BACKGROUND The subject minor development permit review application was received by the City of Arlington on August 3, 2000, and the application was deemed complete on August 28, 2000. Additional information was requested on September 15, 2000, and was received on October 13, 2000. A Notice of Application and Mitigated Determination of Nonsignificance (MDNS) was published, posted, and mailed on October 18, 2000. V. FINDINGS OF FACT 1. Application Process: The minor development permit application was received by the City of Arlington on August 3, 2000. The application was deemed complete on August 28, 2000. A minor development permit is an administrative review process per City of Arlington Uniform Development Code (UDC) Chapter VII, Sections CA and C.S. 2. Comprehensive Plan and Zoning: The City of Arlington Comprehensive Plan identifies this area as being Industrial, and the subject property is zoned Industrial per UDC Chapter III, zoning map, Page III-2. Storage/distribution facilities are a permitted use per UDC Chapter V, Section I. 3. Lot Dimensions, Density and Related Requirements: The proposed development complies with the minimum lot dimensions for storage/distribution facilities (1 acre in size and 100-foot minimum width) and yard setbacks (front 25 feet, rear 20 feet, and each side 20 feet) and with maximum building height (50 feet). Lot coverage is not applicable in the Industrial zone. 4. Non-residential Performance Standards: The proposed development must comply with the standards of performance for noise, lighting, odors and gases, particular matter, electrical interference, hazardous materials storage, waste disposal, open storage, maintenance and alterations, and hazardous waste facilities per UDC Chapter IX, Section 13.2. 5. Off-Street Parking: The proposed use as calculated per UDC Chapter IX, Section CA Parking Requirements, requires 16 parking spaces, at 3.6 spaces per 1,000 square feet of gross floor area for the office area, which is 5,650 square feet, and 1 space per 1,000 square feet of gross floor area for the storage/distribution area, which is 10,800 square feet, plus 1 loading space at 1 space for each 20,000 square feet and 1 dumpster space. Landscaping: The final site plan shall comply with the requirements of UDC Chapter IX, Section N, Landscaping. The required landscaping for a storage/distribution use is Category C, which requires 10 feet of Type III landscaping adjacent to all street frontages. The landscape requirement for the parking area is a minimum of 17-1/2 square feet of landscaping for each parking stall for the first 50 spaces per Chapter IX, Section N.7. The landscape plan reflects sufficient frontage and parking area landscaping to meet the general landscape requirements specified in Chapter IX, Section N.7. Plant material must be guaranteed for one year with any replacements guaranteed for one year also. 7. Transportation: The proposed development is located at 18930 66th Avenue NE, Arlington. The site will access off of 66th Avenue NE. It is anticipated to add approximately 40 average weekday daily vehicular trips, which includes 4 p.m.- peak-hour trips, to the street system. Transportation mitigation fees shall be paid to WSDOT to mitigate the traffic impact from this development to state roads at $1,472.32, to Snohomish County for impacts to county roads at $2,412.00 and to the City of Arlington at $1,038.00 for each p.m.-peak-hour trip, or $4,152.00. A letter reflecting payment of the required fees shall be received prior to issuance of the building permit. 8. Stormwater Management: The City has adopted storm drainage requirements per Arlington Municipal Code Chapter 16.10, Stormwater Management, and the Department of Ecology's Stormwater Management Manual for the Puget Sound Basin (The Technical Manual). Site plan drawings with a proposed drainage system have been submitted. A preliminary review of the system indicates that it will probably work. Per City of Arlington Ordinance 1216, there shall be a payment of storm water system development fees to the City of Arlington at $374.00 per 2,000 square feet of impervious surface area. 9. Critical Areas: The site contains no identified environmentally sensitive areas. 10. Groundwater Resources: Best Management Practices will be applied for the protection of the aquifer recharge area underlying this site. 11. Park Mitigation and Impact Fees: The project will employ 6 people, who will use the City's park system. Per UDC Chapter XI, Section B.4, there shall be a payment of 5 cents ($0.05) per square foot of land per approved site plan. 12. Airport Management: The Arlington Municipal Airport requires that street lamps or light poles located on the property be shielded as to avoid interfering with flight operations. In addition, a 15-foot access easement was granted from the Airport to Thomco Industrial; this was granted on the condition that Thomco Industrial (or any future owners) must maintain that 15-foot easement. 13. Water and Sanitary Sewer: Adequate water and sewer service is available to the site from the City of Arlington; utility services to the building and fire hydrants and fire protection as required will be reviewed when construction drawings are submitted. Criteria for Approval of an Application and Issuance of a Permit: Per UDC Chapter VII, Section D, Criteria for Approval, the Department of Planning and Community Development is required to review for compliance the following criteria before an application can be approved. a. The development is consistent with the dimensional, density requirements and Performance Standards of the UDC and other applicable laws and regulations; and Staff Analysis: As identified above, the development is consistent with the dimensional, density requirements and Performance Standards of the UDC and other applicable laws and regulations. b. The development as proposed incorporates, to the maximum extent feasible, mitigation measures to substantially lessen or eliminate all adverse environmental impacts of the development; and Staff Analysis: The development as proposed incorporates, to the maximum extend feasible, best management practices to lessen or eliminate all adverse environmental impacts of the development. C. The applicant has presented certification that the applicant has filed and paid all the taxes, penalties and interest, and that the applicant has satisfactorily made agreement to pay the taxes (NOTE: this requirement is only applicable to subdivision plats); and Staff Analysis: This requirement is only applicable to subdivision plats. d. Prior to final approval the applicant has followed all permit processing procedures and paid all applicable land use fees. Staff Analysis: As stated above, all permit processing procedures have been followed and a condition is included that requires that all applicable land use fees be paid prior to final decision. VI. CONCLUSIONS 1. The City of Arlington Comprehensive Plan identifies this area as Industrial, and the subject property is zoned Industrial per UDC Chapter III, zoning map, Page III-2. A storage/distribution facility is a permitted use in the Industrial zone per UDC Chapter V, Section I. Therefore, the proposed development as noted and conditioned is consistent with policies governing industrial uses and is allowed in the Industrial zone. 2. The requested minor development permit as conditioned meets all UDC requirements, including Chapter VII, Section D, Criteria for Approval, and all other applicable codes. 3. DECISION The minor development permit is hereby APPROVED, subject to the following conditions: 1. All development shall be in substantial conformance with the approved site plan dated October 13, 2000, subject to any conditions or modifications that may be required as part of the minor development permit. 2. Prior to issuance of a building permit, the applicant shall file a drainage plan and construction plans, meeting the following conditions, in conjunction with a building permit application. The final site plan shall comply with all requirements of the Unified Development Code, Uniform Building Code, Uniform Fire Code and Public Works Construction Standards and Specifications. 3. Prior to issuance of a building permit, the developer shall submit proof of payment of all required mitigation payments (transportation mitigation fees to WSDOT at $1,472.32, to Snohomish County at $2,412.00, and to the City of Arlington at $1038.00 per pm peak hour trip, which is 4, for a total of $4,152.00; and park mitigation fees to the City of Arlington at 5 cents per square foot of land per approved site plan, which is,1.36 acres or 59,241.60 square feet, for a total of $2,962.08)., 4. Prior to issuance of a building permit, the developer shall pay stormwater system development fees to the City of Arlington at $374.00 per 2,000 square feet of impervious surface area, which is 43,782 square feet, for a total of $8,187.23 5. All exterior lighting, including streetlights, shall be down shielded. 6. The Arlington Airport granted Thomco Industrial a 15-foot access easement; this easement shall be maintained by Thomco Industrial (or any future owners). 7. Prior to issuance of a building permit, the developer shall clear all outstanding land use permit-processing accounts with the City. 8. The minor development permit shall become null and void if use and reliance is not established within one year of the below date of approval. Vill. CODE REQUIREMENTS (NOTE: The following items are not conditions of permit approval, rather certain local, state, or federal code requirements that the applicant needs to be aware of. This is in no way intended to be a complete list of code requirements, but a general checklist of major steps and issues. Please refer to the AMC for a complete list of code requirements for your particular project type. 1 . Code Applicability. This application is subject to the applicable requirements contained in the Arlington Municipal Code, Zoning Code, and Building Code. It is the responsibility of the applicant to ensure compliance with the various provisions contained in these ordinances. 2. Pre-Construction Phase. The applicant will be required to design and install erosion control measures deemed necessary by the City. These measures must be installed and inspected by the City prior to the issuance of any permits. C. No site preparation or other disturbances shall be undertaken within environmentally sensitive areas or their required buffers. d. Submit to the Director of the Department of Public Works and receive approval of a stormwater run-off and detention plan in conformance with the AMC Chapter 16.10, Stormwater Management, and the Department of Ecology's Stormwater Management Manual for the Puget Sound Basin (The Technical Manual) for both the construction phase and a permanent system. All site drainage must be directed through biofiltration swales prior to discharge into wetlands. e. All new utility lines shall be placed underground. f. Provide a temporary rock pad at all points of ingress and egress to the site throughout the construction phase. g. On the construction plans show locations of all required streetlights to be installed as designed. h. A Right-of-Way Permit is required for and prior to any work done in a public right-of-way. i. All lighting shall be low sodium or similar low intensity illumination and placed in a way as to not cause glare on an adjoining property or right-of- way. 3. Construction Phase. The following conditions shall apply during construction. a. All applicable noise and other nuisance codes are applicable. b. Mud and dirt shall not be tracked onto public rights-of-way, but if tracked by accident shall be immediately cleaned-up. C. During any site grading or clearing activity, the applicant and contractor shall use all available means of controlling air pollution (dust, ash, and smoke). d. Installation of Improvements. Prior to receiving a building permit, the applicant shall: a. Install all rights-of-way and access easement improvements on all proposed streets internal and existing streets adjacent to the project per the requirements of UDC Chapter IX.A.1.c.12-20 or City of Arlington Ordinance 1213 adopted November 1, 1999. The applicant shall coordinate with all adjacent developments the final design of the street improvements and/or include the appropriate transition tapers for the street pavement to be included from the property. Improvements shall meet the following classifications: 1. Half street improvements (curb/gutter 16", sidewalk 5', landscaping 4', pavement and drainage per street classification standards) are required along the frontage of 66th Avenue NE per City of Arlington TIP, Comprehensive Plan, or as established by street classification standards. C. Install a potable water system to serve the project per City of Arlington's Department of Public Works requirements. Water is to be served by the City of Arlington. d. Any existing water facilities shall be relocated and/or water services/fire hydrants shall be installed prior to the required improvements at the expense of the developer. e. Install a sanitary sewer system created per Department of Public Works requirements. Sanitary sewer is provided by the City of Marysville. f. Install cluster mailbox structures for units in the development in a location approved by the U.S. Postal Service. g. Install a permanent storm water control system, per AMC Chapter 16.10. h. In lieu of completing any of the above improvements, the applicant may submit to the Department of Public Works a performance security to cover the cost of installing any or all of the improvements within one year of the date of permit approval. However, no Certificates of Occupancy may be issued until all improvements are completed. (NOTE: Infrastructure requirements are based on conceptual information as submitted by the applicant. Additional specific requirements may be required upon review of the engineered construction drawings as submitted by the applicant. I have modified the architectural plans. 3. The structural calculations and plans have included the mezzanine designed for a Live Load of 125 psf.
