PROJECT DESCRIPTION AND REQUEST Tosco Corporation requests approval of a minor land use permit to re-brand the existing BP gas station into a 76 gas station at 140 S. Olympic Avenue. As the project is located in the Central Business District (CBD), it requires Design Review for consistency with City of Arlington design standards. II. GENERAL INFORMATION 1. Public Notification: The property was posted on April 7, 2000 with a public notice for the April 18, 2000 Planning Commission meeting for the Design Review process required for projects in the CBD zone per City of Arlington Uniform Development Code (UDC) Chapter IX, Section P.5. III. ENVIRONMENTAL REVIEW The proposal was categorically exempt under Chapter 43.21 C RCW (SEPA). IV. BACKGROUND The applicant submitted permit application materials on February 2, 2000 and was determined to be technically complete on March 24, 2000. The Planning Commission reviewed and approved the Design Review at their meeting on April 18, 2000. V. APPROVAL PROCESS FOR THIS PROJECT Although the underlying land use permit qualifies as a Minor Permit, which is an administrative process, the project is in the CBD zone. Per UDC Section IX.P.5.c, for projects within the CBD zone, the Planning Commission is responsible for Design Review of major new construction (projects with construction costing over $10,000 and any construction requiring the change of the footprint of the building, addition to building floor area, structural changes and/or major site changes). Major new construction requires approval from the Planning Commission per UDC Section IX.P.5.b. VI. FINDINGS OF FACT 1. Application Process: The subject CBD Design Review/Minor Development Permit application was received by the City of Arlington on February 2, 2000. Per UDC Section IX.P.5.b, the Planning Commission must review the project for compliance with UDC Section IX.P.4, Central Business District Design Guidelines for Exterior Rehabilitations and New Additions. The Planning Commission reviewed and approved the Design Review at their meeting on April 18, 2000. The proposal was categorically exempt under Chapter 43.21 C RCW (SEPA). 2. Comprehensive Plan and Zoning: The City of Arlington Comprehensive Plan identifies this area as being Central Business District Subarea 1. The subject property is zoned Central Business District Subarea 1 per UDC Section III, zoning map, Page III-2. HAMN00-005-Tosco BP Rebrand-SR.doc yjp;4/20/00 Page 2 of 6 -I I I 3. Nonconforming Use: Automobile service stations are not a permitted use in CBD Subarea 1 per UDC Section V.F.f; therefore, the existing gas station is a legal nonconforming use and may be continued per UDC Section VI.L.1. Minor repairs to and routine maintenance of property where nonconforming situations exist are permitted provided the work costs less than 25 percent of the appraised value per UDC Section VI.L.7.a. The re-branding/re-imaging (valued at $30,155.00) is ess than 25 percent of the appraised valuation of the existing structure (valued 6a t $126,100.00). Therefore, the re-branding may be permitted provided the wilding Official finds that the work meets the requirements of UDC Section I.L.7.d (does not exceed 25 percent of value and complies with the UDC to the extent reasonably possible). 4. Nonconforming Signs: Per UDC Section IX.D.11, nonconforming signs may not be altered unless in conformity with the Sign Code. Therefore, all signage must be brought into conformance with the current UDC. Per UDC Section IX.D.7, the maximum allowable signage in the CBD zone is 300 square feet; 272 square feet is proposed. The maximum height for a freestanding sign is 20 feet and it must be located anywhere back of the street setback line; the existing freestanding sign meets those criteria. Per UDC IX.3.k, all commercial signage that is illuminated shall be externally-illuminated. The proposed signage will not be internally illuminated, and the existing internally-illuminated signs will have all internal electrical components removed as part of the sign permit. 5. Lot Dimensions, Density and Related Requirements: Not applicable as the building is already constructed and the applicant is not proposing any increase in the gas station's square footage. 6. Off-Street Parking: Not applicable as the building is already constructed and the applicant is not proposing any increase in the gas station's square footage. 7. Landscaping: Not applicable as the building is already constructed and the applicant is not proposing any increase in the gas station's square footage. 8. Transportation: Not applicable as the building is already constructed and the applicant is not proposing any increase in the gas station's square footage. No change in the amount of traffic is anticipated by the proposed project. 9. Stormwater Management: Not applicable as the building is already constructed and the applicant is not proposing any increase in the gas station's square footage or impervious surface. 10. Critical Areas: The site contains no environmentally sensitive areas. 11. Park Mitigation and Impact Fees: Not applicable as the building is already constructed and the applicant is not proposing any increase in the gas station's square footage. 12. Design Guidelines: Per UDC Section IX.P.4, Central Business District Design Guidelines for Exterior Rehabilitations and New Additions, the following guidelines must be met: a. Overview and Goals: Repairs and alterations to buildings shall protect and maintain their historic features and materials. The existing building and signage are not historical in fact or design. The gas station has changed brands and must change their signage from BP to 76 or they will not be able to continue operation. The features and materials will remain the same; however, the existing BP bull-nose design and green and yellow color scheme will be replaced with the flat design and color scheme for 76. In most cases, anything now green will be replaced with a stainless steel/light gray color with orange and blue accent trims. The major exception is the existing freestanding sign, which will have blue panels with an orange 76 logo. The proposed color scheme does not conform to the approved Benjamin Moore colors nor do they reflect that theme; however, neither did the existing color scheme and these are copyrighted, company designs and colors. This guideline, though not necessarily applicable due to the non-historic design of the building or surrounding buildings, has been met in terms of being consistent with the materials and color pallet of the existing building and signage. b. Historic Preservation and Restoration of Existing Architectural Features: Historic architectural features shall be retained or repaired, rather than removed. See Finding "a," above. Nevertheless, no historic features or materials are proposed to be removed; therefore, this guideline has been met. C. Replacement of Pre-existing Architectural Features: Where historic features have been removed in the past, those original features shall be restored where new construction or rehabilitation makes this feasible. No original features have been removed in the past; therefore, this guideline is not applicable. d. Additions to Existing Buildings: New additions to historic buildings shall respect the architecture of the existing building and shall be compatible with adjacent historic buildings. This is not an addition to a historic building, simply a change in signage, and there are no adjacent historic buildings; therefore, this guideline is not applicable. e. CanopieslWeather Protection Over Sidewalks: Historic sidewalk canopies shall be maintained, restored, or rehabilitated. There are no historic or proposed sidewalk canopies; therefore, this guideline is not applicable. f. Relationship of Renovations and Additions to Adjacent Buildings: New additions and infill construction shall be compatible with the architectural features of adjacent historic buildings. Planning Commission Approval: Per UDC Section IX.P.5.b, at their meeting on April 18, 2000, the Planning Commission reviewed the project for compliance with UDC Section IX.P.4, Central Business District Design Guidelines for Exterior Rehabilitations and New Additions, and approved the Design Review for the project. VII. CONCLUSIONS 1. The proposed project as noted and conditioned is allowed as an alteration to an existing nonconforming use in the CBD zone. 2. The requested minor development permit as conditioned meets all UDC requirements, including Chapter VII, Section D, Criteria for Approval, and all other applicable codes. 3. The Planning Commission has approved the Design Review required for the CBD zone per UDC Section IX.P.5.b. 4. The minor development permit should be approved subject to conditions noted below. VIII. DECISION The minor development permit is hereby APPROVED, subiect to the following conditions: 1. The applicant shall file construction and sign plans, meeting the following conditions, in conjunction with a building/sign permit application. The plans shall comply with all requirements of the Unified Development Code, Uniform Building Code and Uniform Fire Code. 2. The applicant shall remove the internal electrical components in all existing signage, including the freestanding sign; only externally illuminated signs are allowed in the CBD zone. 3.
