HomeMy WebLinkAboutSigned Minutes 11-04-13Minutes of the Arlington City Council Meeting Council Chambers 110 East Third November 4, 2013 City Council Members Present by Roll Call: Dick Butner, Randy Tendering, Debora Nelson, Marilyn Oertle, Chris Raezer, Ken Klein, and Steve Baker Council Members Absent: None City Staff Present: Mayor Tolbert, Allen Johnson, Kristin Banfield, Jim Chase, Paul Ellis, Jim Kelly, Kris Wallace, Tom Cooper, Roxanne Guenzler and Steve Peiffle — City Attorney Also Known to be Present: Jesica Stickles, Jan Schuette, Kirk Boxleitner, Shery Christianson, Bob Nelson, Sarah Arney, Neil Knutson and Mike Hopson. Mayor Tolbert called the meeting to order at 7:00 p.m. and the pledge of allegiance followed. APPROVAL OF THE AGENDA Marilyn Oertle moved to approve the Agenda. Randy Tendering seconded the motion which passed with a unanimous vote. PROCLAMATIONS Arlington DECA Chapter President Carly Peterson and fellow DECA students read proclamation urging all citizens to become familiar with the services and benefits offered by the Arlington DECA chapter and to support and participate in these programs to prepare them for college and professional careers. Mayor Tolbert hereby proclaimed November 17-23, 2013 as DECA Week. PUBLIC COMMENT None. CONSENT AGENDA Marilyn Oertle moved and Chris Raezer seconded the motion to approve the Consent Agenda which was unanimously carried to approve the following Consent Agenda items: 1. Minutes of the October 21 st and October 28th meetings 2. Accounts Payable EFT Payments and Claims Checks #80431 through #80511 dated October 22, 2013 through November 4, 2013 for $700,113.13 3. Payroll EFT Payments and Checks #27908 through #27928 for the period October 1, 2013 through October 31, 2013 for $1,215,342.34 4. Resolution to set opening change fund for Community Development 5. Resolution to make an Interfund Loan to the Stormwater Fund from the Water Department Fund 6. Resolution to make a short-term Loan to the EMS Fund from the Growth Fund PUBLIC HEARING 2014 Revenue Sources and Property Tax Rates Finance Director Jim Chase addressed the agenda item via Power Point Presentation. Mr. Chase answered council questions: Mayor Barbara Tolbert opened the Public Hearing at 7:15 pm. Mayor Tolbert closed the Public Hearing at 7:18 pm. Resolution to adopt the Annual Transportation Improvement Plan Public Works Director Jim Kelly addressed the agenda item. Mayor Barbara Tolbert opened the Public Hearing at 7:19 pm; with no one in the audience wishing to speak the Public Hearing was closed at 7:20 pm. NEW BUSINESS Interlocal Agreement with District 21 for Fire Service Deputy Fire Chief Tom Cooper spoke to the request for council to approve the Interlocal Agreement with District 21 for Fire Services. Councilmember Steve Baker moved and Dick Butner seconded the motion to authorize the Mayor to sign the agreement with Snohomish County Fire District 21 to provide Fire Suppression and Prevention Services. The motion was passed with a unanimous vote. Interlocal Agreement with District 21 for EMS Service Tom Cooper discussed the Interlocal Agreement for EMS Service with District 21. Councilmember Steve Baker moved to authorize the Mayor to sign the EMS contract with Fire District 21, motion seconded by Ken Klein. The motion was passed with a unanimous vote. Agreement for funding the Snohomish County Emergency Medical and Trauma Council Tom Cooper addressed the proposed agreement for funding the Snohomish County Emergency Medical and Trauma Council requesting council approval. Councilmember Steve Baker moved to authorize the Mayor to sign the agreement for funding the Snohomish County Emergency Medical Services and Trauma Care Council, which was seconded by Marilyn Oertle. The motion was passed with a unanimous vote. Interlocal Agreement with Snohomish County for Fleet Maintenance Assistant City Administrator Kristin Banfield reviewed the recommendation for council to approve the Interlocal Agreement with Snohomish County for Fleet Maintenance. Councilmember Steve Baker moved to authorize the Mayor to sign the Interlocal Agreement with Snohomish County for police vehicle maintenance. Randy Tendering seconded the motion which passed by unanimous vote. Bid Award for Utilities Installation on 173rd St NE Public Works Director Jim Kelly recommended council award the 173rd St NE Utilities Construction project to Taylor Excavators, Inc. Councilmember Dick Butner moved to accept the bid for construction of the 173rd Street Utility Improvement Project from Taylor Excavators, Inc. in the amount of $1,034,477.58 and authorize the Mayor to sign the construction contract, pending final approval by the City Attorney. The motion was seconded by Randy Tendering and passed by unanimous vote. Interlocal Agreement with Snohomish County for municipal road and street services with the City of Arlington Jim Kelly spoke to the recommendation for council to approve the Interlocal Agreement with Snohomish County for municipal road and street services. Page 2 of 3 Minutes of the City of Arlington City Council Meeting November 4, 2013 Councilmember Randy Tendering moved to approve the Interlocal Agreement with Snohomish County for Municipal Road and Street Services and authorize the Mayor to sign, pending final approval by the City Attorney. Chris Raezer seconded the motion which passed by unanimous vote. Interim Ordinance adopting a Moratorium on the establishment of marijuana producer, marijuana processor, and marijuana retailer establishments and the licensing and permitting thereof Community and Economic Development Director Paul Ellis addressed the proposed Interim Ordinance regarding producing, processing and licensing of marijuana. Discussion followed with Mr. Ellis answering council questions. Councilmember Marilyn Oertle moved to approve the Interim Ordinance adopting a moratorium on the establishment of marijuana producer, marijuana processor, and marijuana retailer establishments and the licensing and permitting thereof. Debora Nelson seconded the motion which passed by unanimous vote. Resolution to authorize Snohomish County to prepare the Multi -Hazard Mitigation Plan for the City of Arlington Paul Ellis reviewed the proposed resolution. Councilmember Steve Baker moved to approve the proposed Resolution authorizing Snohomish County to prepare the Multi -Hazards Mitigation Plan for the City of Arlington. Marilyn Oertle seconded the motion which passed by unanimous vote. ADMINISTRATOR & STAFF REPORTS City Administrator Allen Johnson noted the Ribbon Cutting Ceremony for Airport Blvd. will take place Friday, November 8th at 3:00 pm. COUNCIL MEMBER REPORTS Councilmember Nelson, Oertle and Baker gave brief reports while Councilmembers Butner, Tendering, Raezer and Klein had nothing to report at this time. EXECUTIVE SESSION City Attorney announced that there would be no need for an Executive Session.
