportation impact fees shall be paid prior to issuance of any building permits. c. State and County Facilities— Pursuant to the SEPA MDNS, transportation mitigation fees shall be paid to WSDOT, and pursuant to the City's Reciprocal Traffic Mitigation Interlocal Agreement, transportation mitigation fees shall be paid to Snohomish County for this project's proportionate share of average daily trips and their impacts to state and county transportation facilities. The developer shall submit proof of payment of the required fees prior to issuance of any building permits. 9. Stormwater Management: Per AMC §20.64.300, all stormwater systems shall be in compliance with AMC Chapter 13.28, Stormwater Management, and the Department of Ecology's Stormwater Management Manual for the Puget Sound Basin (The Technical Manual). A preliminary review of the system indicates that they have a conceptually feasible plan. A detailed drainage review will occur during the site civil construction review process. 10. Environmentally Critical Areas: There is a stream and wetland located in the southeast corner of the site. To mitigate potential impacts to the stream and wetland and buffer, per AMC Chapter 20.88 and the project MDNS, the developer shall dedicate to the City of Arlington a Critical Area Protection Easement (CAPE) per the approved mitigation plan by Hydro Terra dated June 25, 2004, received by the City of Arlington on July 7, 2004. No development shall occur within said buffer. 11. Groundwater Resources: The site lies within the Quilceda/Allen watershed recharge area. The groundwater in this area is part of the Quilceda Reservoir. The applicant shall apply Best Management Practices for the protection of the aquifer recharge area that adequately protects this groundwater resource. 12. Potential Cultural Resources: The Stillaguamish Tribe has expressed concern about potential cultural resources in the area where the proposed project will occur. If any archaeological materials are discovered on the site, the State Historical Preservation Officer, the Stillaguamish Tribe, and the City of Arlington shall be contacted and measures taken to preserve the materials and the site. 13. Airport Management: The Arlington Municipal Airport requires that street lamps or light poles located on the property be down-shielded as to avoid interfering with flight operations. 14. Water and Sanitary Sewer: Adequate water and sewer service is available to the site from the City of Arlington (utility extensions may be required); utility services, fire hydrants and fire protection are required and will be reviewed when construction drawings are submitted. All existing and planned utilities shall be shown on the site civil construction drawings. Water and sanitary sewer general facility charges may be assessed when construction drawings are submitted. All fees shall be paid before connection is made to the water or sanitary sewer utility. All utilities shall be operational prior to building certificate of occupancy. F. CONCLUSIONS 1. The City of Arlington Comprehensive Plan identifies this area as being Airport Restricted and Airport Industrial. However, the subject property is zoned General Commercial and Light Industrial per AMC §20.36.100 (zoning map). Per AMC Table 20.40-2, the proposed uses (Use 9.110, motor vehicle sales; Use 2.111, high-volume traffic generation sales; and Use 4.120, manufacturing, assembling, warehousing of goods) are a permitted use. Therefore, the proposed development as noted and conditioned is consistent with policies governing those types of uses and is allowed in the General Commercial and Light Industrial zones. 2. The requested special use permit, as conditioned, is consistent with all AMC requirements, permit processing procedures, and all other applicable codes. 3. CONDITIONS The applicant shall meet the following required conditions in order to receive approval for the special use permit. 1. All development shall be in substantial conformance with the approved site plan received August 10, 2004, subject to any conditions or modifications that may be required as part of the special use permit and site civil construction plan review. 2. Prior to issuance of a building permit, the applicant shall file a drainage plan and site civil construction plans, which meet the following conditions, in conjunction with a building permit application. The final site plan shall comply with all requirements of the Land Use Code, International Building Code, Uniform Fire Code, and Public Works Construction Standards and Specifications. 3. The developer shall meet all local, state, or federal code requirements. Attached is a list of code requirements that are specifically called to the developer's attention. It is in no way intended to be a complete list of code requirements but a general checklist of major steps and issues. Please refer to the AMC for a complete list of code requirements for your particular project type. 4. The developer shall install frontage improvements along 172nd Street NE/SR 531 and 59th Drive NE per Public Works construction standards and specifications for an Arterial/State Highway and Arterial street, respectively. Improvements satisfying this requirement shall be shown on the site civil construction drawings. 5. Prior to issuance of a grading or building permit, the developer shall submit payment of the following estimated City of Arlington impact fees [based on 3,000 square foot vehicle sales (.Building 4), 7;500 square foot retail (Building 3), 9,600 square foot retail (Building 2), and 56,000 square foot warehouse/manufacturing (Building 1)]: Traffic at $1,038.00 per p.m.-peak-hour trip, which is 73, or $75,774.00, distributed as follows: Building 4, 6 trips, or $6,228.00; Building 3, 21 trips, or $21,798.00; Building 2, 18 trips,l or $18,684.00; and Building 1, 28 trips, or�$29,064.00. (NOTE: Actual impact fees due are those as set by resolution at the time the fees are paid. These amounts are provided here as an estimate. They may either increase or decrease by the time they are paid.) 6. Prior to issuance of a building permit, the developer shall pay transportation impact fees to WSDOT and Snohomish County for this project's proportionate share of average daily trips, and the developer shall submit to the City of Arlington proof of payment of the required fees. 7. The developer shall dedicate to the City of Arlington a Critical Area Protection Easement (CAPE) per the approved mitigation plan by Hydro Terra dated June 25, 2004, received by the City of Arlington on July 7, 2004. If any archaeological materials are discovered on the site, the developer shall contact the State Historical Preservation Officer, the Stillaguamish Tribe, and the City of Arlington and take measures to preserve the materials and the site. 10. If new chain link fencing is to be installed on the property, the developer shall install black vinyl coated chain link fencing. 11. Prior to issuance of a building permit, the developer shall clear all outstanding Planning Division and Engineering Division permit-processing accounts with the City. 12. Per AMC §20.16.220, this special use permit shall expire automatically one year of the below date of approval if the use is not commenced or if less than 10 percent of the total construction cost has not been completed. H. APPEALS Per AMC §20.20.010, to appeal this decision, an appeal application must be filed, with all required fees, within 14 days of the date of issuance of this permit. The Hearing Examiner would hear the appeal of the permit and his/her decision would be considered the City's final decision on the underlying governmental action. I.
