A RESOLUTION OF THE CITY OF ARLINGTON TO WAIVE BIDDING REQUIREMENTS FOR THE
PURCHASE OF ADDITIONAL FLOCK LPR CAMERAS AND SOFTWARE SUBSCRIPTION SERVICES FOR
USE BY THE CITY OF ARLINGTON
WHEREAS, the City of Arlington is obligated to follow competitive bidding statutes
except in certain circumstances defined by state law when competitive bidding is not feasible or
in the best interests of the city; and
WHEREAS, when competitive bidding is not feasible or in the best interests of the City
RCW 35.23.352 requires written findings to that effect; and
WHEREAS, the City of Arlington has purchased and placed into service certain cameras
manufactured by Flock Group, Inc. ("Flock") for License Plate Recognition (LPR) at City
intersections; and
WHEREAS, the Flock LPR cameras in use in Arlington and the software to operate the
same are manufactured only by Flock and are unique in their functionality and compatibility;
and
WHEREAS, the City wishes to renew its subscription for the Flock cameras; and
WHEREAS, Flock has offered to provide the City with a 5-year fixed price renewal on
software with 6 additional LPR cameras at a price equal to the existing contract rate, but only if
the City contracts for the service on or before December 31, 2023; and
WHEREAS, the Flock proposal is estimated to save the City at least $65,000 over a five
year period based on the rate to be offered to municipalities in 2024;
WHEREAS, RCW 35.23.352(9) permits the waiving of bidding requirements for the
purchase of materials which are clearly and legitimately limited to a single source of supply,or
services which are subject to special market conditions;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arlington, as
follows:
Section 1: The City Council of the City of Arlington finds that the acquisition of Flock
LPR cameras clearly limits the City of Arlington to a single source of supply,justifying
the waiver of competitive bidding requirements. The City also finds that RCW
39.04.280(1)(b) authorizes the city to waive competitive bidding requirements for
purchases involving special market conditions. The City's adopted Financial Policies
(Purchasing Policy E(b)) also allows the city to waive competitive bidding
requirements when supplies or used equipment are offered at a very favorable price
and will be sold before the City will have a chance to complete the bidding process.
Section 2: The City Council of the City of Arlington hereby waives the bidding
requirements for the purchase of Flock LPR cameras and authorizes staff to purchase
the cameras directly from Flock Group, Inc.

Section 3: This resolution will be effective for three (3) years from the date of
adoption.
