HomeMy WebLinkAboutSigned Minutes 04-06-15Minutes of the Arlington City Council Meeting Council Chambers 110 East Third April 6, 2015 City Council Members Present by Roll Call: Dick Butner, Jan Schuette, Marilyn Oertle, Debora Nelson, Jesica Stickles, and Randy Tendering. Council Members Absent: Chris Raezer. City Staff Present: Mayor Barbara Tolbert, Kristin Banfield, Paul Ellis, Jim Kelly, Eric Scott, Chris Young, Marc Hayes, Bruce Stedman, Jonathan Ventura, Maxine Jenft, Sheri Amundson, Wendy Van Der Meersche, and Steve Peiffle — City Attorney. Also Known to be Present: Jacob Kukuk, Mike Hopson, Bob Nelson, Kirk Boxleitner, Katie Ellis, Sarah Arney, and Sonya Kraski. Mayor Tolbert called the meeting to order at 7:00 p.m. and the pledge of allegiance followed. APPROVAL OF THE AGENDA Marilyn Oertle moved to approve the Agenda. Randy Tendering seconded the motion which passed with a unanimous vote. INTRODUCTIONS OF SPECIAL GUESTS AND PRESENTATIONS Debora Nelson recognized Dick Butner's 80th Birthday and congratulated him and thanked him on behalf of City Council for his 40+ years of public service. PROCLAMATIONS 1. Mayor Tolbert read aloud the Proclamation for National Volunteer Week —April 12 through April 18, 2015. 2. Marilyn Oertle read aloud the Proclamation for Arbor Day —April 11, 2015. 3. Jan Schuette read aloud the Proclamation establishing Stand Up for Transportation Day— April 9, 2015. PUBLIC COMMENT Edward Berg spoke regarding the condition of streets 185th PI NE and 1861h PI NE near his home and requested paving. He stated that vehicles sometimes park on sidewalks, and spoke regarding replacement of damaged street sign. CONSENT AGENDA Marilyn Oertle moved and Randy Tendering seconded the motion to approve the Consent Agenda which was unanimously carried to approve the following Consent Agenda items: 1. Minutes of the March 16 and March 23, 2015 meetings 2. Accounts Payable: EFT Payments & Claims Checks #84072 through #84239 dated March 17, 2015 through April 6, 2015 for $962,313.83. Accounts Payable: EFT Payments & Payroll Checks #28336 through #28355 dated March 1, 2015 through March 31, 2015 for $1,217,785.01. Page 1 of 3 Minutes of the City of Arlington City Council Meetinq April 6, 2015 PUBLIC HEARING City Attorney Steve Peiffle spoke with the use of PowerPoint regarding the Ordinance Amending Camping and Solicitation and the ACLU's request for review and amendment of original ordinance adopted in 2014. Mr. Peiffle spoke to two versions of the proposed ordinance and recommended Council adopt version two. 7:22:48 Public Hearing opened Jacob Kukuk stated his concerns with the ordinance and the amendments. 7:26:43 The public hearing portion was closed and opened to council comments and questions. 7:28:52 No further comments or questions, this matter is closed. PUBLIC HEARING Permit Manager Marc Hayes spoke regarding the Ordinance to Vacate Union Street 7:30:02 Public Hearing opened Sonya Kraski spoke on behalf of herself and her husband in support of the ordinance. 7:31:01 The public hearing portion was closed and opened to council comments and questions. Marilyn Oertle moved and Dick Butner seconded the motion to approve the Ordinance vacating a portion of the Union Street right of way and to authorize the Mayor to sign a relinquishment of the utility easement as requested. The motion was passed with a unanimous vote. 7:32:07 No further comments or questions, this matter is closed. NEW BUSINESS Settlement of City of Arlington v. Kinman case City Attorney Steve Peiffle spoke regarding the proposed settlement of lawsuit filed against Kinman, et al, re nuisance abatement (127 W Gilman). Marilyn Oertle moved and Randy Tendering seconded the motion to allow the City Attorney to settle the Arlington v. Kinman case and sign any necessary documents in exchange for payment of the City's costs and attorney's fees. The motion was passed with a unanimous vote. Streets/Parking Lane Closures Request for Color Vibe 5K, May 9. 2015 Director of Human Resources & Communications Kristin Banfield spoke regarding a streets and parking lanes closure request for Color Vibe 5K Run on May 9, 2015, which will be hosted by Cascade Valley Hospital. Short discussion followed. Marilyn Oertle moved and Jesica Stickles seconded the motion to approve the streets and lane closures for the Color Vibe 5K Color Run on May 9, 2015. The motion was passed with a unanimous vote. Prairie Creek Phase 1 Project Closeout Public Works Director Jim Kelly spoke regarding a request that City Council approve final acceptance of the Prairie Creek Phase 1 Project that was completed by Taylor's Excavators. Short discussion followed. Dick Butner moved and Marilyn Oertle seconded the motion for Project Close Out of the Prairie Creek Phase 1 Project Contract in the amount of $910,001.62, and authorize the mayor to sign the Letter of Acceptance, pending final review by the City Attorney. The motion was passed with a unanimous vote. Authority to Bid the Jensen/Kona Waterline Project City Engineer Eric Scott spoke regarding staffs request for authority to advertise for bid the Jensen Water Improvement Project budgeted for 2015. Short discussion followed. Page 2 of 3 Minutes of the City of Arlington City Council Meeting Aril 6 2015 Dick Butner moved and Randy Tendering seconded the motion to grant authority to bid the Jensen Water Improvement Project, pending final review by the City Attorney. The motion was passed with a unanimous vote. Contracts for Fire Apparatus Kristin Banfield introduced the contracts with Rosenbauer America for a pumper engine and ladder truck whose purchases were approved at the October 6, 2014 council meeting. Short discussion followed. Jesica Stickles moved and Debora Nelson seconded the motion authorize Mayor Tolbert to sign contracts for the purchase of a ladder truck and pumper engine from Rosenbauer America for the Arlington Fire Department. The motion was passed with a unanimous vote. ADMINISTRATOR & STAFF REPORTS City Administrator Paul Ellis announced that MicroGREEN closed Friday, April 3, 2015. There is a possibility of a new investor for production. Work Source is helping to secure new jobs for the over 100 employees. COUNCIL MEMBER REPORTS Dick Butner, Jan Schuette, Marilyn Oertle, Debora Nelson, Jesica Stickles, and Randy Tendering gave brief reports. MAYOR'S REPORT Mayor Tolbert spoke regarding the Arlington Community Resource Center's opening later this spring and gave a legislative update. EXECUTIVE SESSION City Attorney Steve Peiffle spoke to the need for an executive session for approximately 10 to 15 minutes to discuss pending or potential litigation under RCW 42.30.110(1)(i). 8:04:40 Council recessed. 8:18:40 Council reconvened.
