HomeMy WebLinkAboutSigned Minutes 02-04-13Minutes of the Arlington City Council Meeting Council Chambers 110 East Third February 4, 2013 City Council Members Present by Roll Call: Dick Butner, Randy Tendering, Debora Nelson, Marilyn Oertle, Chris Raezer, Ken Klein, and Steve Baker Council Members Absent: There were no Council members absent. City Staff Present: Mayor Tolbert, Allen Johnson, Kristin Banfield, Fire Chief Bruce Stedman, Fireman Doug Schmidt, Eric Scott, Dale Carman, Paul Ellis, Bill Blake, Jan Bauer, Steve Peiffle — City Attorney Also Known to be Present: Sarah Arney — North County Outlook, Kevin Duncan, Mike Hobson — Airport Commission, Jan Schuette, and Kirk Boxleitner — Arlington Times Mayor Tolbert called the meeting to order at 7:OOPM, and the pledge of allegiance to the flag followed. APPROVAL OF THE AGENDA Marilyn Oertle moved to approve the Agenda. Chris Raezer seconded the motion which passed with a unanimous vote. PROCLAMATIONS American Heart Month Mayor Tolbert read the American Heart Month proclamation. PUBLIC COMMENT There was no one in the audience who wished to speak to matters not on the Agenda. CONSENT AGENDA Marilyn Oertle moved and Deborah Nelson seconded the motion to approve the Consent Agenda as presented which was unanimously carried to approve the following Consent Agenda items: 1. Minutes of the January 22 and January 28, 2013 Council meetings 2. Accounts Payable (as presented to Council by email from Debbie Strotz on January 30, 2013) PUBLIC HEARING Extension of Moratorium on Medical Marijuana Dispensaries and Collective Gardens The Public Hearing was opened at 7:03PM. Economic and Community Development Director Paul Ellis spoke to the moratorium issue, giving a thumbnail of the collective gardens background. Surrounding cities have also extended their moratoriums, which the City of Arlington also requests. Page 1 of 3 Minutes of the City of Arlington City Council Meeting February 4. 2013 There was no one wishing to speak on the moratorium, and the Public Hearing was closed at 7:05PM. Marilyn Oertle moved and Dick Butner seconded the motion to adopt the proposed Ordinance adopting findings of fact in support of a moratorium on the establishment of medical marijuana dispensaries, collective gardens, and the licensing and permitting thereof and extend the moratorium for six months. The motion was approved with a unanimous vote. UNFINISHED BUSINESS There was no Unfinished Business. NEW BUSINESS Resolution Rejecting All Bids on the 67th Avenue Final Phase Reconstruction Project & Authorizing Staff to Rebid the Project City Attorney Steve Peiffle gave a brief update of the bid issue and the reasons to ask for a rejection of all bids and go out to bid again. Debora Nelson moved to approve the resolution to reject all bids on the 67th Avenue Final Phase Project received on January 17, 2013, and authorize staff to submit the project for rebid. Randy Tendering seconded the motion that passed with a unanimous vote. Appointment to the Parks, Arts, and Recreation Commission Assistant City Administrator Kristin Banfield gave a brief history of the PARC appointment recommendation of Carey Sorensen to the PARC Board. Marilyn Oertle moved to approve the PARC Board recommendation and consent to the Mayor's appointment of Ms. Sorensen to the PARC Board. Chris Raezer seconded the motion that passed with a unanimous vote. Resolution -to -Surplus Vehicles from Fire -Department Fire Chief Bruce Stedman spoke to the request to surplus fire department vehicles. He described each and asked for support of his request. He then answered Council questions. Steve Baker moved to approve the attached resolution declaring the vehicles as surplus and authorize sale or other disposition. Ken Klein seconded the motion that passed with a unanimous vote. Ambulance Ordinance Fire Chief Bruce Stedman addressed the requested Ambulance Ordinance, explaining the effect of the requested Ordinance on local ambulance companies. He asked for Council support. Steve Baker moved to approve the Proposed Ambulance Ordinance. Marilyn Oertle seconded the motion that passed with a unanimous vote. Declare the Merchantable Trees within the Proposed Right of Way of Airport Boulevard Phase II as Surplus and Authorize the Airport to Hold a Timber Sale Airport Supervisor Dale Carman gave an update of the requested timber sale project and the timber that would be removed for the sale. He asked for Council support of the action. Mr. Carmen then answered Council questions regarding the number of trees that would be affected and if there would be a replanting equal to the trees taken down. Mr. Ellis noted that the forest practice permit given to the airport would be offset by planting other trees in the area. Page 2 of 3 Minutes of the City of Arlington City Council Meeting February 4, 2013 Debora Nelson moved to declare the merchantable trees within the proposed right of way of Airport Boulevard Phase II as surplus and authorize the airport to hold a timber sale. Dick Butner seconded the motion that passed with a unanimous vote. ADMINISTRATOR & STAFF REPORTS City Administrator Allen Johnson gave an update on some Legislative issues in which the City is involved. He also reported on a recent meeting with Forterra, a land conservancy. COUNCIL MEMBER REPORTS and MAYOR'S REPORT Debora Nelson, Marilyn Oertle, Ken Klein, and Mayor Tolbert gave brief reports, while Dick Butner, Randy Tendering, Chris Raezer, and Steve Baker had nothing to report at this time. EXECUTIVE SESSION City Attorney announced that there would not be need for an Executive Session. ADJOURNMENT With no further business to come before the Council, the meeting was adjourned at 7:41 PM.
