HomeMy WebLinkAboutSigned Minutes 08-05-13Minutes of the Arlington City Council Meeting Council Chambers 110 East Third Street August 5, 2013 Councilmembers Present: Dick Butner, Randy Tendering, Debora Nelson, Marilyn Oertle, Ken Klein and Steve Baker Staff Present: Allen Johnson, Kristin Banfield, Jim Chase, Paul Ellis, Jim Kelly, Nelson Beazley, Maxine Jenft and Roxanne Guenzler. Council Members Absent: Chris Raezer - excused Also Known to be Present: Jan Schuette, Jesica Stickles, Scott Keith, Sarah Arney, Sherri McCarthy and Mike Hopson. Mayor Tolbert called the meeting to order at 7:OOPM. Marilyn Oertle moved to approve the agenda with the exception of moving item #3, (Participation in the Washington Aerospace Partnership) from Consent Agenda to item #7 under New Business; Ken Klein seconded the motion, which passed with a unanimous vote. PUBLIC COMMENT Kevin Duncan, 18810 59"' Dr. NE, Arlington, commented and distributed letter on concerns with Arlington Airport Lease Lot 200. CONSENT AGENDA Marilyn Oertle moved and Steve Baker seconded the motion to approve the Consent Agenda which was unanimously carried to approve the following Consent Agenda items: 1. Minutes of the July 15 and July 22, 2013 Council meetings 2. Accounts Payable EFT Payments and Claims Checks #79751 through #79885 dated July 16, 2013 through August 5, 2013 for $1,533,927.17 and EFT Payments and Payroll Checks #27843 through #27863 for the period July 1, 2013 through July 31, 2013 for $1,138,837.40. PUBLIC HEARING Ordinance Amending Arlington Municipal Code Title 20 for Dispensaries and Collective Gardens Community Development Director Paul Ellis addressed the agenda item. Mayor Tolbert opened the Public Hearing at 7:11 pm, with no one wishing to speak the Public Hearing was immediately closed at 7:11 pm. Motion made by Marilyn Oertle, seconded by Dick Butner to adopt the proposed ordinance amending Title 20 of the Arlington Municipal Code to clarify that medical marijuana dispensaries and collective gardens are not permitted uses under city zoning law. Motion passed with a unanimous vote. NEW BUSINESS Amendment #3 to the MSA Contract Public Works Director Jim Kelly spoke to the proposed amendment to MSA contract for Prairie Creek Drainage Improvements contract. Page 1 of 3 Minutes of the City of Arlington City Council Meeting August 5, 2013 Dick Butner moved and Randy Tendering seconded to approve and authorize the mayor to sign Amendment #3 to the MSA Prairie Creek Drainage Improvement contract, pending final review by the City Attorney. Motion passed with a unanimous vote. 67th Ave Final Phase Change Order #3 Jim Kelly spoke to the proposed change order for 67th Ave Final Phase. Discussion followed with Mr. Kelly answering council questions. Councilmember Debora Nelson moved to approve and authorize the City Administrator to sign Change Order #3 to the 671h Avenue Final Phase Project, pending final review by the City Attorney, Ken Klein seconded the motion which passed with a unanimous vote. Franchise with Astound Broadband LLC Assistant City Administrator Kristin Banfield addressed the request to approve the proposed ordinance granting a franchise to Astound Broadband LLC. Marilyn Oertle moved to approve the proposed ordinance granting a franchise to Astound Broadband, seconded by Randy Tendering and passed with a unanimous vote. Appointments to PARC and Library Board Kristin Banfield spoke to recommendations of Sherri McCarthy to the Library Board and Vanessa Peterson Student -Representative to the PARC board. Marilyn Oertle moved to appoint Sherri McCarthy to the Library Board and Vanessa Peterson to the Parks, Arts and Recreation Commission. Motion seconded by Dick Butner and passed with a unanimous vote. Resolution to Surplus Vehicles & Equipment Kristin Banfield addressed the request to formally declare certain equipment obsolete and be declared surplus. Motion made by Marilyn Oertle, seconded by Debora Nelson to adopt the proposed resolution declaring certain vehicles and equipment surplus and authorizing the sale or disposal of the items. Motion passed with a unanimous vote. Ordinance Correcting SR531 Annexation Kristin Banfield addressed the request to correct a typographical error in Ordinance 2012-003. Motion made by Marilyn Oertle, seconded by Dick Butner to approve the proposed ordinance correcting a typographical error in Ordinance 2012-003, providing for the annexation to the City of Arlington of certain unincorporated right of way situated within Snohomish County. Motion passed with a unanimous vote. Participation in the Washington Aerospace Partnership City Administrator Allen Johnson addressed the request to participate in the Washington Aerospace Partnership. Discussion followed with Allen and Paul Ellis providing input. Motion made by Marilyn Oertle, seconded by Ken Klein to authorize the City to participate in the Washington Aerospace Partnership for an amount not to exceed $5,000 annually. Motion passed with a unanimous vote. ADMINISTRATOR & STAFF REPORTS City Administrator and staff provided brief reports on the following: National Night Out Against Crime 67th Avenue final closure Wastewater Treatment Plant received Outstanding Performance Award from DOE Page 2 of 3 Minutes of the City of Arlinqton City Council Meeting August 5, 2013 MAYOR AND COUNCIL MEMBER REPORTS Marilyn Oertle and Mayor Tolbert had brief reports while Dick Butner, Randy Tendering, Debora Nelson, Ken Klein and Steve Baker had nothing to report at this time.
