Also Known to be Present: Congressman Rick Larsen, Lindsey Webb and (23) twenty three YouTube views. Mayor Barb Tolbert called the meeting to order at 7:00 p.m., and the Pledge of Allegiance and roll call followed.
APPROVAL OF THE AGENDA Mayor Pro Tem Jesica Stickles moved to approve the agenda as presented. Councilmember Marilyn Oertle seconded the motion, which passed with a unanimous vote.
INTRODUCTION OF SPECIAL GUESTS AND PRESENTATIONS Congressman Rick Larsen came before City Council to give an update about what’s been going on in the news. First discussed was vaccine distributions and how we may have 600 million doses by July 2021, which would get all vaccinated by the end of July. The number of vaccines that will be distributed next week would be around 57% higher than the number distributed on January 20, 2021. The number will continue to increase. Johnson and Johnson has filed with the FDA for emergency use authorization which is a single use vaccination. Decision should be given in the next few weeks. It’s not the distribution of vaccines that’s the current issue, it’s getting the vaccines made themselves. The House of Representatives vote and send to the Senate on the American Rescue Plan, the next COVID19 relief package. There is a portion of that bill that is given to local cities and counties. In this plan, the dollars would be available directly to local governments and allocation directly. In the current bill, Arlington would get between $3.6 to 4.3 million dollars, and Snohomish County $161 million dollars. Unlike the CARES Act, this package allows for more flexible use, including revenue replacement. Nothing is official without the signature of the President, but that’s the goal to pass by March 14, 2021. Rep. Larsen also stated that they were going to give more airport relief and under that relief Arlington Municipal Airport would receive around $59k for assistance. Community Transit will also receive $6.1 million dollars for healthcare and safety for workers and staff and much more. Mr. Larsen is asking for input , and to reach out because the process is moving quickly.

After this, we will be looking at an economic recovery pack with large focused on a transportation and infrastructure package. It’ll be a broader package ranging not just roads, bridges, highways, transit, sidewalk, pedestrians and bikes, but wastewater, clean water facilities, housing, and housing for non-profit agencies, broadband will also be included in this portion for the bill.

CONSENT AGENDA Mayor Pro Tem Jesica Stickles moved and Councilmember Marilyn Oertle seconded the motion to approve the Consent Agenda that was unanimously carried: 1. Minutes of the February 1st and February 8, 2021 Council meetings 2. Accounts Payable: Approval of EFT Payments and Claims Checks #102076 through #102192 dated February 2, 2021 through February 16, 2021 for $1,343,181.93; Approval of payroll EFT Payments and Checks #30059 through #30065 dated January 1, 2021 through January 31, 2021 for $1,473,378.35. 3. Dedication of Right of Way by Grandview 4 Lot Short Plat for 4th Avenue. 4. Dedication of Right of Way by Swire Coca-Cola for 63rd Avenue. 5. Dedication of Right of Way by PUD for 63rd Avenue. 6. NEW BUSINESS
Interlocal Agreement with Fire District #21 for Fire Protection Fire Chief Dave Kraski requested Council approve the interlocal agreement with Fire District #21 for fire protection. Councilmember Marilyn Oertle moved and Councilmember Michele Blythe seconded the motion to approve the Interlocal Agreement with Fire District #21 for Fire Protection, and authorized the Mayor to sign it.
Petition for Lindsey Annexation Community and Economic Development Director Marc Hayes requested Council approve the 10% petition phase for annexation. Mayor Pro Tem Jesica Stickles moved and Councilmember Debora Nelson seconded the motion to approve the 10% petition phase, as presented, requesting annexation into the City of Arlington, and approved the application process to proceed to the 60% petition phase of the annexation process.

Proposed Revisions to Arlington Municipal Code Title 5 Regarding Business Licenses
and Regulations Community and Economic Development Director Marc Hayes requested Council approve the proposed revisions to Arlington Municipal Code Title 5 regarding business licenses and regulations. Mayor Pro Tem Jesica Stickles moved and Councilmember Marilyn Oertle seconded the motion to approve the ordinance amending provisions of Arlington Municipal Code Title 5 pertaining to business licenses, and authorized the Mayor to sign it, subject to final review by the City Attorney.
Ordinance to Approve Contract with State Department of Revenue for Business
Licensing Services Community and Economic Development Director Marc Hayes requested Council approve the ordinance to authorizing the City to enter into a contract with the State Department of Revenue for business licensing services. Mayor Pro Tem Jesica Stickles moved and Councilmember Marilyn Oertle seconded the motion to approve the ordinance authorizing the City to enter into a contract with the State’s Business Licensing Service program, and authorized the Mayor to sign the contract.

ADMINISTRATOR & STAFF REPORTS City Administrator Paul Ellis thanked crews and staff members from multiple departments for all of their efforts over the weekend keeping the roads clear and safe for Arlington’s residents. He also thanked the community for patience while the crews cleared the snow.
MAYOR’S REPORT Mayor Tolbert reviewed cold weather shelters. North Snohomish County Outreach Organization’s first night for shelter was on November 30, 2020. Since then, they have had a total of 26 below freezing nights where space opened for those who needed shelter. They sheltered 35 households, totaling 510 beds. February 9, 2021 they also were able to pick up a van to assist further for the community.

WORKSHOP ITEMS – NO ACTION WAS TAKEN
Resolution Declaring Police K-9 "Tara" as Public Surplus, and Authorizing her
Disposition to Her Handler Deputy Police Chief Dan Cone reviewed a resolution to surplus police K-9 “Tara” to her handler, Officer Kendahl Metcalfe. Tara has served the police department and Arlington’s citizens for several years, and is now ready to retire as a police dog. Although she is a member of the police force, she is considered public property, and the City must declare her as “surplus” for purposes of disposing of her. The City wishes to make sure that Tara spends the rest of her life with her handler, Officer Kendahl Metcalfe. Discussion followed with Deputy Chief Cone answering Council questions.
Appointment to Cemetery Board Public Works Director Jim Kelly reviewed Maxine Jenft’s reappointment to Cemetery Board. The Cemetery Board serves as an advisory board to the Mayor and City Council regarding all aspects of the Arlington Cemetery. The board meets bi-monthly and reviews activities and operations, as well as finances, capital planning, future expansion plans/needs, and any other issues that may arise.

Maxine Jenft is a strong community member who has served on the Cemetery Board since 2007, and wishes to continue to serve in this capacity for the next four-year term. The City is grateful for Maxine’s many years of service, and staff is pleased to recommend Maxine for reappointment to her position. Discussion followed with Mr. Kelly answering Council questions.
Contract with HWA Geosciences, Inc. for SR 530 Roundabout Public Works Director Jim Kelly reviewed the contract for geotechnical services for the Island Crossing Roundabout Project. The City of Arlington is designing a roundabout for the intersection of Smokey Point Blvd and SR-530. The prime design consultant for this project is SCJ Alliance; HWA Geosciences, Inc. is a sub consultant performing project geotechnical services. HWA has already completed the initial phase of geotechnical investigation determining soil strength for roundabout construction, this phase of work will determine soil infiltration capacity to support project infiltration pond design. To save project costs as on the initial phase of work, the City of Arlington is proposing to contract directly with HWA Geosciences, Inc. for this work effort. Discussion followed with Mr. Kelly answering Council questions.
Contract Amendment with KBA for Construction Management Services for the
204th/77th Roundabout Public Works Director Jim Kelly reviewed the contract amendment with KBA for construction management (CM) services. Construction of the 204th/77th Roundabout project bid in April 2020 and was awarded to Reece Construction Inc. in early June 2020. This is a grant funded project that required full time construction management for contractor oversight and completion of necessary project compliance forms and paperwork, the City elected to contract with KBA, Inc. to provide Construction Management for this project. Due to delay issues associated with the right-of-way procurement along with multiple weather delays, there was additional construction time which required additional on-site construction oversight, management, and supporting paperwork. The amendment to the KBA contract covers the additional cost Base Contract $183,000.00 Amendment #1 $ 0.00 (Time addition only) Amendment #2 $ 47,828.00 Revised Contract $230,828.00 Even with the project amendment, total CM is below budgeted estimate of 10% of project costs. ADMINISTRATOR AND STAFF REPORTS None.
MAYOR’S REPORT Mayor Tolbert stated that our police department in partnership with Marysville and Lake Stevens received an Impact grant, for the first six months of 2021, to provide a crisis intervention outreach team, to focus on mental health issues. She received a letter from WSDOT with a commitment to complete design work on the 531 expansion of 172nd through the Connecting Washington package, and start the public engagement process.
COMMENTS FROM COUNCILMEMBERS Councilmember Mike Hopson spoke regarding property tax exemptions for business developers at the Cascade Industrial Center. He would like affordable housing units to receive the same tax exemption. Mayor Tolbert stated that there is a bill brought to legislators to renew the exemption for the Cascade Industrial Center. Councilmember Jan Schuette stated that with the Cascade Industrial Center and new construction, bus service is needed. She has been working with Community Transit for bus pullouts, and when the widening of 172nd is complete, Community Transit will be ready to proceed with expanded routes.
COUNCILMEMBER REPORTS Councilmembers had no reports this evening.

A RESOLUTION OF THE CITY OF ARLINGTON ACKNOWLEDGING THE SERVICE OF
POLICE DOG "TARA", DECLARING HER AS SURPLUS,
AND AUTHORIZING HER DISPOSITION TO HER HANDLER
WHEREAS, the City has been well served by its police dog “Tara” who has served the
Police Department of the City of Arlington and Arlington’s citizens for several years; and
WHEREAS, it is time for Tara to retire as a police dog; and
WHEREAS, although she is a valued member of the police force, she is considered
personal property and as such the City must declare her as “surplus” for purposes of disposing
of her;
WHEREAS, the City Council finds that the City is unlikely to receive significant value in
a sale of Tara, and the City wishes to make sure she spends the rest of her life with her
beloved handler, Kendahl Metcalfe;
NOW, THEREFORE, the City of Arlington, acting by and through its City Council, does
hereby resolve as follows:
1. The City Council recognizes the valuable contributions made by “Tara”, its eight
year old black lab police dog, to the citizens of Arlington.
2. “Tara” is hereby declared surplus to the needs of the City and should be
permitted to retire.
3. City staff is authorized and directed to transfer “Tara” by bill of sale to its
handler, Kendahl Metcalfe, per the Bill of Sale attached hereto as Exhibit “A”.

called "Grantor", to Kendahl Metcalfe, hereinafter called "Grantee".

That Grantor, for value received, has transferred, sold, assigned, conveyed,
granted, bargained, set over and delivered, and by these presents does hereby transfer, sell,
assign, convey, grant, bargain, set over and deliver unto Grantee, Grantee's successors and
assigns forever, the following:

TO HAVE AND TO HOLD the aforesaid personal property, together with the

deliver to Grantee such other and further instruments and bills of transfer, sale, assignment
and conveyance and all such notices, releases, acquittances and other documents and to
secure all such consents as may be necessary more fully to transfer, sell, assign and convey
to and vest in Grantee the asset and rights hereby transferred, assigned and conveyed or
intended so to be.
And Grantor, for Grantor and Grantor's successors and assigns, covenants and
agrees to and with Grantee, Grantee's successors and assigns, that Grantor is owner of the
said property, goods and chattels and has good right and full authority to sell the same, and that
Grantor will warrant and defend the sale hereby made unto Grantee, Grantee's successors
