RESOLUTION 2018-003 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARLINGTON, WASHINGTON, SETTING A PUBLIC HEARING REGARDING THE CITY'S INTENDED ASSUMPTION OF THE ARLINGTON TRANSPORTATION BENEFIT DISTRICT RETROACTIVE TO JANUARY 1, 2018, PURSUANT TO THE AUTHORITY OF RCW 36.74.010 WHEREAS, Chapter 36.73 of the Revised Code of Washington (RCW) provides for the establishment of Transportation Benefit Districts (TBD) arid the levying of additional revenue sources for transportation improvements within the district; and WHEREAS, the State adopted RCW 36.74.010, which authorizes a city or county that has established a TBD with the same boundaries as the city or county to absorb the TBD and assume all of the TBD's "rights, powers, functions, and obligations," with the result that the TBD would cease to exist as a separate municipal entity; and WHEREAS,the City of Arlington adopted Ordinance 2013-005 on or about April 1, 2013 creating Arlington Municipal Code Chapter 3.94, entitled "ARLINGTON TRANSPORTATION BENEFIT DISTRICT"; forming the Arlington Transportation Benefit District entirely within the geographical boundaries comprised of the corporate city limits of the City of Arlington Washington; and WHEREAS, the City Council intends to consider the assumption of the Arlington Transportation Benefit District coexistent with its boundaries and to exercise all rights, powers, functions and obligations of the Arlington Transportation Benefit District pursuant to RCW Chapter 36.74, retroactive to January 1, 2018; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARLINGTON, WASHINGTON AS FOLLOWS: Section 1. Intent. Pursuant to RCW 36.74.020, it is the intention of the Arlington City Council to conduct a public hearing concerning the assumption of the Arlington Transportation Benefit District and to exercise all rights, powers, functions and obligations of the Arlington TBD pursuant to RCW Chapter 36.74, retroactive to January 1, 2018. Section 2. Hearing. Pursuant to RCW 36.74.020, a public hearing is hereby set for February 20, 2018 to consider the assumption of the Arlington Transportation Benefit District coexistent with its boundaries and to exercise all rights, powers, functions and obligations of the Arlington Transportation Benefit District pursuant to RCW Chapter 36.74, effective as of January 1, 2018. RESOLUTION NO. 2018-003 1 Said public hearing shall be held in the Council chambers located at 110 E.Third Street,Arlington, WA 98223 at 7:00 P.M. or as soon thereafter as this matter may be heard. All persons interested may appear and be heard. Section 3. Publication. Pursuant to RCW 36.74.020,this Resolution of intention shall be published at least two times during the two weeks preceding the scheduled hearing in the newspaper or newspapers of daily general circulation printed or published in the City in which the Arlington Transportation Benefit District is located.
