CONSENT AGENDA Chris Raezer moved and Debora Nelson seconded the motion to approve the Consent Agenda which was unanimously carried to approve the following Consent Agenda items: 1. Minutes of the October 5 and October 12, 2015 Council Meetings 2. Accounts Payable: EFT Payments & Claims Checks #85570 through #85683 dated October 6, 2015 through October 19, 2015 in the amount of $865,984.11. PUBLIC HEARING Finance Director Kristin Garcia reviewed by PowerPoint the 2016 Budget. City Administrator Paul Ellis clarified the Public Safety Director position. Public Hearing opened at 7:09:50. No one wishing to speak, the public hearing portion was closed at 7:10:02. Council questions were opened at 7:10:05. Hearing closed at 7:13:55. Kristin Garcia reviewed by PowerPoint the 2016 Proposed General Fund & EMS Property Tax Levies. Public Hearing opened at 7:16:51. Minutes of the Arlington Cit Council Meetin Minutes of the City of Arlington City Council Meeting October 19, 2015 Page 2 of 3 NEW BUSINESS Ordinance Amendment to AMC 20.64.210 Community and Economic Development Director Chris Young spoke to the editorial changes to Title 20, Section 20.64.210 Encroachments, is needed to be consistent with the regulatory flood plain law, 44 CFR 60.3 (c)(10) and our local floodplain ordinance. Marilyn Oertle moved and Chris Raezer seconded the motion to approve the proposed ordinance relating to land use and zoning; amending Section 20.64.210 of the Arlington Municipal Code. The motion was approved by a unanimous vote. Ordinance Amending Title to AMC Chapter 20.93-Environmentally Critical Areas; Editorial Change to AMC Chapter 20.88-Environmentally Critical Areas Chris Young requested council approve the amendments to Chapter 20.93 and Chapter 20.88 which are both titled “Environmentally Critical Areas.” City Attorney Steve Peiffle noted a typographical error which will be corrected in the final draft of the ordinance. Marilyn Oertle moved and Jesica Stickles seconded the motion to adopt the ordinance amending the title to AMC Chapter 20.93, and direct staff to request correction of the editorial comment to AMC 20.88. The motion was approved by a unanimous vote. CPG Grant (Recycling) from Dept of Ecology for 2015-2017 Public Works Executive Assistant and Staff Accountant Kris Wallace requested council accept the Department of Ecology grant in the amount of $26,071.40, with a $6,517.85 match obligation by the City, to continue to fund the City’s refuse and recycling program for fiscal years 2015-2017. Austin DeFreece moved and Chris Raezer seconded the motion to accept the Coordinated Prevention Grant offered by the Department of Ecology for fiscal year 2015 to 2017 and authorize the mayor to sign the grant agreement, pending final review by the City Attorney. The motion was approved by a unanimous vote. Ordinances updating Low Impact Development (LID) Standards and Codes Stormwater and Natural Resources Manager Bill Blake spoke briefly to the Low Impact Design Code (LID) updates which are required by the 2013 – 2018 NPDES Phase II Permit. Austin DeFreece moved and Debora Nelson seconded the motion to approve the ordinance amending the City of Arlington Development Design Guidelines and Central Business District Design Guidelines relating to Low Impact Development (LID) Standards. The motion was approved by a unanimous vote. Austin DeFreece moved and Randy Tendering seconded the motion to approve the ordinance amending Title 20 of the Arlington Municipal Code relating to Low Impact Development (LID) Standards. The motion was approved by a unanimous vote. Austin DeFreece moved and Chris Raezer seconded the motion to approve the ordinance amending Chapter 13.28 of the Arlington Municipal Code relating to Low Impact Development (LID) Standards. The motion was approved by a unanimous vote. Six Year Transportation Improvement Plan (TIP) Resolution Public Works Director Jim Kelly requested Council adopt the City’s proposed Six Year Transportation Improvement Plan (TIP). Minutes of the City of Arlington City Council Meeting October 19, 2015 Page 3 of 3 Debora Nelson moved and Marilyn Oertle seconded the motion to approve the proposed resolution adopting the City of Arlington 2016-2021 Six Year Transportation Improvement Plan. The motion was approved by a unanimous vote. ADMINISTRATOR & STAFF REPORTS None. COUNCIL MEMBER REPORTS and MAYOR’S REPORT Austin DeFreece, Jan Schuette, Marilyn Oertle, Chris Raezer, Debora Nelson, Jesica Stickles and Randy Tendering gave brief reports. Mayor Tolbert stated she attended a meeting in Everett with Public Safety Director Stedman and other law enforcement officials regarding services for the homeless. Mayor Tolbert also commented on AWC’s Legislative Agenda and suggested it be a topic of conversation at a future workshop. EXECUTIVE SESSION None. WORKSHOP ITEMS – NO ACTION WAS TAKEN Snohomish County Emergency Management Interlocal Agreement (ILA) Stormwater and Natural Resources Manager Bill Blake introduced a proposed Interlocal Agreement between Snohomish County Emergency Management, Cities and Tribes. This agreement outlines services and actions coordinated between the participating members. The City of Arlington has been coordinating with Snohomish County Emergency Management for a number of years. This agreement will be in effect for three years, January 2016 – December 2018. A discussion with council questions followed. Blue Marble Recycling Contract Amendment Public Works Director Jim Kelly spoke regarding Amendment No. 1 to the existing Professional Services Agreement (PSA) with Blue Marble Environmental to continue to provide waste management outreach and educational support to Arlington’s businesses, schools and citizens for the 2015-2017 biennium. The City has been under contract with Blue Marble Environmental since 2006. Blue Marble has been focusing on recycling with schools, businesses, and multi-family dwellings. A discussion with council questions followed. Discussion of the 2016 Budget Finance Director Kristin Garcia spoke regarding the 2016 budget and general levy, as well as transferred change to the capital projects proposed for the Airport in 2016. The Mayor’s budget proposes no increase to the City’s general property tax rate. At last week’s Council meeting, Councilmembers requested that staff present all three options available to the Council in setting the 2016 property tax levy. In response to this request, Kristin presented three options: Option 1: No tax increase, preserve 1% capacity for future use which equals $39,174. Option 2: Increase tax levy by .251% which equals $9,832, preserve remaining capacity up to 1% for future use. Option 3: Increase tax levy by 1% which equals $39,174, no capacity to preserve. With the use of a PowerPoint presentation, City staff presented the preliminary 2016 Budget. Discussion followed. City Council issues and concerns The attendees of the retreat reviewed and discussed the items tabled throughout the day. The topics included:  Property tax foreclosures within City of Arlington  Request to see 2015 and 2016 budget side by side with year to date at the October 12 review  Emergency notification protocol – how do we notify in those rare situations.  Electronic communications for City officials and City staff to ensure compliance with the Public Records Act and Open Public Meetings Act. (Nissen v. Pierce County Supreme Court case)  Follow up to Council for resolution of concerns expressed at City Council meeting 2014 Audit Results Staff reviewed the 2014 Audit results with the Council and Senior Managers. The Exit Conference for the 2014 Audit will be held on September 28, 2015. DEPARTMENT OF ORIGIN Finance: Kristin Garcia – Finance Director EXPENDITURES REQUESTED: 0 BUDGET CATEGORY: Regular Property Tax Levy LEGAL REVIEW: DESCRIPTION: Two resolutions to set the regular property tax levy for 2016 will be presented to Council for approval on November 2, 2015. Each resolution will need to be approved separately. The first resolution is to increase the 2016 regular property tax levy which must state the amount of the increase in terms of dollar and percentage. The resolution reflects an increase of 1% from the prior year levy which is $39,174.17. The second resolution will authorize an increase in tax levy capacity and increasing the limit factor to 101% of the previous year’s levy. The resolution also establishes “substantial need” and is required because the increase of 1% exceeds the Implicit Price Deflator (IPD). HISTORY: On September 26, 2015 a retreat was held with Council to discuss the initial budget for 2016, including the general property tax levy. On October 5, 2015 the preliminary budget was delivered to Council. On October 12, 2015, a workshop was held to review and discuss the 2016 budget. RESOLUTION NO. 2015-xxx A RESOLUTION OF THE CITY OF ARLINGTON TO INCREASE THE 2016 EMS TAX LEVY WHEREAS, the City Council of the City of Arlington has met and considered its budget for the calendar year 20 16; and WHEREAS, the City's EMS actual tax levy amount from the previous year (2015) was $927,421; and WHEREAS, the population of the City of Arlington is more than 10,000, and now therefore, BE IT RESOLVED by the City Council of the City of Arlington that an increase in the regular property tax levy is hereby authorized for the levy to be collected in the 2016 tax year. The dollar amount of the increase over the actual levy amount from the previous year shall be $9,274.22 which is a percentage increase of 1% from the previous year. This increase is exclusive of additional revenue resulting from new construction, improvements to property, newly constructed wind turbines, any increase in the value of state assessed property, any annexations that have occurred and refunds made. Barbara Tolbert, Mayor ATTEST: Kristin Banfield, City Clerk APPROVED AS TO FORM: Steve Peiffle, City Attorney RESOLUTION NO. 2015-XXX RESOLUTION NO. 2015-XXX A RESOLUTION OF THE CITY OF ARLINGTON, WASHINGTON AUTHORIZING AN INCREASE IN EMS TAX LEVY CAPACITY PURSUANT TO RCW 84.55.120 AND AN INCREASE IN LIMIT FACTOR FOR MAXIMUM EMS LEVY CAPACITY PURSUANT TO RCW 85.55.0101 WHEREAS, the City Council of the City of Arlington has met and considered its budget for the calendar year 2016; and WHEREAS, increases in regular property taxes imposed by the City are limited by Chapter 84.55 RCW so that the EMS tax levy of the City may increase from year to year by an amount equal to the limit factor (plus increases permitted due to new construction, refunds and increases in value of state assessed property); and WHEREAS, pursuant to RCW 84.55.005 and 84.55.010, the limit factor for the City’s 2015 EMS tax levy (2016 collection) is 1.01 of the City’s 2014 tax levy (2015 collection); and WHEREAS, the highest regular EMS tax that could have been lawfully levied by the City beginning with the 1985 levy is equal to $936,696 (“Highest Levy Available”); and WHEREAS, the City has an ongoing need to provide emergency medical services to its constituents; and WHEREAS, the City has determined it has substantial need and would like to use its levy capacity for 2016; and WHEREAS, the City is authorized to increase its Highest Levy Available by one percent, which equals $9,274.22. NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Arlington taxing district has determined that due to an increase in general and operations expenses, the City Council finds there is a substantial need to set the levy limit at one hundred one percent (101%). On November 2, 2015, the 2016 budget ordinance will be presented to Council for approval. The total amount of expenditures requested for 2016, representing all City funds, is $50,248,471 of which $14,582,866 is from the general fund. HISTORY: On September 26, 2015 a retreat was held with Council to discuss the initial budget for 2016, including the general property tax levy. On October 5, 2015 the preliminary budget was delivered to Council. On October 12, 2015, a workshop was held to review and discuss the 2016 budget. City of Arlington Council Agenda Bill Item NB #4 Attachment E COUNCIL MEETING DATE: November 2, 2015 SUBJECT: Collective Bargaining Agreement between the City of Arlington and the Arlington Police Officers Association for 2015-2016 ATTACHMENTS: Handout DEPARTMENT OF ORIGIN Administration; Contact Kristin Banfield 360-403-3444 EXPENDITURES REQUESTED: -0- BUDGET CATEGORY: N/A LEGAL REVIEW: DESCRIPTION: Council is asked to approve the Collective Bargaining Agreement between the City of Arlington and the Arlington Police Officers Association for 2015-2016 and authorize the Mayor to sign it. The Arlington Police Officers Association has already ratified the agreement. HISTORY: The prior collective bargaining agreement covering the period from January 1- December 31, 2013, which was extended by a Memorandum of Understanding for January 1-December 31, 2014. The two parties have been negotiating on a successor agreement since October 2014. ALTERNATIVES RECOMMENDED MOTION: I move to approve the Collective Bargaining Agreement between the City of Arlington and the Arlington Police Officers Association for 2015-2016 and authorize the Mayor to sign it. The County Emergency Management Department has continued to evolve over time as the need for preparedness and response has grown with the population growth. HISTORY: The City has been under contract with Blue Marble Environmental since 2006 for providing coordinated waste management outreach and educational services promoting recycling and waste disposal reduction citizens, businesses, schools and industries of Arlington. The Department of Ecology funds 75% of this program under the Coordinated Prevention Grants (CPG) program; Public Works funds the remaining 25% of the program. The City entered into a new Professional Services Agreement with Blue Marble in 2013 for the 2013-2015 grant cycle. This amendment will allow the City to continue to provide waste management outreach and educational support to Arlington’s businesses, schools and citizens for the 2015-2017 biennium. The work will be performed and invoiced in accordance with the terms and conditions listed in the Original Agreement.
