Strategies 360 has been working on our behalf in Olympia and Washington, D.C. to address some of our immediate and long-term transportation improvement goals, as well as assist us in economic development and other areas. The continuation of the contract ensures that our best interests are represented in the decision-making processes of the Washington State Legislature, the Washington State Department of

CONTRACT EXTENSION LETTER OF AGREEMENT
This agreement is made as of January 1, 2022 by and between Strategies 360, Inc (“Consultant”) and City of
Arlington (“Client”).
WHEREAS the parties entered into a certain Services Agreement for Government Relations, Lobbying and
Strategic Communications dated January 1, 2022.
WHEREAS the parties agree to extend the term of the Services Agreement in accordance with the terms of the
Services Agreement as well as the terms provided herein.
The parties hereby agree as follows:
1. The term of the Services Agreement will be extended for a period of 12 months, from January 1, 2022
to December 31, 2022.
2. Compensation for the services will also be extended at a monthly fee of $3,000 for the extended period
of the Services Agreement. Terms for expenses remain as per the original Services Agreement.
This Agreement shall be deemed as part of the Services Agreement. Any reference to the Services Agreement in
any other documents shall be construed as including this Agreement. Except the provisions subject to
amendment, any other provisions of the Services Agreement shall continue to be effective. In case of any
discrepancy between this Agreement and the Services Agreement, this Agreement shall prevail.

HISTORY: City Council accepted the 10% Petition to Annex on February 16, 2021, allowing a 60% Petition to be circulated for signatures. A resolution was approved on June 7, 2021, setting the date for a public hearing to occur on July 6, 2021 to hear public testimony regarding the 60% Petition to Annex. Council accepted the 60% Petition to Annex and approved the Resolution directing staff to submit the Notice of Intention to the Washington State Boundary Review Board for Snohomish County. The Notice of Intention to Annex was sent to the Boundary Review Board on August 18, 2021. On October 8, 2021, the Boundary Review Board requested a meets and bounds continuous boundary description added to the legal description. The updated legal description was sent to the Boundary Review Board on November 8, 2021. The Notice of Intention to Annex was deemed legally sufficient with an effective filing date of December 6, 2021. The Notice of Intention to Annex was heard by Snohomish County Council on January 10, 2022, where it was approved under Motion 22-009. The 45-day review period ended on January 20, 2022 at 5:00 pm, with no request for

ORDINANCE NO. 2022-XXX AN ORDINANCE ANNEXING TO THE CITY OF ARLINGTON A PORTION OF THE NORTH ½ OF THE NORTHEAST QUARTER OF SECTION 26, OF TOWNSHIP 31 NORTH, RANGE 5 EAST, W.M. AND A PORTION OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 25, TOWNSHIP 31 NORTH RANGE 5 EAST, W.M., SNOHOMISH COUNTY, WASHINGTON, COMMONLY KNOWN AS THE LINDSAY ANNEXATION WHEREAS, Chapter 35A.14 RCW authorizes the City of Arlington (“City”) to annex any portion of unincorporated county territory lying contiguous to the City boundaries and within the City’s designated Urban Growth Area; and WHEREAS, the Snohomish County Council and the City of Arlington approved an Urban Growth Area with the Future Land Use Map; and WHEREAS, on August 12, 2020, the City of Arlington received a 10 percent petition and Notice of Intention to Annex the area commonly known as the “Lindsay Annexation” area for and annexation meeting the requirements of RCW 35A.14.120, initiated by Joe Matthias representing the landowners (“Petitioners”); and WHEREAS, the Lindsay Annexation is approximately ninety-seven and eight tenths (97.8) acres and has boundaries contiguous to the City, more specifically described in Exhibit A; and WHEREAS, the Petitioners own parcels in the proposed Lindsay Annexation area, which combined contains a total assessed value of approximately $7,465,400, representing eighty-nine (89) percent of the total assessed value of $8,424,000 in the Lindsay Annexation area; and WHEREAS, RCW 43.21C.222 provides that annexation of territory by a city is exempt from the State Environmental Policy Act (“SEPA”); and WHEREAS, the area proposed for the Lindsay Annexation is within the City’s Urban Growth Area established by Snohomish County under the State Growth Management Act (“GMA”) and annexation of the Lindsay Annexation would be consistent with the GMA; and WHEREAS, the notice of application concerning the proposed Lindsay Annexation was published in the Everett Herald on June 21, 2021; and WHEREAS, the annexation was presented to the City of Arlington Planning Commission at their public meeting on January 21, 2021, February 2, 2021, and June 15, 2021; and WHEREAS, having received the Lindsay Annexation written notification of intent to commence annexation that satisfies the ten percent assessed value threshold, the City Council reviewed the matter for consideration at its regular public meeting on February 16, 2021; and

WHEREAS, on June 7, 2021, the City Council held a public meeting and accepted the 10% Petition for Annexation and allowed the proponent to circulate the 60% Petition for Annexation; and WHEREAS, the annexation of the Lindsay Annexation area, with the adoption of the City’s proposed land use designation of Residential Ultra Low Capacity with Master Planned Neighborhood Overlay is appropriate and achieves the goals of the GMA; and WHEREAS, RCW 35A.14.120 establishes a process to annex unincorporated territory with petitioners who own not less than 60% of the value, according to the assessed valuation for general taxation of the property for which the annexation is petitioned; and WHEREAS, the Arlington City Council held a public hearing concerning the proposed Lindsay Annexation at its regularly scheduled City Council meeting on July 7, 2021; and WHEREAS, after the public hearing at the July 7, 2021 meeting, the Arlington City Council passed a resolution declaring the City’s intent to annex the Lindsay Annexation area; and WHEREAS, a Notice of Intention was filed on August 18, 2021 with the Boundary Review Board, the Board requested additional information to be added to the legal description and map on October 8, 2021; and WHEREAS, a revised legal description and map was filed on November 8, 2021 with the Boundary Review Board and following approval of the legal description for the properties involved, the proposal was deemed legally sufficient with an effective filing date of December 6, 2021. WHEREAS, the 45-day review period ended on January 20, 2022 at 5:00 pm with no request for review having been filed. The City may now proceed with finalizing the annexation NOW, THEREFORE, the City Council of the City of Arlington does hereby ordain as follows: Section 1. Findings: The City Council hereby adopts the above recitals set forth above in support of the annexation of the Lindsay Annexation. The Council further finds that the public interests and general welfare of the City of Arlington would be served by the Lindsay Annexation. Section 2. Annexation: The City of Arlington hereby annexes the Lindsay Annexation area, which is legally described in the attached Exhibit A and depicted as Lindsay Annexation in the attached Exhibit B, which exhibits are incorporated by this reference. Section 3. Zoning Designation: Zoning for the Lindsay Annexation shall continue to have the zoning designation of Residential Ultra Low Capacity with Master Planned Neighborhood Overlay.

Section 4. Assessment and Taxation: All property within the Lindsay Annexation area shall be assessed and taxed at the same rate and on the same basis as the property of the City of Arlington is assessed and taxed, to pay for the portion of outstanding City indebtedness that has been approved by the voters, contracted for, incurred prior to, or existing as of the effective date of this Ordinance. Section 5. Effective Date: For purposes of property taxation and the levy of property taxes in calendar year 2022 under RCW 84.09.030, this Ordinance shall be effective, and the boundaries of the City shall include the Lindsay Annexation area as of August 1, 2022. For all other purposes, including but not limited to the purposes set forth in RCW 35A.14.150, this Ordinance shall be effective, and the boundaries of the City shall include the Lindsay Annexation area five (5) days after the date of publication. Section 6. Filing of Annexation Ordinance: Upon adoption of this ordinance, City staff is directed to file two copies of this Ordinance with the legal description and map to the Snohomish County Council and the Washington State Boundary Review Board of Snohomish County in accordance with RCW 35A.14.140, and to submit a certificate of annexation to the Washington State Office of Financial Management (“OFM”) as provide in RCW 35A.14.700; and further authorize to transmit a copy of this Ordinance to the Washington State Department of Revenue and any such other entities as is required or appropriate. Section 7. Severability: Should any section, paragraph, sentence, clause or phrase of this Ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this Ordinance be pre-empted by state or federal law or regulation, such decision or pre-emption shall not affect the validity of the remaining portions of this Ordinance or its application to other persons or circumstances.

RESOLUTION NO. 2021–021
A RESOLUTION REPLACING RESOLUTION NO. 2020-014,
AND ADOPTING A REVISED FEE SCHEDULE
WHEREAS, the City Council, through ordinance, has adopted regulations requiring certain
actions and services; and,
WHEREAS, these various ordinances set forth that fees shall be set by resolution; and,
WHEREAS, the cost of providing these various services consistent with applicable codes,
regulations, and policies periodically increase or decrease, or certain services or practices are
discontinued and fees are no longer needed; and,
WHEREAS, it is the intent of the City of Arlington to charge appropriate fees and charges that
are consistent with the services provided and to cover the public cost of providing these various
services so that the public is not subsidizing individual benefits derived therefrom;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARLINGTON AS
FOLLOWS:
The following rates, fees, and charges for various services provided, actions performed, or items
sold by the city and/or its contract service providers, and fines levied against code violators, are
hereby adopted:
Section 1. Fees and Charges—General.
1.1 Fees. Fees are intended to cover the normal, recurring costs associated with
providing a given service. Fees are non-refundable.
1.2 Prices. In some instances, the City provides certain goods and merchandise for
sale. Prices for these goods may be included in this resolution.
1.3 Payment Due. Fees are due at the time the action is requested (e.g., at time of
application) or occurs (e.g., prior to a specific action). An applicant may pay all fees
of a multi-phased project in advance; however, doing so does not vest applicable
fees due. Fees due are those in effect at the time the specific action or phase of
an action is requested or occurs.
1.4 Waivers. Upon petition by the applicant, the City Council may waive any of the
fees, or portions thereof, for any non-profit organization or government agency.

charged at the rate set forth in the most current Rental Rate Blue Book for Construction
Equipment ("Blue Book"). If the equipment or machinery rate is not available in the Blue
Book, the City will determine an appropriate fee or rate based on the original cost of the
asset plus operating and maintenance cost and/or comparable rates charged by other
organizations.

Section 9. EMS Fees and Charges.
9.1 Fees and Mileage Charges Established. For purposes of AMC Chapter 3.06,
fees and mileage for EMS services shall be set as set forth in Table 9: Emergency
Medical Services Rates and Charges.
9.2 Beginning on January 1, 2021, the rates set forth for the year 2020 shall
be increased annually effective January 1 of each succeeding year by the June
reported percentage increase of the Consumer Price Index (CPI) for the Seattle-
Tacoma-Bremerton area for All Urban Consumers, or other measure commonly used

by the city should it change; provided, however, that notwithstanding any reduction
in the CPI, rates shall not decrease.
9.3 EMS Transport Fees. In accordance with the requirements of 42 Code of
Federal Regulations (CFR) Parts 410 and 414, which provides that Medicare fees and
charges shall apply to Medicare recipients;
A. Unmet (excess fee) Part B Deductible and Part B coinsurance amounts. In
accordance with the provisions of 42 CFR Parts 410 and 414, the City shall
bill the patient for any unmet or excess fee to the extent authorized by
federal law.
B. Inability to Pay Excess Fee. Individuals who are on fixed or low incomes or
do not have the ability to pay the differential because of financial
difficulties may submit a request to waive the differential to the City with
supporting documentation of the inability to pay.

Section 12. Fees for Duplication of Public Records.
12.1 Fees for various services and actions for duplication of public records shall be
consistent with the provisions of RCW 42.56.120 and listed in Table 12: Fees for Public
Records Services.
12.2 The City of Arlington finds that calculating the actual costs of scanning per page
in order to fulfill a public records request would be unduly burdensome for the following
reasons:
(a)The City employs over 120 employees. Because all City employees contribute to
the production of public records requests and all employees earn different
salaries or rates of pay, the public records officer would have to be privy to
salaries of all employees in order to calculate the invoice;
(b)Employees supplying scanned records to the public records officer would be
required to track time spent, thereby creating a burden for those employees
without work stations as well as additional work not assigned in many
employees’ job descriptions and or union contracts;
(c)The City’s public records officer would be required to maintain a record of all
employees who contribute to each part of a public record request and
potentially charge different amounts for multiple scanned pages;
(d)The City uses more than seven document scanning machines with different
costs and lease agreement fees which change from time to time. The cost of
supplies for the City’s various scanning machines is subject to change based on
current market rates. Calculating the portion of the machines and supplies used

toward scanning public records would require knowledge of the cost of supplies
and an in-depth analysis of timing and application multiplied by each
contributing employee’s hourly rate of pay; and
(e) The response time to a public records request may be delayed in order to
calculate scanning costs and create an invoice with different rates of scanning
charges.
