use rights and privileges permitted to other• properties in the

Dear Mr . Love:
In regards to letter received August 21 , 1989 requesting a
reduction in setback requirements, it is necessary that you
apply for a variance through the Board of Adjustment . The City
Administrator can approve reductions in setback requirements,
but only up to 50%. Your request exceeds that .
For your information, I have enclosed an application
should you decide to apply for the variance . I have also
enclosed additional information regarding variances. There is
a $200 . 00 fee, payable at the time you apply. Once your
application is filed here, it goes to the City Administrator
for review and report . Once the report is complete, the Board
of Adjustment is contacted and date for public hearing is set .
Notice of the hearing must be advertised 10 days prior to the
hearing and property owners within 300 feet notified.

Background :
Mr. Love initially applied for a building permit to construct a

Arlington Comprehensive Flan designation is Urban Residential 4—
E dwelling units per acre.
The surrounding land use includes :
1 ) North — R7200 and R9E00
2) South — R9600 and MR1
3) East — MR1

Staff Comments •
1. Applicant purchased the residence as is with the exception
that the garage has been remodeled for home occupation use of a
repair shop, they do not park their personal vehicles in it.
2. Applicant has a valid business license for a home
occupation. Arlington Municipal Code Section 20. 14. 080 (c) ( 1 )
requires two off—street parking spaces for a single family
dwellino. Also, Arlington Municipal Code Section 20. 14. 040 (e)
requires that one off—street parking space for visitors or,
customers must be available during hours of operation. These
requirements are currently being met. Calculations show that
four stalls are provided.
3. Mr. Love has been parking a pickup in the proposed carport
area, leaving the area in front of the garage open and
available for personal vehicle, visitor or customer parking.
In the past neighbors have complained about noise when this
vehicle is started up in the morning and left to warm up.
4. The strUctUre on the adjoining property is within six (6)
feet of the property line.
5. The residence has a two car garage which the applicant has
converted into a repair shop. The applicant could covet, the
area in front of the converted garage making a smaller carport
and meeting the setback requirements or could move the carport
to the east into the yard area. Any carport built would need
to be left open on all three sides to allow access for
emergency purposes.
6. Allowing this variance would benefit Mr. Love by providing
additional parking space.
7. The granting of this variance would not benefit any
surrounding neighbors.
B. Neighboring property owners may request the same privileges
but would be required to meet the same conditions.

Dear Mr . Love:
In regards to letter received August 21 , 1989 requesting a
reduction in setback requirements, it is necessary that you
apply for a variance through the Board of Adjustment . The City
Administrator can approve reductions in setback requirements,
but only up to 50%. Your request exceeds that .
For your information, I have enclosed an application
should you decide to apply for the variance . I have also
enclosed additional information regarding variances . There is
a $200 . 00 fee , payable at the time you apply. Once your
application is filed here, it goes to the City Administrator
for review and report . Once the report is complete, the Board
of Adjustment is contacted and date for public hearing is set .
Notice of the hearing must be advertised 10 days prior to the
hearing and property owners within 300 feet notified.
