Council has requested a review of ordinance for accessory dwelling units (ADUs) proposed by
Councilmember Hopson.
HISTORY:
AMC 20.44.042‐Accessory Dwelling Units is attached and was last updated in 2003. On March 19th of
2018 City Council approved an amendment to the AMC waiving the utility hookup fees for accessory
dwelling units.

AN ORDINANCE OF THE CITY OF ARLINGTON, WASHINGTON,
AMENDING CHAPTER 20.44.042 – ACCESSORY DWELLING UNITS (ADUs)
OF THE MUNICIPAL CODE
WHEREAS, the City of Arlington has the authority to set rates and charges for its utility
system; and
WHEREAS, the City is interested in encouraging the use of accessory dwelling units
(ADUs) and wishes to amend provisions in the Arlington Municipal Code relating to utility
charges which may be applicable to said ADUs; and
WHEREAS it is the desire of the City Council to provide homeowners with flexibility in
establishing separate living quarters within or adjacent to their homes for the purpose of caring
for elderly parents, providing housing for their children, companionship, security, services, or
other purposes; and
WHEREAS it is the desire of the City Council to increase the supply of affordable housing units
within the community for low‐income people who might otherwise have difficulty finding
homes within the City of Arlington; and
WHEREAS it is the desire of the City Council to provide an alternative to rental projects that
create large and expensive buildings that alter the characteristics of a residential neighborhood;
and
WHEREAS it is the desire of the City Council to develop housing units in single‐family
neighborhoods that are appropriate for people at a variety of stages in the life cycle; and
WHEREAS it is in the best interest of the City to ensure that the development of accessory
dwelling units does not cause unanticipated impacts on the character or stability of single‐
family neighborhoods; and
WHEREAS it is the desire of the City Council to protect neighborhood stability, property values,
and single‐family residential appearance of the neighborhood; and
WHEREAS it the desire of the City Council to regulate ADUs by establishing specific design
standards; and
WHEREAS it is in the best interest of the City to implement comprehensive plan goals and
policies encouraging infill development, more efficient use of the remaining developable land,
protection of environmentally sensitive areas, and creating opportunities for more affordable
housing; and

WHEREAS the City of Arlington Public Works Department shall provide, at no charge, water and
sewer hookups for ADUs pursuant to Revised Code of Washington (RCW) 35.92.380, RCW
82.02.060;
NOW, THEREFORE the City Council of the City of Arlington, Washington do hereby ordain as
follows:
Arlington Municipal Code Section 20.44.042 – Accessory Dwelling Units (ADU) shall be and
hereby is amended to read as follows:
Definition
For the purposes of this ordinance, an Accessory Dwelling Units (ADU) includes a mother‐in‐law
quarters, guest house, granny flat, caretaker house, or rental unit.
Section 1. Applicability
A. Accessory Dwelling Unit Applicability. ADUs shall be allowed as limited uses in all residential
zoning districts if in compliance with all of the development standards contained below. ADUs
shall not be allowed in association with existing single‐family dwellings located within non‐
residential zoning districts. Pursuant to RCW 35.92.380 and RCW 82.02.060, ADUs must be used
for low‐income housing. Low‐income housing shall be defined as 30% of total tenant income
that is equal to or less than 80% of the annual median income (AMI) of Arlington. If converted
later on to higher‐income housing, the owner must pay all applicable fees in effect at the time
of conversion.
B. Approval process. A proposed ADU shall be subject to development standards below and
requires zoning verification.
Section 2. Development standards for accessory dwelling units
An ADU shall comply with the following standards:
A. Configuration. An ADU may be located either within, attached to, or detached from the
primary structure, including the conversion of part or an entire garage into an ADU.
B. Density. Only one ADU may be created in conjunction with each single‐family residence.
C. Minimum lot size. An ADU shall not be established on any parcel smaller than 3600 square
feet.
D. Maximum unit size. The gross floor area, calculated from finished wall to finished wall, of an
existing structure, an addition, or new detached structure, converted to, or constructed for the
purpose of creating an ADU shall not exceed 40% of the gross floor area of the primary single
family structure, not including garage and/or detached accessory buildings or 800 square feet
(whichever is less). The total square footage of impervious surfaces on the lot (lot coverage)
cannot exceed 35%.
E. Minimum unit size. The gross floor area of an ADU shall not be less than 300 square feet even
if this exceeds the maximum requirement in (D) above, or as otherwise established by the
requirements of the City Adopted Building Code.

F. Setbacks and lot coverage. Additions to existing structures or the construction of new
detached structures, associated with the establishment of an ADU shall not exceed the
allowable lot coverage or
encroach into required setbacks as prescribed in the underlying zone. The applicable setbacks
shall be the same as those prescribed for the primary structure, not those prescribed for
detached accessory structures.
G. Scale and visual subordination. The ADU shall be visually subordinate to the primary unit.
Specifically, new detached structures, or additions to existing structures, created for the
purpose of establishing an ADU, shall not comprise more than 40% of the total elevation of the
visible structures (the ADU and primary structure. The primary entrance to the ADU shall be
subordinated to the main home entry and located in such a manner as to be unobtrusive from
the street.
H. Parking. Off‐street parking shall be located to avoid negative impacts to neighbors and
community character (number of parking spaces as per AMC).
I. Design and appearance. Any additions should be consistent with the architectural character
of the home. An ADU, either attached or detached, shall be consistent in design and
appearance with the primary structure as determined by the City staff and Planning
Commission Design Review Board. Necessary fire egress stairs shall be located so that they are
not visible from the street.
J. Construction standards. The design and construction of the ADU shall conform to all
applicable
standards in the building, plumbing, electrical, mechanical, fire, health and any other applicable
codes.
K. Accessibility. To encourage the development of housing units for people with disabilities, the
Building Official may allow reasonable deviation from the stated requirements to install
features that facilitate accessibility. Such facilities shall be in conformance with the current
International Residential Building Code (IRC).
L. Cancellation. The owner may cancel the registration by filing a letter of request with the
Director of Community and Economic Development (CED) for recording purposes, or as a result
of enforcement action.
Section 3. Submission Requirements
The following information shall be submitted as part of an application for review:
A. Application. Completed and signed application provided by the Department of Community
and Economic Development.
B. Impact fees and Charges. Permit‐processing fee only. All standard hook‐up charges for sewer
and water utility tap‐in charges waived.
C. Site plan. To‐scale site plan showing the exact location of the primary residence and any
accessory structures, parking, landscaping and setbacks.
D. Floor plan. Floor plan, drawn to scale, of entire house and accessory unit within the primary
residence or within free‐standing accessory structure.
E. Elevations. Elevations drawn to scale, of the accessory unit within the primary residence or
within free‐standing accessory structure.

F. Covenant. Signed covenant by which the property owner affirms that he/she will occupy
either the primary residence or ADU.
G. Design Plan. Plans showing how ADUs will complement in design with existing structures,
specifically, siding materials, roof pitch, color and window design, as determined by City staff
and Planning Commission.
Section 4. Conversions of Existing Accessory Structures
A. Conversions of an existing structure. An existing garage structure or other outbuilding may
be converted to an ADU.
B. Off‐street parking requirements. Any off‐street parking requirements for the primary
residence can be provided for elsewhere on the site in conformance with the setback, paving
and other development guidelines and regulations. Off‐street parking shall be located to avoid
negative impacts to neighbors and community character (number of space as per AMC).
Section 5. Owner Occupancy
Owner occupancy residence requirement. The owner shall maintain residency on the premises
and at no time receive rent for, or otherwise allow to be occupied, the owner‐occupied unit.
Section 6. Severability
Should any section, paragraph, sentence, clause, or phrase of this ordinance be declared invalid
or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining parts of this
ordinance.
Section 7. Effective Date
The effective date of this ordinance shall be five (5) days after the date of publication.
Section 8. Copy to Commerce Department
Pursuant to RCW 36.70A.106(3), the City Clerk is directed to send a copy of this ordinance to
the State Department of Commerce for its files within ten (10) days after adoption of this
ordinance.

(a) Only one ADU per detached single-family residence is allowed.
(b) An ADU may be either attached or detached to the primary residence.
(c) The ADU may not comprise more than twenty-five percent of the gross floor area of the primary
residence or more than a total of eight hundred square feet, whichever is lesser, nor be less than
three hundred square feet.
(d) The primary entrance to the ADU shall be subordinated to the main home entry and located in such a
manner as to be unobtrusive from the street.
(e) Any additions should be consistent with the architectural character of the home. Materials, roof
forms, and window proportions should match that of the existing building.
(f) Any major exterior additions or alterations should be located to the rear of the home. Any necessary
fire egress stairs shall be located so that they are not visible from the street.
(g) The required off-street parking shall be located to avoid negative impacts to neighbors and
community character.

DESCRIPTION:
The council met in March 2018 to discuss and identify priorities for the 2019/2020 budget. Staff will
be developing a budget based on council priorities. Staff will present the preliminary budget to council
at the budget retreat on October 6. Attached is the budget calendar for adoption of the 2019/2020
budget and dates for amending the 2018 budget.
HISTORY:
On March 7, 2016 the council approved Ordinance No. 2016‐005 establishing a biennial budget
process. The City’s first biennial budget was 2017/2018.
ALTERNATIVES:
Use alternative dates for adopting the 2019/2020 budget and amending the 2018 budget.
RECOMMENDED MOTION:
Workshop; discussion only. At the June 18 council meeting, the recommended motion will be, “I

DESCRIPTION:
Request for sole source authorization allowing the City to have Flygt pumps repaired by the only
Washington state manufacturer authorized distributor/repair facility.
HISTORY:
The impellers on the membrane bioreactor Return Activated Sludge (RAS) pumps that are used at
Water Reclamation Facility have worn away and are in need of replacement. The RAS pumps are
Flygt brand pumps and are only serviceable by an authorized Flygt service facility. Whitney
Equipment Company, Inc. in Woodinville, WA is the sole Washington state authorized Flygt
distributor and service repair facility.
These pumps were installed at the time of construction, in 2010, and used a Gray Cast Iron
190HB impeller (only type available at that time). The replacement impellers will be the new Hard
Iron HRC60 impeller, impellers that will have triple the life expectancy of original impellers.
ALTERNATIVES:
Do not issue sole source resolution; remand to staff for further consideration.
RECOMMENDED MOTION:
Workshop; discussion only. At the June 18, 2018 council meeting the recommended motion will be,
“I move to recognize Whitney Equipment Company, Inc. as the only Flygt authorized service facility
in Washington state and approve a Sole Source Resolution allowing the City to contract for the
repair of the Water Reclamation Facility pumps”.

A RESOLUTION OF THE CITY OF ARLINGTON TO WAIVE BIDDING REQUIREMENTS FOR THE
PURCHASE AND OR REPLACEMENT OF THE MBR RETURN ACTIVATED SLUDGE (RAS) PUMPS
FOR USE BY THE CITY OF ARLINGTON WASTEWATER DEPARTMENT
WHEREAS, the City of Arlington Wastewater Department treats wastewater for all of its
customers; and
WHEREAS, to maintain the consistency of parts, ensure the warranty of the RAS Pump
System at the Wastewater Treatment Plant, and avoid the cost associated with repairs to the
system that may occur using non genuine original equipment manufacturer (Flygt) replacement
parts, a supplier of Flygt RAS Pumps is required; and
WHEREAS, Whitney Equipment Company has provided the City of Arlington with its
existing RAS Pumps, and Whitney Equipment Company Inc. is the sole source representative
authorized to sell Flygt brand pumps; and
WHEREAS, RCW 35.23.352(9) permits the waiving of bidding requirements for the
purchase of materials which are clearly and legitimately limited to a single source of supply or
services which are subject to special market conditions;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arlington, as
follows:
Section 1: The City Council of the City of Arlington finds that replacing RAS
Pumps with Flygt brand pumps clearly limits the City of Arlington to a single
source of supply, justifying the waiver of competitive bidding requirements.
Section 2: The City Council of the City of Arlington hereby waives the bidding
requirements for the purchase, replacement, and or repair of RAS Pumps for use
by the City of Arlington Wastewater Department and authorizes sole source
purchasing from Whitney Equipment Company, Inc.
Section 3: This resolution will be effective for three (3) years from the date of
adoption.

A periodic review is required by the Shoreline Management Act (SMA) per RCW 90.58.080 (4). The
Department of Ecology is awarding grant funds to help in completing this update. The amount of
funding is based on population, and Arlington is eligible for $15,000.00 in funds.
HISTORY:
The City of Arlington’s Shoreline Master Program was originally created by the Watershed Company
in 2011 through a Department of Ecology grant and adopted by City Council August 6, 2012. The
intent is to have the Watershed Company perform the required update, through a Professional
Service Agreement (PSA), since they were the original authors, saving both time and money.
ALTERNATIVES:
Do not accept the grant and incur the cost of the required update.
RECOMMENDED MOTION:
Workshop; discussion only. At the June 18, 2018 council meeting, the recommended motion will be,
”I move to accept the available grant funding of $15,00.00, from the Department of Ecology for the

A RESOLUTION OF THE CITY OF ARLINGTON AUTHORIZING ACCEPTANCE OF GRANT FUNDS FROM
THE DEPARTMENT OF ECOLOGY FOR THE PERIODIC UPDATE OF THE CITY’S SHORELINE
MANAGEMENT PROGRAM
WHEREAS, the Shoreline Management Act requires a periodic review and update of the
local governments Shoreline Management Program; and
WHEREAS, the Department of Ecology is awarding grants to cities and counties to help
fund this periodic update; and
WHEREAS, the Department of Ecology has offered to award a grant in the amount of
$15,000.00 to the City of Arlington to complete the required update of the comprehensive
Shoreline Management Program; and
WHEREAS, the City of Arlington considers it in the best public interest to accept the
available grant funding for the periodic update of its Shoreline Management Program; and
NOW, THEREFORE, the City Council of the City of Arlington Washington do hereby
resolve as follows:
1. That the Mayor be authorized to accept the grant funding offered by the Washington
State Department of Ecology, in the amount of $15,000.00, for the above noted periodic
update to its Shoreline Management Program.
