DEPARTMENT OF ORIGIN Public Works – Jim Kelly EXPENDITURES REQUESTED: None BUDGET CATEGORY: N/A BUDGETED AMOUNT: N/A LEGAL REVIEW: DESCRIPTION: Proposed adoption of the 2017 Amendments to the 2015 Water System Comprehensive Plan per recommendation by the City of Arlington Planning Commission. HISTORY: As required by Washington State Department of Health (DOH) and Washington Administrative Code (WAC) 246‐290‐100, the City of Arlington is required to update its Water Comp Plan (Plan) every 10 years or when as necessary to support changes to the City’s GMA Comprehensive Plan. Following recent modifications to the City’s GMA Comprehensive Plan, staff amended the Water System Comprehensive plan to stay consistent with the General Comprehensive Plan. The 2017 Amendments to the 2015 Water Comprehensive detail how the Water Utility will safely, efficiently, and financially operate, maintain and expand the water system to meet community needs as detailed in the City’s 2017 GMA Comprehensive Plan. The Plan received approval from the Washington State Department of Health. A public hearing was held in front of the Arlington Planning Commission on July 18, 2017 where the plan received approval and recommendation for City Council adoption. ALTERNATIVES: Remand to staff for more information. RECOMMENDED MOTION: Workshop; discussion only. At the October 2, 2017 meeting the motion will be: “I move to accept the recommendation of the Planning Commission and adopt the Amendment to the 2015 Water Comprehensive Plan Update.” ORDINANCE NO. 2016-XXX ORDINANCE NO. 2016--XXX AN ORDINANCE OF THE CITY OF ARLINGTON, WASHINGTON, MAKING CERTAIN FINDINGS AND ADOPTING BY REFERENCE AMENDMENTS TO THE COMPREHENSIVE WATER SYSTEM PLAN FOR THE CITY OF ARLINGTON WHEREAS the City of Arlington operates a water system governed in part by Washington Administrative Code (WAC) Chapter 246-290; and WHEREAS, the City of Arlington is required to periodically take legislative action to review and, if needed, revise its comprehensive water system plan, including capital improvement plans, service levels, and operational and maintenance plans to ensure compliance with city policies, state and federal regulations, to identify any deficiencies which present threats to public health and safety, and to develop and identify funding sources and requirements; and WHEREAS, the City of Arlington’s comprehensive water system plan was amended in 2004 and again in 2011; and WHEREAS, the City of Arlington contracted with RH2 and FCS Group to conduct a thorough review of the City’s water comprehensive plan and prepare with the assistance of city staff analyses of that portion of the water comprehensive plan currently in effect in the City of Arlington for consistency with the requirements of state law; and WHEREAS, the City Council adopted of Ordinance No. 2015-014 on July 6, 2015, noting that portions of the comprehensive water system plan were still in process though the plan was substantially complete; and WHEREAS, based on its review of the requirements of WAC Chapter 246-290 and other requirements of state law, the Planning Commission conducted a public hearing and took public testimony on December 21, 2015; and WHEREAS, the City Council considered the recommendation of the Planning Commission at its workshop on January 11, 2016 and thereafter took the matter under consideration at its January 19, 2016 public meeting; and WHEREAS, based on its review of the requirements of state law, the analysis and proposed revisions prepared by the Planning Commission and staff, and the public comments received, the City Council finds and declares that the review and needed revisions have been prepared in conformance with applicable law, including Chapter 36.70A RCW, Washington Administrative Code Chapter 246-290, RCW Chapter 43.21C RCW, and the approved public participation and adoption process; and WHEREAS, based on its review of the requirements of state law, the analysis and ORDINANCE NO. 2016-XXX proposed revisions prepared by the Planning Commission and staff, the recommended findings on review and proposed revisions forwarded by the Planning Commission, and the public comments received, the City Council hereby finds and declares that Arlington's comprehensive water system plan as revised by this ordinance complies with the requirements of state law; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARLINGTON, WASHINGTON, DOES MAKE THE FOLLOWING FINDINGS: 1. Findings. The Arlington City Council finds that: a. The City has established and followed a public participation program in accordance with RCW 36.70A.130(2)(a), which program was formally adopted and followed by the City via City of Arlington Resolution #2014-022. b. The City Council believes that the SEPA Determination of Non-Significance (DNS) issued by the City’s Responsible Official for the Water System Plan update adequately evaluated all known environmental issues associated with the adoption of the updates to the comprehensive plan. c. The comprehensive water system plan identifies operational and capital improvement projects to meet growth projections established in the Arlington General Comprehensive Plan, adopted July 6, 2015. d. Notice of all amendments to the comprehensive plan adopted to fulfill the state law was sent to the Washington State Department of Health and the Snohomish County Planning Department. e. The City Council finds that the review and needed revisions to the Water Comprehensive Plan have been prepared in conformance with applicable law, including Chapter 36.70A RCW, Chapter 43.21C RCW, WAC Chapter 246-290, and the approved public participation and adoption process and, taken collectively, are in the best interests of all its citizens. NOW, THEREFORE, the City Council of the City of Arlington does hereby ordain as follows: Section 1. Adoption of Water Comprehensive Plan. The City Council approves that certain Comprehensive Water System Plan prepared by the City of Arlington staff with assistance from RH2 Engineers and the FCS Group dated January 2016, as amended, a true copy of which is attached to the original of this ordinance as Exhibit “A” hereto. Section 2. Adoption of Water Use Efficiency Goals. The City Council approves the Water Use Efficiency Goals prepared for adoption and attached hereto as Exhibit “B” hereto. Section 3. Severability. If any provision, section, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged inv alid or unconstitutional. This ordinance or a summary thereof consisting of the title shall be published in the official newspaper of the City, and shall take effect and be in full force five (5) days after publication. The Asset Management purchase was included in the 2017 budget. HISTORY: The City has been using Cartegraph for asset management and work scheduling for over six years, the existing program is cumbersome and has limitations that do not make it productive for the City. As such, the city planned and budgeted for new asset management software in the 2017. The city issued a Request for Proposals on June 1, 2017, eight proposals were received and four selected for presentation. After reviewing all presentations and proposals, the selection rated the proposals and unanimously concluded the Novotx (Elements) was the best product. ALTERNATIVES: ‐ Reject all proposals ‐ Publish a new Request for Proposal ‐ Continue utilizing current software system RECOMMENDED MOTION: Workshop; discussion only. After the guaranteed price period, price increases are not to exceed the Consumer Price Index. Payment Terms Payment terms are outlined below. Terms of Sale City has ordered and agrees to purchase from Novotx the products and services defined under this Sales Agreement at the listed quantities and rates. Upon receipt of an executed Sales Agreement Novotx shall ship all products to the City address and contact defined above and services shall be scheduled and initiated. City acknowledges that Novotx's products and services are subject to the terms and conditions of a separate Software License Agreement between the City and Novotx unless they are contrary to this Agreement. Novotx hereby disclaims all representations and warranties with respect to any product which is not manufactured or otherwise created by Novotx, whether express, implied or statutory including but not limited to, any warranties of merchantability, fitness for a particular purpose, title or non-infringement. Payment for products and services shall be made by the City based on the Payment Terms defined in the Sales Agreement. City understands and agrees that it is responsible for paying any sales, use, excise or transaction taxes with respect to the products and services under this Sales Agreement. If City is tax exempt, City shall provide Novotx with such tax exemption documentation. If City is not tax exempt or does not provide exemption documentation, Novotx shall invoice for such applicable taxes on each invoice. In the event that Novotx does not invoice sales or similar taxes to City and such taxes are ultimately determined to be due by a government entity or court of law, City agrees to pay in full all such taxes, including any applicable interest or penalties. In the event the tax exemption documentation provided by the City is disallowed or deemed invalid, City agrees to pay in full all such taxes, including any applicable interest or penalties. The pricing here does not include this software and the City is responsible for purchasing, installing, and maintaining these applications. •Additional consulting or services beyond the scope of this sales agreement will be billed at $1,200 per day; any additional fees beyond the scope of this agreement will require separate Sales Agreements and must be approved by the City prior to performing the services. Hourly service rates are $150 per hour for services that require less than 1 day. The resolution has been approved by the Airport Commission, but requires final approval by the City Council. HISTORY: Hangar 57 B located on the airfield was built in 1986, is approx. 6,800 square feet and originally occupied by Bayliner to store their company aircraft. The hangar is in fair condition but needs some major repairs including a new roof, painting, electrical, HVAC, etc. The building located at 19319 63rd Ave NE, is also in fair condition, is 10,000 square feet and is also in need of similar repairs (the condition of the roof is unknown.) It has been the practice of the Airport Commission that, when possible, to sell buildings that have reverted to airport ownership. The airport does not have the staff to maintain these large structures and both staff and the commission feel that the capital improvements necessary to bring these building back into good condition would be better spent on airfield projects that benefit all of our tenants. Jennifer Egger was hired to replace Ms. Holocker and is willing and able to finish Ms. Holocker’s term on the lodging tax committee. The term will expire April 2019. HISTORY: State law requires that the LTAC be comprised of an equal number of representatives from those entities that collect the tax (hoteliers) and those that receive tax (grant recipients). HISTORY: ALTERNATIVES: RECOMMENDED MOTION: Workshop; discussion only. 1    2017 August Financial Report – Kristin Garcia, Finance Director  GENERAL FUND   The general fund’s ending fund balance as of August 31, 2017 was $2,595,224 and on track to where  we should be this time of the year.    Sales tax revenues, as of August 31, are continuing to exceed projections, up 8% from collections  this same time last year.  A slight modification will be proposed for the 2017 and 2018 budget to  reflect current projections.  Telephone tax revenues, as noted previously, are continuing to trend downward.  I estimate we’ll be  slightly short of 2017 budget projections, therefore, a budget modification for 2018 will be proposed  for this revenue line item.  Building permit revenues, as of August 31, have exceeded projections by $184,373!  Based on  current projects, we expect the level of activity to continue into next year.  We will include a  modification for the 2017 and 2018 budget to increase permit revenues to align with current activity  levels.  OTHER FUNDS  Social Services Fund – In the month of August, we received donations totaling $126 with $100 of  that amount received from Nasty Jack’s Candy.  EMS Fund – The ending fund balance at August 31 was $88,434.  Year to date transport fees are  $688,393 and about 1% above budget projections.   OTHER ITEMS  Audit Update – The auditors arrived on site Monday September 18 to begin the 2016 audit.  They  are beginning the review of the 2016 financial statements, performing an overall risk assessment  and a tour of both the Airport and Police facilities.  Council will be notified once the date of the  entrance conference is scheduled which will provide more detail with the scope of the audit.  Passports – We began accepting passport applications September 5 and have processed 13  applications so far this month!  I’ll continue to have this as a regular item on the monthly report so  you’ll be able to monitor the activity level.    Investment Interest – Combined revenues for all funds are also exceeding budget projections!  We  are about $6,500 over what we projected to receive in investment earnings.  This is a result of  higher interest rates and an increase of the amount we’re able to invest.
