HomeMy WebLinkAboutOrdinance No. 2026-010 Amending Chapter 20.68 Regarding Signs Under City Planning No. PJ25-0047ORDINANCE NO. 2026-010 AN ORDINANCE OF THE CITY OF ARLINGTON, WASHINGTON AMENDING CHAPTER 20.68 OF THE ARLINGTON MUNICIPAL CODE REGARDING SIGNS UNDER CITY PLANNING NO. PJ25-0047 WHEREAS, the city has proposed an update to the Signs regulations to the City zoning code; and WHEREAS, the Arlington Planning Commission considered the revisions on March 3, 2026 and at a public hearing conducted on March 17, 2026; and WHEREAS, the Planning Commission made findings and provided its recommendations to the City Council concerning the proposed changes; and WHEREAS, the City Council considered the same at a workshop held on April 13, 2026, a meeting on April 20, 2026, and considered them along with the Planning Commission recommendations; and the City Council having determined approving said amendment was in the best interest of the City; and WHEREAS, the amendments were presented to the Department of Commerce for comment and said Department had no comments on the ordinance; and WHEREAS, the City Council has considered the proposed amendment to the municipal code and finds it to be consistent with city and state law and in the best interests of the citizens; and NOW, THEREFORE, the City Council of the City of Arlington does hereby ordain as follows: Section 1. Arlington Municipal Code section 20.68.010(d) shall be hereby amended as follows: 26.68.010 Permit Required for Signs. (d) Sign permit applications shall be governed by the same provisions of this title applicable to zoning permits as provided in (Chapter 20.16, jPermits and I-PIa Land Division Approval). Section 2. Arlington Municipal Code section 20.68.045(c) shall be hereby amended as follows: 20.68.45 Miscellaneous Restrictions and Prohibitions. (c) Signs that revolve or are animated or that use movement or apparent movement to attract the attention of the public are prohibited. Without limiting the foregoing, banners, streamers, animated display boards, pennants, and propellers are prohibited, but signs that only move occasionally because of wind are not prohibited if their movement (i) is not a primary design feature of the sign, and (ii) is not intended to attract attention to the sign. The restriction of this ORDINANCE NO. 2026-010 1 subsection shall not apply to barber poles or signs specified in cubseetkm—§20.68.025(a)(4) (Certain Temporary Signs: Permit Exemptions and Additional Regulations). Section 3. Arlington Municipal Code section 20.68.050 shall be hereby repealed: UM In 02 e a s ►ter - - - - � e _ Section 4. Arlington Municipal Code section 20.68.050 shall be hereby added as follows: 20.68.050 Cannabis Retailers Restrictions and Regulations. (a) Applicability. This section applies to any state -licensed cannabis business operating within the City, including cannabis retailers, processors, and producers, and to any sign or advertising display installed, displayed, or maintained bV or on behalf of such business, whether located on or off the premises. RCW 69.50.369, as now exists or as hereafter amended is adopted by reference and incorporated into this chapter. ORDINANCE NO. 2026-010 2 (b) Retailers —state law adopted by reference. Cannabis retailer signage and advertising shall comply with RCW 69.50.369 and applicable Washington State Liquor and Cannabis Board rules, as amended. (c) Producers and processors —state law compliance. Cannabis_ producer and processor signage and advertising shall comply with applicable state law and Washington State Liquor and Cannabis Board rules, as amended, and in accordance with RCW 69.50.369. (d) Distance Restrictions (1, 000 feet). No licensed cannabis producer, processor, researcher or retailer may place or maintain, or cause to be placed or maintained any sign or other advertisement for a cannabis business or cannabis product, including usable cannabis concentrates, or cannabis -infused product, in any form or through any medium whatsoever within one thousand feet of the perimeter of a school grounds, playground, recreation center or facility, child care center, public park, or library_, or any game arcade admission that allows admittance of persons under the age of 21. (e) Prohibited signs (all cannabis businesses). The following sign types are prohibited for cannabis businesses in all zoning districts: (1) Portable signs. A sign that is not permanently affixed to the ground or to a structure, including an A -frame or sidewalk sign. 2 Mobile signs. A sign attached to or displayed on a vehicle,, trailer, or similar device when the primary purpose is advertising rather than transportation. This does not Prohibit ordinary business identification on vehicles used in the normal course of hutinPss. (3) Inflatables and attention -attracting devices. inflatablesair-dancers, tethered balloons,_ nts. soinners. streamers. or similar attention -attracting devices used for advertising. (4) Proiected or light -cast advertising. Proiected images, laser displays, or other light -cast advertising onto buildings, sidewalks, streets, or other surfaces. 51 Sound -emitting signs. Anv sign or advertising device that emits sou (e) Conflicts. Where this chapter is more restrictive than state law or Washington State Liquor and Cannabis Board rules this chapter controls. Where state law or Washington State Liquor and Cannabis Board rules are more restrictive, the state standard controls. f) Enforcement. Anv sign installed, maintained or displayed in violation of this section is subiect to §20.68.070 (Illegal Signs) and enforcement pursuant to Chapter 20.28 (Enforcement & Review) and/or AMC Title 11, as applicable. Section 5. Arlington Municipal Code section 20.68.055(c) shall be hereby amended as follows: 20.68.055 Maintenance of Signs. (c) If the message portion of a sign is removed, leaving only the supporting "shell' of a sign or the owner of the property where the sign is located or other person having control over such sign shall, within thirty days of the removal of the message portion of the sign, either replace the entire message portion of the sign, install a "blank" sign facing, or remove the remaining ORDINANCE NO. 2026-010 components of the sign. In cases where a blank sign facing is temporarily installed, said facing shall be in place for no longer than twelve months, after which all components must be removed. This subsection shall not be construed to alter the effect of 20.68.065(c) jNonconforming Signs), which prohibits the replacement of a nonconforming signer, nor shall this subsection be construed to prevent the changing of the message of a sign. Section 6. Arlington Municipal Code section 20.68.070 shall be hereby amended as follows: 20.68.070 Illegal Signs. a1 Anv sien erected, installed, altered or maintained without a required sjgn permit or in violation of this chapter is an illegal sign. (b) The burden of establishing a sign to be legal under this section rests upon the person or persons, firm, or corporation claiming legal status for a sign. (c) If a permit is not obtained, within the ried g meted An Sub ©*in (then the City may initiate enforcement procedures pursuant to Chapter 20.28 (Enforcement & Review) or AMC Title 11. Section 7. Arlington Municipal Code section 20.68.130(a) shall be hereby amended as follows: 20.68.130 Total Sign Surface Area. (a) Unless otherwise provided in this chapter, such as pursuant tor� �} FtS) or- §20.68.180 (Subdivision and Multi -Family Development Entrance Signs), the total surface area devoted to all signs on any lot in the RULC, RLC, R- MOD, RMC, OTR, and RHC zones shall not exceed the limitations set forth in this section, and all signs, except temporary signs, shall be included in this calculation. Section 8. Arlington Municipal Code section 20.68.140 shall be hereby amended as follows: 20.68.140 Location and Height Requirements of Signs Attached to Buildings. Section 9. Arlington Municipal Code section 20.68.150(a) and (e) shall be hereby amended as follows: 20.68.150 Freestanding Signs. (a) Freestanding signs are allowed in the RULC, RLC, R-MOD, RMC, OTR, and RHC zones for permissible non-residential uses subject to the following standards. Note -sever, that d}R4' i?rr.9r.icir, .+� fr.r C., ptig al Ef eFtsl (e) Maximum Sign Surface Area —Keeping in mind t4a- there is a limit to the total sign surface area for any particular lot ( In the RULC, RLC, R-MOD, RMC, OTR, and RHC zones a single side of a freestanding sign may not exceed 0.3 square feet in surface area for every linear foot of street frontage along the street toward which such sign is primarily oriented. However, in no case may a single side of a freestanding sign exceed fifty square feet in surface area if the lot on which the sign is located has less than two hundred feet of frontage on the street toward which that sign is primarily oriented, seventy-five square feet on lots with two hundred or more but less than four hundred feet of frontage, and one hundred square feet on lots with four hundred or more feet of frontage. With respect to freestanding signs that have no discernible sides, such as spheres or other shapes not composed of flat planes, no such freestanding sign may exceed the maximum total surface area allowed for a single side of a freestanding sign. Section 10. Arlington Municipal Code section 20.68.170(a) and (b) shall be hereby amended as follows: 20.68.170 Changeable Text Signs (Readerboards). (a) Changeable text signs are prohibited for all residential and residential accessory uses (Table of Permissible Uses, §20.40) in the RULC, RLC, R-MOD, RMC, OTR, and RHC zones. (b) For permissible non-residential uses, each use may have changeable text signs, though the total aggregate surface area of such sign(s) may not exceed ten percent of the use's total allowable permitted signage pursuant to {§20.68.130 (Total Sign Surface Area). Section 11. Arlington Municipal Code section 20.68.230 shall be hereby amended as follows: 20.68.230(a) Total Sign Surface Area of Signs Attached to Buildings. Section 13. Arlington Municipal Code section 20.68.250(a) and (e) shall be hereby amended as follows: 20.68.250 Freestanding Signs. The maximum size of such signs is thirty square feet. The maximum height is ten feet. (Note: Drive -through restaurants are not a permissible use in the NC District.) ORDINANCE NO. 2026-010 Section 14. Arlington Municipal Code section 20.68.270 shall be hereby amended as follows: 20.68.270 Changeable Text Signs (Readerboards). Changeable text signs are permissible in the Neighborhood Commercial and General Commercial zones. Each business may have changeable text signs, though the total aggregate surface area of such sign(s) may not exceed ten percent of the business' total allowable permitted signage pursuant to �§20.68.230 (Total Sign Surface Area of Signs Attached to Buildings). Section 15. Arlington Municipal Code section 20.68.330(a) shall be hereby amended as follows: 20.68.330 Total Sign Surface Area of Signs Attached to Buildings. Arlington Municipal Code section 20.68.590 shall be hereby amended as follows: 20.68.590 Commercial Corridor Regulation (a) All new development, change of uses, or redevelopment of property within the Commercial Corridor zone shall comply with the sign requirements in the Mixed -Use Development Regulations under Chapter 20.110, except those properties along Smokey Point Boulevard from 174th Street south to city limits in accordance with §20.32.080 (Nonconforming Uses in thie Commercial Corridor Zone). Should any section, paragraph, sentence, clause or phrase of this ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this ordinance be pre-empted by state or federal law or regulation, such decision or pre-emption shall not affect the validity of the remaining portions of this ordinance or its application to other persons or circumstances. Section 45. Effective Date. The title of this ordinance which summarizes the contents shall be published in the official newspaper of the City. This ordinance shall take effect and be in full force five (5) days after the date of publication as provided by law.
