Council Members Absent: none. Staff Present: Mayor Don Vanney, Paul Ellis, Sheri Amundson, City Attorney Oskar Rey, Jim Kelly, Amy Rusko, Rory Bolter, Mike Gilbert, Chelsea Brewer, and Julie Petersen. Mayor Don Vanney called the meeting to order at 6:00 p.m., and the Pledge of Allegiance and roll call followed. APPROVAL OF THE AGENDA Mayor Pro Tern Michele Blythe moved to approve the agenda with an amendment to include item number 8, 188 Project Bid Rejection, under New Business. Councilmember Rob Toyer seconded the motion, which passed with a unanimous vote. INTRODUCTION OF SPECIAL GUESTS AND PRESENTATIONS Mayor Don Vanney awarded the Mayor's Volunteer Award to the Kiwanis Club of Arlington. PROCLAMATIONS Yvonne Gallardo-Van Ornam read the Farmers Market Week Proclamation. PUBLIC COMMENT Joe Beardslee, Arlington, provided comments. Jeri Rugtvedt, Arlington, provided comments. Jordan Kurtz, Arlington, provided comments. CONSENT AGENDA Mayor Pro Tern Michele Blythe moved, and Councilmember Leisha Nobach seconded the motion to approve the Consent Agenda that was unanimously carried: 1. Minutes of July 21 and 28, 2025 Council meetings Pagel of 5 Minutes of the City of Arlington City Council Meeting August 4 2025 2. Accounts Payable: Approval of EFT Payments and Claims Checks #113806 through #113915 dated July 8 through July 21 for $1,208,540.19. Approval of Petty Cash Check #2046 dated July 21 for $61.75. PUBLIC HEARING Amendment to Development Agreement with Baker Mor, LLC City Administrator Paul Ellis requested Council approve the first amendment to the Baker Mor LLC, Development Agreement. Mr. Ellis spoke of a map documenting the mixed -use development for 55 and over apartment complex that covers approximately 50% of the area on the back side of the lot. Lot D is the smallest piece of the property and the front faces 172nd Street. This would expand the mixed -use to include Highway Commercial, and help this property develop with its current location with availability for retail. Discussion followed with Mr. Ellis answering Council questions. The public hearing was opened at 6:15 p.m. With no members of the public wishing to speak, the public hearing portion was closed at 6:15 p.m., and Council comments were opened. Councilmember Heather Logan provided comments. The public hearing was closed at 6:17 p.m. Mayor Pro Tem Michele Blythe moved, and Councilmember Leisha Nobach seconded the motion to approve the first amendment to the Baker-MOR, LLC development agreement and authorized the Mayor to sign the agreement amendment. The motion passed unanimously. NEW BUSINESS Apparent Low Bid Award for Jensen Park Improvement Project Community Engagement Director Sarah Lopez requested Council approve the apparent low bid award for the Jensen Park Improvement Project to Reece Construction for $196,177.11. Councilmember Heather Logan moved, and Councilmember Debora Nelson seconded the motion to approve the Jensen Park Improvement Project to Reece Construction in the amount of $196,177.11 and to authorized the Mayor to sign the construction contract. The motion passed unanimously. Apparent Low Bid Award for Pickleball Court Public Works Director Jim Kelly requested the Council approve the interlocal agreement that was formed in December 2023 with the Arlington School District allowing the City to build Pickleball Courts at Haller Middle School. Snohomish County awarded a $200,000 grant to the City of Arlington for this project which is being matched with $200,000 of local funds. The project was advertised on July 10 with bids opened on July 29. Discussion followed with Mr. Kelly answering Council questions. Councilmember Rob Toyer moved, and Councilmember Heather Logan seconded the motion to approve the pickle ball construction contract with Reece Construction in the amount of $403,720.32 and authorized the Mayor to sign the contract, pending final review by City Attorney. The motion passed unanimously. Page 2 of 5 Minutes of the City of Arlington City Council Meeting August 4. 2025 Biosolids Hauling Contract Public Works Director Jim Kelly requested City Council approve contracted Boulder Park, LLC as an alternate bio-solids disposition site. To use the Boulder Park facility, the City needs to contract with a Department of Ecology (DOE) licensed contractor for the hauling of biosolids. A Request for Proposal (RFP) was publicly advertised and the City received two proposals/bids. The City evaluated both proposals/bids and determined that the proposal from Earthwork Solutions meets all the requirements contained in the RFP, is properly licensed with the DOE, and was the low -price bidder. Staff is requesting City Council accept the Earthwork Solutions proposal and authorize the mayor to sign the contract. Discussion followed with Mr. Kelly answering Council questions. Councilmember Debora Nelson moved, and Councilmember Michele Blythe seconded the motion to accept the proposal and enter into contract with Earthwork Solutions for Biosolids Hauling and authorized the Mayor to sign the contract. The motion passed unanimously. Contract Amendment No. 1 with Rock Construction Management Public Works Director Jim Kelly requesting Council accept the Amendment #1 proposal and approve the Public Works capital improvement projects in 2025, and the need for full time construction management on these projects (three projects with Federal funding), the City contracted with Rock Project Management in 2024 for CM services to support the management of several 2025 construction projects. The unanticipated additional time on the 211th Project required more of the CM inspector and Rock CM is requesting an amendment to cover CM services needed for the Division/Broadway project. Staff negotiated a scope of services and fees for additional CM services for the Division/Broadway and 188th Street Roundabout projects. Discussion followed with Mr. Kelly answering Council questions. Councilmember Leisha Nobach moved, and Councilmember Michele Blythe seconded the motion to approve Amendment No 1 with Rock Project Management for Construction Management services in the amount of $79,000 and authorized the Mayor to sign the contract, pending final approval by the City Attorney. The motion passed unanimously. Department of Ecology Grant Award for Solid Waste and Recycling Public Works Director Jim Kelly requested Council accept the two-year grant from the Department of Ecology for $20,217.71, with a $5,054.43 match obligation, to continue funding the City's 2025-2027 refuse and recycling program. The City has been receiving a Department of Ecology Local Solid Waste Grant (formerly called a "CPG" grant) for over 20 years; this grant is used to fund the City's refuse and recycling outreach and education program. The refuse and recycling program provides valuable information and outreach to Arlington's citizens, businesses, and schools about efficient and cost-effective waste management practices - all of which not only reduce waste tonnage sent to landfills, but reduces waste disposal costs for citizens, businesses and schools. This current grant will provide funding for the fiscal years 2025-2027. Discussion followed with Mr. Kelly answering Council questions. Page 3 of 5 Minutes of the City of Arlington City Council Meeting August 4 2025 Councilmember Jan Schuette moved, and Councilmember Rob Toyer seconded the motion to accept the Solid Waste Financial Assistance Grant offered by the Department of Ecology for fiscal years 2025 to 2027 and authorized the Mayor to sign the grant agreement, pending final review by the City Attorney. The motion passed unanimously. Community and Economic Development Quarterly Report Community and Economic Deputy Director Amy Rusko reviewed the Community and Economic Development quarterly report. Discussion followed with Ms. Rusko answering Council questions. 2026 Lodging Tax Distribution City Administrator Paul Ellis reviewed the handout he provided to Councilmembers with an updated spreadsheet for the Gleneagle Golf Course numbers listed as $8,000.00 for the Lodging Tax Funds and no other changes from the discussion last week with Councilmembers. Councilmembers have rejected the proposal from the Lodging Tax Committee and will vote on the updates after the Committee has had 45 days to review and make comments to the Councilmembers submitted recommendations. The consensus from the Councilmembers recommendations is 4 yes to 3 no. Discussion followed between Councilmembers and Mr. Ellis answering Council's questions. 188th Street Project Bid Rejection City Administrator Paul Ellis and Public Works Director Jim Kelly requested that the 188 Project Bids for 188th Street roundabout be rejected and readvertise for bids due to bidders contesting the bid process which poses a risk of delaying the project and attorney fees. Staff will evaluate and qualify the new bids and select the construction firm to present to Councilmembers in September. Discussion followed with Mr. Kelly answering Council questions. Councilmember Michele Blythe moved, and Councilmember Debora Nelson seconded the motion to reject all bids for the 188th street roundabout project. The motion passed unanimously. COMMENTS FROM COUNCILMEMBERS Councilmember Yvonne Gallardo-Van Ornam thanked the Stilly Valley Chamber for the recycling program they sponsored. She thanked Sarah Lopez for the great job she does in marketing events including the support on the Hispanic Heritage Month celebration. She announced that the upcoming Night Market will be Friday, August 22. She reminded everyone to look at Meet Me in Arlington to see the schedule for the Farm Tours. Michele Blythe announced she attended the Police Academy graduation. She asked if the downtown sound system could be used for emergencies. ADMINISTRATOR & STAFF REPORTS City Administrator Paul Ellis had nothing to report. MAYOR'S REPORT Mayor Vanney announced he attended the Police Academy graduation. City Council was dismissed and went into an Executive Session at 7:10 p.m. and reconvened at 7:25 p.m. No action was taken by Council.
