City Staff Present: Mayor Tolbert, Allen Johnson, Kristin Banfield, Jim Chase, Jim Kelly, Eric Scott, David Kuhl, Jan Bauer, Steve Peiffle — City Attorney Also Known to be Present: Neil Knutson, Ron Thomas, Mike Hopson, Bob Nelson, and Sarah Arney — North County Outlook Mayor Tolbert called the meeting to order at 7:OOPM, and the pledge of allegiance to the flag followed. APPROVAL OF THE AGENDA Marilyn Oertle moved to approve the Agenda. Chris Raezer seconded the motion which passed with a unanimous vote. PUBLIC COMMENT Andrew Shanafelt from the Muscular Dystrophy Association thanked the City Firefighters who helped "Fill the Boot". He then presented a plaque of appreciation to Mayor Tolbert from the MDA. CONSENT AGENDA Marilyn Oertle moved and Chris Raezer seconded the motion to approve the Consent Agenda which was unanimously carried to approve the following Consent Agenda items: 1. Minutes of the January 21, 2012 Council Mini -Retreat and January 23, 2012 Council Meeting 2. Accounts Payable Approval of Payroll Checks #27445 through 27453 for the period of December 31, 2011 through December 31, 2011 for $6,606.11 and Approval of EFT Payments and Payroll Checks #27454 through #27475 for the period of January 1, 2012 through January 31, 2012 for $1,203,362.07 and Approval of EFT Payments and Claim Checks #75716 through #75841 dated January 18, 2012 through February 7, 2012 for $390,966.23 3. Public Art Donation Acceptance PUBLIC HEARING There was no Public Hearing. NEW BUSINESS Star Annexation — Acceptance of 10% Petition and Move Forward on 60% Petition With the use of a power point presentation Community Development Director David Kuhl located and described the Star property. He then gave a brief history of the Annexation request. Mr. Kuhl then answered Council questions. Marilyn Oertle moved to accept the Annexation 10% Petition from the Star Annexation, allowing the circulation of the 60% petition for annexation, subject to the assumption of their proportionate share of the City's bonded indebtedness and the assumption of the Comprehensive Plan Land Use Designation of General Commercial and High Density Residential and zoning of General Commercial and High Density Residential. Chris Raezer seconded the motion that passed with a unanimous vote. Snohomish County Coordinated Prevention Grant Agreement Public Works Director Jim Kelly gave a brief history of the Prevention Grant Agreement and he reviewed the ways in which it can be used. He requested acceptance of the Grant. Dick Butner moved to approve the Snohomish County Coordinated Prevention Grant Agreement for funding for the City's recycle program and authorize the Mayor to sign the 2012- 2013 grant agreement when finalized and approved by the City Attorney. Randy Tendering seconded the motion that passed with a unanimous vote. Blue Marble Environmental Contract Amendment #4 Jim Kelly spoke to the Contract Amendment. Dick Butner moved to authorize the Mayor to sign Contract Amendment #4 to the Professional Services Agreement with Blue Marble Environmental for the 2012-2013 grant Cycle. Randy Tendering seconded the motion that passed with a unanimous vote. Ordinance Amending Arlington Municipal Code 13.12 to reject the 2012 CPI Increases to City Water Rates and Changes Jim Kelly explained and then requested deferment of the CPI Increase to City Water Rates and Changes. This would pass the savings on to the rate -payers. Dick Butner moved to adopt the proposed ordinance amending Arlington Municipal Code 13.12 to defer the 2012 CPI increases to the water rates and changes. Randy Tendering seconded the motion that passed with a unanimous vote. ADMINISTRATOR & STAFF REPORTS Mr. Johnson noted the Yellow Pages and asked for Council questions. MAYOR'S REPORT Mayor Tolbert gave a reporting of meetings she had recently attended. COUNCIL MEMBER REPORTS — OPTIONAL Dick Butner, Randy Tendering, Debora Nelson, Marilyn Oertle, Chris Raezer, Ken Klein, and Steve Baker gave brief reports.
