In September 2014, the finance director retired. During the retirement transition, recording of the bond issuance in the accounting system was overlooked. The accounting error did not impact ending fund balances, nor impact the City’s cash position but did impact the need for a final budget amendment, for the general fund, at the end of 2014. The accounting error was discovered subsequent to year end so a budget amendment could not be approved in a timely manner. Corrective action has been taken as well as a change in procedure to prevent future errors. See executive summary for a more detailed description. HISTORY: See attached executive summary. EXECUTIVE SUMMARY  In 2014 the City took steps to increase its bond rating, reduce bond interest costs and retire  interest only debt in favor of debt that can be reduced through making principal payments.  As  a means to achieve these efforts, the City issued refunding bonds in August 2014.    Shortly after the bond issuance, the finance director retired.  At that time, it was customary  practice to record various types of financial data (including debt) on spreadsheets that were  external to the accounting system.  The spreadsheets were then used to record the data into  the accounting system. During the retirement transition, the bond issuance was overlooked and  not recorded into the accounting system.  The transaction should have been recorded to reflect  an increase in revenues representing bond proceeds (the refunding bonds) and a corresponding  increase in expenses representing the bonds that were paid off (the refunded bonds).    The accounting error resulted in revenues and expenditures exceeding original budget  appropriations in the general fund. The accounting error did not impact ending fund balances  nor did it negatively impact any other funds.  Please refer to the chart for illustration of the  general fund’s beginning and ending fund balance before and after the accounting error;  ORIGINAL   Beg. Fund Balance Revenues Expenditures Ending Fund Balance  505,494 13,611,538 (13,109,456)1,007,576      CORRECTED   505,494 20,353,587 (19,851,505)1,007,576    This chart shows the difference between final approved appropriations and actual expenses  after the accounting error was recorded;  ORIGINAL   Final Appropriations Actual Expenses Variance 13,235,530 11,964,256 1,271,274     CORRECTED   13,235,530 19,851,505 (6,615,975)   The error was found during preliminary audit procedures and immediately corrected, however  because the error was found subsequent to year end, a legal budget amendment could not be  adopted in a timely manner.  State statute requires all budget amendments be approved before  fiscal year end. The error will most likely result in a financial statement finding once the audit is  complete.     It is the priority of the finance department to maintain high standards and accuracy, therefore  the following procedures have been changed to prevent future errors;  elimination of external  spreadsheets to record financial data, consultation with other accounting professionals when  unusual transactions occur, continuing education for finance department staff, and an  enhanced financial statement review process.    City of Arlington Council Agenda Bill Item: WS #5 Attachment B COUNCIL MEETING DATE: July 27, 2015 SUBJECT: June 2015, Quarter 2 Financial Report ATTACHMENTS: Financial Reports – Narrative Revenue Charts General Fund Operating Statement Other Fund Operating Statements DEPARTMENT OF ORIGIN Finance: Kristin Garcia – Finance Director EXPENDITURES REQUESTED: 0 BUDGET CATEGORY: N/A LEGAL REVIEW: DESCRIPTION: Attached is the June 2015 financial report. Staff will answer questions. HISTORY: ALTERNATIVES RECOMMENDED MOTION: Workshop; discussion only. 1    2015 June Financial Report – Kristin Garcia, Finance Director    GENERAL FUND   The General Fund Ending Fund Balance was $1,667,809.  We’ve received 52.61% of property taxes  with the next large payment expected in November.  Based on historical trends, the City is collecting  100% of its tax levy, therefore we’re on track to meet the amount budgeted of $3,920,000.  Retail sales tax dollars (1%) received in the General Fund YTD (Jan ‐ June 2015) are $1,751,634 which  is approximately $124,789 more than the amount received for the same time period in 2014.  Based  on historical collection trends of actual revenue received and the percentage collected of budget  the past 3 years, I estimate 2015 sales tax collections to be 3% higher than what we collected last  year and 1% over what we budgeted.  Utility taxes (combined) received YTD (Jan – June 2015) are $1,537,829, about $29,849 less than  what was received during this time period in 2014.  This is because both natural gas and telephone  taxes are lower than last year.  Most likely natural gas is lower due to the unusually warm weather  we’ve had since early in the year.  As we’ve noted before, telephone taxes are on a decline as  people are removing their land lines in favor of cell phones.  We’ll need to consider this trend as we  begin developing the 2016 budget.    Gambling taxes have already exceeded the budget by $865.78.  Gambling tax revenues by year end  in 2014 also exceeded the budget by over $20,000.  As we begin to build the budget for 2016, we’ll  need to consider whether a slight increase is appropriate.  Building permit revenues are 53% of budget and we are on track to reach our revenue target.   Revenues YTD June 2015 were $79,536 as compared to YTD June 2014 of $36,919.  Although the  number of permits issued is consistent with last year, the increase in revenue in 2015 resulted from  larger projects such as Smokey Point Distributing and Arlington Chevrolet.  This is also consistent  with the revenue increase we see in the Growth Management Fund for traffic mitigation fees.  Miscellaneous revenues have exceeded budget by over $24,000.  We’ve received $17,000 YTD in K‐9  donations with $10,000 of that amount from Roy Robinson.  We received another $5,000 in July  from the Stillaguamish Tribe.            2    OTHER FUNDS  Growth Management has received $477,102 YTD in traffic mitigation fees as compared to $18,152  for the same time period in 2014.  The large increase resulted from two major projects, Arlington  Chevrolet and Smokey Point Distributing.  The fund balance as of June 30, 2015 was $1,947,765.  Emergency Medical Services Fund has received $502,317 in transport fees and $492,113 in property  taxes YTD June 2015.  Payments have also been received from District #25 and District #19.  Ending  Fund balance in the EMS fund was $203,799 at the end of June.    INVESTMENTS  As of June 30, 2015, the City has $21.4 million in investments.  $2 million of that amount are in  Certificates of Deposit held with Skagit State Bank.  $3.5 million is held in the Local Government  Investment Pool with the Washington State Treasurer’s Office.  The remaining amount is held in  various investments with Time Value Investments, a brokerage firm the City uses to help manage its  investments.  The City has received $117,288 in investment interest through June 30, 2015.  Interest  is distributed monthly based on individual fund balances.  Following is the usual charts for some of the major revenue sources and operating statements for  each fund.       City of Arlington Council Agenda Bill Item WS #6 Attachment C COUNCIL MEETING DATE: July 27, 2015 SUBJECT: Library Board and Cemetery Board Appointments ATTACHMENTS: Applications of Stephanie Dickson and Annette Patterson DEPARTMENT OF ORIGIN Administration; Contact Kristin Banfield 360-403-3444 EXPENDITURES REQUESTED: -0- BUDGET CATEGORY: N/A LEGAL REVIEW: DESCRIPTION: Council is asked to confirm the appointments of Stephanie Dickson to the Library Board and Annette Patterson to the Cemetery Board. Stephanie was interviewed and recommended in May by members of the Library Board. Annette was interviewed and recommended in June by members of the Cemetery Board. HISTORY: Stephanie Dickson will fill the vacant position created upon the recent passing of Charles Van Pelt. Ms. Dickson’s term will expire April 1, 2019. From tiny small town libraries, to Carnegie libraries, to big city libraries, we love them all. The skills I would bring to the board include a 30 year familiarity with the town of Arlington and knowledge of programs that appeal to various ages (I have 8 children with ages from 1-22). I am extremely organized and put a priority on following through with my commitments. For the past four years I have been managing an all volunteer produce co-op. I am responsible for all aspects of the co-op including: managing the finances, placing orders, creating spreadsheets, supervising volunteers, dealing with grievances and recruiting new members. I believe I would be a valuable member of the library board. I love wandering cemeteries, looking at the artwork on the stones, reading about the people interred there, and learning about the history of an area through the eyes of the past. Preserving cemeteries is one of the most important things a community can do to keep the history of the community alive, to be passed along to future generations. I developed my love for cemeteries in the 9th grade, when Mrs. Jacks, my History teacher, assigned the class to do a cemetery study. We had just moved to the area, and by doing a cemetery study, I learned quite a bit about the community's history and the people who were there before me. And that sparked a love for cemeteries that continues to this day. I have wandered several cemeteries in Washington State. I believe the oldest I have wandered is the one at Lake McMurray. In 2002, George Groesbeck from troop 4057 as an Eagle Scout Project, cleaned up and mapped the cemetery (http://lakemcmurraycemetery.weebly.com/). I so enjoyed visiting that cemetery. Even though it is right next to Hwy. 9, it is a peaceful spot to rest. I grew up in Alabama, spending my summers in Spring City, Tennessee where my mother grew up. Spring City is a little town right by Watts Bar Lake. The old Porter, McClendon, and Spring City Cemeteries, where my great-great-grandparents and great-grandparents, great aunts and uncles, and cousins from both sides of the family, and now my grandparents, are buried, are in the Spring City area. These old family cemeteries expanded my love of wandering among the stones and reading about the people interred there. From them, I learned quite a bit about my family, as well as the early peoples of Spring City. According to the stones I read, my family has been in Spring City since the early 1800s. I like to read, crochet, sew and embroider. I enjoy camping, and spending time outdoors. Recently, my husband and I have taken up metal detecting. That is one hobby that is both fun and full of exercise! Joseph and I have been married for 30+ years. We have a son, Jason, who is married with two sons of his own. They live in Alabama. Joe and I have lived in Arlington proper since May of 2002. Before 2002 we lived in Smokey Point. We have lived in Washington State since 1998. I know nothing about being on a cemetery board. I will bring to the table a love for cemeteries, the history and stories they have to tell, and a willingness to study and learn what is needed for me to fulfill my duties. I will work to preserve the Arlington Cemetery as it is today. I will open my eyes to look to the future, so that the needs of the public who will use the cemetery can be met. The update is requested by the Marysville Municipal Court, which will no longer process our parking tickets without this update HISTORY: The Council last updated this section of the Arlington Municipal Code in April 2010. ALTERNATIVES Remand to staff for further revisions RECOMMENDED MOTION: Workshop; discussion only. ORDINANCE NO. 2015-XXX 1 ORDINANCE NO. 2015-XXX AN ORDINANCE OF THE CITY OF ARLINGTON, WASHINGTON AMENDING ARLINGTON MUNICIPAL CODE CHAPTER 10.54 REGARDING PARKING WHEREAS, the City of Arlington, Washington, the legal authority to regulate parking within the City; and WHEREAS, the City Council wishes to amend and clarify the provisions relating to parking infractions and fines for the same and to add certain provisions relating thereto; NOW, THEREFORE, the City Council of the City of Arlington, Washington, does ordain as follows: Section 1. Arlington Municipal Code Section 10.54.060 shall be and hereby is modified to read as follows: 10.54.060 - Violation—Infraction and impound. A person violating any provision of this chapter commits an infraction, for the violation of which they shall pay a civil penalty in a sum to be set by city resolution, plus court fees, where applicable. Any vehicle parked in violation of any provision of this chapter will be subject to impound at the discretion of the police department. A. Parking infractions shall be paid at the Arlington Violations Bureau at City Hall in person or by mail within fifteen (15) days of issuance. B. The fine for all parking infractions paid on the City’s next full business day after the citation is given shall be reduced by one half the fine amount. C. For payments made by mail, a postmark shall serve as the date the payment is made. D. A parking infraction may be contested by notifying the Violations Bureau within fifteen (15) days of issuance and requesting a hearing. E. Requests must be made in writing and signed by the owner of the vehicle. ORDINANCE NO. 2015-XXX 2 F. When a request for a contested hearing is made, the Police Department will forward a Notice of Infraction to the Municipal Court for a hearing. G. The fine for parking infractions that are neither contested nor paid within fifteen (15) days of issuance shall be doubled. H. Failure to remit the fine within fifteen (15) days of receiving a reminder notice from the Municipal Court that the fine is due will result in the inability to renew the vehicle registration without remitting the fine. I. If no response or payment is made within 15 calendar days from the date of issuance of the notice of parking violation, the penalty for each violation may be referred to a collection agency 30 days from the due date, or 15 days after the penalty is due, pursuant to RCW 3.02.045 and 19.16.500. The violator may be liable for any and all collection costs J. For all infractions that are neither contested nor paid within fifteen (15) days of issuance, the Municipal Court shall send the vehicle owner a reminder notice stating that payment has not been made and describing the consequences of non-payment set forth in Parts G through I above. Section 2. A new Arlington Municipal Code Section 10.54.055 shall be and hereby is added to read as follows: 10.54.055 Reserved Disabled Parking. (a) A parking space or stall for a disabled person shall be indicated by a vertical sign, between 36 and 84 inches off the ground, with the international symbol of access, whose colors are white on a blue background as described under RCW 70.92.120 and the notice “State disabled parking permit required.” (b) The person, partnership, firm or corporation owning or controlling the property where required parking spaces are located shall ensure the parking spaces are properly marked, not blocked or made inaccessible. (c) It is unlawful to park in a space or area reserved and properly marked for disabled parking without State-recognized identifiers on or in the vehicle. (d) Violation of this provision shall result in the issuance of a Notice of Infraction and/or the vehicle may be towed by the property owner. ORDINANCE NO. 2015-XXX 3 Section 3. A new Arlington Municipal Code Section 10.54.070 shall be and hereby is added to read as follows: 10.54.070 Impounding Vehicles. The City may tow any vehicle that violates this chapter in a manner that obstructs the travel portion of any roadway, sidewalk, or walkway. Section 4. A new Arlington Municipal Code Section 10.54.080 shall be and hereby is added to read as follows: 10.54.080 Registered owner responsible – Presumption. (1) Every person in whose name a vehicle is registered shall be responsible for any violation of this chapter caused by the parking, standing or stopping of said vehicle in violation hereof. It shall be no defense that the vehicle was parked illegally by another, unless proof is presented that said vehicle had been stolen and had not been returned to the registered owner by the date of the violation. This section shall not apply to registered owners transferring vehicle ownership who have complied with RCW 46.52.104 prior to the date of the violation. (2) In any parking violation case involving a violation of this chapter relating to the stopping, standing or parking of a vehicle, proof that the particular vehicle described in the notice of parking violation was stopping, standing or parking in violation of any such provision of this chapter, together with proof of registered ownership of the vehicle at the time of the violation, shall constitute in evidence a prima facie presumption that the registered owner of the vehicle was the person who parked or placed the vehicle at the point where, and for the time during which, the violation occurred provided the procedure for issuing a parking violation set forth in this chapter has been followed. Section 5. Effective Date. The title of this ordinance which summarizes the contents shall be published in the official newspaper of the City. The fees included in the schedule cover all departments in the city and address items not included in the Arlington Municipal Code. Staff is recommending the inclusion of fees for parking tickets as well as public records requests in this update. HISTORY: The Council last updated the City’s fee schedule in April 2015. Page 1 RESOLUTION NO. 2015-003xxx A RESOLUTION REPLACING RESOLUTION NO.2012-0092015-003, AND ADOPTING A REVISED FEE SCHEDULE WHEREAS, the City Council, through ordinance, has adopted regulations requiring certain actions and services; and, WHEREAS, these various ordinances set forth that fees shall be set by resolution; and, WHEREAS, the cost of providing these various services consistent with applicable codes, regulations, and policies periodically increase or decrease, or certain services or practices are discontinued and fees are no longer needed; and, WHEREAS, it is the intent of the City of Arlington to charge appropriate fees and charges that are consistent with the services provided and to cover the public cost of providing these various services so that the public is not subsidizing individual benefits derived therefrom; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARLINGTON AS FOLLOWS: The following rates, fees, and charges for various services provided, actions performed, or items sold by the city and/or its contract service providers, and fines levied against code violators, are hereby adopted: Section 1. Fees and Charges—General. 1.1 Fees. Fees are intended to cover the normal, recurring costs associated with providing a given service. Fees are non-refundable. 1.2 Prices. In some instances, the City provides certain goods and merchandise for sale. Prices for these goods may be included in this resolution. 1.3 Payment Due. Fees are due at the time the action is requested (e.g., at time of application) or occurs (e.g., prior to a specific action). An applicant may pay all fees of a multi-phased project in advance; however, doing so does not vest applicable fees due. Fees due are those in effect at the time the specific action or phase of an action is requested or occurs. 1.4 Waivers. Upon petition by the applicant, the City Council may waive any of the fees, or portions thereof, for any non-profit organization or government agency. EMS Fees and Charges. 10.1 Fees and Mileage Charges Established. For purposes of AMC Chapter 3.06, fees and mileage for EMS services shall be set as set forth in Table 9: Emergency Medical Services Rates and Charges. 10.2 Beginning on January 1, 2013, the rates set forth for the year 2012 shall be increased annually by the June reported percentage increase of the Consumer Price Index (CPI) for the Seattle-Tacoma-Bremerton area for All Urban Consumers, or other measure commonly used by the city should it change; provided, however, that notwithstanding any reduction in the CPI, rates shall not decrease. 10.3 EMS Transport Fees. In accordance with the requirements of 42 Code of Federal Regulations (CFR) Parts 410 and 414, which provides that Medicare fees and charges shall apply to Medicare recipients; A. Unmet (excess fee) Part B Deductible and Part B coinsurance amounts. In accordance with the provisions of 42 CFR Parts 410 and 414, the City shall bill the patient for any unmet or excess fee to the extent authorized by federal law. B. Inability to Pay Excess Fee. Individuals who are on fixed or low incomes or do not have the ability to pay the differential because of financial difficulties may submit a request to waive the differential to the City with supporting documentation of the inability to pay.
