Minutes of the Arlington
City Council Meeting
Councilmembers Present: Don Vanney, Heather Logan, Debora Nelson, Marilyn Oertle, Jan
Schuette, Michele Blythe, and Yvonne Gallardo-Van Ornam.
Council Members Absent: None.
Staff Present: Mayor Barb Tolbert, Paul Ellis, Kristin Garcia, Chief Jonathan Ventura, Amy
Rusko, City Attorney Steve Peiffle, Tony Orr, and Julie Petersen.
Also Known to be Present: Kathy Vanney, Bob Nelson, Lindsay Dunn, Dylan Sluder, John
Kinsley.
Mayor Barb Tolbert called the meeting to order at 7:00 p.m., and the Pledge of Allegiance and
roll call followed.
APPROVAL OF THE AGENDA.
Mayor Pro Tem Jan Schuette moved to approve the agenda with revision. Councilmember
Marilyn Oertle seconded the motion, which passed with a unanimous vote.

None.
PROCLAMATIONS
None.
PUBLIC COMMENT
Lindsay Dunn, 735 E. Highland Drive, stated his concern for the 172 Street roundabout by
Walmart and Amazon. John Knisley, 19908 54 Drive NE, stated his concern for the dust on
Cemetery Rd., and requested the speed radar sign located in his front yard be removed.
CONSENT AGENDA
Mayor Pro Tem Jan Schuette moved and Councilmember Marilyn Oertle seconded the motion
to approve the Consent Agenda that was unanimously carried:
1. Minutes of the October 1, 2022 Budget Retreat, and October 3 and October 10, 2022
Council Meetings.
2. Accounts Payable: approval of EFT Payments, Petty Cash Check #2018, and Claims
Checks: #106602 through #106731 dated October 4, 2022 through October 17, 2022
for $1,849,201.12; and approval of Payroll EFT Payments and Check #30218 through
#30224 dated September 1, 2022 through September 30, 2022 in the amount of
$1,293,975.40.
3. Low Bid Award for the Washington Trucking Water Main Replacement Project.

PUBLIC HEARING
2022 Zoning Code Amendments
Community and Economic Planning Development Manager Amy Rusko requested Council
approve the 2022 Zoning Code Amendments that were proposed with the 2022 Docket. The
2022 Zoning Code Amendments are necessary in order for the zoning code to correctly
represent previous changes that were made to the zoning map, zoning designations,
residential housing types and to complete a clean-up of multiple code chapters that have not
been updated for many years. Planning Commission has reviewed the design standards at
multiple workshops and meetings over the past nine months. A public hearing was held
before planning commission on September 20, 2022.
The public hearing was opened at 7:14 p.m. Dylan Sluder from the Master Builders
Association of King and Snohomish Counties (MBAKS) expressed his gratitude for the
updates to the Code Amendments, and suggested that the addition to the Code
Amendments state that the Community and Economic and Development Director have the
discretion to approve the panhandling lot amendments verses using the specific variance
language. He urged City Council to adopt and approve the 2022 proposed Code
Amendments. The public hearing portion was closed at 7:17p.m. Council questions were
opened at 7:18 p.m. Mayor Tolbert and Councilmember Heather Logan provided comment.
The public hearing was closed at 7:23 p.m.
Councilmember Debora Nelson moved and Councilmember Marilyn Oertle seconded the
motion to approve the proposed ordinances adopting the 2022 Zoning Code Amendments
and authorized the Mayor to sign the ordinances with the director discretion for panhandle
lots amendments with subject to final review by the City Attorney, and authorized the City
Attorney and City Clerk to make any necessary corrections of clerical errors, should they be
discovered. The motion passed unanimously.
NEW BUSINESS
Approval of Amended September 19, 2022 City Council Meeting Minutes
The minutes of the September 19, 2022 Council meeting were pulled from the Consent
Agenda on October 3. The Consent Agenda included a reference to "Approval of Payroll EFT
Payments and Checks: #30198 through #30210 dated August 1, 2022 through August 31,
2022 for $1,225,717.60". The corrected check numbers are #30211 through #30217. The
attached minutes have been updated to reflect the correct check numbers.
Mayor Pro Tern Jan Schuette moved and Councilmember Debora Nelson seconded the
motion to approve the City Clerk's corrections to the September 19, 2022 minutes due to
an error in the consent agenda. The motion passed unanimously.
Ordinance Approving Arlington Municipal Code (AMC) 2.04.020, Changing City
Council Meetings' Start Time
City Administrator Paul Ellis requested Council approve the ordinance to amend the AMC
Code 2.04.020 changing City Council Meeting start times from 7:00 p.m. to 6:00 p.m.,
beginning in January 2023.

Councilmember Don Vanney moved and Councilmember Debora Nelson seconded the
motion to approve the ordinance amending AMC 2.04.020 and authorized the Mayor to
sign it. The motion passed unanimously.
Purchase of Land from Smokey Point Community Church for community Park
City Attorney Steve Peiffle reviewed the land purchase from the Christian Missionary
Alliance Church and Smokey Point Community Church. The City has identified this property
as an excellent location for a community park in the Smokey Point community. It is
designated in the City's parks plan for future development of a community park. The City
has been negotiating the terms of purchase with representatives from the Smokey Point
Community Church (SPCC).
Councilmember Marilyn Oertle moved and Councilmember Debora Nelson seconded the
motion to approve the purchase of property from the Smokey Point Community church as
described in the 12/8/2021 offer and 10/10/22 addendum, and authorized the Mayor to
sign the offer and addendum and any documents necessary to close the sale, subject to the
negotiation of any additional requirements and the final approval of the City Attorney as to
form. The motion passed unanimously.
COMMENTS FROM COUNCILMEMBERS
Councilmember Marilyn Oertle announced that the Public Art Committee will be meeting on
October 18, 2022 to review the proposals for the next round of art for the city.
Councilmember Debora Nelson thanked the Arlington Police Department for their work and
excellence on the job, and their professional interactions with each other and with the
community members.
ADMINISTRATOR & STAFF REPORTS
None.
MAYOR'S REPORT
Mayor Tolbert announced that the candidates for the Youth Council have been selected, and
they will be introduced to City Council in November.
EXECUTIVE SESSION
None.

With no further business to come before the Council, the meeting was adjourned at 7:29 p.m.
