APPROVAL OF THE AGENDA Mayor Pro Tem Jesica Stickles moved to approve the agenda as presented. Councilmember Debora Nelson seconded the motion, which passed with a unanimous vote.
DISCUSSION ITEM
Regional Fire Authority (RFA) City Administrator Paul Ellis opened the discussion reviewing the slide deck distributed to Councilmembers. City Attorney Steve Peiffle acted as facilitator.
• Today’s goal – an indication from Council whether or not to proceed with RFA annexation discussions
• Assumptions – what an RFA is and why Arlington considers this an option
• Financial Reality Check – there is no path forward in the RFA where there is no additional cost to the taxpayer without a significant cost to the City’s General Fund. Taxpayer costs go up because labor costs go up.
• Financial Scenarios were reviewed, with costs to the average taxpayer for the RFA.
• Impacts of the Ambulance Utility Fee (AUF) were discussed, with increased costs projected to keep up with labor costs.
• Bottom Line – taxes will increase with or without the RFA.
• Asset Puzzle Pieces – debt on fire stations, book value on vehicles, employee liabilities, administrative support, and reserves.

• Governance Structure – the committee is initially recommending appointing three Arlington representatives by the Council and from the Council to the six member RFA board, which would transition to five districted, elected positions (including two in Arlington) and two at-large positions, which could occur in 2024 or 2026. City Council was united in staff continuing conversations with North County Regional Fire Authority to move forward with the RFA, agreeing that transparency in city government and Fire and EMS sustainability are top priorities. Staff will continue to provide monthly check-ins with more information to Council. Mr. Ellis stated that in September when Council returns after summer break, a formal action will have to be reached on whether or not to put this item to voters on the February 2021 ballot.

NEW BUSINESS
Coronavirus Relief Fund Grant for Local Governments City Administrator Paul Ellis requested City Council approve the awarded CARES Act Grant for $592,200. This grant is to cover eligible expenses from the COVID-19 pandemic. The funding is available under Section 601(a) of the Social Security Act (CARES ACT). The funding has been awarded based on a population formula to be used on a reimbursement basis. The funds will cover COVID-19 related expenses between March 1, 2020 and October 31, 2020. Councilmember Debora Nelson requested to have the decision with WSU be set aside for more research before making a final decision and included into this relief fund grant. City Council discussed and agreed with this request. Mayor Pro Tem Jesica Stickles moved and Councilmember Mike Hopson seconded the motion to approve the Coronavirus Relief Fund for Local Governments in the amount of $592,200, and approved the expenditure of funds in the proposed budget, and authorized the Mayor to sign the grant agreement. The motion passed unanimously.
Business Rent Relief Grant Program City Administrator Paul Ellis requested City Council approve the Business Rent Relief Grant program. The City of Arlington is expected to receive approximately $592,200 of CARES Act funds through the Washington State Department of Commerce. The City could use $200,000 of the funds to support small businesses with the grant program. The maximum award per Arlington business is $3,500. The business must meet the criteria, including: have a physical location inside city limits, have a current city business license, and have a business sustainability plan. Scoring criteria includes: business sales tax generator, business survival outlook, how business has been affected by COVID-19 closure, if the grant will allow the business to re-open/rehire employees, which phase the business is allowed to fully open, how many years in business and the business recovery plan. Mayor Pro Tem Jesica Stickles moved and Councilmember Debora Nelson seconded the motion to approve the Arlington Business Rent Relief Grant Program, pending funding. The motion passed unanimously.
Contract with FCS Group for EMS Fee Study Fire Chief Dave Kraski reviewed the contract with FCS Group for a fee study update in 2020 to re-establish 2021 and 2022 rates. Arlington Fire has provided EMS services to Fire Districts 19 (Silvana), 21 (Arlington Heights) and 25 (Oso) for decades. Beginning in 2019, the previous rate model was discontinued, and a cost for service model was established by the FCS Group. The current EMS contracts outline a fee study update in 2020 for the remaining two years of the contracts. The fee will be divided proportionately, based on usage, between all agencies, including Arlington.

Councilmember Marilyn Oertle moved and Councilmember Debora Nelson seconded the motion to approve the contract with FCS Group, and authorized the Mayor to sign the contract, pending final review by the City Attorney. The motion passed unanimously.
Contract with Marysville Regional Fire Authority for Battalion Chief Services Fire Chief Dave Kraski reviewed the contract with the Marysville Regional Fire Authority. The contract is for a renewal of services provided by the Marysville Regional Fire Authority for 24-hour command and control. Battalion #61 responds to Arlington to assist with larger scale incidents requiring a more complex and longer duration command presence. The original contract was initiated a year ago as a trial, and expires on June 30, 2020. The new contract is a mirror image with the exception of a slight increase in the hourly rate and duration. The new contract will continue through 2021. Councilmember Marilyn Oertle moved and Councilmember Michele Blythe seconded the motion to approve the renewal of the contract for Battalion Chief Services with Marysville RFA, and authorized the Mayor to sign the agreement, subject to final review by the City Attorney. The motion passed unanimously.
Bond Ordinance to Fund New Fire Station #48 Finance Director Kristin Garcia reviewed the Ordinance authorizing the issuance of long term general obligation bonds for the construction of a new fire station. The bond ordinance for financing the construction of the new fire station was discussed with City Council at the May 26, 2020 workshop. Per the discussion, the ordinance has been updated to allow the bonds to be used for construction of the new fire station, a police impound facility and/or maintenance and operations facility. This will give the city flexibility on the use of the funds in the event that the fire station bid results are favorable and come in less than $5,500,000. Mayor Pro Tem Jesica Stickles moved and Councilmember Marilyn Oertle seconded the motion to approve the ordinance to issue long term general obligation bonds for the construction of a new fire station, police impound facility, and a maintenance and operations facility, in an amount not to exceed $5,500,000, and authorized the Mayor to sign the ordinance. The motion passed unanimously.
COMMENTS FROM COUNCILMEMBERS Mayor Pro Tem Jesica Stickles stated she was appreciative to the other Councilmembers for their quick responses to requests from members of the community. Councilmember Marilyn Oertle discussed how positive the RFA meeting went earlier in the day and thanked the other Councilmembers for their collaboration.

MAYOR’S REPORT Mayor Tolbert stated that Phase 2 variance for Snohomish County has officially been submitted. It typically takes up to two days for approval or word of denial, but with recent events, could take a little longer.

Termination of Interlocal Agreement with Snohomish County for Twin Rivers Park
Maintenance Administrative Services Director James Trefry presented the proposed termination of the August 30, 2018 interlocal agreement with Snohomish County.
The Interlocal Agreement with Snohomish County for Arlington’s maintenance of Twin Rivers County Park is being terminated. Termination of the agreement is due to reduced and limited availability of City of Arlington maintenance personnel to properly maintain the park, per Section 15.2 of the Interlocal Agreement. City of Arlington Parks, Arts and Recreation Commission (PARC) recommends that the City terminate the agreement, but revisit it in 2021. The Commission values the athletic facilities, and the soccer and softball fields, located at Twin Rivers Park. The purpose and intent of the original agreement with Snohomish County and City of Arlington over 30 years ago was to jointly operate and maintain Twin Rivers Park as a public

park with athletic facilities. Discussion followed with Mr. Trefry answering Council questions.
Bid Award for 2020 Utility and Pavement Preservation Public Works Director Jim Kelly presented the proposed bid award to JB Asphalt & Paving. The City has planned capital improvement projects for the years 2018 – 2021 that include the replacement of aged and failing water-sewer-storm infrastructure and the resurfacing of roads in the same streets where utility improvements occur. The roads that get resurfaced are the ones listed in the TBD Pavement Preservation Plan. The capital improvements and pavement preservation program for year 2020 were advertised for bid in early May; bids were opened on May 21st and JB Asphalt & Paving is the qualified the low bidder. Staff is requesting the award of the contract for this project to JB Asphalt & Paving. Discussion followed with Mr. Kelly answering Council questions.
Conveyance of Real Property for Right-of-Way Purposes Related to the Villas at
Arlington Project Community and Economic Development Director Marc Hayes presented a dedication of real properties as right of way for the purposes of roadway construction. The conveyances of real property on Smokey Point Blvd. as described in Exhibit A, and 31st Ave. NE as described in Exhibit B, are for the purpose of roadway construction for the Villas at Arlington housing project. Conveyance of property for right of way purposes related to new development is typically dedicated through the Land Use process, pursuant to 20.56.170 AMC. Discussion followed with Mr. Hayes answering Council questions.
ADMINISTRATOR AND STAFF REPORTS City Administrator Paul Ellis stated that M & O has set picnic tables along Olympic Avenue, the plaza, and the park. Now in Phase 2, restaurants will be open with a reduced occupancy, and patrons can use the picnic tables. Mr. Ellis provided a report on the Rent Relief Grant on behalf of Finance Director Kristin Garcia. Forty-two applications were received, with a possible total of approximately $107,000. Seven of 42 applications received were missing documentations. Staff is working with those businesses to secure that information to qualify. Not all applicants have business licenses, so they are being directed to obtain those, as well. Because not all grant money was expended, the qualified applications will be processed, and another application period will open for additional applicants. The Mayor asked for a head nod from Councilmembers to move forward with a second round. All agreed.

COMMENTS FROM COUNCILMEMBERS Councilmember Nelson stated that all of the questions she had regarding the proposal from WSU were answered, and she is comfortable with WSU to assist businesses. All agreed.
Councilmember Oertle spoke of the Centennial Trail Coalition. New signage will be installed on the entire trail through Snohomish County. The Coalition would like Arlington to donate. As soon as there is an official amount, she will bring that forward to Councilmembers. Councilmember Schuette asked about police participation prior to Friday night’s gathering in Legion Park. Councilmember Vanney asked about Fire District 21’s new construction. Mr. Ellis indicated he and Public Works Director Jim Kelly met with District 21 last week, and the District is in the early stages and moving forward. This location is within Arlington’s water service area. Councilmember Hopson stated in light of recent events, Council should be reviewing police department policy. Mayor Tolbert indicated that the police policy manual is now located on the City’s website on the police page. Mayor Pro Tem Jesica Stickles stated that on June 3, Snohomish County Council passed a resolution in response to the wrongful death of George Floyd and others, condemning racism and supporting peaceful protests. She would like Councilmembers to vote on a similar Resolution next Monday, June 15 at the Council meeting. Mayor Tolbert suggested adding an invitation to other cities in Snohomish County make a similar declarations be included on Arlington’s proposed Resolution.
COUNCILMEMBER REPORTS Councilmember Jesica Stickles provided a brief update, while Councilmembers the other had nothing to report this evening.

A RESOLUTION OF THE CITY OF ARLINGTON DIRECTING THE CESSATION OF PROCESSING
SPECIAL EVENTS PERMITS
WHEREAS, on February 29, 2020, the Governor of the State of Washington
proclaimed that a State of Emergency existed in all counties in the State of Washington
due to the outbreak of novel coronavirus (COVID-19); and
WHEREAS, on March 5, 2020, Mayor Barb Tolbert, issued a Declaration of
Emergency as a result of COVID-19; and
WHEREAS, on March 13, 2020, the President of the United States declared a
national emergency to allow the federal government to marshal additional resources to
combat the virus;
WHEREAS, on March 13, 2020, the Governor issued an emergency proclamation
requiring all K-12 schools to close from March 17, 2020 through April 24, 2020; and
WHEREAS, on March 23 2020, the Governor issued a “Stay Home, Stay Healthy”
emergency proclamation placing prohibiting all people in the State of Washington from
leaving their homes or participating in social, spiritual and recreational gatherings of any
kind regardless of the number of participants, and all non-essential businesses in
Washington from conducting business through April 6, 2020, and recommended the
public practice “social distancing”; and
WHEREAS, the Governor has extended the “Stay Home, Stay Healthy”
proclamation through at least July 1, 2020, and the Governor’s “Safe Start, Stay Healthy”
extension of the original Proclamation is effective through at least July 1, 2020; and
WHEREAS, the spread of COVID-19, a respiratory disease that spreads easily

Dash, the annual professional fireworks display, among others; and
WHEREAS, implementation of restrictions on social, spiritual and recreational
gatherings is one necessary piece of a successful strategy for limiting the transmission
and spread of COVID-19; and
WHEREAS, COVID-19 is a threat to life and public health and demands ongoing
and further emergency action to avoid the damage to public and private health,
finances and well-being if a second shutdown were to be necessitated by a “second
wave” of COVID-19 infections; and
WHEREAS, state Health Districts indicate that while positive effect of the efforts
to contain the COVID-19 virus have been observed, in large part due to the social
distancing measures previously put into place, and while some simulation models
indicate that Washington state may have passed the peak infection period, the impact
of easing restrictions could create a second wave or peak if implemented too quickly;
and
WHEREAS, most simulations predict that negative effects of easing mitigation
efforts too quickly would extend well into fall; and
WHEREAS, public events attract large numbers of people to the City of Arlington,
and under the Governor’s “Safe Start, Stay Healthy” plan, large gatherings are
prohibited until the County reaches “Phase 4” status; and
WHEREAS, these recommendations and restrictions are intended to protect the

A RESOLUTION OF THE CITY OF ARLINGTON REJECTING A BID CHALLENGE BY REECE
CONSTRUCTION COMPANY AND FINDING JB ASPHALT PAVING, INC.
TO BE THE APPARENT LOW BIDDER FOR THE 2020 UTILITY IMPROVEMENT & PAVEMENT
PRESERVATION PROJECT
WHEREAS, the City of Arlington solicited bids for a project known as the 2020 Utility
Improvement & Pavement Preservation Project (hereinafter the “Project”) and bids were
opened on May 21, 2020; and
WHEREAS, a bid protest was filed on May 28, 2020 by Reece Construction Company,
relating to the apparent low bid of JB Asphalt Paving Inc.; and
WHEREAS, the bid documents reserved the right of the City to waive any and all
irregularities in the bids; and
WHEREAS, the City Council wishes to reject the bid protest by Reece Construction
Company and waive the irregularities in the bid, if any, submitted by JB Asphalt Paving Inc.
within the terms of the bid documents and the meaning of RCW 35.23.352;
NOW, THEREFORE, the City Council of the City of Arlington, Washington do hereby
resolve as follows:
1. The City Council finds as follows:
a. The City of Arlington has sought qualified contractors to bid on the
Project.
b. JB Asphalt Paving Inc. submitted the apparent low bid on the Project and
has been determined to be the Qualified Low Bidder.
c. RCW 39.30.060 expressly requires that on public works projects in excess
of one million dollars, proposed HVAC, plumbing, and electrical subcontractors must be
separately listed, and if not so listed, the bids are deemed void.
d. The Project does not call for the use of a specific WSDOT form to list
subcontractors under RCW 39.30.060(3), and there is no HVAC or plumbing work on the
project.
e. JB Asphalt Paving, Inc.’s bid contained a clear notation reading
“* Electrical Sub-Contractor: Service Electric” on its bid at page 7, which gives a clear
indication of its intention to use that subcontractor for electrical work.
f. Reece Construction Company also objected to the projects identified in
RESOLUTION NO. 2020-XXX 2
the statement of bidders qualifications. However, the term “similar” did not require a
specified price range or any particular level of detail; the term “similar” means
“resembling without being identical”.
g. The bid documents also clearly indicate that “The City of Arlington
expressly reserves the right to reject any and all bids, to waive minor irregularities or
informalities, and to further make award of the project to the lowest responsible Bidder
as it best serves the interest of the City of Arlington.”
h. The City Council finds that the low bid of JB Asphalt Paving, Inc. is lower
than the other bidders, including the bid of Reese Construction, Inc.; that JB Asphalt
Paving, Inc.’s bid complies with the requirements of RCW 39.30.060; and that it is in the
best interests of the City and the taxpayers to accept the low bid and waive the
irregularities in the bid, if any exist.
i. The City Council finds that the irregularity, if any, in the bid is not a failure
which provided JB Asphalt Paving, Inc. with a substantial advantage over other bidders.
2. Based on the foregoing findings, the City Council hereby declares that the bid
submitted by JB Asphalt Paving, Inc. for the 2020 Utility Improvement & Pavement
Preservation Project is hereby accepted, that any irregularities therein are waived, and
JB Asphalt Paving, Inc. is declared to be the Qualified Low Bidder for purposes of
awarding the bid on that project.
3. The City hereby notifies Reece Construction Company of its intention to enter
into a contract with JB Asphalt Paving, Inc., as required by RCW 39.04.105.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARLINGTON IN RESPONSE TO THE DEATH
OF GEORGE FLOYD, CONDEMNING RACISM, AND SUPPORTING PEACEFUL PROTESTS IN
SNOHOMISH COUNTY
WHEREAS, on May 25, 2020 in Minneapolis, Minnesota the life of George Floyd was tragically
taken by a Minneapolis police officer; and
WHEREAS, the unjust death of George Floyd and many others have sparked demonstrations and
protests nationwide in response to continued racism and unequal justice that still exists in our
nation; and
WHEREAS, it is every American’s constitutional right to peacefully assemble and protest, and
the overwhelming majority of those protesting are doing so peacefully to fight for justice for
George Floyd and social justice in our nation; and
WHEREAS, there are groups of individuals resorting to violence, whether out of genuine anger
or opportunism, causing further destruction and hurt in our communities, and further dividing
us; and
WHEREAS, due to claims on social media about non-peaceful protests coming to the City of
Snohomish, bringing fear of potential destruction to local businesses, many citizens
congregated in downtown Snohomish on Sunday, May 31st, 2020; and
WHEREAS, as while the majority of these citizens were peacefully gathered to protect their city
from harm, there were instances of individuals advertising hate symbols; and
WHEREAS, as we move forward and continue striving for social justice and racial equity, let
these words by Rev. Martin Luther King Jr. be on the forefront of our minds: “Darkness cannot
drive out darkness; only light can do that. Hate cannot drive out hate; only love can do that”;
and
WHEREAS, leadership and those in power across our County should speak out against social
injustice and racism in any form; and
WHEREAS, the City of Arlington urges all other cities in Snohomish County to adopt a similar
Resolution;

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Arlington:
1. Mourns the death of George Floyd and joins the call for justice;
2. Supports those who wish to protest peacefully without fear of intimidation;
3. Does not support returning hate with hate or violence with violence;
4. Condemns acts of violence and damage to public and private property;
5. Commits to ongoing efforts to listen to our historically marginalized communities of color
and finding actionable ways to make our system more just for everyone;
6. Stands proudly for racial equality and condemns any and all hate-based organizations that
are counter to this mission.
