APPROVAL OF THE AGENDA Mayor Pro Tem Jan Schuette moved to approve the agenda as presented. Councilmember Heather Logan seconded the motion, which passed with a unanimous vote. INTRODUCTION OF SPECIAL GUESTS AND PRESENTATIONS Danette Klemens, Executive Director Stilly Valley Center presented information on the variety of services provided to the seniors who live in Arlington and the surrounding area. She shared her gratitude of the support she has received from the City. She asked for the Council to consider providing a higher level of funding in the coming year which will help restore the services that were previously offered before the COVID pandemic. Councilmembers and the Mayor shared their gratitude for the work of the Stilly Valley Center to help the senior population be able to feel connected during the pandemic isolation. PROCLAIMATIONS Mayor Barb Tolbert signed and presented the proclamation for Black History Month. PUBLIC COMMENT None. CONSENT AGENDA Mayor Pro Tem Jan Schuette moved and Councilmember Marilyn Oertle seconded the motion to approve the Consent Agenda that was unanimously carried: 1. PUBLIC HEARING None. NEW BUSINESS Public Works Personnel Requests Public Works Director Jim Kelly requested Council approve a revision to the 2022 pay plan for the addition of three new full-time employees, and reclassification of two current employees. Discussion followed with Mr. Kelly answering Council questions. Councilmember Deborah Nelson moved and Councilmember Don Vanney seconded the motion to approve the addition of three new Public Works full-time employees, and reclassification of two current Public Works employees. The motion passed unanimously. Procurement of Remaining Membranes for Water Reclamation Facility Public Works Director Jim Kelly requested Council approve the purchase of a Kubota Membranes for Water Reclamation Facility MBR trains #1, #3, and #4. Councilmember Deborah Nelson moved and Councilmember Heather Logan seconded the motion to approve the purchase of membranes from Kubota Membrane USA for the City of Arlington’s Water Reclamation Facility, and authorized the Mayor to sign a purchase order for $2,320,770.00. The motion passed unanimously. Inter-local Agreement with City of Lake Stevens and Acceptance of Public Defense Grant Police Chief Jonathan Ventura requested Council approve a third amendment to an ILA with the City of Lake Steven to accept a Public Defense Grant of $36,000 over two-years (2022-2023) to provide indigent defense social services. This is a local matching grant in partnership with the City of Lake Stevens. Arlington’s portion of the grant per year is 60% or $10,800 - $2,520 of that amount is paid for by the grant and the out of pocket costs for the local match will be $8,280 per year. Discussion followed with Police Chief Jonathan Ventura answering Council questions and Mayor Tolbert requesting Police Chief share the results from the last two year agreement. Mayor Pro Tem Jan Schuette moved and Councilmember Marilyn Oertle seconded the motion to approve the third Amendment to Inter-local Agreement Concerning Grant from the Office of Public Defender, and authorized the Mayor to sign it, pending final review by the City Attorney. The motion passed unanimously. COMMENTS FROM COUNCILMEMBERS Councilmember Jan Schuette announced that Community Transit has added a supplement service called “Snow Goose”. The pilot program is operated by Lincoln Hill Retirement Community (formerly Stanwood Community & Senior Center) and funded by the State Minutes of the City of Arlington City Council Workshop February 7, 2022 Page 3 of 3 Department of Transportation, the Lincoln Hill Retirement Community, Stillaguamish Tribe of Indians and the Floyd & Delores Jones Memorial Fund. Many other organizations are partnering in the project. The 14-passenger bus transportation will have its regular route, and will offer door-to-door service for those with mobility issues who schedule a day in advance to get citizens to their appointments and shopping centers. Bus drivers can flex from the set route to include scheduled door-to-door pick-ups and drop-offs. Councilmember Michael Hopson shared the webinar that he attended on Tax Increment Financing (TIF). He described the Tax Increment Financing (TIF) as a value capture revenue tool that uses taxes on future gains in real estate values to pay for new infrastructure improvements. The TIF creates funding for public or private projects by borrowing against the future increase in these property-tax revenues. He encourages the City to use this type of tool. WORKSHOP ITEMS – NO ACTION WAS TAKEN Contract Renewal with Strategies 360 City Administrator Paul Ellis reviewed the Strategies 360 professional services agreement renewal. The contract extension describes the work to be done by Strategies 360 at the state and federal level from January 1 through December 31, 2022. Strategies 360 has been working on our behalf in Olympia and Washington, D.C. to address some of our immediate and long-term transportation improvement goals, as well as assist us in economic development and other areas. The continuation of the contract ensures that our best interests are represented in the decision-making processes of the Washington State Legislature, the Washington State Department of Transportation, the United States Congress, as well as other state and federal agencies. The City has budgeted $36,000 annually for the 2022 budget. The City has been a direct client of Strategies 360 starting in fall 2012. Prior to that, the City was a client through our participation in the SR9 Coalition. Discussion followed with Mr. Ellis answering Council questions. City Council Zoom Workshop Minutes of the City of Arlington City Council Workshop February 14, 2022 Page 2 of 3 Ordinance Adopting the Lindsay Annexation Planning Manager Amy Rusko reviewed the ordinance adopting the Lindsay Annexation. City Council accepted the 10% Petition to Annex on February 16, 2021, allowing a 60% Petition to be circulated for signatures. A resolution was approved on June 7, 2021, setting the date for a public hearing to occur on July 6, 2021 to hear public testimony regarding the 60% Petition to Annex. Council accepted the 60% Petition to Annex and approved the Resolution directing staff to submit the Notice of Intention to the Washington State Boundary Review Board for Snohomish County. The Notice of Intention to Annex was sent to the Boundary Review Board on August 18, 2021. On October 8, 2021, the Boundary Review Board requested a meets and bounds continuous boundary description added to the legal description. The updated legal description was sent to the Boundary Review Board on November 8, 2021. The Notice of Intention to Annex was deemed legally sufficient with an effective filing date of December 6, 2021. The Notice of Intention to Annex was heard by Snohomish County Council on January 10, 2022, where it was approved under Motion 22-009. The 45-day review period ended on January 20, 2022 at 5:00 pm, with no request for review, and the action deemed complete. The City of Arlington received official notice of approval from the Boundary Review Board on January 21, 2022. Discussion followed with Ms. Rusko answering Council questions. Resolution Adopting an Updated Fee Schedule Planning Manager Amy Rusko reviewed Community and Economic Development’s updates to the resolution adopting an updated fee schedule. Paul Ellis provided additional updates by other departments. Staff has prepared an update to the City’s fee schedule. The fees included in the schedule cover all departments in the City, and address items not included in the Arlington Municipal Code. The Council last updated the City’s fee schedule in May 2021. Discussion followed with Ms. Rusko answering Council questions. December 2021 Financial Report Finance Director Kristin Garcia presented the December 2021 financial report. Discussion followed with Ms. Garcia answering Council questions. January 2022 Police Department Report Police Chief Jonathan Ventura presented a recap of 2021, and the January 2022 police report. Discussion followed with Chief Ventura answering Council questions. North County Regional Fire Authority (NCRFA) Quarterly Report North County Regional Fire Authority (NCRFA) Deputy Chief of Operations Dave Kraski presented the quarterly report. Minutes of the City of Arlington City Council Workshop February 14, 2022 Page 3 of 3 Modification to Salary Schedule for Non-Represented Employees for 2022 Administrative Services Director James Trefry reviewed the modification to the 2022 Salary Schedule for Non-Represented Employees. Public Works and Human Resources are requesting a revision to the 2022 Non-Represented pay plan to add the new classification of Deputy Public Works Director, in a new pay grade “O”. Police and Human Resources are also requesting to add the new classification of Police Lieutenant to existing pay grade M. Maintenance and Operations and Human Resources are requesting an increase in the hourly rate for pay grade A to a minimum rate of $17.00 and a maximum of $19.00. There is no requested change to the budget allocation for Maintenance and Operations or Police. The existing salary schedule was originally adopted on November 2, 2020 as part of the 2021/2022 Biennial Budget and most recently amended May 17, 2021. A 2% adjustment was applied per the adopted budget for 2022, effective January 1, 2022. Discussion followed with Mr. Trefry answering Council questions. ADMINISTRATOR AND STAFF REPORTS None. MAYOR’S REPORT None. COMMENTS FROM COUNCILMEMBERS Councilmember Jan Schuette stated that the state supreme court will be hearing the case for fee enforcement for transit. Mayor Tolbert congratulated Councilmember Schuette on being elected as vice president of board of directors for Community Transit. WHEREAS the parties entered into a certain Services Agreement for Government Relations, Lobbying and Strategic Communications dated January 1, 2022. WHEREAS the parties agree to extend the term of the Services Agreement in accordance with the terms of the Services Agreement as well as the terms provided herein. The parties hereby agree as follows: 1. The term of the Services Agreement will be extended for a period of 12 months, from January 1, 2022 to December 31, 2022. 2. Compensation for the services will also be extended at a monthly fee of $3,000 for the extended period of the Services Agreement. Terms for expenses remain as per the original Services Agreement. This Agreement shall be deemed as part of the Services Agreement. Any reference to the Services Agreement in any other documents shall be construed as including this Agreement. Except the provisions subject to amendment, any other provisions of the Services Agreement shall continue to be effective. All applications received a score of 60 or more. The committee reviewed and discussed the applications and is recommending 100% funding for each application. An executive summary of the event descriptions is attached. The full application packets can be accessed on SharePoint, City Council Page, EXEUCTIVE SUMMARY – LTAC APPLICATION EVENT DESCRIPTIONS Arlington Arts Council – Art of Arlington Brochure: The new brochure will be an update to the current Art Walk brochure and will include recent projects such as the airplane sculpture by Wayne Kangas located at the airport, the Ball of Fun by Lin McJunkin and Milo White that was installed by Quake Field, and Going with the Flow by Verena Schwippert near Airport Blvd. The brochure would also include things to see and do within Arlington such as highlighting the centennial trail. The Arts Council will partner with DABA, the Stilly Valley Chamber and other organizations to help with distribution. Arlington Fly in – Arlington Sky Fest: The 2022 event will continue the drive-in style event to capture the return attendee market as 60% of those attending the drive-in event haven’t previously attended. The Fly-In will be partnering with the Airport to host the Legends of Victory Tour by the Arizona wing of the Commemorative Airforce. This will provide two legacy aircraft displays which will extend the event to six full days. The Sky Fest event will also continue to grow the hot air balloons display and lighted drone show. City of Arlington – Stronger Together Cultural Celebration: The event has been held the past two years but it is the first request for lodging tax funding. The city will be partnering with the Arlington School District, Town of Darrington, Darrington School District, Lakewood School District and the Stillaguamish Tribe on the stronger together initiative which aims to build unity through community. The one day event will have a series of professional acts representing their culture through music and dance. Downtown Arlington Business Association - Tourism Brochure: The brochure includes a map that identifies type of business, their location and contact information. The brochure also includes a general description of Arlington including visitor amenities, places to stay and local events. The brochure also contains a map so that visitors can find what events and businesses are offered locally. The brochure will be distributed throughout Washington State and given out at other local events within the community. Downtown Arlington Business Association – Hometown Holidays: DABA partners with the City of Arlington, Lifeway Church, Youth Dynamics and the Stilly Valley Chamber on this event. The event includes a Shop Small Saturday promotion, Santa parade, wagon rides, a holiday open house and other entertainment to bring visitors into downtown for shopping and dining. Downtown Arlington Business Association – Summer Cruisin Concerts: In 2019 DABA invested into a new event, a summer kick off concert in the park. In 2022, this event will be re-branded as summer cruising concerts to offer concerts/entertainment every Saturday June thru September. DABA is working with a local restaurant to offer a beer garden and working with the farmer’s market to see if vendors are interested in extending their day so concert attendees can sample local products. Downtown Arlington Business Association – 2022 Show and Shine: This will be a two day event which brings hundreds of classic, vintage and custom vehicles to Arlington for two days of socializing, entertainment and casual competition. Registrants are encouraged to cruise in on Friday to pick up registration packets and enjoy the entertainment planned for Friday afternoon and evening. DABA is partnering with Lifeway Church to hose a free movie and popcorn on Saturday. Local businesses are encouraged to stay open late on Friday so that guests have an opportunity to experience everything Arlington has to offer. Sound Publishing: Marketing for Frontier Days, the Arlington Sky Fest event and Hometown Holidays. Marketing will include a 450 word story, website presence and social media promotion with a geographical reach of Whatcom, Skagit, Island, King and Snohomish Counties. Stilly Valley Chamber – Farm to Table Tour: The event will highlight agricultural and agritourism in our community. The event will feature farms, farm tours, farm to table events and highlight locally sourced products from retailers and restaurants. Stilly Valley Chamber – Visitor’s Guide and Marketing: The visitor’s guide would include experiences and itineraries that would allow guests to explore the region. The guide would include things to do in Arlington like the centennial trail, local shopping and dining, regional events like the eagle festival, fly-in, festival of the river, frontier days, 4th of July and the farmer’s market. Other considerations for inclusion in the visitor’s guide are bike tours, winery and distillery tours, day trips to Arlington and sports options. Stilly Valley Chamber – Visitor’s Guide and Marketing: The Farmer’s Market will work with other non-profits and community organizations to participate in the market. The season will run from May 7th to September 25 with holiday markets on October 29, November 26 and December 3. The market would like to expand to the Smokey Point area to help support that neighborhood by bringing fresh produce and food access to the community. Fees and Charges—General. 1.1 Fees. Fees are intended to cover the normal, recurring costs associated with providing a given service. Fees are non-refundable. 1.2 Prices. In some instances, the City provides certain goods and merchandise for sale. Prices for these goods may be included in this resolution. 1.3 Payment Due. Fees are due at the time the action is requested (e.g., at time of application) or occurs (e.g., prior to a specific action). An applicant may pay all fees of a multi-phased project in advance; however, doing so does not vest applicable fees due. Fees due are those in effect at the time the specific action or phase of an action is requested or occurs. 1.4 Waivers. Upon petition by the applicant, the City Council may waive any of the fees, or portions thereof, for any non-profit organization or government agency. In accordance with the provisions of 42 CFR Parts 410 and 414, the City shall bill the patient for any unmet or excess fee to the extent authorized by federal law. B. Inability to Pay Excess Fee. Individuals who are on fixed or low incomes or do not have the ability to pay the differential because of financial difficulties may submit a request to waive the differential to the City with supporting documentation of the inability to pay. Dog Licensing Fees. 10.1 Fees for dog licenses as called for in Arlington Municipal Code Chapter 8.09 shall be listed in Table 10: Dog Licensing Fees 10.2 Per RCW 49.60.380, the City of Arlington shall honor a request by a blind person or hearing impaired person not to be charged a fee to license his or her guide dog, or a request by a physically disabled person not to be charged a fee to license his or her service animal. 10.3 All dogs require proof of current Rabies vaccination to be licensed. Fees for Duplication of Public Records. 12.1 Fees for various services and actions for duplication of public records shall be consistent with the provisions of RCW 42.56.120 and listed in Table 12: Fees for Public Records Services. 12.2 The City of Arlington finds that calculating the actual costs of scanning per page in order to fulfill a public records request would be unduly burdensome for the following reasons: (a) The City employs over 120 employees. Because all City employees contribute to the production of public records requests and all employees earn different salaries or rates of pay, the public records officer would have to be privy to salaries of all employees in order to calculate the invoice; (b) Employees supplying scanned records to the public records officer would be required to track time spent, thereby creating a burden for those employees without work stations as well as additional work not assigned in many employees’ job descriptions and or union contracts; (c) The City’s public records officer would be required to maintain a record of all employees who contribute to each part of a public record request and potentially charge different amounts for multiple scanned pages; (d) The City uses more than seven document scanning machines with different costs and lease agreement fees which change from time to time. The cost of supplies for the City’s various scanning machines is subject to change based on current market rates. Calculating the portion of the machines and supplies used CITY OF ARLINGTON FEE SCHEDULE RESOLUTION NO. 2021-021 toward scanning public records would require knowledge of the cost of supplies and an in-depth analysis of timing and application multiplied by each contributing employee’s hourly rate of pay; and (e) The response time to a public records request may be delayed in order to calculate scanning costs and create an invoice with different rates of scanning charges. For the purposes of providing requestors estimated costs of a request under RCW 42.56.120(2)(f), the City estimates that redaction takes ten minutes of staff time per minute of raw footage for targeted video redaction (with or without audio redaction); five minutes of staff time per minute of raw footage for targeted audio redaction alone; and one minute Section 13.
