Marilyn Oertle moved to approve the Agenda. Randy Tendering seconded the motion which passed with

Debora Nelson recognized Dick Butner’s 80th Birthday and congratulated him and thanked him on behalf
of City Council for his 40+ years of public service.

18, 2015.
2. Marilyn Oertle read aloud the Proclamation for Arbor Day—April 11, 2015.

PUBLIC COMMENT
Edward Berg spoke regarding the condition of streets 185th Pl NE and 186th Pl NE near his home and
requested paving. He stated that vehicles sometimes park on sidewalks, and spoke regarding
replacement of damaged street sign.

Marilyn Oertle moved and Randy Tendering seconded the motion to approve the Consent Agenda which
was unanimously carried to approve the following Consent Agenda items:

City Attorney Steve Peiffle spoke with the use of PowerPoint regarding the Ordinance Amending
Camping and Solicitation and the ACLU’s request for review and amendment of original ordinance
adopted in 2014. Mr. Peiffle spoke to two versions of the proposed ordinance and recommended Council
adopt version two.

Marilyn Oertle moved and Dick Butner seconded the motion to approve the Ordinance
vacating a portion of the Union Street right of way and to authorize the Mayor to sign a
relinquishment of the utility easement as requested. The motion was passed with a
unanimous vote.

NEW BUSINESS
Settlement of City of Arlington v. Kinman case
City Attorney Steve Peiffle spoke regarding the proposed settlement of lawsuit filed against Kinman, et al,
re nuisance abatement (127 W Gilman).
Marilyn Oertle moved and Randy Tendering seconded the motion to allow the City Attorney to settle the
Arlington v. Kinman case and sign any necessary documents in exchange for payment of the City’s costs
and attorney’s fees. The motion was passed with a unanimous vote.
Streets/Parking Lane Closures Request for Color Vibe 5K, May 9, 2015
Director of Human Resources & Communications Kristin Banfield spoke regarding a streets and parking
lanes closure request for Color Vibe 5K Run on May 9, 2015, which will be hosted by Cascade Valley
Hospital. Short discussion followed.
Marilyn Oertle moved and Jesica Stickles seconded the motion to approve the streets and lane closures
for the Color Vibe 5K Color Run on May 9, 2015. The motion was passed with a unanimous vote.
Prairie Creek Phase 1 Project Closeout
Public Works Director Jim Kelly spoke regarding a request that City Council approve final acceptance of
the Prairie Creek Phase 1 Project that was completed by Taylor’s Excavators. Short discussion followed.
Dick Butner moved and Marilyn Oertle seconded the motion for Project Close Out of the Prairie Creek
Phase 1 Project Contract in the amount of $910,001.62, and authorize the mayor to sign the Letter of
Acceptance, pending final review by the City Attorney. The motion was passed with a unanimous vote.
Authority to Bid the Jensen/Kona Waterline Project
City Engineer Eric Scott spoke regarding staff’s request for authority to advertise for bid the Jensen Water
Improvement Project budgeted for 2015. Short discussion followed.

Dick Butner moved and Randy Tendering seconded the motion to grant authority to bid the Jensen Water
Improvement Project, pending final review by the City Attorney. The motion was passed with a
unanimous vote.
Contracts for Fire Apparatus
Kristin Banfield introduced the contracts with Rosenbauer America for a pumper engine and ladder truck
whose purchases were approved at the October 6, 2014 council meeting. Short discussion followed.
Jesica Stickles moved and Debora Nelson seconded the motion authorize Mayor Tolbert to sign contracts
for the purchase of a ladder truck and pumper engine from Rosenbauer America for the Arlington Fire
Department. The motion was passed with a unanimous vote.
ADMINISTRATOR & STAFF REPORTS
City Administrator Paul Ellis announced that MicroGREEN closed Friday, April 3, 2015. There is a
possibility of a new investor for production. Work Source is helping to secure new jobs for the over 100
employees.

brief reports.
MAYOR’S REPORT
Mayor Tolbert spoke regarding the Arlington Community Resource Center’s opening later this spring and
gave a legislative update.
EXECUTIVE SESSION
City Attorney Steve Peiffle spoke to the need for an executive session for approximately 10 to 15 minutes
to discuss pending or potential litigation under RCW 42.30.110(1)(i).

Amy Spain--Snohomish County Tourism Bureau Annual Report
Amy Spain, from Snohomish County Tourism Bureau, reviewed their annual report via PowerPoint. Amy
and Andy Tift answered council questions.
WSDOT LAG Agreement Pavement Preservation (PW)
City Engineer Eric Scott reviewed the proposal to contract with WSOT to act as our Certified Agency for
the Smokey Point Boulevard Pavement Preservation Project. The Certified Agency will oversee the
performance of the project and expenditure of funds.
Haller Parking Lot Bid Award
Eric Scott reviewed the received bids for the Haller Parking Lot indicating E&D Excavating is the apparent
low bidder. Council comments and questions followed.
Fee Resolution Update
Director of Human Resources and Communications Kristin Banfield reviewed the city’s proposed updated
fee schedule. Kristin and Kris Wallace answered council questions.
Street Closures- July 4th, Car Show, Street Fair
Kristin Banfield spoke to the request for road closures for these special events.

Citizen Salary Commission Interviews
Kristin Banfield spoke regarding the candidates for the citizen salary commission. Chris Raezer, Jesica
Stickles, and Debora Nelson spoke to the candidates and the recommendation to appoint McCarthy,
Clay, Barden, Chase and Logan. Brief discussion regarding remaining candidates and vacancies on
other city commissions. Council will be asked to confirm the appointments at the April 20, 2015 Council
meeting.
Division Street Boundary Line Adjustment
Permit Center Manager Marc Hayes spoke to the proposed boundary line adjustment which addresses
the issue of a portion of E Division Street constructed on private property and the need for additional
parking at the existing apartment building. The adjustment would convey the southerly portions of Lots
12, 13 and 14 to City of Arlington and the northerly portions of Lots 15 and 16 to the Stillaguamish Tribe.
Brief discussion followed.
Miscellaneous Council Items
Councilmember Schuette provided a handout for “Out of the Shadows.”
Councilmember Oertle spoke regarding replacement wheel stops near Lebanon Park.
City Administrator Paul Ellis spoke briefly to the transportation package.

DESCRIPTION:
The Council conducting a public hearing on April 6 regarding revisions to the
camping and solicitation ordinance adopted in 2014. Version 2 retained and
renumbered the provisions banning solicitation while intoxicated and soliciting in a
manner which exploits children.
HISTORY:
The City adopted Ordinance #2014-010 on July 7, 2014. The Ordinance regulates
pedestrian interference, unlawful camping, and related matters. The ACLU of
Washington asked the City to review the ordinance.
ALTERNATIVES
Further revise ordinance; make no changes; remand to staff for additional changes.
RECOMMENDED MOTION:
I move to approve the proposed “Version 2” revisions to the Camping and
Solicitation Ordinance as presented.

ORDINANCE NO. 2015--XXX
AN ORDINANCE OF THE CITY OF ARLINGTON, WASHINGTON
AMENDING ARLINGTON MUNICIPAL CODE CHAPTER 9.56
REGARDING PUBLIC SOLICITATION AND CAMPING
WHEREAS, the City of Arlington, Washington has the authority to enact laws to protect
citizens and visitors to the City; and
WHEREAS, the City previously enacted regulations intended to protect the members of
the public and persons engaged in solicitation activities, which regulations have been codified in
Arlington Municipal Code Chapter 9.56; and
WHEREAS, the City has been asked to review those regulations; and
WHEREAS, the City Council has reviewed the regulations and believes certain
amendments are desirable;
NOW, THEREFORE, the City Council of the City of Arlington do hereby ordain as
follows:
Section 1. Arlington Municipal Code section 9.56.010 shall be and hereby is amended to
read as follows:
9.56.010 Findings. The City Council finds as follows:
(1) Consistent with the findings of other Washington State Cities, the city
council finds that it is important to the general welfare of the citizens and
residents of the city to protect and preserve the public safety of pedestrians and to
insure the safe and efficient movement of pedestrian and vehicular traffic in
public places. The city council further finds that public places as defined in this
sectionrights of way serve the primary purpose of enabling pedestrian and
vehicular traffic to safely and efficiently move about from place to place and that
public places rights of way have become increasingly congested and should be
maintained to serve their primary purpose.
(2) Arlington, as well as other cities in Washington, has experienced an
increase in the number of incidents of aggressive coercive solicitation by
individuals towards pedestrians, and vehicular traffic and others and that such
interference in public places deteriorates from the primary purpose and threatens
public health, safety and welfare.can cause citizens to reasonably fear for their
safety, and can cause children and the elderly to feel compelled to make donations
they would not otherwise be willing to make out of fear for their safety.

(3) The city has a compelling interest in protecting its citizens and its
most vulnerable residents and visitors from threatening, intimidating or harassing
behavior caused by coercive solicitations, in preserving the quality of life and in
protecting and preserving public health, safety and welfare.
(4) The City has an interest in while discouraging the use of public parks
as temporary living quarters.
Section 2. Arlington Municipal Code section 9.56.020(6) shall be and hereby is
amended to read as follows:
(6) “Coerce” or “coercive” means to do any of the following with intent:
(a) To approach, speak or gesture to a person in such a manner as would
cause a reasonable person to believe that the person is being threatened
with a commission of a criminal act upon the person, another person or
property in the person’s possession; or
(b) To approach within one foot of a person for the purpose of making a
solicitation without obtaining said person’s initial consent; or
(c) To persist in a solicitation after the person solicited has given a
negative response; or
(d) To intentionally impede the passage of a person, pedestrian traffic, a
vehicle or vehicular traffic while making a solicitation including, but not
limited to, public places adjacent to any public roadway where the
solicitation is directed or intended to attract the attention of the occupant
of any vehicle stopped or traveling on the roadway, unless said vehicle is
legally parked; or
(e) To engage in conduct that would reasonably be construed as intended
to compel or force a person being solicited to accede to demands; or
(fe) To make any false or misleading representation in the course of
making a solicitation.
(gf) Soliciting in a manner that exploits children.
(hg) Solicit under the influence of alcohol and or controlled substances.
Section 2. Arlington Municipal Code section 9.56.020(8) shall be and hereby is
amended to read as follows:
(8) “Obstruct pedestrian or vehicular traffic” means to walk, stand, sit, lie, or
place an object in such a manner as to block passage by another person or a
vehicle, or to require another person or a driver of a vehicle to take evasive action
to avoid physical contact, or to cause or initiate the interaction or exchange of
money, leaflets, or other tangible items between an occupant of a motor vehicle
within a city street and a pedestrian in such a manner as to block passage by
another person or a vehicle. Acts authorized as an exercise of one’s constitutional
right to picket or to legally protest, and acts authorized by a permit issued

pursuant to Chapter 5.44 of the Arlington Municipal Code, shall not constitute
obstruction of pedestrian or vehicular traffic.
Section 3. Arlington Municipal Code section 9.56.020(11) shall be and hereby is
amended to read as follows:
(11) “Solicitation” for the purposes of this chapter is any means of asking,
begging, requesting, or pleading made in person, orally or in a written or printed
manner, directed to another person, requesting an immediate donation of money,
contribution, alms, financial aid, charity, gifts of items or service of value, or the
purchase of an item or service for an amount far exceeding its value, under
circumstances where a reasonable person would understand that the purchase is in
substance a donation.
Section 4. Arlington Municipal Code subsections 9.56.020(14) through 9.56.020(19)
shall be and hereby are repealed.
Section 5. Arlington Municipal Code subsections 9.56.060 and 9.56.070 shall be and
hereby are repealed.
Section 6. A new Arlington Municipal Code section 9.56.060 shall be and hereby is
adopted to read as follows:
9.56.060 Soliciting while intoxicated. It shall be unlawful to solicit while
under the influence of alcohol and/or controlled substances.
Section 7. A new Arlington Municipal Code section 9.56.070 shall be and hereby is
adopted to read as follows:
9.56.070 Soliciting in a manner which exploits children. It shall be unlawful
to solicit in a manner that exploits children.
Section 8. Arlington Municipal code section 9.56.080 shall be and hereby is amended to
read as follows:
9.56.080 Penalty for pedestrian interference, coercive solicitation, or any
violation of the time and/or place of solicitation restrictions.
Pedestrian interference is a misdemeanor. Coercive solicitation is a misdemeanor.
Violation of either AMC 9.56.060 or AMC 9.56.070 the time and/or place of
solicitation restrictions is a misdemeanor.
(1) First Offense. Any person violating any of the provisions of this chapter shall,

upon conviction of such violation, be punished by a fine of not more than $1,000
or by imprisonment not to exceed 90 days, or by both such fine and
imprisonment.
(2) Second Offense. Every person who violates any of the provisions of this
chapter a second time within a five-year period shall be guilty of a misdemeanor,
punishable by a fine of not more than $1,000 or by imprisonment not to exceed 90
days, or by both such fine and imprisonment. One hundred dollars of the fine and
one day of imprisonment shall not be suspended or deferred.
(3) Third or Subsequent Offense. Every person who violates any of the provisions
of this chapter a third or more times within a five-year period shall be guilty of a
misdemeanor, punishable by a fine of not more than $1,000 or by imprisonment
not to exceed 90 days, or by both such fine and imprisonment. Five hundred
dollars of the fine and five days’ imprisonment shall not be suspended or deferred.
Section 9. The heading for Arlington Municipal Code section 9.56.120 shall be and
hereby is amended to read: “9.56.120 Camping Permit.”
Section 10. Severability. If any provision, section, or part of this ordinance shall be
adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provision or part thereof not adjudged invalid or
unconstitutional.
Section 11. Effective Date. This ordinance shall be effective five days from its adoption
and publication as required by law.

WSDOT Local Agency Agreement and Project Prospectus allowing WSDOT Local Programs
Engineer to serve as the certifying agency overseeing work performed and expenditures on a
project receiving a federal transportation grant.
HISTORY:
The City of Arlington has been awarded $156,029 in Federal Grant Funding from the Puget
Sound Regional Council (PSRC) for construction of the Smokey Point Boulevard Pavement
Preservation Project. Since these are Federal Funds, the City is required to have a Certified
Agency (CA) oversee the performance of the project and expenditure of funds – the WSDOT
Local Programs office will act as the City’s CA. The City needs to sign the attached Local
Agency Federal Aid Project Prospectus and the Local Agency Agreement to enter into contract
with WSDOT to act as our CA.

DESCRIPTION:
The Haller Parking Lot Project was recently advertised for construction and bids were opened on
Tuesday April 7th, a summary of received bids is on the attached bid list.
HISTORY:
The Water Department is ready to construct a 38-space parking lot until expansion on the utility plant is
needed. The parking will serve Centennial Trail parking, Haller Park, Stillaguamish Community Room,
and general public use. The parking lot will include an electric vehicle charging station, handicap
parking (2), trees for shade, and picnic shelters (2). The construction estimate for the parking lot was
$170,000.
Given the construction location, an additional capital improvement project was added to this project -
drainage improvements to protect the Haller Well Field (SD-CIP#7). Stormwater flows down West
Avenue and infiltrates at the Haller Well Field, this was identified as a sanitary well-head protection
concern. This project will add a new storm drain system to Cox Ave that will collect and convey runoff
from the West Ave drainage ditch to the stormwater wetland. These improvements are included with
the parking lot package to achieve an economy of scale for construction and thus reduce the overall

DESCRIPTION:
Staff has prepared an update to the City’s fee schedule. The fees included in the
schedule cover all departments in the city and address items not included in the
Arlington Municipal Code. In addition to general clean-up of the resolution and
correction of typographical errors, staff is recommending revised fees for the
cemetery as recommended by the Cemetery Board. A change to the fee for late
renewal of business licenses is included in accordance with the change to AMC 5.28
adopted in January. Police has requested the inclusion of fees for fingerprinting,
lamination of concealed pistol license (CPL), and the service of anti-harassment
orders.
HISTORY:
The Council last updated the City’s fee schedule in 2012.

A RESOLUTION REPLACING RESOLUTION NO.2012-004009,
AND ADOPTING A REVISED FEE SCHEDULE
WHEREAS, the City Council, through ordinance, has adopted regulations requiring certain
actions and services; and,
WHEREAS, these various ordinances set forth that fees shall be set by resolution; and,
WHEREAS, the cost of providing these various services consistent with applicable codes,
regulations, and policies periodically increase or decrease, or certain services or practices are
discontinued and fees are no longer needed; and,
WHEREAS, it is the intent of the City of Arlington to charge appropriate fees and charges
that are consistent with the services provided and to cover the public cost of providing these various
services so that the public is not subsidizing individual benefits derived therefrom;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ARLINGTON AS FOLLOWS:
The following rates, fees, and charges for various services provided, actions performed, or items
sold by the city and/or its contract service providers, and fines levied against code violators, are
hereby adopted:
Section 1. Fees and Charges—General.
1.1 Fees. Fees are intended to cover the normal, recurring costs associated with
providing a given service. Fees are non-refundable.
1.2 Prices. In some instances, the City provides certain goods and merchandise for sale.
Prices for these goods may be included in this resolution.
1.3 Payment Due. Fees are due at the time the action is requested (e.g., at time of
application) or occurs (e.g., prior to a specific action). An applicant may pay all
fees of a multi-phased project in advance; however, doing so does not vest
applicable fees due. Fees due are those in effect at the time the specific action or
phase of an action is requested or occurs.
1.4 Waivers. Upon petition by the applicant, the City Council may waive any of the
fees, or portions thereof, for any non-profit organization or government agency.

Section 10. EMS Fees and Charges.
10.1 Fees and Mileage Charges Established. For purposes of AMC Chapter 3.06,
fees and mileage for EMS services shall be set as set forth in Table 9: Emergency
Medical Services Rates and Charges.
10.2 Beginning on January 1, 2013, the rates set forth for the year 2012 shall be
increased annually by the June reported percentage increase of the Consumer Price
Index (CPI) for the Seattle-Tacoma-Bremerton area for All Urban Consumers, or other
measure commonly used by the city should it change; provided, however, that
notwithstanding any reduction in the CPI, rates shall not decrease.
10.3 EMS Transport Fees. In accordance with the requirements of 42 Code of
Federal Regulations (CFR) Parts 410 and 414, which provides that Medicare
fees and charges shall apply to Medicare recipients;
A. Unmet (excess fee) Part B Deductible and Part B coinsurance amounts. In
accordance with the provisions of 42 CFR Parts 410 and 414, the City shall
bill the patient for any unmet or excess fee to the extent authorized by
federal law.
B. Inability to Pay Excess Fee. Individuals who are on fixed or low incomes
or do not have the ability to pay the differential because of financial
difficulties may submit a request to waive the differential to the City with
supporting documentation of the inability to pay.

Six applicants for the newly formed Citizen Salary Commission were interviewed
Monday, April 13, 2015, by the Council selection committee. Five names were
brought forward by the selection committee to the April 13 workshop for
consideration by the full Council. Those names are Sherri McCarthy, Chad Clay,
Frank Barden, Jim Chase, and Heather Logan. At the workshop, Council was asked
to forward a final recommendation to the Mayor for appointment to the
Commission.
HISTORY:
A new chapter 2.89 was added to the Arlington Municipal Code on January 20, 2015
that created a Citizen Salary Review Commission for the salaries of elected officials.
It is the policy of the city of Arlington to base salaries and per diem reimbursement
of elected officials on realistic standards so that elected officials of the city may be
paid according to the duties of their offices, and so that citizens of the highest
quality may be attracted to public service.
ALTERNATIVES
Reject Council selection committee’s recommendations.

This proposed BLA addresses the issue of a portion of E Division Street constructed
on private property and the need for additional parking at the existing apartment
building. The BLA would convey the southerly portions of Lots 12, 13 and 14 to City
of Arlington and the northerly portions of Lots 15 and 16 to the Stillaguamish Tribe.

Staff Analysis of Proposed Boundary Line Adjustment
The proposed Boundary line Adjustment (BLA) is in connection with the recent purchase by the
Stillaguamish Tribe of Indians, of an existing six unit apartment (formerly known as the Togstad
Apartments) located at 421 E Division St. The Tribe intends to remodel and upgrade the
apartment structure and the surrounding grounds.
The apartment is situated on lots 12, 13 and 14, block 13, Plat of Haller City. The City owns
adjacent lots 15 and 16, which it gained possession of through a tax title sale in March of 1942.
Included in the planned improvements of the apartment building is the desire to increase the
available parking for the site, during discussions with the applicant regarding this, it became
apparent that where the parking expansion was to occur, there may be a conflict with traffic
flow on E Division St., as the parking stalls would be an encroachment into the travel lane, and
also require backing into the oncoming traffic in order to exit the site creating a potential safety
concern.
The existing E Division St. location came about simply from the inability to construct a road
upon the Right of Way that was dedicated for this purpose, due to inaccessible topography and
possibly the proximity of the Pioneer Cemetery which is situated upon this knoll. Over time the
need to improve this street was necessitated by higher traffic demands, so what was once a
narrow gravel drive became a paved street.
This proposed BLA addresses two issues;
1. The ability to create additional parking stalls along the alleyway upon the northerly
portion of lots 15 & 16 (currently City owned, to be conveyed to the Tribe) as opposed

southerly portion of lots 12‐14 (currently owned by the Stillaguamish tribe, to be
conveyed to the City) this would place the roadway upon publicly owned property.
