Marilyn Oertle seconded the motion which passed with a unanimous vote. INTRODUCTIONS OF SPECIAL GUESTS AND PRESENTATIONS Linda Byrnes, citizen volunteer, addressed the "Arlington Remembers Challenge Coins". The Challenge Coin will have the name of one of the 343 firefighters or one of the 72 police officers who died in the attacks on the World Trade Center towers in New York City on September 11, 2001. The coins are being _sold_ for_$100;_funds will be -used to__complete_the 911 World Trade_ Center Memorial -Project and — future -maintenance. PROCLAMATIONS Mayor Tolbert read proclamation declaring July 2014 to be General Aviation Appreciation Month. PUBLIC COMMENT None CONSENT AGENDA Chris Raezer moved and Marilyn Oertle seconded the motion to approve the Consent Agenda which was unanimously carried to approve the following Consent Agenda items: 1. Minutes of the June 16 and 23, 2014 Council meetings 2. Accounts Payable: EFT Payments & Claims Checks #82142 through #82270 dated June 17, 2014 through July 7, 2014 in the amount of $373,352.67. 3. Payroll: EFT Payments & Checks #28130 through #28172 dated June 1, 2014 through June 30, 2014 in the amount of $1,281,173.11. PUBLIC HEARING None Page 1 of 4 Minutes of the City of Arlington City Council Meetinq July 7, 2014 NEW BUSINESS Ordinance to Refinance 2004 and 2009 LTGO Bonds Finance Director Jim Chase addressed the refinancing of the 2004 and 2009 LTGO Bonds and recommended council approval. Questions were answered by Mr. Chase. Chris Raezer moved and Dick Butner seconded the motion to approve the proposed ordinance providing for the issuance, sale and delivery of not to exceed $9,000,000 aggregate principal amount of limited tax general obligation refunding bonds to refund the City's outstanding Limited Tax General Obligation Bonds, 2004, to prepay the City's Limited Tax Obligation Bonds, 2009, and to pay the costs of issuance and sale of the bonds. The motion was approved by a unanimous vote. Ordinance Establishing a Line of Credit and Providing for the Issuance and Sale of a Limited Tax General Obligation in the Aggregate Principal Amount of not to Exceed $500,000 Jim Chase addressed the request to approve ordinance establishing a line of credit with Cashmere Valley State Bank not to exceed $500,000 at an interest rate of 2.5%. Chris Raezer moved and Debora Nelson seconded the motion to approve the proposed Ordinance establishing a line of credit and providing for the issuance and sale of a limited tax general obligation bond in an aggregate principal amount not to exceed $500,000. The motion was approved by a unanimous vote. Award of Bid — Bystrom House Removal Public Works Director Jim Kelly addressed the bid from SkyCorp, LTD recommending council approval Dick Butner moved and Randy Tendering seconded the motion to accept the SkyCorp, LTD bid for the Bystrom House Recovery, Salvage and Removal Project and award the contract to SkyCorp in the amount of $19,257.60, pending final review by the City Attorney. The motion was approved by a unanimous vote. Settlement Agreement with Tim Riddle Community & Economic Development Director Paul Ellis addressed the Settlement Agreement and Release with Timothy Riddle, recommending council approval. Marilyn Oertle moved and Chris Raezer seconded the motion to authorize the Mayor sign the Settlement Agreement and Release to settle the lawsuit brought against Timothy Riddle. The motion was approved by a unanimous vote. Ordinance Amending AMC Title 9 — Adopting a New Chapter Relating to Unlawful Camping and related matters Sergeant Jon Ventura addressed unlawful camping, pedestrian interference and related matters with the council. Mr. Ventura recommended council approve an ordinance currently being used in other local jurisdictions in Snohomish County with a relative amount of success. Brief discussion followed with Sgt. Ventura answering council questions. Jesica Stickles moved and Debora Nelson seconded the motion to approve the proposed ordinance amending Arlington Municipal Code Title 9 and adopting a new chapter relating to pedestrian interference, unlawful camping and related matters. The motion was approved by a unanimous vote. Amendment to Snohomish County Housing & Community Development Urban County Consortium Interlocal Agreement Assistant City Administrator Kristin Banfield addressed the amendment to the Snohomish County Housing Authority & Community Development Urban County Consortium ILA. Chris Raezer moved and Debora Nelson seconded the motion to approve the amendment to the Snohomish County Housing & Community Development Urban County Consortium Interlocal Agreement Page 2 of 4 Minutes of the City of Arlington City Council Meeting July 7, 2014 and authorize the Mayor to sign it. The motion was carried with a unanimous vote Ordinance Adopting Revisions to the City's Park Regulations to Permit Limited Consumption of Beer and Wine in Certain City Parks Kristin Banfield addressed the request from the Arlington Arts Council to allow beer and wine tasting events in certain city parks. Brief discussion followed. Marilyn Oertle moved and Jesica Stickles seconded the motion to approve the proposed ordinance adopting revisions to the City's park regulations to permit limited consumption of beer and wine in certain City parks. The motion passed with a unanimous vote. Approval of IAFF Local No. 3728 Collective Bargaining Agreement Kristin Banfield presented the proposed 2014 -2016 Collective Bargaining Agreement with IAFF Local No. 3728 recommending council approval. Chris Raezer moved and Marilyn Oertle seconded the motion to authorize the Mayor to sign the Collective Bargaining Agreement with IAFF Local No. 3728. The motion passed with a unanimous vote. Moratorium on the Acceptance of Marijuana Producer and Processors Paul Ellis addressed the request for a moratorium of marijuana producers and processors. The city has received notification from the Liquor Control Board that 47 pre -applications have City of Arlington listed as the location. Mr. Ellis distributed a list of the applications received by the Liquor Control Board. Lengthy discussion followed. Marilyn Oertle moved and Jesica Stickles seconded the motion to approve the proposed Ordinance adopting a moratorium on the acceptance of applications for marijuana producer and marijuana processor establishments; providing for a public hearing; establishing an effective date; and providing that the moratorium, unless extended, will sunset within six (6) months of the date of adoption. The motion failed with a 4 -3 vote as a majority vote plus one is needed to declare an emergency per proposed ordinance. Marilyn Oertle moved and Debora Nelson seconded the motion to approve the proposed Ordinance with the exception of removing the declaration of an emergency to adopt a moratorium on the acceptance of applications for marijuana producer and marijuana processor establishments; providing for a public hearing; establishing an effective date; and providing that the moratorium, unless extended, will sunset within six (6) months of the date of adoption, subject to acceptance of the City Attorney. The motion passed with a majority 4 -3 vote. Dedication of a Local Field Name for Arlington Municipal Airport as "Major Wesley Duane Schierman Memorial Field" Paul Ellis addressed the request from the Black Jack Squadron to dedicate a local field name for the airport in memory of Wes Schierman. Discussion followed; it was determined the Airport Commission recommendation was to omit the local field name in the dedication. Jan Schuette moved and Chris Raezer seconded the motion to approve Black Jack Squadron's request for a dedication to honor Major Wesley Duane Schierman at Arlington Municipal Airport. The motion passed with a unanimous vote. ADMINISTRATOR & STAFF REPORTS None COUNCIL MEMBER REPORTS and MAYOR'S REPORT Jesica Stickles, Debora Nelson, Marilyn Oertle, Jan Schuette, Chris Raezer and Dick Bunter had brief reports while Randy Tendering had nothing to report at this time. Mayor Tolbert provided update on the Stilly Valley Economic Recovery effort.
