DESCRIPTION: The Council is being asked to terminate the MOU with Davis and Silesky
Investment and purchasing all documentation/permits/approvals for $375,000.
HISTORY: After several years of permitting process, approvals and lease negotiation the
concept of having the business park area built by a developer is coming to a close. The final
straw for D & S came with the FAA disapproving a 75-year lease term. On the plus side, all
documentation and permits are completed to start the construction engineering and
construction on phases of the project. The Airport Commission approved terminating the MOU
and the payment of $375,000 for the documents.
ALTERNATIVES: Approve the recommendation with modifications

Subject: Action Regarding Termination of the MOU with Davis and Silesky
ISSUE: Action regarding terminating the MOU with Davis and Silesky, pros and cons
of purchasing the approvals and proposed uses versus potential uses of the property.
BACKGROUND: See Steve Peiffle’s memo dated 11/7/07.
DISCUSSION & ANALYSIS: Davis and Silesky have requested that the MOU be
terminated, conditioned on a payment of approximately $375,000 for all of the
approvals/permits that they acquired. The main question before us is what is the value
of the approvals/permits and how long would it take to go through the process again. I
believe it would be optimistic if I said that it would take three years to go through the
City and Federal permitting process to get us to back to this point. I would also
estimate that it would easily cost at least $300,000 (The majority of their funds were
spent in 1997-2000). I contacted two companies to give estimates in both time and
costs for going through the process again. If the cost to purchase the approvals proves
to be reasonable it would make sense to agree to the terms and move forward with
construction drawings for 51st. Technically, we have already used the approvals for
development because the flightline property was part of the approval process. If we
started over we would not be able to lease any property along the flightline or within
the business park.
Only one firm, HBA, responded with an estimate of the amount of time and funds it
would take to go through the permitting process. John Burkholder, HBA, is very
familiar with the project because he was the City Planner during the early stages of the
project and later his company worked on the project. I have attached John’s e-mail, but
he has listed all of the documents that were produced, estimated that it would take
three to four years and cost between $300,000 to $500,00 to get back to this point in the
process.

Dear Rob: You have asked me to provide you with a rough estimate of what it would cost to
reproduce the permits today for the Arlington Airport Business Park Binding Site Plan. You also
requested an approximate schedule for completion of the work.
Over the last 10 years we completed the following as part of the binding site plan approval:
1. Expanded SEPA checklist by Shockey Brent
2. Preliminary engineering design report by Group 4
3. Extensive, geotechnical and geo-hydrological studies by Terra Associates (this included
over four years of groundwater monitoring, the installation of 30 wells, the mapping of
groundwater depth.
4. The development of the office park standards including landscape and architecture
5. The development of the original master plan and phasing plans by Cascade Design
Collaborative
6. The Preliminary Drainage Analysis completed by HBA to comply with new stormwater
manual
7. Development agreement produced by HBA
8. Preliminary plat application package by HBA
9. Boundary and topographic survey by Metron
10. Wetland Reconnaissance
11. NEPA Process including Biological Evaluation, submittal package and correspondence with
NOAA, NMF, USFW FAA
12. Project management through the permit process including negotiations with the
Stillaguamish Tribe, adjacent landowners, various public meetings
13. Two traffic reports with one requiring evaluation of the entire SR 531 corridor and the
interchange and I-5.
14. Hearing process for Quasi-judicial Permit through the City of Arlington
While this process originally took over 10 years to complete, starting today we could probably
do it in three to four years depending on the NEPA process and communications with the FAA.
Those two efforts took the longest time to complete.
A rough estimate of the cost for this would be between $300,000 and $500,000 say $400,000

DESCRIPTION:
The Arlington Art Council proposes that the City match the $10,000 from at the 2007 Art
Council Auction for the acquisition of four pieces of art. The following pieces of public art are
proposed for acquisition:
1. James Madison’s Raven & the Sun sculpture ($7000)
2. Harry Engstrom’s Stilly River mural ($4,500),
3. Steve Jensen’s pole ($3,500)
4. Funds to construct Labyrinth ($5,000).
HISTORY:
The City has previously purchased public art that has been recommended by the Arlington Arts
Council.
ALTERNATIVES:
Deny any or the entire request.
RECOMMENDED MOTION:
No action at this time. Council will be asked to allocate the funds for the acquisition and accept
the art pieces at the February 19, 2008 Council meeting.

DESCRIPTION:
The City Council is requested to adopt Ordinance 1448 setting forth rules and regulations for
the operation of non-fire based ambulance services operating within the City limits.
HISTORY:
As the City continues to grow there will be an increased need for non-fire based non-emergency
ambulance services to provide non-emergency patient transportation to care facilities that are
located outside of the City limits. This ordinance establishes minimum operational conditions
and standards for all non-fire based ambulance services in order to ensure that the public
receives an acceptable level or standard of care comparable to the City’s emergency medical
care.
ALTERNATIVES:
Continue the current practice.
RECOMMENDED ACTION:
No action at this time, Ordinance No. 1448 will be presented for approval at the February 19th
Council meeting.

ORDINANCE NO. 1448
AN ORDINANCE OF THE CITY OF ARLINGTON, WASHINGTON
CREATING A NEW CHAPTER 5.48 OF THE ARLINGTON
MUNICIPAL CODE ESTABLISHING RULES AND REGULATIONS
RELATING TO THE PROVISION OF EMERGENCY MEDICAL AND
AMBULANCE SERVICES WITHIN THE CITY OF ARLINGTON
WHEREAS, the City Council of the City of Arlington has the authority to adopt
regulations designed to protect the health, safety and welfare of its citizens; and
WHEREAS, the City Council deems the adoption of this ordinance and the
procedures contained therein to be in the best interest of the citizens;
NOW, THEREFORE, the City Council of the City of Arlington, Washington,
does ordain as follows:
Section 1. Findings.
The City Council makes the following findings:
a. The provision of emergency medical services is a governmental function
in support of public health and safety.
b. The City of Arlington has provided fire department emergency medical
services and other emergency responses for the City of Arlington and for
other fire districts and/or cities with which it has contracted for services.
c. The provision of transportation of patients by ambulance or other suitable
conveyance to the hospital, clinic, or other location where professional
medical care is available is a necessary element of the emergency medical
service function. As part of these services to the community, the City has
established and maintained both advanced life support (ALS) and basic
life support (BLS) medical services.
d. Current emergency medical services funding is dependent upon continuing
provision of ALS and BLS services within the City of Arlington. Current
funding, due to impacts of tax-limiting measures, is inadequate to maintain
the current requirements of ALS and BLS services, much less to meet the
anticipated future needs of the City to provide ALS and BLS services.
e. It is the intent of the City Council to assure that the fire department is
exclusively authorized to provide for the transport of patients in all
emergency situations, and to provide for the continuing needs of the
citizens for emergency transport services.

Section 2. New Chapter Adopted. The Arlington Municipal Code is hereby
amended to add a new Chapter 5.48, as follows:

5.48.010 Definitions

5.48.010 Unless a different meaning is plainly required by the context, the following words
and phrases as used in this chapter shall have the meanings indicated:
a. The City adopts and incorporates by reference herein all definitions set forth
in Revised Code of Washington (RCW) Chapter 18.73.030, as may be
amended from time to time.
b. “Emergency” means a situation or patient condition (a) in which either of the
following procedures is performed: administration of a drug (except oxygen)
or initiation of an intravenous line; (b) which a person requesting ambulance
assistance requires immediate response by medically trained personnel; or (c)
which an emergency medical technician (EMT) would assess, in the interest
of good patient care, as requiring the assistance of at least a paramedic
certified pursuant to RCW 18.71 and regulations promulgated thereunder.
c. “Mutual Aid” refers to situations in which a licensed non-emergency
ambulance service is required, as determined by the Fire Department, to make
ambulances and personnel available for emergency response under the City’s
direction.
d. “SNOPAC” means the Snohomish County Police Staff and Auxiliary Service
Center.

e. “City” means the City of Arlington, Washington.
5.48.020 Applicability.
a. Since emergency medical service is provided in the City by its Fire
Department, the provisions of this chapter shall apply to non-emergency
ambulance services based within city limits and also to those whose
vehicles that enter the city on a regular basis to deliver or pick up patients.
b. Emergent and non-emergent ambulance services for the purposes of this
ordinance includes:
i. Inter-facility transports that occur at the BLS (non-emergent) and
Registered Nurse ambulance level.
ii. Any transports that would require a higher level of medical
services or personnel.
iii Advanced life support patients requiring transportation to facilities
south of Providence Medical Center (Everett) or north of Skagit
Valley Hospital (Mount Vernon) except in those cases where at
transport agency is not available.
iv Advanced life support patients that are non-emergent; i.e.,
patients that are in need of surgery, but the surgery is not
immediately necessary.
v. Basic life support patients that are going to be transported to any
area facility that is not within the City of Arlington.
vi. Basic life-support patients that can be transported via cabulance.
c. Nothing herein shall prohibit the Fire Department from operating
non-emergency ambulance services.
5.48.030 License Required – Application.
a. It shall be unlawful for any person, firm or corporation to operate or cause
to be operated (as described in Section 5.48.020(a) within the city limits
an ambulance or ambulance service without first being issued a license
therefore by the City. It shall also be unlawful for any person, firm or
corporation to violate any of the provisions of this chapter.
b. It shall be unlawful for any person, firm or corporation (other than the City
Fire Department) to operate or cause to be operated (as described in
section 5.48.020(a) emergency ambulance service within the city limits,
except as provided in Section 5.48.100.
c. Such license may be obtained by applying therefore at the office of the
City Finance Director on forms provided.

d. To the extent not inconsistent with other provisions of this chapter, the
provisions of Arlington Municipal Code Chapter 5.28 dealing with general
issuance of City licenses, shall be applicable to this chapter and are hereby
incorporated herein by this reference.
5.48.040 Standards for License.
a. All applicants shall be appropriately certified by the Secretary, and be in
good standing, pursuant to RCW 18.73 and applicable regulations adopted
from time to time. Upon receiving an application, the Finance Director
shall forward the application to the Fire Chief for review and approval.
No license shall be issued unless the Fire Chief is satisfied, pursuant to
policies duly adopted, that (a) the applicant is properly certified by the
state; (b) the applicant’s facilities, ambulances, and equipment meet State
standards; (c) employees of applicant are certified and in good standing;
(d) a record check of applicant and its employees by the Chief of Police
shows no criminal convictions of offenses having a direct adverse
relationship to custody of incapacitated persons, custody of narcotic or
controlled substances, or safe driving of emergency vehicles; and (e) the
applicant is otherwise in good standing and capable of performing
ambulance services.
b. Applicant shall obtain and at all times maintain in full force the following
insurance in amounts determined by the Fire Chief: (1) comprehensive
general liability, (2) automobile liability for all vehicles, and (3)
professional liability. Applicant shall provide an insurance certificate to
this effect, naming the City of Arlington as an additional insured for items
(1) and (2), above. Such policies shall also provide for prompt advance
notice to the City of intended cancellation of coverage.
5.48.050 Ambulance Personnel.
a. No ambulance shall be operated as such without at least two persons, each
of whom shall be an emergency medical technician (EMT), or person
licensed or certified by the State as having at least an equivalent or higher
level of training, and shall hold a valid Washington State driver’s license.
Such personnel shall not have been convicted of offenses having a direct
relationship to custody of incapacitated persons, custody of narcotic or
controlled substances, or safe driving of emergency vehicles.
b. Ambulance personnel shall have and maintain all certifications required
by the state department of health and local medical protocols established
from time to time by the Snohomish County Medical Program Director.
5.48.060 Ambulances and Equipment.

a. Ambulances shall be maintained and inspected pursuant to requirements
from time to time as adopted by the Secretary. All licensees shall provide
the Fire Department with copies of reports of inspection submitted to the
Secretary pursuant to RCW 18.73.145.
b. All ambulances and equipment storage and cleaning areas are subject to
inspection by the Fire Department, at reasonable times, to ensure that they
are maintained in a clean and functional state. Disinfection or chemical
sterilization of reusable equipment must meet guidelines established by
the National Center for Disease Control.
c. Licensees shall take immediate action to eliminate any unsanitary
condition when becoming aware of it and shall immediately correct any
situation about which the Fire Chief or the Secretary has delivered written
notice.
d. Ambulances shall not be used without the minimum equipment prescribed
by the Secretary. In the event any variance from requirements is granted
by the State, a licensee must apply for and obtain a similar such variance
from the Fire Department.
5.48.070 Performance Standards – Compliance – Records.
a. All services performed hereunder shall be in accordance with the
standards and principles of the course of instruction given EMTs or
paramedics, as the case may be, by the State, and pursuant to local medical
protocols established from time to time by the Snohomish County Medical
Program Director.
b. The Fire Department shall be informed by the licensee of rates charged
and changes in rates which may occur from time to time.
c. Records shall be logged by ambulance crews and shall include the
appearance and status of and treatment administered to injured, sick or
incapacitated persons treated or transported. Copies of such records shall
be mailed or otherwise delivered to the Fire Department on a weekly
basis, or more often if requested for good cause. Subject to the
requirements of the State Public Disclosure Act, such records are
confidential and shall be released only to proper officials of the City.
5.48.080 Emergency Notification.
a. In the event a representative of licensee, in responding to a non-emergency
call, discovers the existence of an emergency situation, he or she shall
immediately (1) call for fire department assistance via E-911 and comply
with all directions which may be given by SNOPAC, and (2) initiate
necessary patient care which the licensee is qualified to give.
b. In the event a call for emergency medical assistance is received by
licensee or a representative thereof, the caller shall be directed to call 911

(SNOPAC).
5.48.090 Response to Calls. It is unlawful for a licensee in responding by a vehicle
to any call to use emergency lighting or siren, unless (a) responding to
emergencies or transporting a patient in accordance with the mutual aid
provisions of this chapter or (b) directed to do so by SNOPAC.
5.48.100 Mutual Aid. A licensee is required to cooperate with any request by the
Fire Department for mutual aid assistance. At such times, the City may
dispatch ambulances to any point within Snohomish County. However, in
the event of any suit or claim arising out of activities under this section,
the City and licensee shall each be responsible for, and to the extent of,
their respective liability.
5.48.110 Penalty For Violation
a. In the event of a violation of any provision of this chapter, the Fire
Department shall promptly notify the licensee thereof and, if the situation
warrants it, give licensee a reasonable opportunity to take corrective
action.
b. Any licensee or employee of a licensee who violates any provision of this
chapter shall subject licensee to revocation of their license pursuant to
AMC Chapter 5.28. Any person violating a provision of this chapter shall
be subject to penalties as set forth in AMC section 5.28.190.
5.48.120 Appeals. Any person applying for or holding a license under this chapter
who believes he or she is aggrieved by an action of any City official in
connection with a license may timely appeal the matter to the Hearing
Examiner for review.
Section 3. Severability. Should any section, paragraph, sentence, clause or
phrase of this ordinance, or its application to any person or circumstance, be declared
unconstitutional or otherwise invalid for any reason, or should any portion of this
ordinance be pre-empted by state or federal law or regulation, such decision or pre-
emption shall not affect the validity of the remaining portions of this ordinance or its
application to other persons or circumstances.
Section 4. Effective Date. This ordinance shall take effect and be in full force
five (5) days after the date of publication as provided by law.

Resource Assessment

DESCRIPTION: The City has received a conditional offer for a $519,905 grant from the
Department of Ecology’s 2008 Stormwater Management Implementation Grants program. The
grant condition is that the City must complete a project SEPA review and Cultural Resources
Assessment (per EO 05-05) by March 31, 2008. Northwest Archaeological Associates is
currently under contract with the City to perform cultural resource and archeological work as
part of the WWTP project; they submitted a Scope of Work and cost estimate to perform the
Cultural Resource Assessment for the Stormwater Wetland project within the given timeframe.
This work will be performed as an amendment to their existing contract.
HISTORY: The City of Arlington purchased the Butler-Hammer property in Sept 2000 for the
specific purpose of constructing a stormwater wetland that would naturally treat stormwater
runoff from old town Arlington prior to its discharge into the Stillaguamish River. With the
recent issuance of the NPDES-Phase 2 stormwater permit and adoption of the Stillaguamish
TMDL Implementation Plan; completion of this project has greater urgency. In 2007 the
Department of Ecology issued a notice that it would accept applications for the 2008
Stormwater Management Implementation Grants program. The City applied for this grant to
assist with construction of the planned Stormwater Wetland. On Dec 21, 2007 the City received
notice that were placed on the draft offer list to receive $519,905 in grant funding for the
Stormwater Wetland project – that offer was final on Jan 31, 2008. We are currently working
with DOE on developing the Grant contract.
ALTERNATIVES: Do not perform the Cultural Assessment at this time; refuse the grant.
RECOMMENDED ACTION: No action at the February 11th meeting. This will be an action
item for the February 19th meeting. (Authorize the mayor to sign an amendment to the
Northwest Archaeological Associates contract authorizing them to perform the Stormwater
Wetland Cultural Resource Assessment per the submitted Scope of Work and cost estimate.)

The project is lo c a ted adja c e nt to and west of Sta te R o ute (SR ) 9, south o f the Stilla guam ish R iver and
le vee road , an d n orth o f S R 5 3 0 , in th e S W ¼ of S ectio n 2 , T o w n sh ip 3 1 N o rth , R a n ge 5 E ast, W illam e tte
M e rid ia n , S n o h om ish C o u n ty. T h is p ro je c t is fu n d ed in p a rt b y a g ra n t from th e W a sh in gton S ta te
D epartm e nt of Ecolog y a nd is thus subj e c t to Executiv e O rder 05-05 whic h require s re v ie w to dete rm ine
p otential im p acts to cultu ral resou rces th at are not un d ergoin g S ection 10 6 review un d er th e N ation al

p roh ib its kn ow in gly excavatin g or distu rb in g prehistoric an d historic archaeological sites on p u b lic or
private la nd and the India n G rav e s and R e c ords A ct [R C W 27.44] whic h pro hibits k nowing ly destro ying

and H isto ric Prese rvatio n (D A H P) in O lym pia , prio r to a ny field activ ity to dete rm ine the lo c a tio ns and
character of sites, bu ild in gs, and stru ctu res already record ed in th e project vicin ity. O th er in form ation
w ill b e collected from N W A A ’s p reviou s w ork in th e A rlin gton area, eth n og rap h ic an d h istoric accou n ts,
p reviou s region al cu ltu ral resou rce in vestigation s, local h istorical societies, city an d cou n ty offices,
in form ants, m aps, and ph otograph s. In -h ou se in form ation and resou rces w ill also b e con sulted for prior
arch aeo logical, eth n og rap h ic, an d h isto rical fin d ing s, an d oth er p u b lish ed an d m an u scrip t sou rce s.
The Stillag ua m ish Tribe and The Tula lip Tribe s will be conta c ted about the pro je c t to solicit any
ad d ition al co n ce rn s ab ou t heritag e resou rces an d to in form them w h en field in v es tig ation s w ill tak e p lace .

needed.
Ta sk 2 : Field Study
N W A A archaeologists w ill w alk system atic transects over th e project property w ith sp acin g no m ore th an
2 5 m eters (8 2 feet) to in spect th e su rface. U p to 85 han d -excavated shovel probes or su rface scrapes m ay
b e ex cavated to a m axim u m dep th of 60 cen tim eters to exp lore th e dep osition al settin g and search for
archaeological m aterial. N W A A m ay requ est th at th e city provid e a backh oe to assist in exam in ation of
su b su rface d e p osits . T h is w ill b e coo rd in ate d w ith th e U tilities D ivisio n . T h e su rvey w ill verify field
co nditio ns and ide ntify herita ge properties. The arc ha e olog ical survey will be co nduc ted by four
arch aeo logists ov er th ree d ays.
T h ere are at lea st th ree b u ild ing s or stru ctu res o n th e p ro je ct p rop erty that are likely old er th an 4 0 years.
If rese arc h co n firm s th is, they w ill b e reco rd ed an d evalu ated b y N W A A ’s arc h itec tu ral h isto rian .
Ta sk 3 : Analys is a nd Site F orm an d Report Prep aration
R esu lts of th e su rvey w ill be sum m arized and all sh ovel/auger probes will be exam in ed for in form ation
on dep osition al settin g and for possib le cu ltu ral content. N ew ly id entified sites w ill be record ed on
W ash in gton A rchaeological In ventory form s th at in clu d e w ritten d escrip tion of th e site an d its settin g,

sketc h maps, lo c a tion on U SG S 7.5 minute maps using G PS, and pho to graphs. H istoric buildings will be
p h otograph ed, d escrib ed, and docu m ent ed for th e state historic properties database . A d d ition al research
may b e n e c e ssa ry to evalu a te b u ild in g s for th e NRH P. Ele c tro n ic an d p ap er cop ie s of th e in v e n to ry forms
w ill b e p rep ared an d su b m itted to th e D A H P .
The re sults o f the se inv e stig a tions will be prese nted in a te c hnical repo rt suitable fo r subm ission by the
C ity to D A H P and oth er app rop riate agencies and affected trib es. T h e report w ill present th e resu lts of
arch ival an d field in vestig atio n s a n d in c lu d e re c om m en d atio n s fo r w ays to av oid , m in im ize, o r m itigate
ad v e rse effe c ts to h isto ric p rop erties an d ass e ss th e n eed fo r a d d itio n a l field w o rk to c o m p le te
id entification of heritage p rop erties if app rop riate. T h is report can be u sed to su p p ort preparation of
N EP A o r SE PA docum ents. D ue to confide ntia lity require m e nts fo r archaeo lo gic a l site lo c a tion,
d istribu tio n of th e rep o rt m ay b e restricted .

N W A A w ill coordin ate w ith th e C ity U tilities D ivision to receive p roject m aterials, p rep are progress
repo rts and inv oic ing and transm it co rre spo nde nc e . N W A A will maintain pro je c t file s to inc lude
n ecessary su p p ortin g m aterials as requ ired. T h e Project M anager w ill m on itor project task perform ance,
sc h e d u le, b u d g e t, an d ap p ro v e p ro j e c t ex p e n se s. T h e P ro j e c t M an ag e r w ill en su re th at syste m s a re in
p lace to cond u ct qu ality assurance and qu ality control on d eliverabl es and corresp on d ence.
