APPROVAL OF THE AGENDA Chris Raezer moved to approve the Agenda. Marilyn Oertle seconded the motion which passed with a unanimous vote. INTRODUCTIONS OF SPECIAL GUESTS AND PRESENTATIONS PROCLAMATIONS PUBLIC COMMENT James Mulally at 8402 SR 530 NE spoke regarding high rates of speed by the Yield sign near the Fountain Drive Inn, the condition of 59th along the airport, and general speeding and lack of police presence within the city. CONSENT AGENDA Chris Raezer moved and Marilyn Oertle seconded the motion to approve the following Consent Agenda items: 1. Minutes of the January 5th and 12th Council Meetings 2. Accounts Payable: EFT Payments & Claims Checks #83591 through #83672 and #83722 dated December 31, 2014 through December 31, 2014 for $266,978.20, Approval of EFT Payments and Claim Checks #83590 and #83673 through #83721 dated January 6, 2015 through January 20, 2015 for $427,301.29. PUBLIC HEARING None Page 1 of 4 Minutes of the City of Arlington City Council Meeting January 20, 2015 NEW BUSINESS Ordinance rescinding utility rate increases for 2015 Public Works Director Jim Kelly requested council amend Arlington Municipal Code (AMC) 13.12 allowing the City to defer implementation of the 2015 mandatory water, sewer, and storm utility rate increases. This is due to the fact that staff has reviewed the current Utility budget forecast and has determined that the mandatory CPI increase is not necessary. Dick Butner moved and Chris Raezer seconded the motion to approve the proposed Ordinance deferring the scheduled 2015 CPI increase to the water, sewer, and storm utility rates. The motion was approved by a unanimous vote. Contract with FCS for detailed financial analysis of the Water and Sewer utilities connection fees and utility rates Jim Kelly requested council approve the proposal from FCS Group for a detailed financial analysis of the Water and Sewer utilities connection fees and utility rates. Dick Butner moved and Jesica Stickles seconded the motion to accept the FCS Group proposal for financial analysis of the City's water and sewer connection fee and utility rate schedule and authorize the mayor to sign the contract pending final review by the City Attorney. The motion was approved by a unanimous vote. Ordinance to amend AMC 5.28 regarding Business Licenses Community and Economic Development Director Chris Young spoke to the need to amend Title 5 of the AMC related to business licenses. He stated the business license ordinance needs to be amended to better enforce non -renewals and also reflect the changes made to the process. Council questions followed. Chris Raezer moved and Marilyn Oertle seconded the motion to approve the proposed ordinance amending AMC Chapter 5.28 regarding Business Licenses. The motion was approved by a unanimous vote Ordinance to amend AMC 5.40 regarding Towing Licenses Chris Young spoke to the need to amend Title 5 of the AMC regarding Towing Licenses. He stated the towing license ordinance needs to be amended to reflect an expiration and renewal date consistent with the business license and also reflect changes made to the process. Marilyn Oertle moved and Dick Butner seconded the motion to approve the proposed ordinance amending AMC Chapter 5.40 regarding Towing Licenses. The motion was approved by a unanimous vote. Ordinance adopting the current edition of the International Plumbing Code Chris Young reviewed state law regarding the UPC and IPC. He stated that staff is recommending adoption of the IPC to be used along with the UPC until the state takes action to coordinate and requested council approve the ordinance as presented. Council questions followed. Marilyn Oertle moved and Debora Nelson seconded the motion to adopt the proposed ordinance adopting the current edition of the International Plumbing Code. The motion was approved by a unanimous vote. Page 2 of 4 Minutes of the City of Arlington City Council Meetinq January 20. 2015 Creating the Deputy Chief position in the Arlington Police Department, declaring the position exempt from Civil Service, and eliminating the Commander position in the Arlington Police Department Public Safety Director Bruce Stedman spoke to the proposed new position of Deputy Police Chief in response to the Matrix Study. Council questions followed. Jesica Stickles moved and Chris Raezer seconded the motion to create the position of Deputy Chief in the Arlington Police Department, declare the position exempt from Civil Service, and eliminate the position of Commander in the Arlington Police Department. The motion was approved by a unanimous vote. Contract with Feldman & Lee for Indigent Defense Services Communications and Human Resource Director Kristin Banfield spoke regarding the successor agreement with Feldman & Lee for public defense services covering the term from January 1, 2015 through December 31, 2016. Council questions and comments followed. Jesica Stickles moved and Chris Raezer seconded the motion to approve the contract with Feldman & Lee for public defender services and authorize the Mayor to sign it. The motion was approved by a unanimous vote. Professional Service Agreement for Finance Director Search Kristin Banfield spoke to the proposed professional service agreement with The Prothman Company for the recruitment of a new finance director. Council questions and comments followed. Chris Raezer moved and Dick Butner seconded the motion to approve the contract with The Prothman Company for the Finance Director search and authorize the Mayor to sign it. The motion was approved by a unanimous vote. Creating a new AMC Chapter 2.89 relating to a Citizen Salary Review Commission Kristin Banfield reviewed the proposed ordinance for a Citizen's Salary Review Commission to periodically review the salaries of City elected officials. The draft ordinance has been drafted by the City Attorney to be consistent with the requirements of state law, RCW 35.21,015, on the creation and composition of such commissions. Council questions followed. Chris Raezer moved and Debora Nelson seconded the motion to approve the proposed ordinance creating a new Chapter 2.89 of the Arlington Municipal Code relating to a Citizen Salary Review Commission. The motion was approved by a unanimous vote. ADMINISTRATOR & STAFF REPORTS None. MAYOR'S REPORT Mayor Tolbert indicated she attended a meeting with Governor Inslee approximately two weeks ago regarding transportation as well as attending the State of the Union address. She also noted that Governor Inslee would be visiting Arlington on Wednesday January 21s' to talk to businesses regarding transportation issues. She also spoke regarding the Neighborhood Program and staff attendance at various neighborhood association meetings.
