NEW BUSINESS Opioid Litigation Settlement City Attorney Steve Peiffle asked City Council for approval to proceed with the opioid litigation settlement. He reminded the Council that the current settlement proposal is to join in a $518 million settlement entered into by the Washington State Attorney General’s office, which has entered into a proposed settlement with the same three distributors of opioids. Mr. Peiffle answered Council questions. Mayor Pro Tem Jan Schuette moved and Councilmember Michele Blythe seconded the motion to approve the City’s participation in the Opioid Settlement litigation brought by the State of Washington, and authorized the Mayor to sign the participation form, the allocation agreement, and the Memorandum of Understanding (MOU) and any related documents to receive settlement funds, subject to final review by the City Attorney. The motion passed unanimously. Interlocal Agreement with the Snohomish Health District for Naloxone Police Lieutenant Peter Barrett requested City Council approve an Interlocal Agreement (ILA) with the Snohomish Health District (SHD) allowing them to provide naloxone at their expense to the Arlington Police Department to reverse overdose in return for statistical tracking data for each incident in which naloxone is administered. The SHD is merging with Snohomish County Human Services in 2023, at which time a new ILA will be required. Councilmember Heather Logan moved and Councilmember Don Vanney seconded the motion to approve the Interlocal Agreement with the Snohomish Health District and authorized the Mayor to sign the agreement. The motion passed unanimously. Interlocal Agreement with the City of Everett In-Service Training Police Lieutenant Peter Barrett requested City Council approve an Interlocal Agreement with the City of Everett for the Arlington Police Department to participate in regular in-service training sessions on various law enforcement topics. Lieutenant Barrett answered Council questions. Councilmember Don Vanney moved and Councilmember Michele Blythe seconded the motion to approve the Interlocal Agreement with the City of Everett and authorized the Mayor to sign the agreement. The motion passed unanimously. City Applications for Arlington Tourism Grant (Lodging Tax Funded) Community Engagement Director Sarah Lopez requested authority from City Council to apply for the Hotel/Motel Tourism Grant that will assist in the Eagle Festival, Summer Entertainment Series, Stronger Together Entertainment, picnic tables for events, kiosk Minutes of the City of Arlington City Council Meeting September 19, 2022 Page 3 of 3 replacements for Centennial Trail, and sound system for Olympic Avenue in 2023. Ms. Lopez and Ms. Garcia answered Council questions. Councilmember Debora Nelson moved and Councilmember Heather Logan seconded the motion to authorize staff to apply for the City of Arlington’s Hotel/Motel Tourism grant. The motion passed unanimously. Amendment No. 1 for Construction Management Services with KBA, Inc. Public Works Director Jim Kelly requested Council approve Contract Amendment No. 1 for Construction Management services with KBA, Inc. for the Smokey Point Blvd. Overlay Project. Councilmember Debora Nelson moved and Councilmember Marilyn Oertle seconded the motion to approve the amendment to the KBA contract for Construction Management services for the Smokey Point Boulevard Project, and authorized the Mayor to sign the amendment. The motion passed unanimously. COMMENTS FROM COUNCILMEMBERS Mayor Pro Tem Jan Schuette announced that the SnoTRAC survey will be in the City of Arlington Newsletter. WORKSHOP ITEMS – NO ACTION WAS TAKEN Smokey Point Corridor Update Public Works Director Jim Kelly introduced Dan Hansen, PE, from Perteet Engineering, who provided a PowerPoint presentation with design of the Smokey Point Boulevard Corridor project. Mr. Hansen was joined by Jim Hansen, PE, of HBB Landscape Architecture. Discussion followed with Mr. Hansen and Mr. Kelly answering Council questions. Minutes of the Arlington City Council Workshop Minutes of the City of Arlington City Council Workshop September 26, 2022 Page 2 of 3 Inflow and Infiltration Repair Contract Award Public Works Director Jim Kelly reviewed a 24-month “on-call” contract with Pro Vac for inflow/infiltration repair on sanitary sewer system. Inflow and infiltration of groundwater into the Arlington sewer system has a major impact on the operation of the Water Reclamation Facility and downstream lift stations. Clean groundwater inflow and infiltration into the sanitary sewer system robs capacity at both the WRF and lift stations and causes excessive and unnecessary operation costs. Discussion followed with Mr. Kelly answering Council questions. Utilities and Transportation Quarterly Report Public Works Director Jim Kelly provided the Utilities and Transportation third quarter report. Discussion followed with Mr. Kelly answering Council questions. Finance Monthly Report Finance Director Kristin Garcia provided the August 2022 financial report. ADMINISTRATOR AND STAFF REPORTS City Administrator Paul Ellis thanked Finance Director Kristin Garcia and Assistant Finance Director Sheri Amundsen and finance staff for great audit results. Mr. Ellis also stated that the binders for Saturday’s budget retreat have been distributed, and any additional information requested by Council will be handed out at the retreat. MAYOR’S REPORT Mayor Tolbert thanked councilmembers who attended the Cascade Industrial Center networking event Thursday, September 22. COMMENTS FROM COUNCILMEMBERS Councilmember Schuette provided additional comments about the Cascade Industrial Center COUNCILMEMBER REPORTS Councilmembers had nothing to report this evening. Also Known to be Present: Councilmembers Don Vanney, Jan Schuette, Heather Logan, Michele Blythe, Assistant Audit Manager Courtney Amonsen, and Audit Lead Miranda Shales. Finance Director Kristin Garcia began the special meeting 3:00 p.m.., and introduced city staff, councilmembers, and audit staff. DISCUSSION Assistant Audit Manager Courtney Amonsen provided an overall summary of the Financial and Federal Compliance Audit. The exit conference packet was emailed prior to today. Ms. Amonsen stated that two separate audits were conducted for the City of Arlington, all for the time period of January 1, 2021 through December 31, 2021. Ms. Shales provided the results of the two audits conducted: • Financial statement audit for January 1, 2021 through December 31, 2021 • Federal grant compliance audit for January 1, 2021 through December 31, 2021 The team tested the following federal programs: • Airport Improvement Program, CFDA no. 20.106–$304,402 • Coronavirus State and Local Fiscal Recovery Fund, CFDA no. 21.027–$329,885 The audit team did not identify any material misstatements during the audit. There were no uncorrected misstatements in the audited financial statements. There were no instances of noncompliance material to the financial statements. The city received an unmodified opinion on the financial statements. The city received an unmodified opinion on compliance with requirements applicable to each major program. Ms. Amonsen provided closing remarks, and stated that the 2021 report will be published on the state auditor’s website by September 29, 2022. The 2022 audit will begin summer of 2023, with accountability for public resources, financial statement, and federal program audits, all for the period of January 1, 2022 through December 31, 2022. Mayor Tolbert asked if the audits would continue to be conducted electronically to save taxpayer dollars. Ms. Amonsen stated that they would continue to be electronic, with the possibility of hybrid. Electronic audits have proven to be very efficient. Public Works advertised the Sanitary Sewer Inflow and Infiltration Control project as a unit-priced contract on the MRSC Small Works Roster, only one bid was received. Work began in 2020. Both Public Works and Community and Economic Development worked with the Perteet team on public outreach, corridor planning, transportation analysis, and preliminary design of the Smokey Point Blvd Corridor preferred alternative. Though work was impacted by COVID-19 meeting restrictions, the RESOLUTION NO. 2022–016 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARLINGTON APPROVING THE SMOKEY POINT BOULEVARD CORRIDOR PREFERRED ALTERNATIVE AND AUTHORIZING STAFF TO PROCEED WITH FINAL DESIGN AND PUBLIC OUTREACH WHEREAS, the City applied for and received a federal grant for design of the Smokey Point Boulevard Corridor Project; and WHEREAS, City staff contracted with Perteet Engineering to conduct public outreach and produce design documents for a preferred corridor alternative; and WHEREAS, public input and comment has been received during the design process; and WHEREAS, a draft concept of the preferred corridor alternative design plan was presented to council at the September 26, 2022 council meeting; and WHEREAS, the preferred alternative is the best suited to provide transportation system safety improvements, mobility improvements, and neighborhood improvements to meet the Smokey Point community’s needs into the future, and WHEREAS, it appears to be in the best public interest to allow staff and consultant to proceed with the proposed design plan. NOW, THEREFORE, BE IT RESOLVED that the City of Arlington approves of the Smokey Point Boulevard Corridor preferred alternative and directs City staff and the Perteet design team to continue the design of the Smokey Point Boulevard Corridor Project as presented. Passed by the City Council of the City of Arlington on this 3rd day of October, 2022.
